They didnt fear our stupidity so much as the limited ability of our forbears to learn about candidates outside their home region. Complicating matters further, a large bloc of smaller states sought to safeguard their powers within the new federal union. At one point, the founding fathers approved a system whereby Congress would choose the president something akin to Britains parliamentary system, minus the king. But that crumbled after fears that uncouth deals might be struck by legislators in private, so other proposals were considered. Direct election by the people was rejected, as was election by a vote of the governors, voting by electors chosen by each states legislators and, loopiest of all, voting by a special cadre of congressmen chosen by lot. Who Are Electors? The Constitution bans any person holding an office of trust or profit under the United States from becoming an elector. (State officials, such as governors or state legislators, are allowed.) Beyond that, anyone can do it. There are no age restrictions, no residency requirement, not even a citizenship test. In theory, theres nothing preventing a newborn from Norway from accepting a gig as a Nevada elector. In practice, however, being an elector is a political plum carefully doled out by state party officials. Usually, the major political parties select these individuals either at their state conventions or through appointment by state party leaders, while third parties and independent candidates simply designate theirs. How Are Votes Doled Out? Every state gets one electoral vote for each of its two U.S. senators, and one vote per U.S. representative. Because there is a fixed number of senators (100) and representatives (435), the number of electoral votes also is fixed at 538 with the District of Columbia getting three electoral votes (the territories have none). Therefore, the minimum number of electoral votes a state can have is three; the most of any state is Californias current 54 (two senators plus 52 representatives). With a total of 538 electoral votes, 270 are needed for a majority to win the White House. How Do They Vote? On the Monday following the second Wednesday of December (this year: Monday, Dec. 18), each states electors meet in their respective state capitals, where each casts one electoral vote for president and one for vice president. To prevent electors from voting only for favorite sons of their home state, each elector must cast at least one of their votes for a person from outside their state. According to the Office of the Federal Register, this has never been a problem because no winning presidential candidate has ever chosen a running mate from his home state. However, it would have posed a problem for the Bush-Cheney ticket had Bush won and Cheney had not switched his voter registration from Texas to Wyoming. Although the form may differ a bit from state to state, the electors do cast ballots of some sort, which they are required to sign. The ballots are then sealed and transmitted from each states secretary of state to the president of the Senate (in this case, Al Gore) who, on the following Jan. 6, opens and reads them before both houses of the Congress. The ballots also are sent to the National Archives. At this point, the candidate for president who wins an absolute majority (270 votes or more), is declared president. Likewise, the vice-presidential candidate with the absolute majority is declared vice president. At noon on Jan. 20, the duly elected president and vice president are sworn into office. What If Theres a Tie? In the event that no candidate obtains an absolute majority, the House of Representatives (as the chamber closest to the people) elects the president from among the top three contenders. The last time this happened was in 1888, when Benjamin Harrison lost to Grover Cleveland at the polls, 48 percent to 49 percent, but won in the Electoral College. Each state delegation casts only one vote, and an absolute majority of the states is required to elect. Similarly, if no vice-presidential candidate obtains an absolute majority, then the Senate picks from among the top two contenders for that office. According to the Office of the Federal Register, there is no rationale behind why the House chooses from the top three candidates for president while the Senate chooses from only the top two candidates for vice president. (Along with the Constitution itself, this process is codified in a provision in the US Code, Title III, Chapter One.) Can Electors Support Whomever They Want? States have tried to outlaw it, but a faithless elector can still is follow the framers wishes for electoral independence rather than heeding the wishes of his sponsoring

The fact that [Bush vs. Gore] is a close election raises the specter, says Neal R. Peirce, a syndicated columnist. Contrary to what some people may believe, American voters do not directly elect the president. Instead, they vote for special electors from their state. It takes votes from 270 of the 538 members of the Electoral College to win the White House. Those of us who are critics of the system believe there would be severe credibility problems for someone who has just lost the election to win the electoral vote, adds Peirce, co-author of The Electoral College Primer 2000. A pair of professors at Columbia University in New York City believe that if this years race is close, a split decision between popular and electoral votes could happen. Robert Erikson and Karl Sigman have crunched poll numbers and considered where Bush and Gore are most likely to win. They have determined Bush needs a 2 percentage point margin of victory with Americas voters to have an even shot at winning the electoral tally. If Bushs edge with voters is 1 percentage point, Gore has a 90 percent chance of an electoral victory, according to their study. Bush has big leads in several states, but