And Karen Hughes, the president's press secretary, might be forgiven if she had attached a similar note to President Bush's morning press digest Monday, directing him to the Miami Herald's story on the results of its own recount of last November's "undervotes" in Florida. This showed that Al Gore would have gained only 49 net votes in Miami-Dade County even if a very liberal interpretation of voting intentions had been in force--far short of the 600 votes that the Gore camp had estimated in the post-election skirmishing. When added to similarly modest gains for Gore in the three other counties where his team had requested recounts, the former vice president still would have lagged 140 votes behind Bush in Florida's total vote. All in all, the president would be fully justified in demanding that Terry MacAuliffe, the new Democratic National Committee chairman; the Rev. Jesse Jackson; U.S. Civil Rights Commission; its chairman, Mary Berry, and assorted liberal pundits and political consultants should add their concession speeches to Gore's and grudgingly concede that Bush is the legitimate president. They are unlikely to do so, however. The U.S. Civil Rights Commission still is trying to uncover evidence that minority voters were either discouraged from voting or saw their votes for Gore discarded. Democrats seemingly believe that they have a potent electoral issue in such voter "intimidation." So it is hard to understand the GOP silence over another aspect of the recent election that disadvantages the GOP--namely, deliberate voter fraud. Yet as the Miami Herald carried out its investigations into ballot inefficiency, it also uncovered more and more evidence that votes were cast illegally in numbers that overwhelm "undervotes." On Jan. 22, the Herald reported that at the very least 2,000 illegal votes had been cast in about a third of Florida's counties--very roughly 6,000 for the state as a whole. On Jan. 9, it revealed that 452 felons had voted unlawfully in Broward County alone. Election officials cheerfully admitted ignoring the electoral rules, allowing people to vote without evidence of identity, registration, domicile, citizenship or even breath in their bodies. Most of these votes seem to have gone to Gore. If this had been confined to Florida, it would have been scandal enough. But as Karen Saranita of the California-based Institute for Fair Elections points out, electoral fraud is found across the United States, usually in the large urban areas but not confined to them. Baltimore, Philadelphia, New Orleans, Los Angeles and Miami all have had voter fraud scandals in recent years. The drift of current policy is toward making such theft easier. As National Review's Rich Lowry pointed out in a 1996 article, the Motor Voter Law imposes fraud-friendly rules on the states-- it permits mail-in registration, forbids government workers to challenge new registrants, makes it exceedingly difficult to purge "deadwood" voters (i.e. those who have died or moved away), and so on. This permits such absurdities as the fact that the 1994 assassin of the Mexican presidential candidate Luis Donaldo Colosio was illegally registered to vote in San Pedro, Calif.-- twice! If the GOP has any survival instinct, however, it will actively campaign to halt voter fraud--and the rules that make it easy. Immigration and Naturalization Service memos obtained by the Boston Globe show an internal audit of the Boston office, conducted in 1998, found an average of five out of every 30 immigrants approved for citizenship had criminal records, and 16 percent had been convicted of a crime not known to the FBI. Data about other states was not included in the Globe's report. In all, the Boston office naturalized 21,052 citizens in 2000, compared to 5,923 in 1990, the Globe reported Wednesday. The Globe said the pressure was partly a byproduct of a now-disbanded 1996 Clinton administration initiative aimed at reducing the citizenship application backlog. Because of pressure to reduce the backlog, agents check criminal backgrounds with the FBI but normally don't review state criminal records, the Globe reported. However, the audit found that felons from Massachusetts don't always show up on FBI records. Under INS policy, all people applying for citizenship submit to a 10-finger print, which is sent to the FBI to check for matches, but many police departments in Massachusetts don't send prints to the FBI, so those felons don't show up on FBI checks, according to INS Special Agent Thomas Carroll, a quality control officer, who wrote the memo obtained by the Globe. He declined to comment on it. Steven Farquharson, district director of the Boston INS office, said that after receiving Carroll's audit he sent a memo to INS headquarters asking for guidance, but he told the Globe the response several months later said he was not allowed to use other databases. Russell Bergeron, spokesman for INS headquarters, said the fault