Defense Rests in Miami Terrorism Trial
Nov 20, 2007 http://ap.google.com/article/ALeqM5idfDmrtarDonhbdqZdXQwhTtFYRwD8T1RN7O0 MIAMI (AP) - The defense wrapped up its case Tuesday in the trial of seven men charged with plotting to destroy Chicago's Sears Tower and bomb FBI offices in Miami and other cities. U.S. District Court Judge Joan Lenard ordered the jury to return next Tuesday to hear a brief rebuttal case from federal prosecutors. Closing arguments could begin the following day. During the trial, which has lasted nearly two months, only one of the defendants took the stand. Narseal Batiste, the alleged leader of the so-called "Liberty City Seven," testified that he invented a fake plot to destroy Chicago's Sears Tower in order to con money out of a man who claimed to be an al-Qaida operative. Batiste had dozens of meetings with the man, who was actually a paid FBI informant. During an FBI audiotape played for jurors, Batiste alone takes the oath of allegience to al-Qaida from the informant and then makes plans to meet him again with the entire group at a new warehouse. Batiste was told the building was being provided by al-Qaida but it was actually had been fitted by the FBI with hidden surveillance cameras. A few days later, on March 16, 2006, the other six defendants were recorded taking the oath. Prosecutors say the seven men plotted to topple the 110-story Sears Tower and bomb FBI offices in five cities in hopes of starting a broader anti-U.S. insurrection, although their plans never got very far. The men face up to 70 years in prison if convicted of four terror-related conspiracy counts. Copyright 2007 Associated Press. All rights reserved. "Fair Use" legally eliminates the need to obtain permission or pay royalties for the use of previously copyrighted materials if the purposes of display include "criticism, comment, news reporting, teaching, scholarship, and research." Section 107 establishes four criteria for determining whether the use of a work in any particular case qualifies as a "fair use". A work used does not necessarily have to satisfy all four criteria to qualify as an instance of "fair use". Rather, "fair use" is determined by the overall extent to which the cited work does or does not substantially satisfy the criteria in their totality.
