These board members want Pacifica's national leadership to reverse course on its takeover of WBAI, and to "build democratic decision-making structures throughout Pacifica." A statement supporting the dissenting board members (below) was signed by the Local Advisory Board chairs of four of Pacifica's five stations and by former Pacifica staffers and board members, as well as by political figures, community leaders, journalists, artists and academics. These include Dennis Brutus, Noam Chomsky, Martn Espada, Frances Farenthold, June Jordan, Tom Morello, Tim Robbins, Edward Said, Studs Terkel, Urvashi Vaid and many more. WE PROTEST PACIFICA'S NATIONAL LEADERSHIP ACTIONS AND SUPPORT THE DISSENTING BOARD MEMBERS In an action reminiscent of its closing of Berkeley's KPFA in 1999, the Pacifica Foundation's national leadership is now moving against New York's WBAI. The station's managers have been fired, door locks changed in the middle of the night, staffers banned from the station and protesters arrested. Security guards have been brought in to enforce the changes imposed without warning or explanation by Pacifica's Washington, D.C.-based executive director, backed by its board leadership. Another target of the action, Democracy Now! host Amy Goodman, hangs on to her job amid harassment on air and off by Pacifica's national leaders and recently installed station management in New York. Meanwhile, WBAI's newly appointed morning show host has spoken on-air in support of the Pacifica board selling off WBAI. For most of its 50-year history, Pacifica has been a public resource for the progressive community. Recently, a self-selected, unaccountable and secretive board majority has acted as if it owns Pacifica and has ruled by fiat. In the wake of this latest crisis, six courageous members of Pacifica's national board issued the following public dissent on January 18 in hopes of getting the Pacifica network back on path. "We are deeply troubled by the recent developments at WBAI radio in New York City, one of the five stations of the Pacifica Foundation. It is not too late to remedy the situation, and we are working toward that end . "The National Board must take steps to ensure the immediate reinstatement of the three people fired at WBAI: Station Manager Valerie Van Isler, Program Director Bernard White, and Producer Sharan Louise Harper. According to the information we have, the Pacifica Foundation's internal procedures were not followed, there was not compliance with union contracts, and none were informed of the cause of their firings. All three of these people should be reinstated as full time employees without further delay. Existing internal processes which address job performance, or any other concerns, must be followed. " The continuing 'banning' of long time volunteers and freelance reporters, the decision to not allow the Local Advisory Board to meet at the station, and the use of security personnel are all having a chilling effect at the station. Action must be taken now to lift the bans, to ensure that the LAB can meet at the station and to remove security people from the station . " As members of the National Board, we believe it is critically important to review the internal processes within the Pacifica Foundation. We must build democratic decision making structures throughout Pacifica and re-commit ourselves to work for the principles of free-speech, community-based, corporate-free radio, as first articulated by Pacifica Foundation's founder, Lewis Hill. -Caveat Lector- Marc Rich's Hidden History as a Union-Buster By Russell Mokhiber and Robert Weissman Longtime fugitive from justice Marc Rich has become the most notorious recipient of a presidential pardon since Richard Nixon. President Clinton issued a pardon for the commodities trader in the final hours of his tenure in office. What is now widely known about Rich has cast a dark cloud over what Clinton hoped would be a glorious exit from the presidency. Charged with income tax fraud and conspiracy, Rich fled to Switzerland, from which he could not be extradited. Living in the lap of luxury, he continued his wheeling and dealing in international commodities markets, including through trades with apartheid South Africa. He invested heavily in seeking a pardon, courting the Israeli government (dethroned Israel President Ehud Barak personally lobbied Clinton for Rich's pardon), hiring top-ranking officials from Democratic and Republican administrations to represent him, and relying on his ex-wife to lavish money on Democrats during the Clinton years. What is not widely known, at least outside of West Virginia and certain labor circles, is that Rich played a central role in one of the highest profile union-busting efforts the United States has seen in recent decades. In the early 1990s, Marc Rich was the power-behind-the-scenes at the Ravenswood Aluminum Corporation (RAC) facility in Ravenswood, West Virginia, site of one of the most embittered U.S. labor-management disputes of recent decades. The Ravenswood conflict has been chronicled by Tom Juravich and Kate Bronfenbrenner in their inspiring account, Ravenswood: The Steelworkers' Victory and the Revival of American Labor (Ithaca, New York: ILR/Cornell University Press, 1999). In 1990, in a premeditated effort to break the union, RAC locked out its 1,700 workers, members of the United Steelworkers of America, and hired permanent replacements. As the contract deadline neared, RAC installed surveillance cameras, new security systems and a chainlink fence around the perimeter of the facility. The night of the lockout, the company brought in a goon squad security force equipped with riot gear, clubs, tear gas and video cameras used to constantly monitor the workers' pickets. The goons introduced a climate of fear and made violence on the picket lines, and in the town, an ever-present fear. Caught unprepared, the Steelworkers' local was able to keep all but a handful of workers from crossing the picket line and union solidarity was strong and militant, but RAC was ready to wait the workers out. As the lockout progressed, the Steelworkers' international union became engaged, and eventually launched a corporate campaign to complement the local's efforts. That corporate campaign took them to Marc Rich. The Ravenswood plant, which had been owned by Kaiser Aluminum for four decades, passed into the ownership of RAC in 1988. The union discovered that, behind a convoluted corporate ownership smokescreen, stood one man with a controlling interest in RAC: Marc Rich. It is unlikely that Rich initially knew what RAC was up to when the lockout began -- RAC was just a piece in his global corporate puzzle. But about four months into the conflict, the union had made the Rich connection and was calling on him to end the lockout. "From that point on, Rich was culpable for what went on and the suffering the Ravenswood workers went through," says Bronfenbrenner. For 20 long months, the workers lived on minimal strike benefits, six months worth of unemployment benefits and donated food and supplies. Being out of work for so long, even from a lockout where union solidarity remains high, takes an emotional toll to match the financial one. It is no exaggeration when Bronfenbrenner speaks of the suffering of the workers and their families. As the Steelworkers tracked Rich to Switzerland and began applying pressure on his business operations in Europe, the corporate campaign moved to a new plane and the union discovered how extensive was Rich's reach. Soon they found themselves negotiating with Leonard Garment, White House Counsel under Richard Nixon, and William Bradford Reynolds, the number two at the Reagan Justice Department. Both Garment and Reynolds worked for Rich -- who would later show that he was right to trust in high-priced, politically connected legal help when Jack Quinn, former Clinton White House Counsel, would do the crucial work to win Rich his pardon. As the Steelworkers' campaign got closer to Rich's significant financial interests, union representatives received numerous death threats. When left-leaning Michael Manley was elected president of Jamaica in 1989, the Steelworkers were hopeful he would follow through on promises to cut his predecessor's close ties to Rich -- ties which gave Rich access to Jamaica's alumina at less

On the other hand, I believe no one has sufficiently celebrated our new Treasury secretary, Paul O'Neill. Fellow citizens, we have a prize on our hands; this man is going to enrich our national life like nobody's business. Last week, during Tax Cut Week, O'Neill was front and center, on the chat shows, giving interviews to select print outlets, pushing that dandy Bush tax cut -- the solution to all our problems, the finest thing since Elvis. In the immortal words of the Prince of Darkness, columnist Robert Novak: "This is about income redistribution." How true it is. This tax cut is beautifully designed and carefully crafted to redistribute wealth from the poor to the rich. But O'Neill does `not' like people who point this out. He is firm on this; he suspects us of populism. "I don't believe this society should still be operating with a robber baron premise as the basis for how we discuss public policy," he told `The Washington Post.' "I think it is really corrosive to have this argument about the rich and the poor. It's not worthy of where we are in our development as a country." On yet another chat show, O'Neill pronounced that some people's dreadful flogging of the very dead class-warfare horse "demonstrates their detachment from real life." O'Neill is a man who knows from real life. He made $59 million last year as the CEO of Alcoa, the giant aluminum company, so he is in tune with the Average Bubba and we can safely assume that he speaks for us all. I am particularly fond of the O'Neillian argument that anyone who points out that this tax cut redistributes wealth from the poor to the rich is guilty of class warfare. Passing a tax cut that gives 42.5 percent of the cut to the wealthiest 1 percent of the citizens is, in fact, class warfare. One cannot even make the pathetic argument that since the rich pay more in taxes, they should get a bigger cut, as though the principle of progressive taxation were a foreign concept. The top 1 percent of taxpayers pay 21 percent of all federal taxes but will get 43 percent of the tax cut -- which, if you do the math, is more than twice their share. I am so sorry that O'Neill is upset by people who refer to the corporate aristocracy in this country as "robber barons." That `is' rude, isn't it? Personally, I prefer to call them greedy bastards, and to point out that there is absolutely no limit to their insatiable greed. In 1990, average CEO pay was 80 times that of the average worker: by 1999, it was 485 times that of the average worker. Rich folk are feeling picked on. I have nothing against rich people; I hope to become one myself. But I'll be darned if I want to pay more in taxes than they do. President Bush holds a news conference with his "tax families" purporting to show that a $25,000-a-year waitress with two kids is a beneficiary of this tax cut. But according to the Center on Budget and Policy Priorities, under the Bush plan, 12 million lower- and moderate-income families, supporting 24 million children, get absolutely nothing out of this tax cut. Here's the Catch-22: 74 percent of American taxpayers pay more in payroll taxes than they do in income taxes. A $26,000-a-year couple with two kids would have their income tax liability eliminated, thus saving exactly $20, but they would still be paying $2,689 in payroll taxes. According to `The Wall Street Journal,' a noted organ of class warfare, a middle-management couple with two kids making $180,000 a year would get a $2,000 tax break, but the $18,000-a-year worker with wife and two kids would get nothing. It's a common sentiment. In a Senate Democratic Caucus divided between predictably liberal northern Democrats, predictably moderate southern Democrats, and the predictably opportunistic Robert Torricelli, Feingold stands out as the one guy likely to surprise you. While most of his Democratic colleagues long ago took Clintonesque dives on the death penalty, the Wisconsin Democrat continues to passionately oppose it. While most Democrats support campaign finance reform on two conditions--that it doesnât include labor unions and that it have no chance of passing--Feingold is actually sincere. In his 1998 reelection campaign, he applied the McCain-Feingold limits to his own campaign, and when the Democratic Party tried to run ads on his behalf, he told the party to buzz off. Feingold was one of the few Democrats to call for an independent counsel investigation of Clinton's 1996 fundraising, and he infuriated the White House by voting with the Republicans to proceed with the impeachment trial and to depose witnesses. And last month, he defied his Democratic brethren on the Judiciary Committee and voted to confirm John Ashcroft. All this has led some Democratic partisans to curse Feingold's name, but overall, it's been a savvy route to beltway prestige. Feingold shares more with John McCain than just a campaign finance reform bill; heâs following the same career playbook. In a Senate whose leaders can no longer really punish renegades, and a city where journalists throw around the terms "maverick" and "bipartisan" like bouquets, defying your own party can get you pretty far. After his vote for an impeachment trial, the New York Times wrote that, "Mr. Feingold's political career has been marked by principled stands that flouted conventional wisdom or party unity." In 1998, USA Today warned that if Feingold lost his seat in the Senate, it would be "Halloween all year long." But there's a difference between Feingold and McCain. In 1998 and 1999, McCain's various heresies--campaign finance, tobacco, Kosovo--seemed genuinely idiosyncratic. But since his presidential run, they have started to form a consistent pattern: it's called liberal Republicanism. With his recent endorsement of Democratic positions on a patients' bill of rights and perhaps even gun control, McCain has become a kind of super-charged James Jeffords. Heâs a "maverick" because his positions are unusual in the Republican Party and in his state, but not because they're unique to him. Feingold's a stranger case. His heresies don't follow an ideological pattern; they follow an anti-ideological one. Or put another way, Feingold's ideology is process. He breaks with his party because time and again he places procedure over substance. When he first ran for the Senate in 1992, he posted a list of promises to his garage door: he would keep his primary residence in Wisconsin, he would visit each county every year, he would not miss a vote, he would refuse a pay raise and he would finance his campaigns with in-state money. Not one promise concerned policy. When Feingold stood for re-election six years later, he ran a kind of meta-campaign, focusing greater attention on his refusal to air attack ads or raise more than one-quarter of his funds out of state than on social security, education or any of the other issues that usually dominate Democratic campaigns. On impeachment, Feingold voted with his Democratic colleagues to acquit, but defied them on procedural questions, such