lies with the FBI for not requiring all police departments to file fingerprints and with the departments themselves for not sending them. A Department of Justice investigation of the Citizenship USA program concluded last summer that the flaws in the program were the result of an agency that is "a mess" with systemic problems, including poor criminal history background checks, that date back decades. Wishes By MARC LACEY and DON VAN NATTA Jr. WASHINGTON, Feb. 28 - Former President Bill Clinton's brother-in-law Tony Rodham helped obtain a presidential pardon for a Tennessee couple last March over the objections of the Justice Department, Mr. Rodham and lawyers involved in the pardon said today. Mr. Clinton pardoned Edgar Allen Gregory Jr. and his wife, Vonna Jo. The Gregorys, who live outside Nashville and own United Shows of America, a carnival company based in Smyrna, Tenn., were convicted of bank fraud in 1982 amid allegations that they had used the assets of a bank they owned to give loans to friends. They were placed on probation. The pardon frees them of the consequences of a felony conviction. The couple are also major campaign campaign contributors to both Democrats and Republicans, and they contributed to the Senate campaign of Hillary Rodham Clinton, Tony Rodham's sister. In an interview tonight, Mr. Rodham acknowledged that he had asked the president to pardon Mr. and Mrs. Gregory, but he said he received no payment for his efforts. But Mr. Rodham does have a financial tie to the Gregorys and has worked as a consultant for Mr. Gregory for about seven years, helping him buy radio stations and expand his carnival business. In interviews tonight, neither Mr. Rodham nor Mr. Gregory would disclose the terms of their financial relationship. "I told him about Ed Gregory," Mr. Rodham said of his conversation with Mr. Clinton, adding it was the only pardon application he had mentioned to the president. "I didn't push. I told the president about Ed Gregory and that he had applied for a pardon. He's what the pardon process is all about." Mr. Clinton pardoned the Gregorys on March 15, 2000. Although this was months before the controversial batch of pardons he approved on his last day in office, the clemency for the Gregorys attracted criticism inside the Clinton administration because lawyers at the Justice Department strongly opposed it. Mr. Clinton's late flurry of pardons on Jan. 20 included two for which Hugh Rodham, Tony Rodham's brother was paid $400,000, which he later returned. They also included one for fugitive financier Marc Rich. The pardons have drawn criticism because they were approved at the White House, without substantial involvement by the Justice Department and sometimes over the objections of government lawyers. House and Senate committees, as well as federal prosecutors in New York, are investigating the scores of pardons and commutations that Mr. Clinton granted on his final day in the White House. As part of that review, investigators are also looking at earlier grants of clemency in the Clinton presidency. Asked about Mr. Clinton's pardons for the Gregorys, Julia Payne, a spokeswoman for the former president, said tonight that they were approved on the merits. "The president has said many, many people advocated pardons directly to him. But the president determines to grant or deny a pardon based on the merits," Ms. Payne said. Mr. Rodham is the third Clinton relative to be involved in pardon decisions. His brother, was hired by two people who obtained clemency in January. He returned nearly $400,000 in payments for his work on two clemency applications. Mr. Clinton's half brother, Roger, urged the president to pardon six people. Their applications were rejected, former Clinton aides said. Mr. Gregory said his and his wife's applications for pardons had languished for nearly 18 months at the Justice Department. When Mr. Clinton failed to grant them in December 1999, Mr. Gregory said he asked Mr. Rodham for his help. "The only thing I ever said to Tony Rodham about the pardon is, `Tony, we've applied for the pardon, and if you can help us in any way, we'd really appreciate it,' " Mr. Gregory said. Several people involved in the pardon process said Mr. Rodham had referred to his success in helping the Gregorys gain pardons in persuading others that he had White House influence in pardon decisions. Mr. Rodham denied this. Mr. Rodham did play an active role in helping Mr. Gregory's company get the opportunity to erect a carnival on the White House lawn in June 1998. "I got a call from Tony that his sister was interested in having an old-fashioned carnival outside the White House and putting some rides up there, and he asked if we were interested," Mr. Gregory said. Former Clinton aides said that two carnival companies were considered and that Mr. Gregory's company offered to donate more services than the rival company. The Justice Department's recommendation