they account for a more modest number of electoral votes, says Erikson, a political science professor. By contrast, Gore has smaller leads in states that yield a greater number of electoral votes. With a close popular vote, the electoral edge goes to Gore. Turmoil PossibleIf that happens, it could produce political fireworks, observers say. There would be an outcry and, yes, there would be pressure and, yes, there would be demands that we reform the system, says Curtis Gans of the Committee for the Study of the American Electorate. Most electors are directed to follow the will of the majority of their states voters. But in about half the states, electors votes are not bound by law. Political watchers say that could mean a whole new campaign, long after the polls have closed. There would be a lot of jockeying among the Electoral College for them to switch their votes, said Craig Crawford of the Hotline political digest. Can you imagine the wheeling and dealing? Different Political TimesThree times in American history, a candidate for president has gone down in defeat even though he was the popular choice of the American people. And once, a candidate who finished second in both popular and electoral votes became president anyhow. But times were different then, and many think todays electorate wouldnt allow such an event to occur without demanding change. The last time was 1888, and we werent quite at the democratic fervor that we have now, Peirce said. Women didnt vote yet, blacks were just getting the right to vote, and it was quite a different world. There are already calls, as there have been hundreds of times in the past, to eliminate the Electoral College. Last Wednesday, Sen. Richard Durbin, D-Ill., and Rep. Ray LaHood, R-Ill., announced they are backing a push to adopt a constitutional amendment to have presidential elections decided by popular vote. Its time to put this electoral dinosaur permanently in a museum, Durbin said. Has Happened BeforeThat dinosaur dates back at least 175 years. In 1824, Andrew Jackson outpaced John Quincy Adams in both popular and electoral votes, but because of additional candidates in the race neither Jackson nor Adams gained a majority of the 261 electoral votes available that year. Under the Constitution then and now, if no candidate gets a majority of electoral votes, the decision goes to the House of Representatives. Each state gets a single vote, and that year they chose the second place finisher Adams. In 1876, Rutherford B. Hayes became president when he eked out one more electoral vote than Samuel Tilden, even though Tilden had defeated him at the polls. The electoral total was 185-184 for Hayes; the popular vote was 50.9 percent to 47.9 percent for Tilden. It happened again in 1888, when Cleveland, the incumbent president, beat Benjamin Harrison at the polls, 48.6 percent to 47.8 percent. Despite the popular vote, Harrison defeated Cleveland 233 electoral votes to 168 to become president. Incidentally, four years later, Cleveland once again beat Harrison at the polls, but in that case managed to regain the presidency by defeating him in electoral votes as well. There have been some close calls in twentieth century elections as well, according to Lawrence D. Longley, Peirces co-author on The Electoral College Primer 2000. In 1960, the tally was so close that it also could be said to be a misfire since we will never know whether Kennedy or Nixon had the greatest vote, he said.

The measure, supported by the Clinton administration, passed by a voice vote. The legislation would allow a bank or investment firm in bankruptcy-court protection and its creditors to use the net value of the company's losses from derivatives trading in calculations, rather than the much larger gross value. The difference is designed to avoid tying up the trading contracts too long in bankruptcy proceedings. Treasury Secretary Lawrence Summers, representing the administration, and Federal Reserve Chairman Alan Greenspan last Friday urged lawmakers to approve the legislation before Congress adjourns soon for the year. Scientists from the University of Bristol's Department of Clinical Veterinary Science told the national seed list hearing that nutrition tests on chickens, presented by biotech company Aventis, "is inadequate in terms of providing any evidence or conclusions. It is not of a standard that would be acceptable for publication in a scientific journal ". Concerns were also raised about " suspicious " higher death rates among chickens that ate the GM maize during the study. Aventis research compared broiler chickens fed GM maize with those fed on conventional maize. Friends of the Earth approached Dr Steve Kestin and Dr Toby Knowles, scientists working on chicken studies for the Ministry of Agriculture, Fisheries and Food, to peer- review it. Their conclusions included: *A failure to investigate " suspicious " trends in the death of chickens fed the GM maize (10 died) compared with those fed conventional maize (5 died). This, they said "suggests either a fault in the study or a real direct effect of diet...and should act as a spur for further investigation "; *That there were " far too few " replicates used in the study. Only 4 replicates were used, as opposed to the minimum of 14 recommended by the independent scientists. Using such a small number would be " one of the best methods...to show no effect "; *The absence of a positive control (feeding maize to 3, instead of 2, groups of chickens) was a " major flaw in the design of the study ". During the hearing, leading experts have already questioned Aventis' scientific evidence for the marketing of this GM forage maize . In particular, they have expressed concern over the failure to test the GM maize on cows (for whom it's being produced). Tony Juniper, Policy and Campaigns Director at Friends of the Earth said: "Once again the 'sound science' of