as whether the trial should include witnesses. Devotion to procedure over outcome is not a common trait among Washington politicians--which is why during impeachment and the Florida recount both parties flagrantly violated supposed principles like executive privilege, local control, and judicial restraint, to get the result they wanted. But Feingold's career makes clear the opposite danger. The Wisconsin Senator stands on principle no matter whose ox is gored. But it's not enough to have principles; those principles have to make sense. Feingold's vaunted 1998 reelection bid makes the point: he took a stand against negative ads, and out of state fundraising, but a lot of people in Wisconsin didn't see those stands as particularly meaningful. And they were right. There's nothing wrong with negative ads--they're usually more honest than positive ones. And it makes more sense to limit your campaign fundraising based on the interests and ideology of donors than on their state residence. (See "Fussy Russ," TNR, November 23, 1998). BY MAX BOOT Monday, February 12, 2001 12:01 a.m. During the presidential campaign, National Security Adviser Condoleezza Rice caused a furor by suggesting that a Bush administration would be interested in rethinking the U.S. commitment to Balkan peacekeeping: "We don't need to have the 82nd Airborne escorting kids to kindergarten." Now the whole issue is said to be "under review." As part of that process, Team Bush should look at a historical parallel that suggests getting out may not be easy or desirable. This isn't the first time a Republican president has come into office having criticized interventions undertaken by his two-term Democratic predecessor. So did Warren G. Harding in 1920. Woodrow Wilson had been even more interventionist than Bill Clinton, and for much the same reason. Both presidents believed that expanding democracy around the world was in America's interest. Wilson wound up not only getting America into World War I but also occupying Veracruz, Mexico (1914), Haiti (1915), the Dominican Republic (1916) and part of Cuba (1917); sending Gen. John J. Pershing deep into Mexico with 10,000 soldiers in pursuit of Pancho Villa (1916); and dispatching 15,000 soldiers to North Russia and Siberia in 1918 to safeguard Allied war supplies and cooperate with anti-Bolshevik forces. Although Wilson, like Mr. Clinton, succeeded GOP presidents who believed in a muscular foreign policy, by the end of his term he too found himself assailed by Republicans who claimed that U.S. troops were doing too much. During the 1920 campaign, in particular, Harding denounced "the rape of Haiti." This helped him appeal for the votes of blacks, then a Republican constituency, and it gave him a cudgel with which to beat the Democratic vice presidential nominee, Franklin Delano Roosevelt, who as an assistant secretary of the Navy had played a prominent role in setting occupation policy. Harding vowed he would not "empower an assistant secretary of the Nav y to draft a constitution for helpless neighbors in the West Indies and jam it down their throats at the point of bayonets." Once in office, however, Harding found pulling out a lot tougher than it seemed. His powerful secretary of state, Charles Evans Hughes, launched protracted and laborious negotiations with Dominican politicians over the te rms of withdrawal. The last Marines did not leave Dominican soil until 1924, and then only after the U.S. had won agreement on a treaty that gave Washington a fair amount of say in the republic's financial affairs. As for Haiti, Harding deferred to Congress. A special Senate committee chaired by Sen. Medill McCormick of Illinois spent 11 months studying conditions in Hispaniola, taking testimony from both critics and supporters of t he occupation. The committee criticized some abuses committed by the Marines but did not find evidence of widespread atrocities. The senators concluded that a U.S. pull-out would lead to a return to the kind of anarchy th at had led U.S. troops to land in 1915. "We are there, and in my judgment we ought to stay there for 20 years," Sen. McCormick said. Harding followed this advice, even if it was at odds with his campaign rhetoric. The U.S. Marines remained until 1934 when, ironically enough, former Assistant Navy Secretary Roosevelt pulled them out. It did not take Haiti long to return to a state of despotism interspersed with periods of chaos. By contrast, the 1920s had been one of the most peaceful and prosperous decades in the country's troubled history--as the 1990s might have been, had Mr. Clinton not ended the second U.S. occupation so soon. While the GOP administrations of the 1920s stayed in Haiti, they did briefly abandon another military commitment, in Nicaragua. U.S. Marines had first been sent there by President Taft in 1909-12 to help depose a dictator who had destabilized Central America. Thereafter, a legation guard of 100 Marines remained in Managua--an implicit threat that an unconstitutional usurpation of power would be met with American military force. This helpe d ensure 13 years of relative stability. But in 1925 Calvin Coolidge, Harding's vice president and successor, decided to withdraw the legation guard. Within a month, Conservative strongman Emiliano Chamorro overthrew the Managua government. The opposing political party, the Liberals, raised the banner of revolt. By 1926 U.S. Marines were back in Nicaragua to protect Am erican lives and property from the ensuing civil war. The U.S. then supervised a fair election that resulted in a victory for the Liberal candidate. But a rival Liberal leader, Augusto Sandino, wanted power for himself an d launched a guerrilla campaign to seize it. The U.S. Marines would spend six frustrating years chasing the

When Carlos Vignali walked out of prison on Jan. 20 and returned home to his family in Los Angeles, he appeared to fit the broad outlines of that profile. But the 30-year-old Vignali, who had served six years of a 15-year sentence for federal narcotics violations, fit another profile entirely. No small-time offender, he was the central player in a cocaine ring that stretched from California to Minnesota. Far from disadvantaged, he owned a $240,000 condominium in Encino and made his way as the son of affluent Los Angeles entrepreneur Horacio Vignali. The doting father became a large-scale political donor in the years after his son's arrest, donating more than $160,000 to state and federal officeholders--including Govs. Pete Wilson and Gray Davis--as he pressed for his son's freedom. The grateful father called the sudden commutation of his son's sentence by Clinton "a Hail Mary and a miracle." The improbability that such a criminal would be granted presidential clemency, as well as the younger Vignali's claim that he alone steered a pardon application that caught the president's attention and won his approval, has sparked disbelief and outrage from nearly everyone involved in his case. "It's not plausible; it makes no sense at all," said Margaret Love, the pardon attorney who oversaw all Justice Department reviews of presidential clemency applications from 1990 to 1997. "Somebody had to help him. There is no way that case could have possibly succeeded in the Department of Justice." Because it is a hard-edged criminal case, Vignali's commutation adds another dimension to the wave of eleventh-hour Clinton clemencies and raises new questions about the influence of political donors and officials on different stages of the process. As criminal justice authorities in Minnesota learned of Vignali's sudden freedom, they reacted with the same indignation that has greeted several other beneficiaries of the 140 pardons and 36 commutations Clinton granted in his last hours as president. The Vignali case also illustrates the secrecy that enshrouds the clemency process. A federal prosecutor who had urged Justice Department superiors to reject clemency for Vignali demanded an official explanation--only to be denied information from his own department. The judge who sentenced Vignali is openly aghast at the decision, which was made without his knowledge. And they all--from defense attorneys to street detectives to former pardon attorney Love--scoffed that Vignali could have walked free without the intervention of politically connected helpers. Key details of the case remain a mystery. Did political officials and other authoritative figures appeal for Vignali's freedom to the president or high-ranking Justice Department officials? What action, if any, did the Justice Department recommend to the White House? Vignali could not be reached for comment. But his father strongly denied that he or anyone else in the family asked politicians to press their case with Clinton. "I didn't write him a letter, I didn't do anything," Horacio Vignali said. "But I thank God, and I thank the president every day." Page 9 New Cold War Warms Up By Pavel Felgenhauer Last week Security Council Secretary Sergei Ivanov surprised an international security conference in Munich, Germany, with an uncompromising speech denouncing Western plans to further expand NATO, as well as the American intention to deploy a national missile defense. Many in the West believe that the present Kremlin positions on NATO expansion and NMD are just public poses for domestic consumption to keep anti-Western forces happy while the new "pro-liberal" President Vladimir Putin implements much-needed military reforms. Further NATO expansion is virtually inevitable and the United States will almost certainly proceed with NMD no matter what Moscow says. So the Kremlin should begin accepting the inevitable, say Western diplomats. The Munich conference would have been a good place to start. Conference attendees also hoped that Ivanov — who appears to be Putin’s main national security adviser — is influential enough to speak reasonably on serious matters. Instead he repeated that the 1972 Anti-Ballistic Missile treaty remains a cornerstone of international security and that it forbids the deployment of any NMD. Ivanov added that any breach of the ABM treaty would begin a new arms race, including an arms race in space. Ivanov’s remarks imply that today’s Russia is capable of competing with the mighty United States both on earth and in space, a scenario that seems highly questionable considering that Moscow does not have enough money to buy even a few night-capable attack helicopters for its troops in Chechnya. The new U.S. defense secretary, Donald Rumsfeld, told reporters in Munich that Russia should not fear NMD since it is designed to intercept only a handful of incoming "rogue" missiles. Rumsfeld said the Kremlin is "off the mark" in calling NMD a threat to arms control. "That’s cold-war thinking," said Rumsfeld. Defense Minister Igor Sergeyev responded promptly, telling reporters Monday that in response to NMD and NATO expansion Moscow will abandon most other arms control agreements and will deploy "asymmetrical" countermeasures that were designed in the 1980s to counter Ronald Reagan’s "Star Wars" initiative. In fact, the latest Russian intercontinental ballistic missile, the Topol-M SS-27, was specifically designed to penetrate ABM defenses. Sergeyev has been criticized for spending virtually all the Defense Ministry’s procurement money in 1997-99 — depriving the army of any new weapons — to deploy the SS-27 that has, among other features, the capability to carry many decoy warheads to baffle enemy radar and interceptors. A number of decoy warheads were developed and tested in space during the Soviet period. Russian "asymmetrical measures" are already in place. The only problem is that up to now the United States does not have any missile defense at all, while Russia is already deploying the SS-27. For the Russian military and for Sergeyev, NATO expansion and NMD are a vindication for squandering the country’s last resources on new ICBMs aimed at the United States a full decade after Russia lost the Cold War. NMD and NATO expansion will also provide the military and defense industry chiefs with a pretext to whip up xenophobia and clamor for more money. But why does Putin support these suicidal policies — virtually the same policies that brought the powerful Soviet Union to collapse in the 1980s? In 2000 Putin united Russia and won a landslide victory at the polls by giving the people a clear enemy — the Chechen separatists, supported by an international Moslem extremist cabal. Now the war in the Caucasus has been officially proclaimed to have ended in victory, so a new enemy is being put forward to mobilize the nation. Of course, the Kremlin apparently hopes it can manage the level of confrontation with the West, so that Russians feel threatened and work harder but Western investments continue to flow in. But will the gamble work? In Chechnya, the Kremlin originally planned a limited engagement, but a full-scale war that Russia cannot win ensued. Today the same military chiefs hope to replay the Cold War again and to "restore" the Russian military to its Soviet glory in the process. LAKE Copyright 2001 by United Press International 2/12/01 WASHINGTON, Feb. 12 (UPI) -- In the next month, a handful of Iraqi rebels are scheduled to go to College Station, Texas, for their first round of weapons training from federal lawmen and members of the military's Special Forces under a U.S. plan to support insurgency activities inside Iraq. The Iraqi National Congress, the coalition of Iraqi dissidents and rebels supported by the United States officially since 1998, are in the final stages of completing a $98,000 contract with the Guidry Group, a consulting firm comprised of ex-secret service agents. Under that contract, INC security officers will learn the fine art of diplomatic security. What distinguishes this training from previous courses for the INC, is that the rebels attending the five-day seminar will also learn how to use pistols, Kalishnikov rifles, 12-gauge shotguns and a variety of other fire-arms. Previous U.S.