against pardons for the Gregorys was based in part on the opposition of the United States attorney who prosecuted the case and the sentencing judge, officials said. -Caveat Lector- http://www.townhall.com/columnists/anncoulter/ac20010301.shtml Ann Coulter March 1, 2001 Mary Jo White-wash While ostentatiously pursuing an "investigation" of the Marc Rich pardon (which will lead precisely nowhere), Mary Jo White, the U.S. attorney for the Southern District of New York, has stubbornly refused to indict top Democratic and union officials directly implicated in a money-laundering scheme uncovered by her own office some years ago. In what is now called the Teamsters Swap Scandal, prosecutors working for Mary Jo White won three guilty pleas from top Teamsters aides back in 1997. Two years later, the Teamsters' former political director, William Hamilton, was convicted for his role in the kickback scheme. But for four years now, the Big Kahunas implicated in the money-swap operation have been largely forgotten by White's office. One big fish studiously ignored by Ms. White is the current chairman of the Democratic National Committee and Clinton pal, Terry McAuliffe. At the center of the money-laundering scheme was Ron Carey, who had been anointed Teamsters president by "the most ethical administration in history" as part of an ingenious plan to "clean up" the Teamsters. When Teamsters legacy James Hoffa Jr. later challenged Carey for the union presidency in 1996, Carey's aides -- and perhaps Carey himself -- decided to give the Carey campaign a boost using general union funds. As was proved by the government, both in oversight and criminal investigations, the Carey campaign repeatedly arranged for the Teamsters to make huge contributions to various liberal and Democratic groups, and then those groups would funnel the money right back -- not to the Teamsters, but to the Carey campaign. This is on the order of the IRS commissioner using tax revenues to buy himself a Porsche. After sitting on evidence for four years that implicated Carey, the tough-talking Ms. White finally indicted him only days after George W. Bush was sworn in as president. But even a Republican in the White House hasn't prompted Clinton-appointed White to blink in her intractable refusal to pursue McAuliffe. This is somewhat startling inasmuch as White's own office adduced testimony during the Hamilton trial naming McAuliffe as a party to the money-laundering operation. Democratic Party official Richard Sullivan testified that his former boss, Terry McAuliffe, outlined a plan to him that would allow the Democratic National Committee to participate in the Teamsters' evidently well-known kickback scheme. Sullivan said that McAuliffe told him the Democratic Party would be rewarded with up to a million dollars in campaign contributions from the Teamsters if the Democrats could find someone to donate $100,000 to the Carey campaign. (Though completion of the scheme is not required for a criminal offense, the Teamsters came through with their quid. The donor located by the Democrats for their quo backed out at the last minute.) Though Sullivan later told Senate investigators he did not view this arrangement as money laundering but rather as a way to "help raise money from the union," Sen. Arlen Specter informed Mr. Sullivan that he was using language that "is the equivalent of a quid pro quo." After Sullivan's shocking trial testimony, even The New York Times was forced to admit that Sullivan's description of McAuliffe's role was "troubling." While trying to mitigate the force of Sullivan's testimony by incorrectly claiming that he had been given a "no-prosecution" deal from the prosecutor (correction issued 10 days later), the Times referred vaguely to "some judgment calls" that Mary Jo White was going to have to make with regard to McAuliffe. An indictment seemed imminent. That was in 1999. We're still waiting. Indeed, according to McAuliffe's lawyer, Richard Ben-Veniste, McAuliffe was given "assurances" three years ago from Mary Jo White's office that he "was not a target of the investigation." Meanwhile, three other Democratic or union officials have given sworn statements to Senate investigators also fingering McAuliffe as a player in the Teamsters' money-swap scandal. Not only that, but the three Carey campaign aides who pleaded guilty to felonies back in 1997 still have not been sentenced. Federal judges do not normally wait more than three years to sentence felons -- unless the U.S. attorney has requested that sentencing be delayed. Why is Mary Jo White blocking their sentencing? Prosecutors will sometimes request that sentencing be deferred when a convict is cooperating so that the full extent of the cooperation can be known by the court prior to sentencing. But four years is enough time to have these guys describe the history of the world since the Earth cooled -- to say nothing of a simple money-laundering scheme. David