the biotech industry has been found sadly wanting. This shoddy study should never have been submitted to support the case for this GM maize to be granted a commercial licence. The fact that it was, and the Government did nothing about it, is a scandal. When will we learn the lessons of BSE? "It's high time the cosy and unquestioning relationship between the biotech industry and Government was ended. The well-being of the public, health and environment must be put above vested interest and profit. Aventis can start today by withdrawing this GM application." Speaking after the hearing, Dr Kestin commented: "It's astonishing that this study has not been assessed and found wanting by the Government, and that it's been left to Friends of the Earth to have it properly reviewed". Earlier this week the continuation of the hearing was put in severe doubt when the Government revealed that official basic tests on Chardon LL, carried out by the French authorities, had only been conducted for one year rather than the two required under EU law. In April, the Government announced its intention to allow Chardon LL, which has been genetically modified to be resistant to Aventis' own herbicide, on to the national seed list. This is the final legal barrier before a GM seed can be sold to farmers. This would have been the first GM crop to have been added to the list. However, FOE discovered a little- known law which gave the public the right to appeal against the decision. Sixty seven groups and individuals have paid £60 to have their objections heard in public, with hundreds more filing written objections (which cost £30). The National Seed List hearing started on 2 October and is scheduled to last about 9 weeks. But after 10 hours and 10 minutes in a small, windowless interrogation room at police headquarters, Cowling confessed to beating Carter to death and robbing him of $100 to buy heroin. As the hours and questions wore on Cowling, a heroin addict, grew sicker from withdrawal, he later testified, but the detectives withheld treatment. "They kept telling me what they think happened, I kept denying it. And the whole time I'm denying it, I'm asking to see a nurse," Cowling said in an interview. "After I saw it wasn't doing any good to keep denying it, I figured I must have to tell them something to at least get medical attention." Cowling, 49, was charged with murder and robbery and if convicted faced a mandatory sentence of life in prison without parole. But in an extraordinary verdict, an Alameda County jury acquitted him after finding his confession false. The Cowling case holds a bare light bulb over interrogation practices at the Oakland Police Department and other law enforcement agencies around the country, tactics that experts say can result in false confessions, guilty people going free and innocent people going to prison. "The vast majority of people believe that no one would confess to a crime they didn't do," said Assistant Alameda County Public Defender William G. Locke, Cowling's lawyer. "But false confessions happen. Innocent people have gone to prison and even to their deaths." At least 60 people confessed falsely in the United States between 1973 and 1998, with 29 convicted, 11 sentenced to life imprisonment, three sentenced to death and one executed, according to a 1998 study by UC Professors Richard Ofshe and Richard Leo that was published in the the Journal of Criminal Law Criminology. In October, Virginia Gov. James S. Gilmore III pardoned a man who came within five days of execution but eventually was cleared by a DNA test. The Cowling case is one of at least five murder prosecutions in California that were derailed in the past two years after judges or prosecutors cited illegal or improper police interrogation tactics, The Examiner found. In three cases charges were dropped and in a fourth a conviction was reversed. In addition to allegedly taking advantage of Cowling's addiction, the court record shows, detectives unlawfully interrogated him after he twice invoked his Miranda right to remain silent, failed to pursue evidence that might confirm or contradict the confession, and tape-recorded only 16 minutes of the 14 hours and 41 minutes they held him incommunicado. And once the judge barred prosecutors from using Cowling's taped confession to prove his guilt because of the Miranda violation, the state was forced to rely on the detectives' admittedly scanty notes and faulty memories of what they claimed was an earlier unrecorded confession. "A lot of the interrogation tactics were questionable," said juror Doretta McIntosh, a homemaker and mother in Montclair. "There were too many questions about what was said before that tape recorder was turned on." Police say they handled the case properly and that Cowling is guilty. Deputy District Attorney Jerry Curtis acknowledged that the lack of an independent record of the interrogation was a "big issue" with the jury. Police relied too much on Cowling's alleged admission, he said. "But this is not a case of a false confession," said Curtis, who has returned to the state attorney general's office after being on loan to the district attorney's office. The group hosted a conference in 1998 in which Hamas, Hezbollah, and Egyptian and Algerian fundamentalist groups took part, and has continued to be a major player in terms of trying to unify the "jihad" campaign against the US and Israel. The group has stated that the US, Israel, Russia and Britain have declared war on Islam. The British Charity Commission reportedly withdrew al-Muhajiroun's charity license around Nov. 1999. The licenses for the Sharia Court of the UK and the London School of Sharia were also revoked. All three organizations are supervised by Sheikh Omar Bakri Mohammed. I'm thinking of installing TFN3K servers and doing the cnn.com and yahoo.com thing again any one in, mail me quick." iDEFENSE has