-backed training for the INC has been limited to "non-lethal" activities, such as emergency medical care, public relations and war crimes investigations, according to an INC adviser. While the State Department still considers this assistance to be of the non-lethal variety, the INC clearly does not. "This is important because this is the first time we are receiving lethal training with the United States government funding," said Francis Brooke, the Washington adviser for the INC. Retired Gen. Wayne Downing, the commander of the joint special operations task force during the Gulf War, concurred. He told United Press International, "This is significant because this is the first lethal training. It is designed to protect, so the significance is that this is the first time they are being trained to do anything on this level." But State Department officials disagree. One official said, "This is not lethal assistance. The skills involved are purely protective and defensive in nature of the type necessary for the Iraqi National Congress to protect any non lethal presence or activities inside Iraq." The debate over lethal assistance marked the INC's fiercest battle with the Clinton Administration. The lethal aid promised in the 1998 legislation that authorizes $98 million for the group was never delivered largely under the premise that the INC was not ready to challenge Hussein militarily. But this thinking may change under the Bush administration. While Secretary of State Colin Powell has carefully avoided making any comments on the military aspect of the Iraq Liberation Act, his counterpart at the Pentagon, Donald Rumsfeld is a long time supporter of a plan to oust Hussein through U.S. backed rebels. Both Rumsfeld and his deputy, Paul Wolfowitz signed a letter to President Clinton in 1998 that spurred the creation of the Iraq Liberation Act. The Feb. 18, 1998 letter states, "Iraq today is ripe for a broad-based insurrection. We must exploit this opportunity." It goes on to outline a series of steps the government should take to aid the INC, including positioning "U.S. ground force equipment in the region so that, as a last resort, we have the capacity to protect and assist the anti-Saddam forces in the northern and southern parts of Iraq." The $98,000 contract with the Guidry group is tucked into a larger $4 million aid package -- separate from the Iraq Liberation Act funding -- aimed at establishing an alternative Iraqi media through radio transmitters, satellite television stations and newspapers. The plan, approved initially in September by the Clinton administration, also sets aside money for INC members to go inside Iraq to collect information on war crimes, Iraq's military and political changes. One of the INC's principal leaders, Ahmad Chalabi, speaking to reporters and analysts Friday at the American Enterprise Institute, said he believed his group could attract a number of defectors from Iraq's military if they established a presence inside the country. "The Iraqi army is unwilling to defend Saddam, but they are too weak to overthrow him," Chalabi said, estimating that 40 percent of Iraq's elite Republican guard is absent without leave. To be sure, the five-day security seminar is a far cry from the battle field training and American military support envisioned by Chalabi and his supporters in Washington. Chalabi on Friday said he hoped the Pentagon would change the rules of engagement for American aircrafts patrolling the no-fly zone in northern and southern Iraq, to allow fighters to attack Iraqi army battalions when they were moving against civilian targets. Downing, who has worked as an adviser on a volunteer basis with the INC for three years, called the security training in the State Department aid package a "drop in the bucket." Church members were not allowed to carry anything off the property. All the many streets around the church are blocked off by IPD officers, who claimed they would not be involved in the seizing of the church. The church was seized by marshals because of a mult-million dollar tax debt. Federal marshals entered the building through a side door and found church members praying. No resistance was reported. A few people who refused to leave the church were carried out on stretchers. Greg J. Dixon, the elder of the Dixon pastors, was carried out of the church on a stretcher. He asked god to forgive the marshals for what they were doing, placing most of the blame on the Bush administration and Attorney General John Ashcroft. Dixon said that the church had been deceived by the Bush administration, claiming that a deal had been agreed on that would have rolled back the taxes the church owed. Dixon's son, Pastor Greg A. Dixon, stated the church plans to continue its battle because members are united. He accused the marshals of trampling the Constitution. He went on to say that there were a number of things the Temple could do from a legal standpoint about today's church seizure. From a political standpoint, Dixon says the church will continue to try to get a resolution to preserve religious liberty. He says the government is giving millions of dollars to churches and faith-based organizations, and he calls that hypocrisy. U.S. marshal Frank Anderson says the Temple will likely be turned over to the IRS this afternoon. Anderson says the seizure has been one of the most difficult tasks he has had to carry out in his 37 years of service. However, Anderson says marshals had a duty and they've done their duty. He says marshals waited 91 days for the safest and most opportune moment to act. Anderson says people were honest and open on both sides, and the intent was to take the church in a peaceful manner. "We didn't want anyone from our side or the other side to get hurt," said Greg Dixon Sr., the elder of the pastors, who was removed from the building on a gurney. Other church members who refused to leave were taken outside on stretchers. No one was arrested and the building was to be turned over to the Internal Revenue Service. The standoff at began Nov. 15 after church leaders refused to pay $6 million in Social Security withholding, Medicare and income taxes and penalties. The Temple stopped collecting taxes in 1984. "I can't believe this is happening," said Pastor Wiley S. Drake, pastor of First Southern Baptist Church in Buena park, Calif., who was at the Temple when the siege began. "I can't believe that (U.S. Attorney General John) Ashcroft is doing this his on his watch. He had every legal right to stop that." Drake, interviewed by telephone in California, said he had sent letters to Ashcroft and President Bush in January, urging them not to allow the first seizure of a church by the federal government in U.S. history. His letter to Ashcroft said his cousin, Susan, has asked Drake to discuss the Indianapolis Baptist Temple situation with the new attorney general. John McCain (R-Ariz.) and Joe Lieberman (D-Conn.) are quietly working together to draft an alternative compromise that both parties can support. The discussions between McCain and Lieberman are still in the infant stages, but the bill is likely to include a reworked version of the controversial gun show loophole, trigger locks and more funds and support for the law enforcement community, aides to both Senators said. Some of McCain's GOP colleagues believe that the Arizonan's interest in the gun issue and other hot topics, such as HMO reform, is an attempt to undercut President Bush's agenda. "[McCain] is just trying to set the presidential agenda, and there is a discomfort with that," griped a GOP Senator close to the Republican leadership team. McCain, however, sharply denies that he's trying to sabotage Bush. "I have supported President Bush in his campaign," he said. "No one campaigned harder for him. No one campaigned harder for [GOP] candidates, and I have supported literally [Bush's] entire agenda." "So I don't think I would fail any kind of loyalty test," he added. Staffers for both McCain and Lieberman have been talking about a compromise gun bill since late last year; however, the two Senators were able to discuss the issue in greater depth during their official visit to Munich, Germany, this past weekend. "This is not done," a source close to McCain cautioned. "But we are working on it." A spokesman for Lieberman acknowledged that the Connecticut Democrat is eager to work with the Arizona Republican, whom he "deeply respects." "This would be an opportunity to chart a third way on stopping gun crime by dedicating more resources to enforcing existing gun laws while also fixing some of the loopholes that persist in those laws," Lieberman spokesman Dan Gerstein said. The McCain-Lieberman alliance is also expected to be the first of many ventures the two independent-minded Senators are expected to partner on during this Congress. The move could cause heartburn among members of both parties, since McCain sought his party's presidential nomination last year, while Lieberman was the Democrats' unsuccessful vice presidential candidate. The two Senators are also talking about drafting legislation to curb violence on television and in the movies, as well as foreign policy initiatives, sources said. The original gun safety measures passed Congress in 1999 in the wake of the Columbine High School massacre but stalled in conference committee when Republicans and Democrats reached an impasse over several provisions. McCain's interest in the subject could force the Republican leadership to address this issue, which has largely been pushed to the side and virtually forgotten. "With Senator McCain joining Senator Lieberman on this debate, you are all but guaranteed it is going to register on the public's radar screen," said a senior Senate Democratic aide, who noted that the Senate Democratic leaders would likely embrace Lieberman's efforts to pass a gun safety bill. "McCain is unbelievable," the aide added. "He has got absolutely no fear of antagonizing his leadership." McCain's decision to tackle this issue is likely to further infuriate his Senate GOP colleagues, who are working hard to implement Bush's legislative priorities. "There is a lot of frustration," a Republican Senator said. "He has got his own agenda." The coalition with Lieberman is just the latest in a series of partnerships the Arizona Republican has formed on high-profile issues that pits him against the Republican leadership and many of his GOP colleagues. He drew private scorn Tuesday from some Republican Senators for joining Sen. Edward Kennedy (D-Mass.), among other liberal Democrats, in sponsoring a managed care reform bill that most Congressional Republicans oppose. That move, which blindsided many Republicans, comes on the heels of McCain's repeated efforts to bring up campaign finance reform - oftentimes against the wishes of the GOP leadership. "I think it is not good if he thinks he is going to go in on every issue where we have had a dispute and try to take a few Republicans with him and settle these issues with the Democrats," a GOP Senator said. Weyrich John Ashcroft told me this story: After he had been defeated for re-election to the U.S. Senate and before he had any idea that he would be nominated to be Attorney General, he was making the rounds during the lame duck Senate session, saying goodbye to his colleagues. He caught the eye of Senator Robert Torricelli (D-N.J.). As Chairman of the Democratic Senatorial Campaign Committee, Torricelli had spent millions to defeat Ashcroft. In one particular case, Torricelli had accused Ashcroft, in an ad, of pandering to some special interest by sponsoring a certain piece of legislation. It turned out that Ashcroft was only a co-sponsor. The chief sponsor was...Robert Torricelli! But the damage to Ashcroft's reputation had already been done. So when he saw Torricelli, at first Ashcroft hesitated. He didn't want to shake hands with Torricelli. But then he thought better of it and he went across the floor and held out his hand and said to the Senator from New Jersey "I want you to accept my apology. I was going to let bitterness rule. I wasn't going to shake your hand because of what happened. But that would be wrong. You beat me and that's all in the past and I just want to say no hard feelings, Senator." Torricelli was virtually speechless. He managed to come out with some nice cliche. And that was that. A few days later Bush announced Ashcroft as his choice for Attorney General. Torricelli immediately had high praise for the Senator from Missouri. Later he gave his home phone number to Ashcroft, suggesting to Ashcroft that if the media needed someone to call over the holidays who would say nice things, he would be it. Ashcroft had every reason to believe that Torricelli would be a vote in his favor when it came time for confirmation. Ashcroft had applied a Christian principle (turning the other cheek) and it seemed to have moved Torricelli to act in a positive way. So far so good. The problem was that Torricelli did make positive public comments about Ashcroft. Among those who read them was one of his big time fundraisers, who also happens to be active in the abortion rights movement. This woman went crazy. Torricelli got the message in mega decibels. In the end, Torricelli was one of the three Democrats who had told Ashcroft he would be there for him who caved. Now, George Bush wants us to put the Ashcroft business behind us and to move forward - and I am perfectly happy to do so. I do believe the story is worth mentioning, however, because George W. Bush is doing his level best to change the atmosphere in Washington. Like Ashcroft, he is going the extra mile. He is turning the other cheek. He is extending the olive branch to liberals and Democrats in a way that Washington has never seen before. And as with Torricelli, it is apt to have a temporary positive effect. But Bush should understand that there are forces of evil at work in this town as well, and they are going to work against anything positive. Not that this fact should deter Bush in any way, mind you, but it is a fact of life. Bush should not be shocked or surprised if his goodwill gestures do not get him very far when it comes to the cornerstones of his program. The key is goodwill. If that is in good supply, remarkable things can happen. Absent goodwill, nothing constructive will happen. There is no doubt in my mind that Bush is exhibiting much goodwill. He actually means to change the tone here. I have listened carefully to much of the response. I don't hear a lot of goodwill in response. Indeed, most of the time I hear the opposite. (February 13, 2001 1:20 p.m. EST http://www.nandotimes.com) - Steve Kohller looks out over the winter stubble on his 1,000-acre farm on the Illinois prairie. Several years of poverty prices for corn and soybeans have him dreaming of a new crop, one that would grow as tall as 14 feet and, he says, might someday rival soybeans in terms of cultivated acres throughout the Midwest. "It's not a savior," he says, wearing only a thin denim jacket against the bitter February cold. "But it may be the answer we've been looking for." The crop he's talking about is hemp, whose close ties to marijuana have long drawn a stern gaze from authorities. But in farm country, where something close to a depression reigns, the struggle to legitimize industrial hemp is serious business. Some 27 states have either passed laws favoring hemp or are considering such legislation, according to the North American Industrial Hemp Council (NAIHC). Hemp production is illegal by federal statute, so states generally call on Washington to alter its policy or set up research plots, which are required to be fenced and guarded. Here in Illinois, legislation that would allow hemp research at the University of Illinois has passed both the state House and Senate and is currently sitting on the governor's desk, awaiting action. "You aren't going to solve the corn-, soybean-, and wheat-price problems so long as we're producing far beyond our needs and the needs of the world," says Bud Sholts, chairman of NAIHC. "What this country deeply needs - in terms of agricultural development and price stabilization - is an alternative crop of significant acreage that works well in the rotation, which industrial hemp does." Hemp proponents call it a miracle crop. Its fiber can be blended together to create a Fiberglas-like material lighter and stronger than steel, which can be used to make a variety of products, including cars. Hemp can also be used in textiles, building materials, carpeting, even circuit boards. As a replacement for petroleum-based products, hemp would lessen dependence on foreign