Dreyer, a partner in a Washington communications firm, said Tuesday that he spoke about three times last year to White House chief of staff John Podesta and once to White House lawyer Beth Nolan about the case of Harvey Weinig, a New York City lawyer. Podesta called Dreyer on Jan. 20 to say that President Clinton had commuted Weinig's sentence, Dreyer said. Weinig was sentenced in 1996 to 11 years in prison for laundering tens of millions of dollars in drug proceeds and failing to report a kidnapping. With the commutation, Weinig is scheduled to be released from federal prison April 16. He will have served over five years. Last summer, Weinig's family "asked me to help; I took the information to people I knew in connection with my White House service and I let them know I cared about Harvey," said Dreyer, who was deputy White House communications director from 1993 to 1995 and then spent two years at the Treasury Department. Dreyer said the Weinig family was "floored" in 1995 because they felt the prison term was much longer than warranted and Weinig's sentence was longer than that of other defendants in the case. Washington attorney Reid Weingarten began exploring the possibility of a commutation about a year ago, filing an application with the Justice Department's pardon attorney. The Justice Department on Tuesday declined to say what the pardon attorney recommended. "I met with Reid and he gave me a three-ring binder on Harvey's case that was going through the pardon attorney," said Dreyer, who presented the cover memo from the binder to Podesta. After Weinig's name didn't turn up among Clinton's pre-Christmas commutations, "I called John Podesta and he said it was still under consideration," Dreyer said. Dreyer said he spoke briefly to Nolan about the case at a White House staff party. Podesta's office on Tuesday declined comment, referring to his comments Sunday on NBC's "Meet the Press." Podesta said then that he recommended the Weinig commutation "on humanitarian grounds. ... It was done on the basis of a humanitarian plea that was made to us by someone we knew who had rendered good public service." U.S. prosecutors said Weinig was one of the heads of a major international ring operating in New York and other cities, including in Germany, Switzerland, Italy, Puerto Rico and Colombia. Alfonso Valdivieso, Colombia's United Nations ambassador who as top prosecutor during the mid-1990s oversaw efforts to put drug traffickers behind bars, called Clinton's action "sordid." "This gives us the notion that the anti-drug fight is asymmetrical," former Foreign Minister Rodrigo Pardo said of Weinig's commutation. "The United States demands more from Colombia than it is disposed to do itself." Colombian President Andres Pastrana met with President Bush in Washington on Tuesday to discuss U.S. support for drug-fighting programs in the world's largest cocaine-producing nation. The jury already has issued subpoenas and is collecting the fund-raising lists and documents for Bill Clinton's presidential library -- a clear sign that they are looking for evidence of a quid pro quo between the Rich pardon and donations to the former president. = Separately, federal prosecutors in Minneapolis have asked the = Justice Department for advice on whether they should open a = grand jury investigation into Clinton's commutation for Carlos = Vignali of Los Angeles. Vignali, a convicted drug dealer, was = released after a lobbying campaign by Southern California = elected officials and $200,000 in fees paid to Clinton's = brother-in-law, Hugh Rodham. The New York investigation was begun after Mary Jo White, the U.S. attorney there, expressed dismay over Clinton's last-minute pardon of Rich. The involvement of a grand jury means that prosecutors may believe they can develop enough evidence to secure a criminal indictment in the pardon scandal that has tarnished Clinton's legacy since he left the White House on Jan. 20. = Federal prosecutors in New York declined to comment Tuesday about = the scope of their probe. But the fact that a grand jury has = been impaneled allows them to use it as a vehicle to review = other pardons that Clinton granted in cases originating there. Those include clemencies for four Hassidic Jews convicted of bilking tens of millions of dollars from the government, and Harvey Weinig, who was sentenced to 11 years in prison for laundering $19 million for a Colombian drug cartel. Clinton pardoned 15 people whose cases originated from White's district in New York. The former president's lawyer, David E. Kendall, confirmed the grand jury's probe when he advised congressional investigators Tuesday that they may have to wait to see the library foundation's records until after the grand jury completes its review. The foundation is in the process of complying with a subpoena issued by a grand jury of the United States District Court for the Southern District of New York, Kendall wrote in a