confirmed the existence of TFN3K but has not yet established whether or not ReALiST has the tool or the ability to launch an attack using it. One pro-Palestinian group has deployed a FloodNet type tool and is currently carrying out an attack against the sites of the Bank of Israel, the Tel Aviv Stock Exchange and Israeli government. If Al Gore pulls off a miracle it will presumably be business as usual - more or less the same breed of earnest young Democrats that has been filling the Starbucks branches on Pennsylvania Avenue for the past eight years. If George W Bush triumphs, however, Washington will have to brace itself for a cultural tidal wave rolling in from Texas. If elected, the governor from Austin would inevitably bring a new crowd of advisers, wonks, gurus and hangers-on from the governor's mansion in Austin. There will be many immediate changes. Overnight, cowboy boots will become de rigueur with business suits, and the Texas twang (in both its authentic and ersatz varieties) will reverberate around the cafes of Georgetown. But beneath the froth, there will be another, more profound, cultural transformation at the epicentre of the world's sole superpower. Gore has the reputation of making key decisions on his own. To know him is to know who is going to be behind the wheel. Bush is an entirely different kind of operator. He keeps normal business hours, and expects his team to agree on a policy decision and present it to him in digestible form, rather like Ronald Reagan. So, as with Reagan, the identity of those advisers will take on a particular significance for the US and the world should America swing right today. They are, to say the least, a pretty interesting bunch - a different tribe entirely from the slick, pragmatic New Democrats in power at the moment. They have more in common with the Reaganauts than the subsequent court run by Bush the Elder. Bush's key economic adviser is Larry Lindsey, an early adherent from the Reagan era of supply-side economics. The doctrine (famously derided as "voodoo economics" by the governor's dad), provides an academic rationale for giving tax cuts to the rich. The theory is that rich people would invest their windfall in the stock market, providing a morale-boosting injection of funds and investment capital to create jobs, providing "trickle-down" wealth to the ordinary people. The supply-siders thus provide a do-gooder gloss to the Bush tax-cut plan, which would hand $81bn (60% of the total reduction) to the richest 13m taxpayers. The foreign affairs team also has an 80s feel to it. Condoleeza Rice, the likely national security adviser in the event of a Bush win, worked for the governor's father, but is a child of the cold-war mentality which reigned supreme under Reagan. Together with Paul Wolfowitz (another hard-line Reaganaut and possible defence secretary), she advocates a much tougher, adversarial stance towards Russia and China, and a much more hard-headed assessment of vital national interests, stripped of the humanitarian interventions which have flourished under the Clinton-Gore administration. In terms of economic and foreign policy then, a Bush White House is likely to be merely a throwback. It is the underlying ethos (what the governor would undoubtedly call "the heart") of a future Republican administration that would be truly exotic, even bizarre. Bush's favourite slogan "compassionate conservatism" is no empty jingle - it is actually borrowed from a body of work by a pair of obscure conservative gurus, whose influence would surely grow exponentially if the Republicans recapture the White House. One is Myron Magnet, a cultural hawk from the right-wing Manhattan Institute. His rival for George W's heart and soul is a Marxist turned born-again Christian from Texas, Marvin Olasky, who believes the whole machinery of state-provided social welfare should be scrapped in favour of a return to 19th-century-style religious charities and soup kitchens. Olasky has come on a long intellectual journey. Born into a Boston Jewish family in 1950, he renounced his religion at the age of 14 and became an avowed atheist. At Yale, he joined the Communist party and in 1972 travelled to Moscow on a Russian freighter, to prove his Marxist-Leninist ardour. His 180-degree transformation came only a year later, apparently as a result of watching a lot of Hollywood westerns. He was doing a graduate degree in American culture at the University of Michigan, focusing on US cinema. To know him is to know who is going to be behind the wheel. Bush is an entirely different kind of operator. So, as with Reagan, the identity of those advisers will take on a particular significance for the US and the world should America swing right today. Bush's key economic adviser is Larry Lindsey, an early adherent from the Reagan era of supply-side economics. The theory is that rich people would invest their windfall in the stock market, providing a morale-boosting injection of funds and investment capital to create jobs, providing "trickle-down" wealth to the ordinary people. The supply-siders thus provide a do-gooder gloss to the Bush tax-cut plan, which would hand $81bn (60% of the total reduction) to the richest 13m taxpayers. The foreign affairs team also has an 80s feel to it. Condoleeza Rice, the likely national security adviser in the event of a Bush win, worked for the governor's father, but is a child of the cold-war mentality which reigned supreme under Reagan. Together with Paul Wolfowitz (another hard-line Reaganaut and possible defence secretary), she advocates a much tougher, adversarial stance towards Russia and China, and a much more hard-headed assessment of vital national interests, stripped of the humanitarian interventions which have flourished under the Clinton-Gore administration. In terms of economic and foreign policy then, a Bush White House is likely to be merely a throwback.