oil and is a renewable resource. It is also biodegradable. Hemp car bodies could be shredded and dumped in landfills. More than 30 countries have legalized hemp growing, including Germany, Canada, England, Australia, and France. But in this country, hemp can't shake its shady reputation. Although both sides in the debate acknowledge it's impossible for someone to get high on hemp even if he or she smokes a boatload of it, suspicion lingers. Drug Enforcement Agency spokeswoman Rogene Waite said a 1998 statement on industrial hemp that equates it with marijuana still represents the agency's policy on the matter, but added the DEA is "currently in the process of reviewing some of the security and other issues surrounding the regulation of industrial hemp." Robert Weiner, a spokesman for the White House drug policy office, cites a litany of complaints about hemp. "From a plane, it's very difficult to distinguish between marijuana and hemp, so the enforcement side of this would be extraordinarily difficult." But Paul Mahlberg, a professor of cell biology at Indiana University in Bloomington, says law enforcement in Europe has no trouble telling the two apart. He says hemp grows eight to 14 feet high, is unbranched, and is planted a few inches apart, like a cornfield. Marijuana plants are typically three to four feet high, branch out like bushes, and need to be planted four feet apart. Moreover, Mahlberg maintains that planting the two species together would be ill-conceived: When hemp cross-pollinates with marijuana, it cuts the drug's potency in half, making it useless for illicit purposes. But White House officials also question hemp's value to farmers. "Hemp is not necessarily economically viable," says Weiner, citing an Agriculture Department report that says U.S. markets for hemp products in 1999 could have been produced on less than 5,000 acres of land. Jeff Gain, former chair of the USDA's Alternative Agriculture Research and Commercialization Corp., scoffs at the comment. "Of course, there's no market if they won't let us grow the stuff," he says. "We've told the DEA and the others: Go to Detroit and talk to them, and they'll tell you how important they believe these kinds of fibers are to the future of the automobile industry. It's no secret." In a letter published in The Sunday Oklahoman, McVeigh questioned the fairness of limiting the number of witnesses to his execution. The Federal Bureau of Prisons is considering a closed-circuit broadcast to accommodate survivors and relatives of victims. "Because the closed-circuit telecast of my execution raises these fundamental equal access concerns, and because I am otherwise not opposed to such a telecast, a reasonable solution seems obvious: hold a true public execution allow a public broadcast," he wrote. McVeigh, 32, is set to be executed May 16 by injection at the federal penitentiary in Terre Haute, Ind. McVeigh's attorney, Rob Nigh Jr., confirmed that McVeigh wrote the letter and is serious about broadcasting his execution. "He is in favor of public scrutiny of government action, including his execution," Nigh told the newspaper. About 250 people who survived or lost family members in the April 19, 1995, bombing of the Alfred P. Murrah Federal Building have asked to see McVeigh's execution, but only eight seats are available for witnesses on behalf of victims. A national broadcast is not an option, bureau spokesman Dan Dunne said. "It hasn't been considered. It won't happen," Dunne said. Closed-circuit television has been a part of McVeigh's legal process from the start. His Denver trial was shown to bombing victims at an auditorium in Oklahoma City. In McVeigh's Feb. 1 handwritten letter, he wondered who would be considered for watching his execution. "It has ... been said that all of Oklahoma was a victim of the bombing. Can all of Oklahoma watch?" he wrote. He also complained in the letter about the limits put on his witness list. McVeigh can have six witnesses, including one spiritual adviser, two lawyers and three adult relatives or friends. McVeigh would be the first federal inmate executed since 1963. He dropped all appeals in January and has until Friday to seek clemency from President Bush. The idea of televising executions is not new in the United States. Several states, including Oklahoma, have allowed relatives of murder victims to watch executions on closed-circuit television. In 1994, former talk-show host Phil Donahue tried to get permission to televise the execution of murderer David Lawson, but was denied by the North Carolina Supreme Court and the U.S. Supreme Court. McVeigh will not make a legal push for a public execution, but Nigh said he supports the idea. A Mockery of Justice by George Szamuely Having exonerated NATO of war crimes charges, Carla del Ponte, Chief Prosecutor of the International Criminal Tribunal for the Former Yugoslavia, has decided that NATOs notorious bombing of Serbian state television station and the death of 16 of its employees may have been a war crime after all. The perpetrator, however, was not NATO, but former Yugoslav leader Slobodan Milosevic. According to her, "Milosevic had been warned of the airstrike on the television station, buthe had chosen to disregard the information so that the employees would be killed and NATO potentially smeared." "Sentence first verdict afterwards" the legal principle of the court in Alices Adventures in Wonderland is a model of sanity next to del Pontes Tribunal. Yet the law as interpreted by del Ponte is current NATO doctrine. It is not the bully but his victim who is the real bully. By refusing to accede to the bullys demands the victim brings his own fate upon himself. He also commits a crime against his attacker who may suffer psychological damage as a result. Thus Milosevic victimized NATO. NATO was forced to murder 16 innocent civilians and made to weather two hours of bad publicity. Indeed, the entire 11-week bombing campaign was a war crime perpetrated by Milosevic. By refusing to accept the US ultimatum at Rambouillet, he provoked the bombing of Yugoslavia. Every hospital destroyed, every housing estate reduced to rubble, every bridge crashing into the Danube, every petrochemical plant going up in flames was Milosevics war crime not NATOs. Most horrifying of all, NATO that repository of all that is finest, most honorable and decent in men hearts was "smeared." The Serbs must be made to pay for this violation of the global moral order. The current dispute between the regime in Belgrade and Carla del Ponte as to who gets to put Milosevic on trial first is largely a sideshow. We know the outcome already. Indeed, the outgoing Clinton Administration had already suggested a solution. Milosevic does not have to be shipped off to The Hague. He can be put on trial in Belgrade, but the prosecutors will be from The Hague. After his inevitable conviction of war crimes and crimes against humanity, the Yugoslav courts can try him. The prosecutors will be representatives of the new regime who clearly have their own reasons for wanting to purge Yugoslavia of every vestige of the pre-Kostunica/Djindjic era. The trials will, of course, be a mockery of justice. Is there anyone in the world who seriously doubts how del Pontes "court" will rule? Is there anyone who doubts the outcome of the Yugoslav domestic trials? Milosevic will be convicted of every crime under the sun from "vote stealing" to embezzlement to double parking and spitting on the sidewalk. The fairness of the trial Milosevic can expect at The Hague is to be gauged from the fact that the Court had indicted him on the basis of a few interviews with Kosovo Albanian refugees. Yet Louise Arbour, del Pontes predecessor, knew immediately that Milosevic was personally responsible for any atrocities that may have been committed. The flimsiness of the evidence against him was evident from the beginning, as NATO repeatedly revised downwards its estimates of Kosovo Albanian casualties. Just the other day, OSCE investigators were forced to acknowledge that they had found no evidence to substantiate an NPR report that Yugoslav forces had burned the bodies of 1500 Albanians in the Trepca blast furnace as they were pulling out of Kosovo. The fairness of the trial Milosevic can expect from the Belgrade authorities is to be gauged from the remarks of Interior Minister Zoran Zivkovic. "Milosevics place is in jail," he declared, "It would be just for him to stand trial here because he committed all those crimes here. Our prosecutor should accept The Hagues indictment, add the local charges, and trigger the proceedings in front of our courts. Steele Inquirer Staff Writers Want to take advantage of the stew of rules, regulations and laws that govern the U.S. economy and the conduct of business in America? And maybe make a few million dollars and cut your taxes along the way? Here are a few tips. * Become a fugitive from justice and set up operations in a foreign country to conduct business, even to deal with government agencies back home. * Become a citizen of a foreign country, in order to play American stock and bond markets, or even to buy and sell American businesses, at lower tax rates than you'd get staying at home in the United States. * Form an American subsidiary of a foreign-owned company so you can pay lower taxes than your U.S.-owned competitors. * Start an American company, and then move your factory, jobs and investment dollars offshore. Any one of those setups is now to your advantage because of the way the rules that govern business in this country have been written and rewritten over the last 20 years. Why would the U.S. government rig the game that way? In part because of the influence exercised by special interests in Congress and in federal agencies. In part because of good intentions gone awry. One of the consequences: American companies, and companies worldwide, are now conducting a replay on a global scale of a business practice that became common here in the 1960s. That was the decade that U.S. companies began playing off one region of the United States against another, one state against another, one city against another. The objective was to locate a new plant or relocate an existing one in whatever area would offer the greatest tax incentives - so the company would have to pay the smallest amount of local and state taxes - and where employee wages and fringe benefits could be held down the most. Now that practice has gone global, as corporations and financiers play off one country against another, one national tax system against another, one country against its possessions. President Bush put a glowing light on it in February in his annual report on the state of the economy: "The benefits of global economic integration and expanded international trade have been enormous, at home and abroad. U. S. firms gain from access to global markets; U. S. workers benefit from foreign investment in America. . . . Competition and innovation have been stimulated, and businesses have increased their efficiency by locating operations around the globe." The aptly named Marc Rich quite likely feels the same way. You may not recognize his name. But you quite likely have used one of his products. Rich, a member of Forbes magazine's directory of the 400 richest Americans, operates a highly secretive and successful commodities business around the world. Through a maze of closely controlled companies, he buys and sells billions of dollars worth of oil, copper, nickel, wheat, alumina and other commodities. What makes this remarkable is the fact that Marc Rich is a fugitive from the U.S. government. Back in 1983, Rich; two associates, and one of his companies, Clarendon Ltd., were accused by the federal government of failing to pay taxes on profits from rigging the price of crude oil during the 1979-80 energy shortage, then hustling the money out of the country. In order to continue doing business, Clarendon pleaded guilty to the charges and paid $172 million in taxes and penalties. Rich fled the country, apparently unwilling to risk the possibility of a trial, conviction and a sentence that could add up to more than 300 years in prison. Ever since the indictment, Rich has been operating from Zug, Switzerland, where he lives in a multimillion-dollar mansion. His father's political donations increased sharply after the 1994 conviction. By RICHARD A. SERRANO and STEPHEN BRAUN Los Angeles Times Staff Writers WASHINGTON--In the waning days of his presidency, Bill Clinton promised to use his clemency powers to help low-level drug offenders languishing in prison. When Carlos Vignali walked out of prison on Jan. 20 and returned home to his family in Los Angeles, he appeared to fit the broad outlines of that profile. But the 30-year-old Vignali, who had served six years of a 15-year sentence for federal narcotics violations, fit another profile entirely. No small-time offender, he was the central player in a cocaine ring that stretched from California to Minnesota. Far from disadvantaged, he owned a $240,000 condominium in Encino and made his way as the son of affluent Los Angeles entrepreneur Horacio Vignali. The doting father became a large-scale political donor in the years after his son's arrest, donating more than $160,000 to state and federal officeholders--including Govs. Pete Wilson and Gray Davis--as he pressed for his son's freedom. The grateful father called the sudden commutation of his son's sentence by Clinton "a Hail Mary and a miracle." The improbability that such a criminal would be granted presidential clemency, as well as the younger Vignali's claim that he alone steered a pardon application that caught the president's attention and won his approval, has sparked disbelief and outrage from nearly everyone involved in his case. "It's not plausible; it makes no sense at all," said Margaret Love, the pardon attorney who oversaw all Justice Department reviews of presidential clemency applications from 1990 to 1997. "Somebody had to help him. There is no way that case could have possibly succeeded in the Department of Justice." Because it is a hard-edged criminal case, Vignali's commutation adds another dimension to the wave of eleventh-hour Clinton clemencies and raises new questions about the influence of political donors and officials on different stages of the process. As criminal justice authorities in Minnesota learned of Vignali's sudden freedom, they reacted with the same indignation that has greeted several other beneficiaries of the 140 pardons and 36 commutations Clinton granted in his last hours as president. The Vignali case also illustrates the secrecy that enshrouds the clemency process. A federal prosecutor who had urged Justice Department superiors to reject clemency for Vignali demanded an official explanation--only to be denied information from his own department. The judge who sentenced Vignali is openly aghast at the decision, which was made without his knowledge. And they all--from defense attorneys to street detectives to former pardon attorney Love--scoffed that Vignali could have walked free without the intervention of politically connected helpers. Key details of the case remain a mystery. Did political officials and other authoritative figures appeal for Vignali's freedom to the president or high-ranking Justice Department