letter to the House Government Reform Committee, and will produce lists of and documents pertaining to all persons who have given or pledged to the foundation an amount in excess of $5,000. Denise Rich, the fugitive's ex-wife, has donated $450,000 to the foundation and more than $1 million to the Democratic Party. Prosecutors as well as congressional investigators want to know if any of that money actually came from Marc Rich, who has lived outside the country since 1983. Foreign money is prohibited from U.S. political campaigns. One way to sort that out is to examine the divorce settlement between Marc and Denise Rich, which might show how likely it is that she alone could afford to contribute such large sums of money. Meanwhile, Marc Rich refused to testify before the House panel or provide any documents related to his pardon effort -- becoming the third person to turn the committee down after his ex-wife and her friend, former Democratic Party fund-raiser Beth Dozoretz, each invoked the Fifth Amendment against self-incrimination. Also Tuesday, Clinton waived executive privilege for three of his top White House aides in preparation for their testimony Thursday before the House Government Reform Committee. Foot-and-mouth has gained a grip on this nation and fear of the disease seems as powerful as the disease itself. We recognise foot-and-mouth not by its symptoms, but by what we do to control it: the restrictions on movement, the slaughter of animals, the burning of carcasses. From the panic and the headlines you would imagine that this is a most dreadful disease. Yet foot-and-mouth very rarely kills the animals that catch it. They almost always recover, and in a couple of weeks at that. It almost never gets passed on to humans and when it does it is a mild infection only. The meat from animals that have had it is fit to eat. In clinical terms, foot-and-mouth is about as serious, to animals or to people, as a bad cold. Why, then, the concern? And why the policy of wholesale slaughter? The concern, of course, is economic. This is a financial issue, not an animal welfare issue, nor a human health one. No one abroad will take our meat if it might be infected with foot-and-mouth. And that worldwide exclusion zone stems from British policies of the past. It was we who, in the late 19th century, decided that foot-and-mouth should not be lived with, but should be eliminated, shut out through the cordon sanitaire; it was we, in the 1950s, who encouraged first the Continent, then the rest of the world, into following suit. Now it is we who must live with the results of that policy. Foot-and-mouth disease does reduce the productivity of an animal: its milk yield, its rate of putting on of flesh. There are no figures for how much it reduces these things; part of the reason for that is that no one since the 1920s in Britain has seen the disease take its full course. Any animal infected with it has been immediately slaughtered That reduction in productivity, that fear of small economic loss, is what lies behind the elimination policy and the huge economic costs that are now being incurred. It need not have been like that. The animal control policy was the result of economics rather than biology. Under conditions of world trade now it is a decision almost impossible to reverse. Foot-and-mouth first appeared in Britain in 1839 from the import of live infected animals and later from ships, from dockyards, from Argentinian meat and skins, even from foreign hay. For much of the 19th century it was endemic in the UK and it did not destroy farming. Farmers lived with it, as they live with bad weather, poor harvests and other afflictions of their livelihood. It was owners of pedigree herds, rather than common-or-garden milk or meat producers, who from 1869 prompted efforts to eradicate it. It was achieved by isolation, by movement restrictions, by temporary closures of markets and by prohibition of live imports but not by slaughtering. By 1900, Britain was disease-free but was subject to waves of re-introductions of foot-and-mouth from the Continent and from South American meat. Outbreaks, and now slaughters as well as isolations, were frequent; but familiarity made them more of an irritant than the terror we have today. A policy of living with foot-and-mouth almost became an option again in the 1920s. A bad outbreak in Cheshire was on the verge of running out of control.Ministry teams were so far behind in their slaughtering that on many farms the cows had recovered from the disease before the slaughterers arrived. And farmers looked at their now-normal cows in bewilderment and asked: Was that it? Was that rather trivial illness what all the fuss was about? Not surprisingly, they began to question the need for slaughter. Even the Ministry of Agriculture, now wedded to the policy of slaughter, was pressured into taking heed of farmers views, and even asked them which policy they would prefer, elimination