officials? What action, if any, did the Justice Department recommend to the White House? Vignali could not be reached for comment. But his father strongly denied that he or anyone else in the family asked politicians to press their case with Clinton. "I didn't write him a letter, I didn't do anything," Horacio Vignali said. "But I thank God, and I thank the president every day." For now, the Vignali case is a curious tale of how an inmate buried deep in the federal penal system won presidential help while others in more desperate straits remained behind. "Go figure," said an exasperated Craig Cascarano, the lawyer for one of Vignali's 30 co-defendants, many of them poor and black. "How is it that Carlos Vignali is out eating a nice dinner while my client is still in prison eating bologna sandwiches?" Clinton Concerned About Drug Sentences Clinton and his White House staff have not fully explained why he granted certain clemencies, including the highly controversial pardon of fugitive commodities broker Marc Rich. But in recent months, the president had expressed concern about mandatory federal sentences imposed on some small-time drug offenders. "The sentences in many cases are too long for nonviolent offenders," Clinton said in a November interview with Rolling Stone magazine. ". . . I think this whole thing needs to be reexamined." His comments prompted a flurry of last-minute clemency requests to the White House, said the former president's spokesman, Jake Siewert, particularly since Clinton believed that Justice was not moving fast enough in making clemency recommendations to the White House. Until April, he was one of 800 production workers at the Whitehall Laboratories plant in Elkhart. That was the month his job was eliminated. Come Nov. 1, Whitehall Laboratories, a division of American Home Products Corp., will close the Elkhart plant permanently; the last of the 800 still on the job will be out of work. Some of the products once manufactured there now are being turned out at a new facility in Guayama, Puerto Rico. As for American Home Products, the Puerto Rican subsidiary already has allowed the company to escape payment of millions of dollars in U. S. income taxes, not to mention saving millions of dollars in salaries. Said the 52-year-old Skelton: "All the companies that have moved down there, so far as I know, are good, healthy, rich companies. It's like giving welfare to the rich, the way I'm looking at it. Robbing from the poor and giving it to the rich." For that, thank members of Congress and the 1976 Tax Reform Act that amended the tax code. While provisions in the Internal Revenue Code encouraging investment in Puerto Rico date to 1921, the 1976 law added a twist that led to a corporate stampede to the island. Under the old law, the subsidiary of a U. S. company operating in Puerto Rico had to pay federal income taxes on its profits earned there when it transferred the profits back to this country. In other words, a company could accumulate its profits, year after year, on the island, and pay no U.S. income tax. But taxes had to be paid when the subsidiary paid dividends to its parent company. The new law exempted the dividends - or profits in Puerto Rico - from the U. S. income tax, and allowed the profits to be shipped back to the United States tax-free. There is no comparable tax provision for individual taxpayers. If there were, it would go something like this: If you had two jobs, one in Philadelphia and the other in Princeton, N. J., you would pay federal income taxes only on the money you earned in Philadelphia. The money you earned in Princeton would be tax-free. Since passage of the 1976 tax act, corporations have terminated the jobs of tens of thousands of factory workers in the United States, replaced them with lower-paid workers in the possessions, mostly Puerto Rico, and escaped payment of billions of dollars in federal income and other taxes. Pharmaceutical companies, in particular, have embraced this provision. So much so that Puerto Rico boasts the world's largest concentration of drug companies. The effect on U. S. mainland workers may be measured in announcements by pharmaceutical companies over the last few years. In October 1988, then-SmithKline Beckman Corp. announced that it would transfer production of prescription drugs from a Philadelphia plant to a plant in Puerto Rico - and terminate the jobs of 800 Philadelphia production workers. In April 1990, Bristol-Myers Squibb Co. announced that it would transfer production of a cardiovascular drug from a plant in New Brunswick, N. J., to Puerto Rico - and terminate the jobs of 500 New Brunswick workers. Let's look at one company, American Home Products, a New York-based health- care conglomerate that had sales of nearly $7 billion in 1990. Its Whitehall Laboratories division manufactures non-prescription products with such familiar names as Advil and Anacin-3, Preparation H and Dristan. In February 1989, American Home Products told stockholders that ''completion of a new facility in Puerto Rico in the fourth quarter of 1988 . . . will enable Whitehall to achieve significant cost efficiencies while maintaining the highest manufacturing standards." In October 1990, American Home Products announced that within one year it intended to close the Whitehall plant in Elkhart and transfer some of the work to its new plant in Puerto Rico. Among the products to be manufactured in Puerto Rico: Anacin, Dristan, Denorex and Advil. The move exacted a heavy toll on the Elkhart workforce, whose average length of service was 15 years. More than half the production workers were women. A recent survey showed that of 100 employees laid off a year ago, only about half have found other work. In many cases, they have been forced to accept part-time employment. Their average pay today is $6 an hour. Before, it was $13.40. Harvey was serving an 11-year jail sentence for money laundering until in the dim twilight zone of his presidency Bill Clinton set him free. In all probability, Harvey's name means nothing to you, but it will. Why should Americans pay taxes to fund efforts to stop illegal drugs when presidential pardons are available? Once again, if enough people know about Harvey Weinig, they might vote down Bill and Hillary when they next dare to venture out to face voters. Harvey and a friend of his by the name of Robert Hersch once worked for a prestigious Manhattan law firm, Berger and Steingut. Stanley Steingut, who has occupied an unrecorded burial plot for the past 10 years, for decades was the most powerful Democratic Party boss in New York state. As speaker of the New York State Assembly, Stanley decided what measures would come up for a vote and what would go to oblivion. He never did favors, he traded favors and some are still being called. Part of Steingut's public career, like Hillary Rodham Clinton's, centered on health care for the aged. Stanley's career ended abruptly when the miserable, filthy conditions and enforced poverty of elderly men and women kept in the chain of nursing homes that he controlled, for his own personal profit, were blasted over the front pages of every New York City newspaper. Steingut, enormously rich and unrepentant, soon disappeared. For a while, his law firm remained, but it did not prosper. Not even Democrats could stand the stench. Weinig and Hersch were worthy members of Steingut's apparatus. They made money, lots and lots of money. Someone who knew them both told the story. The Colombian drug cartel would send cocaine to Manhattan; and it would be sold for many, many dollars on the streets, in bars, in clubs, on street corners - everywhere. The dealers carried money from the sales to Weinig and his office mate, Hersch. Both these members of the New York State Bar became bankers and money launderers to the Colombian drug lords. Hersch and Weinig recruited a number of "runners" to carry the loot. Generally, these were rabbis who had some association with the gem trade. So, if their runner was apprehended by U.S. Customs for smuggling unreported currency, he would claim that the thousands of dollars in his pockets were going for the purchase of gemstones. It worked! The Colombian drug cartel got its money and exported more and more cocaine to Manhattan. Weinig and Hersch prospered - enormously! But they were greedy. One day they went to the U.S. Attorney's Office and stole some letterhead, various forms and some government rubber stamps. Then they prepared a sheaf of documents purporting to show how the FBI and the U.S. Attorney had discovered $3 million of drug money and confiscated it, so there was nothing left for the Colombians. Our two thieving, money-laundering lawyers were very sad, but delighted that they had $3 million for themselves. They were happy for a whole two days. It is said that two FBI agents turned up at the offices of Berger and Steingut at about 4 o'clock on a Thursday afternoon. They told one of the three beautiful receptionists that they were there to see Weinig and Hersch, adding, "No, we don't have an appointment." Reportedly, the FBI agents told Weinig and Hersch that they had stopped in on their way home, and just wanted to tell both money launderers that the bureau knew what was going on. The agents explained that they were not going to waste time asking if the heist of $3 million was fact. The agents just smiled saying, "It doesn't matter to us, guys. Kennedy jnr has either been destroyed or mysteriously gone missing as a family court battle looms over the accident. The US Navy has conceded it destroyed up to eight hours of video footage taken by divers recovering the bodies of Mr Kennedy, his wife, Carolyn Bessette, and her sister, Lauren Bessette, in the waters off the island of Marthas Vineyard in July 1999. At the same time, a large quantity of photographs has apparently been lost between the navy and the organisation empowered to investigate aircraft accidents, the National Transportation Safety Board (NTSB). The developments have given rise to claims that the Kennedy family used its political influence to have the images destroyed before they could go to a court and become publicly available. Family members did not want to suffer the same pain over John jnr's death by being subjected to constant replays of graphic footage of the recovery operation. Navy divers filled four 120-minute VHS cassettes with footage during the operation. The film included their discovery of Mr Kennedy's body, wedged from the waist down between the seat and instrument panel of the plane and his arms waving back and forth in the current. It also showed the bodies of Ms Carolyn Bessette and her sister lying crushed and partially obscured behind Mr Kennedy. A freedom of information application by a United States newspaper seeking access to the film forced the navy to concede at the weekend that it had burned the tapes "out of respect for the family". However, the NTSB said it had told the navy it did not need the footage because it had been able to recover almost all the wreckage and determine a cause of the accident from that. The Bessette family's lawyers believe the videos would have been crucial to their pending court actions seeking damages from Mr Kennedy's estate. The Bessette sisters' mother, Ms Ann Freeman, and father, Mr William Bessette, are preparing separate suits based on the official finding that the deaths were caused by pilot error on Mr Kennedy's part. The Kennedys recently offered Ms Freeman $US10 million ($18.6 million) from Mr John F. Kennedy jnr's $US100 million estate. The leading Senate Judiciary Committee Republican said that if Clinton is convicted in a Pardongate Senate trial, he could lose his presidential pension, his Secret Service protection and even his presidential library trust fund. He also hinted that the House of Representatives would soon consider such a move. Specter offered his stunning comments about prospects for a second Clinton impeachment on Fox News Sunday during an exhange with Tony Snow and Brit Hume. SNOW: Let's suppose there's a breach of trust. Let's suppose that people find out that the Rich pardon was conducted under auspices they don't like. What on earth can Congress do about it? SPECTER: Well, in our investigation we found a very interesting point that I hadn't known about in talking to the counsel that represented President Ford in the pardon of President Nixon. That is -- and this may surprise a lot of people, and I'm not suggesting that it should be done -- but President Clinton technically could still be impeached. And you say, how could that happen? He's out of office. Because a president may be impeached for the emoluments of office, such as the substantial sums being spent on the (Clinton) library, such as the bodyguards, such as his pension. President Clinton avoided a conviction on impeachment last time around because he had not lost the confidence of the American people and we didn't want to shake up the government. But he's not in office anymore. HUME: Are you planning to propose that he be impeached? SPECTER: No, I'm not suggesting it, but, Brit, wait and see. Somebody in the House of Representatives may do that tomorrow. That's their job to talk about HUME: Do you have someone in mind or are you just speculating? SPECTER: Well, no. And some people have suggested that you don't need a Constitutional amendment because you could always impeach a president. Clinton Presidential Foundation, which is expected to be the next focus of the House Pardongate probe, has been accused of witness tampering by a former Clinton bodyguard. The foundation, which plans to collect $200 million in tax-deductible donations from Clinton intimate Denise Rich and other fat-cat backers, is administered by Skip Rutherford - a close friend of the ex-president who runs an Arkansas-based public relations firm. In his 1999 book "Crossfire: Witness in the Clinton Investigation," former Arkansas state trooper and one-time Clinton bodyguard Lawrence Douglas Brown charges that Rutherford tried to silence him because of what he knew about Clinton's personal misconduct and involvement in Whitewater. At the suggestion of his brother Dwayne, Brown says he accepted Rutherford's invitation to meet in late 1993, just as Whitewater was heating up. "Skip was glad-handing me as I entered the office as if we were old friends," Brown writes. "'Want some coffee L.D.?' he asked." Before long, says Brown, Rutherford got down to business. "What do they know, L.D.?" he asked, referring to reporters who had begun talking to Brown's colleagues about Clinton's womanizing. "Rutherford wanted a detailed list of the women the media knew about. He wrote them all down - Susan McDougal, Gennifer Flowers, Beth Coulsen, just about all of them." "There were questions about Madison as well," Brown told the Clinton Library director, referring to the bank owned by the president's Whitewater business partners Jim and Susan McDougal. Brown said Rutherford's tone turned ominous after his revelation. "L.D., you know you're going to get subpoenaed over this, don't you?" "Now, L.D., you have to lay your head down on the pillow at night," Rutherford continued. "You have to live with yourself." Then came a warning, the former Clinton bodyguard says. "And L.D., you wouldn't want all your credit card receipts splashed all over the front page of the newspapers, now would you?" "Intimidation and a threat?" Brown wrote. "You bet. And that's exactly what he was trying to get across. I left and was determined then and there to tell my story." Despite Rutherford's alleged threat, Brown would later tell investigators that Clinton had guilty knowledge of an illegal $300,000 SBA loan arranged for Susan McDougal. The former Clinton bodyguard also charged that the president knew about an illegal drug running operation in Mena, Arkansas. When he was subpoenaed by the Senate Whitewater Committee a year later, Brown told lead Republican counsel Michael Chertoff about Rutherford's attempt to get him not to talk. "Chertoff remarked, 'That's obstruction of justice,'" Brown writes. On Friday, House Pardongate probers said they would have to subpoena the records of the William J. But his failure to silence the U.S.