or toleration. It even went to a vote. But by that time burnings had got on top of the disease, and the vote, though close, was to continue measures of eradication. This was the last time that people saw the full course of the illness. Memories of what a slight disease it was began to fade. The biggest outbreak in our history, in 1967-68, is the one that lingers in present memories, and memory of those days fuels the grim processes we now see. A policy of living with foot-and-mouth might have worked in the 1920s, and had we adopted it we would not be witness to the present scenes. But in those days productivity was not the be-all and end-all that it is now. So many diseases were around that a farmer was happy if his animals survived to give milk and meat at all. PALESTINIAN RULING BODY TO COLLAPSE IN WEEKS, SAYS UN By Phil Reeves in Jerusalem [The Independent, UK, 1 March 2001] United Nations officials say Yasser Arafat's Palestinian Authority may have only one month left before it collapses financially, plunging the occupied territories into anarchy. Their warnings back recent statements by the UN's Middle East envoy, Terje Roed-Larsen, about the growing fiscal crisis facing the Palestinian Authority (PA) because of the five-month intifada and Israel's economic blockade of the West Bank and Gaza. The envoy's office is trying to convince the international community to take these predictions seriously and to help bail out the Palestinians before it is too late. "There is no question in our minds that the PA could collapse by the end of March, if nothing is done," said one source. "We have been criticised for saying this but we seriously believe it to be true. We do not want to be accused, after the event, of saying nothing." The Palestinian intifada and particularly Israel's unprecedentedly harsh and almost uninterrupted blockade of the occupied territories has devastated the Palestinian economy, tripling unemployment (to at least 30 per cent) and pushing the number of people living below the poverty line to about one million. About 100,000 Palestinians have been unable to cross into Israel to work. Figures released this week by Mr Roed-Larsen's office showed income losses of $1.15bn from October to January. The main fear of Western diplomats is not that the financial collapse of the PA which cannot pay its 130,000 employees will bring about the fall of Yasser Arafat. His role as a figurehead, the international face of the Palestinian cause for decades, is well understood by his domestic opponents. But diplomats fear that the Palestinian leader's already partial control over his population of three million will be so eroded that he will no longer be in a position to negotiate with the Israelis for example over restoring calm and that the occupied territories will slide into anarchy, withwarlords and armed groups running amok. Web search technology has long been vexed by the problem of prioritizing the thousands of Web pages that common queries yield. Project Pandango, the work-in-progress of Seattle-based i5 Digital, attempts to determine that priority by examining the Web surfing histories of a wide network of computers on the Web. The ambition driving Pandango's creators is to take the peer-to-peer model, made famous by file-swapping applications such as Napster, and build a search technology on it that will topple the current market leaders. "This is the third generation of Web searching, and Google has to be concerned with how they stay ahead of the curve," said Liad Meidar, chief executive of i5 Digital. "Being able to leverage a P2P network to do a search is taking what Google's done to the next level." i5 Digital is putting the finishing touches on Pandango while pursuing negotiations with what Meidar describes as "a lot of the household names in search portals, ISPs if you will, Web-based companies with large numbers of users," Meidar said. Because Google powers the search feature on Yahoo, the Web's most-visited site, it is considered the reigning king of search technology. The company also runs its own Web site. Meidar is quick to point out how Pandango's approach differs from those of its potential competitors. Google, for example, is based on traditional academic citation analysis, which determines the relevance of a scholarly article based on how many times other articles cite it. Google ranks pages based on how many other pages link to them. Pandango, by contrast, would determine relevance by examining a radiating network of "referrers." Once someone downloaded Pandango and joined its peer-to-peer network, that person's keyword search would examine the Web histories and bookmarks of an initial network of 100 referrers. From there, the application would search the Web histories of those 100 referrers' combined 10,000 referrers, and once again--so that the query would canvass the Web pages visited and bookmarked by 1 million people. The system is being designed