-supported radio station B-92 was emblematic of the war he lost to control the country. By Peter Maass March 2001 In Belgrade, you don't need to be paranoid, but it helps. It's late October, and I'm sipping an espresso at the Window Caf, along Knez Mihailova, the city's main shopping street, with Sasha Mirkovic, the general manager of B-92, an independent radio station that had the annoying habit of exposing the lies of Slobodan Milosevic's government. Outside the caf, the city is laced with remnants of the euphoria that greeted the downfall of Milosevic's regime just a few weeks earlier. The government was washed away by a wave of protesters, many of whom found their way to the city center on October 5 by following a bulldozer as it cleared a path through police roadblocks. A few yards from where Mirkovic and I sit, street vendors are selling postcards of the famous bulldozer now a political icon with treads, and they are selling copies of a CD of popular protest songs with a torn campaign poster of Milosevic on the cover, under the title "He's Finished." Mirkovic is telling me about B-92, checking his watch, running his hand through his dark hair (which is not far from a crew cut), and asking the waiter to turn down the music. He suddenly stops and points to his cell phone, which he has placed on the table between us. Whenever Mirkovic had face-to-face conversations with sources or friends during the Milosevic era, he tells me, he not only turned off his cell phone but removed its battery. "It's not paranoia," says the stocky 33-year-old in the weary, know-it-all tone of a mechanic describing what's wrong with a car. "If you don't take out the battery, even though the phone is turned off, your conversation can be listened to." Detaching the battery to illustrate, he adds: "People are still doing this, even though Milosevic is gone." I thought this was strange, another example of the suspicion that fills the Balkans with enough conspiracy theories to keep Oliver Stone busy for years, but other Serb journalists were telling me the same thing, assuring me, usually at the outset of our conversations, that they are not being paranoid. But none of them could explain how a switched-off cell phone could transmit their conversations to government snoops. When I return to New York, I call Jeff Schlanger, chief operating officer of the security-services group at Kroll Associates, the global investigative company. Schlanger begins the conversation by reminding me of a simple fact: "A cell phone is a listening device." He explains that technicians can reconfigure a phone to transmit a conversation even though its owner has turned it off. The trick, he explains, is to make the phone appear as though it's been turned off when it is actually on. When I ask Schlanger what could be done to thwart this mischief, he suggests detaching the cell phone's battery. For quite some time, being an independent journalist in Serbia required a range of skills that edged into the realms of spycraft and diplomacy. That's because the struggle for power in Serbia centered on information, not politics, and Mirkovic's station was at the center of this war. B-92 -- which stands for Belgrade 92, its original frequency, began operating in 1989 as a low-wattage radio station for young people, but it quickly evolved, under Mirkovic's boss, editor in chief Veran Matic, into the Serbian capital's most influential source of honest and live news about the wars that were tearing apart the former Yugoslavia and about the government lies that were fueling the nationalist madness. Milosevic made sure that the state-owned media, especially Radio Television Serbia (RTS), broadcast his nationalist propaganda at all times; the station was staffed by loyalists who heaped praise upon the politicians, including Milosevic, who was later indicted for war crimes by the United Nations tribunal in The Hague. While leaders of the police and army were making deals with the opposition in the weeks before Milosevic was ousted, the ever loyal men and women of RTS pumped out increasingly strident propaganda, and they didn't stop until a mob stormed their headquarters on October 5 and set it on fire. Milosevic understood that if you can brainwash your people, you don't need to arrest them. He understood a corollary lesson, too a regime that draws its power from propaganda rather than terror faces its greatest threat from independent journalists who have the desire and the means to expose its lies. Milosevic never banned any opposition party and rarely arrested politicians who opposed him; he did, however, force the closure of radio and television stations he didn't like, and he didn't hesitate to throw journalists into jail. -Caveat Lector- Denise Rich's donations increased as pardon neared Bulk of money given in last two years By Robert Windrem NBC NEWS PRODUCER NEW YORK, Feb. 13 Newly available financial data shows that Denise Richs giving to the Democratic Party and the Clintons intensified dramatically over the past two years, ending in a final rush as the Clintons neared their White House exit. AN NBC NEWS analysis of documents on file with various federal agencies, including the Federal Election Commission, the Internal Revenue Service and government ethics office shows that while Rich gave at least $1.5 million to Clinton-related political, legal and charitable organizations during the last decade, the majority of the giving more than $900,000 came over the final two years of the Clinton era just before her ex-husband, Marc Rich, was pardoned. More than $200,000 came in a spurt during the final six months, $140,000 of that in September, October and November, as her ex-husbands team of lawyers, led by former White House counsel Jack Quinn, began pressing Clinton for a pardon. In fact, four of Denise Richs biggest contributions to the Clintons and the Democratic Party and its candidates two gifts of $25,000, one of $40,000 and one of $41,500 came during those last few weeks. Among those donations were several gifts to the Clintons of a personal nature. In addition to the $7,397 in furniture provided to the Clintons for their Chappaqua, N.Y., home, Rich paid $40,000 in travel expenses for the entertainers who performed at Hillary Rodham Clintons birthday party on Oct. 25. She also gave President Clinton a gold saxophone when he appeared at her cancer foundation benefit on Nov. 30, although the saxophone does not appear to have been reported on the Clinton gift list. Her last political contribution some are still being tallied appears to be a $25,000 donation to the Gore-Lieberman Recount Committee given in late November. Rich also gave heavily in the first six months of 2000, with her last contribution to the William J. Clinton Presidential Foundation coming at around the same time as her two largest campaign contributions to the Democratic National Committee. Rich gave $450,000 to the library foundation in three tranches, the final one in May of last year. According to FEC records, she also gave the DNC $100,000 around the same time: $50,000 recorded on March 31 and the other $50,000 recorded on May 18. While GOP Sen. Arlen Specter used a Sunday chat show to toy with the idea of impeaching Bill Clinton a second time, the federal prosecutor is "considering" a criminal probe of the pardon of fugitive financier Marc Rich, Newsweek magazine is reporting today. Newsweek said White is considering issuing a subpoena for Denise Rich's bank records to determine whether money for donations to Democrats originated in Switzerland with Marc Rich. Marvin Smilon, spokesman for White, said yesterday, "We're not commenting." Specter, a Senate Judiciary Committee member from Pennsylvania, said a Clinton impeachment saga Part II would allow critics to strip the former president of his pension, his library and his bodyguards. "President Clinton technically could still be impeached," Specter told Fox News Sunday. "I'm not suggesting it," added Specter - who is famous for tossing around radical ideas for effect. With Clinton out of office since Jan. 20, complaints about his 11th hour pardons continued yesterday, and a judiciary-committee review kicks off Wednesday. And the leader of a separate House probe, Rep. Dan Burton (R-Ind.), said he's sending a letter to the U.S. Justice Department today seeking criminal immunity for Denise Rich. Last week, a lawyer for Denise Rich invoked the Fifth Amendment in declining to allow the songwriter to testify in the early stages of the investigation. "We'll try to get her immunity so she'll testify," Burton told "Meet the Press," explaining his plan to smoke out whether gifts and donations to Clinton, his wife and his library were aimed at winning a pardon. Clinton and Rich say no. Burton says he'll subpoena Clinton library-foundation records, since the ex-president's lawyer, David Kendall, last week said "no way" to turning over the gift list. He said he'll also subpoena Beth Dozoretz, who handled money for the Democratic National Committee until last year. On the same show yesterday, Joseph diGenova -a lawyer for Marc Rich's lawyer Jack Quinn - said Clinton knew what he was doing. "The president of the United States was fully aware of this pardon and its consequences," said diGenova, who also says Israeli support for Rich helped sway Clinton. "Mr. Rich has a huge foundation in Israel, giving hundreds of millions of dollars to charitable causes there. This was a very important case to the Israeli government, and they weighed in very heavily directly with the president," diGenova said. Meanwhile, Democratic Sen. Dianne Feinstein of California gave her blessing to forcing Clinton to appear before Congress to explain his decision. Clinton "really did make a major mistake" Feinstein said on CNN, while Sen. Staff and reporters are improperly fired. Armed guards are brought in. Personnel who refuse to go along with censorship, firings and bannings are themselves threatened. Reporters are harassed for challenging powerful public figures. Large protests are held in support of persecuted station personnel. Is this taking place in the tentative new democracy of a post-Communist country? Or in the media capital of the Free World? Both. The turmoil at New York's WBAI-FM is eerily mirrored by that at the public TV station in the Czech Republic. Ironically, the situation in Prague is now approaching a resounding victory for free speech-while that at WBAI is only deteriorating. In April 2000, Jiri Hodac, a crony of former prime minister Vaclav Klaus, was appointed news director at Czech Television. Viewers and critics warned that Klaus' right-wing Civic Democratic Party would be granted undue influence. Sure enough, in June, talk-show host Roman Prorok was fired after insisting that if Klaus refused to show up for a live round-table featuring the Czech political party bosses, there would be an empty chair with his name on it in the studio. Hodac stepped down following the resultant outcry. But at Christmastime, Hodac was rewarded for his loyalty by being appointed station director. He hired a news director who was a Klaus political advisor, and fired 20 people who were perceived as disloyal. The news staff rebelled, locking themselves in the news room, broadcasting their own, unapproved and uncensored programs. Hodac pulled the plug, and screens went blank across the Czech Republic. On December 31, security guards were brought in to secure access to the news room, and criminal charges were filed against strikers. But viewers mobilized, holding large protests in support of the journalists. On January 11, Hodac acceded to the popular mandate for his resignation. The journalists continued their strike, demanding that all Hodac appointees must go. Finally, on January 23, President Vaclav Havel signed a law allowing Parliament to appoint a new interim director and calling for the Czech Television Council, which picks the station director, to be nominated by citizen groups, not politicians. The government has also announced an audit of the station. The journalists have broached ending their strike. Now, dateline New York City: listeners, producers and staff are similarly protesting a "Christmas coup" at non-commercial WBAI Radio, in which the station's general manager and program director were removed and others banned for perceived disloyalty to the new regime. The banned staff charge that the National Board of the Pacifica Foundation, which holds BAI's license, is attempting to purge dissenting voices from the airwaves-or even sell the station to commercial interests. On November 29, 2000, 10-year Station General Manager Valerie Van Isler received a letter giving her an ultimatum: to accept a job with the Pacifica Board in Washington DC, or resign. She refused to do either. The timing was predictable. Two years earlier, Van Isler had-at Pacifica's request-testified against the rights of unpaid station staff to unionize before the National Labor Relations Board. But now, in a turn-around, she had just signed a nine-month extension of the contract recognizing the rights of unpaid staff to representation by the United Electrical Workers Local 404. She also protested Pacifca's efforts to rein in Amy Goodman's hard-hitting network-wide "Democracy Now!" show, which is produced at BAI. In October, Pacifica had imposed harsh restrictions on Goodman, ordering her to submit show ideas in advance for review-prompting Goodman to file a grievance with the UE. Then, on Election Day morning, Goodman and President Bill Clinton were surprised to find themselves on the air with each other when the president called New York stations to get out the vote. Goodman's relentless grilling won her a phone call from the White House the next morning, admonishing her that she would no longer have the president's

SERRANO and JUDY PASTERNAK Los Angeles Times Staff Writers WASHINGTON--President Clinton released a convicted Los Angeles cocaine dealer from federal prison after influential congressmen and city leaders personally lobbied the White House and the Justice Department to secure his commutation, it was learned Sunday. The concerted effort to free Carlos Vignali included a series of personal contacts between California Rep. Xavier Becerra (D-Los Angeles) and the White House, and correspondence from former California Assembly Speaker Antonio Villaraigosa. Cardinal Roger M. Mahony of Los Angeles and Los Angeles County Sheriff Lee Baca also wrote letters. The letters, some written as early as 1996 and others sent last year, suggested that Vignali was wrongly convicted and that his case deserved a careful review by the White House. Their view conflicted sharply with the position of federal law enforcement authorities, who insisted that Vignali deserved his 15-year prison sentence for his central role in a narcotics operation that stretched from Los Angeles to Minneapolis, delivering more than 800 pounds of cocaine. Clinton commuted Vignali's sentence, and he was freed from prison on Jan. 20 after serving six years. On his last day in office, Clinton issued 140 pardons and 36 commutations. Clinton spokesman Jake Siewert, asked about cases such as Vignali's, said he did not remember any specific cases but added: "We tried to make a judgment on the merits." The Times reported Sunday that law enforcement authorities were indignant that the convicted cocaine dealer had been freed and suggested that he never would have been released without political intervention. Vignali's request for clemency went first to the Justice Department and then to the White House with a recommendation that has not been determined. Former President Clinton has not fully explained why he pardoned 140 individuals and commuted the sentences of 36 others on his last day in office. Vignali's father, Horacio Vignali, is an affluent Los Angeles businessman with deep ties in the Latino community who became a major political contributor to top state and federal officeholders after his son was convicted and imprisoned in 1994. Both Becerra and Villaraigosa are candidates for mayor of Los Angeles. On Jan. 19, Clinton's last night in office, Becerra said he phoned the White House and the Justice Department to find out if Vignali had a chance of being pardoned. The call was only the most recent of a series of contacts with the White House that Becerra pursued to bring Vignali's case before Clinton, Becerra acknowledged Sunday night. Becerra conceded that the Vignalis were not his constituents but added that the father had been a major contributor and a friend of five years. However, the congressman denied that he was helping the son in return for the father's political contributions. Vignali had donated at least $11,000 to Becerra's political action committee over the last three years. The congressman said he never investigated the accuracy of the father's description of his son's case. "They [the Vignali family] believed to the depths of their heart he was innocent," Becerra said. Becerra said Horacio Vignali had repeatedly asked him since 1996 to help him win his son's release. But the congressman insisted his intervention was aimed only at finding out about the son's case--not securing his freedom. "I told him [Horacio Vignali] I thought it was a longshot to do this," Becerra said. "I said I'd try to find out what it looked like." In a Nov. 21, 2000, letter to Clinton, Becerra said: "Mr. Vignali's parents are dear friends of mine and solid, upstanding members of the Los Angeles community. They have made it their personal crusade to clear their son's record and bring him home. "They believe their son to be innocent and, in any case, feel strongly that he has paid his debt to society," Becerra wrote. Becerra then noted that a number of influential Los Angeles area leaders "have weighed in on behalf of Mr. Vignali." "I respectfully urge you to take a thoughtful look at this case. The Vignali family's efforts deserve your careful consideration," he concluded. Starting in mid-December, Becerra said, he had a series of telephone conversations with Deputy White House Chief of Staff Maria Echaveste about Vignali's case. "I at one point raised it with her," Becerra said. "When we got close to the closing of the [congressional] session, I asked, 'Are you familiar with the request for commutation on this particular case?' She said she didn't know anything about it. I said, 'Would you mind checking?' " Becerra said Echaveste "got back to me within a week. She said there's no word on any particular progress on the case." Smith Monday, Feb. 12, 2001 U.S. defense experts are concerned that America is falling behind Russia and China in a new missile arms race. While U.S. weapons development stalled almost completely during the 1990s - both Russia and China have continued to field a new generation of missiles for which the west has no equal nor defense. The Western press in recent years has already reported on the development of Russia's new intercontinental ballistic missile, the TOPOL-M. Already two regiments of the nuclear weapon bearing missiles have been deployed. The TOPOL-M is more sophisticated than any similar missile in the U.S. arsenal, and enables the missile to enter earth's orbit before striking its target. Russia is now threatening to spark a global arms race with the development and transfer of a new series of missiles. Top among the new threats is the recent movement of the Russian made S-300PMU missiles by the Chinese Army, NATO code named SA-10C "Grumble". U.S. intelligence sources confirmed for NewsMax.com that the Chinese Army has deployed dozens of the deadly new air defense missiles directly opposite Taiwan within the past few days. "The S-300PMU is simply a highly effective fast SAM (surface-to-air missile) that is very hard to jam and stop," stated Richard Fisher, a senior fellow at the Jamestown Foundation. "The PLA is now placing their S-300s in bases along the Taiwan Strait. Taiwan has little defense against this effective SAM and even lacks stand-off weapons like the HARM anti-radar missile to counter the S-300. In 2001 Taiwan has little choice but to sacrifice many aircraft to take out these SAM sites in order to avoid having to cede half the Strait in the event of an air battle." Transfer to Iran To make matters worse, Pentagon officials quietly confirmed that Russia has also sold S-300 missiles to Iran. According to defense intelligence officials, joint Russian/Iranian crews currently man two S-300 units just outside of Tehran and Iranian Army soldiers are now undergoing operational training on the advanced missile system in Moscow. The Russian missile sale to Iran may alter the defense equation as viewed by the Pentagon and the oil rich Persian Gulf. There is no question the S-300 missile is a threat to the air forces of U.S. allies such as Saudi Arabia, Kuwait, Japan, and Taiwan. None are equipped with aircraft that can counter the new Russian missile. The recent Bush White House declaration that it would not seek to increase the Clinton defense budget may be undermined as the threat Iran's new missile stockpile becomes clearer. The Almaz S-300PMU is considered the best Russian air defense missile available, equal to the U.S. Army Patriot, and can destroy any current western fighter aircraft. Pentagon officials quietly assert that that America currently does not have the air power to counter the deadly S-300 missile. Jamestown defense analyst Richard Fisher noted that in 1999 U.S. defense officials feared that Serbia had obtained S-300 missiles from Russia and might use them to ambush NATO fighter jets in "SAM" traps. "If the Serbs had the S-300 it would have been a very different air war," stated Fisher flatly. "Over the Persian Gulf, the S-300 will significantly raise the cost of combat to opposing Arab air forces, and make future U.S. air operations far more difficult." America Response Needed "The proliferation of these advanced air-defense weapons is an argument for the F-22, a stealthy, fast air superiority fighter," asserted Jack Spencer, a defense specialist and fellow at the Heritage Foundation. "This is why we need more B-2s, and long-range air launched cruise missiles that will allow our aging B-52 and B-1 fleets to engage heavily defended targets without getting blown away," warned Spencer. The new S-300 air defense missile represents just one example of a new generation of weapons being sold on the open market by Russia. Another popular new weapon is the Vympel R-77 missile, NATO code named AA-12 Adder. The R-77 is a long-range air-to-air missile carried by Russian built fighters. The R-77 is designed to destroy other aircraft beyond visual range (BVR) and reported to be equal to or better than the U.S. made AIM-120 AMRAAM missile. R-77 missiles have also recently appeared in the arsenal of the People's Liberation Army Air Force (PLAAF). "(Russia) selling the R-77 to China is a big concern," noted Jamestown defense analyst Richard Fisher. "The U.S. AMRAAM was supposed to provide a margin of air superiority on which to base deterrence. This is now gone with the sale of the R-77; we now have to invest in a much better missile to sustain deterrence, and sell it to select friends. Bush's grandfather derived a portion of his personal fortune through his affiliation with a Nazi-controlled bank. John Loftus, a former prosecutor in the Justice Department's Nazi War Crimes Unit, said his research found that Bush's grandfather, Prescott Bush, was a principal in the Union Banking Corp. in Manhattan in the late 1930s and the 1940s. Leading Nazi industrialists secretly owned the bank at that time, Loftus said, and were moving money into it through a second bank in Holland even after the United States declared war on Germany. The bank was liquidated in 1951, Loftus said, and Bush's grandfather and great-grandfather received $1.5 million from the bank as part of that dissolution . . . Loftus pointed out that the Bush family would not be the only American political dynasty to have ties to the "wrong side of World War II." The Rockefellers had financial connections to Nazi Germany, he said. Loftus also reminded his audience that John F. One was John Tower, the elder President Bush's ill-fated pick to head the Defense Department. The other was Richard L. Armitage. Armitage, who served as an assistant secretary of defense under President Reagan, was to be the new administration's secretary of the Army. Before his nomination could come to a vote, however, he withdrew his name, citing the traditional need to spend more time with his family. Perhaps more relevant was the draft of an article of mine that had just been shown by a right-wing Republican senator to a top Pentagon official. Co-authored by Richard Ryan, this article never appeared in print, but the threat that it would soon be published apparently convinced Armitage and the administration that the confirmation process would not be worth the trouble. The article was about Armitage's relationship with a woman named Nguyet Thi Deputy Secretary of State Richard Armitage DEPT. OF DEFENSE O'Rourke, a Vietnamese immigrant convicted of running a gambling operation in Northern Virginia. Armitage had already attracted the attention of the President's Commission on Organized Crime by writing a glowing character reference for her in conjunction with her trial, on Pentagon stationery no less. What our article added was the juicy personal angle that has become a requirement for killing a nomination. It seemed that when the Arlington Police raided O'Rourke's house, they discovered some unusual photographs: They showed a nude O'Rourke holding another photo, which depicted her and Armitage wearing swimsuits. The most obvious motive for taking such photos was to give O'Rourke some kind of leverage over Armitage; even though they didn't prove anything in themselves, they certainly implied an intimate relationship between a high-ranking government official and an organized crime figure. At the very least, they raised the question of why the official had put himself in a position where a mobster might think she could blackmail him. Why was a Republican senator showing this article to the Pentagon? There were people on the right, like Ross Perot, who were deeply suspicious of Armitage and his involvement in MIA negotiations. Many conservatives believed that Vietnam still held U.S. prisoners in secret camps, and Armitage's failure to press the Vietnamese harder was seen as evidence of collusion. Ryan and I, who personally thought it likely that the MIAs were all dead, nonetheless cultivated these conservative sources because their distaste for Armitage was much more intense than any liberal politician's. Perhaps unwisely, we shared an advance copy of our article with them, which became exhibit A in the senator's case against Armitage. We were interested in Armitage because of his prominent role in the Christic Institute lawsuit. The lawsuit--which was eventually thrown out of court, with sanctions that crushed the nonprofit law firm--alleged that members of the secret Contra resupply effort like Richard Secord were part of a long-standing "Secret Team" of military and intelligence operatives that had been involved in various illegal activities going back at least to 1959. According to the Christic Institute's affidavit, Armitage was a key player in this team, helping to funnel drug profits from Laos and Thailand into assassination programs in Vietnam and Iran. The Christic Institute's charges have never been proven, or fully investigated, for that matter. But Armitage's documented history and associations do tantalizingly track the Christic allegations (see "Pentagon Aide Linked to Drug Ring," July 8, 1987). Armitage did come under investigation for his role in the Reagan administration's Iran-Contra scandal. Though he testified that he didn't know about the administration's secret sale of arms to Iran until November 1986, when they became public knowledge, independent counsel Lawrence Walsh's report laid out extensive evidence that he knew about them a year earlier. In fact, Armitage apparently opposed the arms sales as early as December 1985, on the grounds that Iranians were "sleazebags." Secord later testified that he met with Armitage then in an effort to change his mind. Armitage claimed not to remember meeting with Secord, though Armitage's own meeting logs show that he did. Armitage kept a December 6, 1985 document describing the legal ramifications of the Iran arms sales, entitled "Possibility for Leaks," locked in his Pentagon safe until June 1987, when it was belatedly turned over to Walsh and the congressional Iran-Contra committee. Armitage also attended a Pentagon meeting in August 1986 in which Oliver North outlined the covert activities

Kennedy jnr has either been destroyed or mysteriously gone missing as a family court battle looms over the accident. The US Navy has conceded it destroyed up to eight hours of video footage taken by divers recovering the bodies of Mr Kennedy, his wife, Carolyn Bessette, and her sister, Lauren Bessette, in the waters off the island of Marthas Vineyard in July 1999. At the same time, a large quantity of photographs has apparently been lost between the navy and the organisation empowered to investigate aircraft accidents, the National Transportation Safety Board (NTSB). The developments have given rise to claims that the Kennedy family used its political influence to have the images destroyed before they could go to a court and become publicly available. The family already endures frequent rebroadcasting of amateur footage of the assassination of Mr Kennedy's father, president John F. Kennedy, in a 1963 shooting during a motorcade in Dallas. Family members did not want to suffer the same pain over John jnr's death by being subjected to constant replays of graphic footage of the recovery operation. Navy divers filled four 120-minute VHS cassettes with footage during the operation. The film included their discovery of Mr Kennedy's body, wedged from the waist down between the seat and instrument panel of the plane and his arms waving back and forth in the current. It also showed the bodies of Ms Carolyn Bessette and her sister lying crushed and partially obscured behind Mr Kennedy. A freedom of information application by a United States newspaper seeking access to the film forced the navy to concede at the weekend that it had burned the tapes "out of respect for the family". However, the NTSB said it had told the navy it did not need the footage because it had been able to recover almost all the wreckage and determine a cause of the accident from that. The Bessette family's lawyers believe the videos would have been crucial to their pending court actions seeking damages from Mr Kennedy's estate. The Bessette sisters' mother, Ms Ann Freeman, and father, Mr William Bessette, are preparing separate suits based on the official finding that the deaths were caused by pilot error on Mr Kennedy's part. An administration official, requesting anonymity, said President Bush was expected to announced James' nomination later this week along with two other top Justice Department nominees, whose names were disclosed by administration officials last week. They are Larry D. Thompson, an Atlanta lawyer and former U.S. attorney, as deputy attorney general, and Theodore Olson, a Washington lawyer who argued the Supreme Court case on Florida voting that sealed Bush's election, as solicitor general. Thompson also is black. Olson headed the Justice Department's Office of Legal Counsel during the Reagan administration. At a Monday news conference, Attorney General John Ashcroft left little doubt that two of the nominations are imminent. ''Mr. Thompson and Mr. Olson are very outstanding individuals, whose records of public service, including service with this Department of Justice, are exemplary records,'' Ashcroft said, noting that it was up to President Bush to announce such nominations. Administration officials say they expect the selection of two blacks among the first three Justice Department nominees to serve under Ashcroft will go a long way toward rebutting critics who charged during his confirmation proceedings that he was racially insensitive. Ashcroft has interviewed all prospective candidates and participated in the selection process. Ashcroft refused to back off his opposition that blocked black Missouri Supreme Court judge Ronnie White from a federal judgeship and would not rule out another visit to Bob Jones University, a school which had a ban on interracial dating at the time Ashcroft accepted an honorary degree there. In his confirmation hearing, Ashcroft denounced racial discrimination and pointed out that he set a record as Missouri governor for appointing black judges. James, now a lawyer here for the Cleveland-based firm of Jones, Day, Reavis Pogue, has served in both of the government's antitrust agencies. From 1979-1985, he was first an attorney and then assistant to the director in the Federal Trade Commission's Bureau of Competition, which reviews mergers. During 1991-1992, he was deputy assistant attorney general for policy in the Justice Department's antitrust division, and then briefly acting head of the division. ''He's extraordinarily bright and well-steeped in antitrust law and policy,'' said James Rill, who headed the antitrust division when James served there. ''He's got broad experience and a balanced outlook.'' As chief deputy to Rill, James was extensively involved in the 1992 revisions to the government's guidelines for mergers between competitors. These guidelines were the first ones issued jointly by the Justice Department and the Federal Trade Commission. They are still in force, with only a section on efficiency added in 1997. The 1992 guidelines expanded on those issued in 1982 by adding new analyses of the competitive effects of mergers and of the ease of entry for new competitors who might want to enter the affected market. At the antitrust division, James also helped craft the $290 million in fines, forfeitures and compensation that Salomon Inc. paid in 1992 to avoid criminal prosecution for its admitted illegal bidding in the Treasury bond market. He headed the review that approved the Armco-Cyclops steel merger. And he conducted talks with Japanese officials on antitrust issues. His first big decision would be reviewing the Clinton administration's pending lawsuit to break up Microsoft Corp. The company's appeal is to be heard by the U.S. Circuit Court of Appeals for the District of Columbia in late February. Stephen Hsu and his partners at SafeWeb Inc. launch a Web site offering the utmost in Internet privacy -- and then hook up with the notoriously intrusive Central Intelligence Agency. The new alliance between the Oakland, Calif., entrepreneurs and the spooks from Langley, Va., shows how serious the CIA is about improving its spycraft. The agency two years ago set up its own venture-capital firm, known as In-Q-Tel, to search out just the sort of innovations that SafeWeb offers. The CIA, in this case, wants to use a SafeWeb program to mask its own movements on the Internet, so it can gather information incognito. SafeWeb suggests that the CIA also might use its technology to allow its far-flung agents and informants to communicate home, without the countries they are spying on ever knowing. What's puzzling is why a tiny, year-old start-up would want to link up with an agency that is the nemesis of privacy buffs everywhere. 'I'm sure we'll take a hit from the 5% of our most paranoid customers,' says Mr. Hsu, SafeWeb's 34-year-old co-founder and a theoretical physicist by training. But the CIA connection, he says, is deliberately distant. SafeWeb will provide the agency with customized software, but the CIA will have no access to the company's Web computers or to the workings of its core software, he insists. And who better to test the power of its privacy software than the world's top spies? 'If our technology can satisfy them,' Mr. Hsu says, 'it can satisfy just about anyone.' The technology is a clever piece of software called Triangle Boy that SafeWeb plans to post free this month on the Web. The CIA, through In-Q-Tel, is investing in a revved-up version of the software, which can bounce digital traffic around the Web anonymously, as well as rights to an equity stake in SafeWeb should the company go public. Neither side will disclose financial details. The CIA has been slow to mine the riches of the Internet for fear of exposing its own vast computer network to viruses or hacker attacks. It also worries that others will monitor its activities if it roams the Web without proper disguise. What SafeWeb offers is a chance to move about the Internet without leaving any trace. Users simply go to the company's Web site (www.safeweb.com) and type in the address of the actual site they are seeking. SafeWeb's site acts as an intermediary; anyone monitoring the activity would see only the traffic between the user's computer and SafeWeb -- and not the user's ultimate destination. The site recorded more than one million unique visits last month. But what really caught the CIA's fancy was Triangle Boy, a software package that can turn any personal computer into a surrogate Web server. The system allows users to navigate to any number of innocuous PC addresses, and then go to the actual Web site they are seeking -- without leaving a trace. Triangle Boy works by forwarding the request for the desired Web site on to SafeWeb's site, which then makes the connection. SafeWeb developed Triangle Boy to deter companies or countries from blocking access to its site, as Saudi Arabia did last November. CIA specialists say their core interest in Triangle Boy is anonymous Internet browsing. 'We want to operate anywhere on the Internet in a way that no one knows the CIA is looking at them,' says a senior CIA official with connections to the In-Q-Tel team. But the possible uses go way beyond that. SafeWeb says the agency also could use the technology as a secure way for its 'assets,' or contacts, to communicate with CIA headquarters. The CIA also suggests that it may one day build a global network made up of Triangle Boys and servers equipped with SafeWeb-style software to communicate with employees and informants. CIA Director George Tenet told the Senate last week that one of his chief ambitions is 'to take modern Web-based technology and apply it to our business relentlessly.' The SafeWeb technology could prove just as handy in getting information covertly into other countries. It was this application that originally inspired Mr. Hsu to reach out to the CIA last summer. 'I imagined them wanting to use Triangle Boy to get Voice of America or something like that into countries where it was blocked,' he said. Others suggest more devious possibilities. An application like Triangle Boy, if scattered among hundreds of PCs, could be a way to cloak a multipronged ' cyber attack' on someone else's computer system. The CIA, along with the Pentagon, has worked for years to perfect ways to electronically meddle with other countries' banking systems or electricity grids, and Triangle Boy could allow them to do it without the target ever knowing who was behind the attack.

This little nugget, which surfaced in a footnote-sized bit in the February 16 issue of U.S. News World Report, is alarmingly significant in its implications. The Council on Foreign Relations (CFR) is the pre-eminent "policy committee" which includes high ranking members from governments, the wealthy elite, corporate chiefs, high finance, big oil, and spooks from the intelligence and military communities. Its members slither between cabinet-level posts (in both Republican and Democratic administrations) and CEO suites. The policies formulated by this group become U.S. government policy. The CFR holds the power to declare wars and assassinate people, manipulate financial markets, and essentially "runs the world." The CFR is affiliated with the Trilateral Commission. David Rockefeller is a top-ranking member of both groups, as are both George Bushes and Alan Greenspan. One does not simply join this cabal. One is invited. We must ask ourselves how and why Katherine Harris-the hateful and venomous apparatchik whose sole career accomplishments allegedly were to have affairs with both Bush brothers and to commit election fraud and treason-was invited to join one of the most dominant (and some would say the most influential) cabals on the face of the earth. According to investigator Sherman Skolnick (www.skolnicksreport.com), Harris' crimes predate the stolen presidential election. As Florida Secretary of State, Katherine Harris was the Bush family's bag lady. She supervised a massive money laundering operation, funneling upwards of $75 million in clandestine funds for the Bush family. She was also responsible for the concealment of records for various shell corporations operating illegally within the United States. It is also rumored that she assisted with Bush financial games long before becoming state secretary in Jeb's administration. Harris' election to the CFR offers clear evidence to the values and ethics espoused by this panel of "concerned citizens." What does it say about corporate America that CEOs applaud Harris' unsavory activities? For her lifetime of service to the world's top crime family, and for assisting in a corporate/right wing coup d'etat of historic proportions, the CFR membership is Harris' big, fat thank you gift, and her invitation to participate in future plundering-alongside the really big boys. The board will hold a special meeting to call in the circuit attorney for a criminal investigation. The U.S. Attorney's office, the St. Louis Circuit Attorney and the St. Louis Police Department have already been alerted to the problem. Among the voters registered fraudulently: Albert "Red" Villa, a veteran city alderman who died in 1990. The 3,000 registration cards appear to be filled out by two people who initialed the cards with either "M.T." or "M.R." In addition, those two people filled them out and then allegedly forged the voters' signatures, said the election board's directors - Republican Kevin Coan and Democrat Keena Carter. They have already determined that 500 of the cards were forged. "Whoever did this knows we now have a limited time to process these and they're hoping they get through even though they are bogus," Coan said. "We have a responsibility to protect the integrity of the voting process. We're required by law to act on these and we have to verify that these people are who these cards say they are." Election board workers spent Monday morning calling the names on the cards trying to determine if they had registered. Nearly every person contacted said they had not. It also appears that whoever filled out the voter registration cards used a street directory or phone book to find the residents to register, said the election officials. They came to that conclusion after reviewing the cards and determining that the card numbers are in consecutive order and the voters registered were listed for the same street with each address following in consecutive order. The majority of the addresses were located on James "Cool Papa" Bell and Dodier streets in the northern portion of the city. The directors' suspicions were bolstered by the ages placed on the voter's registration cards that were incorrect. "They're just using a criss cross or phone book and they don't know the date of birth, so they're just making it up," Carter said. "We've got cards here where the voters are already registered and the new cards show the persons name wrong with a forged signature." Most problematic, the directors said, is that when someone registers a voter bogusly and the actual voter is already registered to vote, it could harm the actual voter's chance to vote. Immediately after the ambush, angry Serbs gathered at the local headquarters of KFOR and the United Nations police in Strpce, southern Kosovo, and threw petrol bombs and rocks, badly damaging seven KFOR and U.N. vehicles, an eyewitness said. Peacekeepers fired shots in the air but the violence continued, the witness said, adding that he had seen an UNMIK (United Nations Mission in Kosovo) policeman and several civilians injured. Major Jim Marshal, a U.S. spokesman for the NATO-led KFOR peacekeeping force, told Reuters on Tuesday evening the situation had calmed but protests were continuing. ``Right now in Strpce demonstrations are going on, there are between 500 and 700 demonstrators. They have burned several vehicles, he said by telephone. Kfor Sends Reinforcements ``At the moment there are some 200 KFOR peacekeepers at the scene and they are attempting to stabilize the crowd without further violence. Currently there are KFOR units from Ukraine, Poland, Italy, Greece, United Arab Emirates and us, he said. UNMIK spokeswoman Susan Manuel said in Pristina all U.N. personnel had been evacuated safely from their buildings in Strpce, where the demonstrators had rung church bells to call others to join them. She had no word on the reported injury to its policeman.