to refine itself over time based on which pages--and by extension which referrers--the searcher selected. Frequently selected referrers would move to the top of an individual's referrer heap, while others would drop off and new recruits would join. In the process, the Pandango member would be developing an initial referrer group of like-minded Web surfers, whose once- and twice-removed referrers would be increasingly like-minded as well. A P2P collaboration If Pandango is a child of the peer-to-peer craze, then its other parent is the more tried-and-true Web marketing technology known as collaborative filtering. Familiar to shoppers at e-commerce sites such as Amazon.com, collaborative filtering analyzes people's behavior to speculate on preferences and make recommendations. In the Amazon example, the technology lets the company look at what one customer has bought and recommend books based on what other buyers of that book have purchased in addition to it. "This was about finding a way to find a group with common interests," said Erik Fretheim, chief technical officer for i5 Digital. "The idea comes from collaborative filtering, the concept that people who are like you, who have similar interests, are probably the best guides to what to find." Fretheim likened the Pandango search experience to common word-of-mouth queries. "When you come to a new town looking for a doctor, you could look in the phone book, which is like your typical search engine. What you do instead is you ask your peers, people you know, for recommendations rather than just take a blind shot at something." Peer-to-peer schemes have proved wildly popular in some instances, such as Napster. But so far they have proven both legally hazardous and difficult to translate into profits. Although Pandango would likely sidestep the legal quagmire that has tripped up Napster--and frightened other peer-to-peer ventures--analysts say i5 Digital will have to be creative in coming up with ways to make money with the project. "I really like the technology, but whether or not it's a business model is the question I have," said Scott Pope, a Boston-based independent analyst and consultant until recently with the Delphi Group. "It's an interesting concept, but who's going to pay for this? In a note issued last Friday "For Internal Distribution Only" they say that the rise in gold lending rates - now 4.5 per cent compared with 0.5 per cent before Christmas - has inverted the yield curve for gold lenders. The "shorts" are starting to feel the pain and that is the reason for the sharp moves in gold equities and the metal itself. But there is a way to go. At the time of the Washington Agreement in September 1999 lease rates were as high as 10 per cent. These higher lease rates, the bankers suggest, are either due to traders borrowing to "short " the metal or trying to acquire gold to meet a market shortage. Interestingly they see the steady flattening of the yield curve over the past six months as a mirror image of the way the market reacted before the Washington Agreement when limits were set on sales and lending by central banks. There are now rumours that a second Washington Agreement, formulated by the new Bush administration, may now be in the offing. This view is supported by an unusual note circulated to all member representatives by the World Gold Council. The note suggests that the central banks are no longer agreed in their attitude to gold lending. The combination of a low gold price and huge short positions is worrying the major official holders of gold and this undermines the aim of the Washington Agreement which was to remove uncertainty over the likely volume of official sales and put a ceiling on gold lending. The World Gold Council has noticed big selling at the PM market fix recently which reflects either some hefty selling by the official sector or a very large hedge being put in place. At the same time a tightness in supply is causing the rise in gold lease rates and the Bank of England appears to have suspended its gold lending. Such a move is unprecedented and seems to be the nub of the WGC's concern as its short term lending is a vital tool in the smooth running of the London market. And it even goes as far as to suggest that the Bank's explanation for the current tightness in liquidity is less than fulsome. This is quite something, and it goes further with the World Gold Council apparently preferring the stories going round the market that another move by central banks to cut the amount of gold available for lending is imminent. Such a move would obviously crank up lease rates and countries who did not subscribe to the original Washington Agreement and have increased their lending significantly in recent months would have to run for cover. This would make a price spike in gold inevitable. Countries such as Sri Lanka, Bangladesh and Uruguay have been lending gold of late and it is the severe shortage of physical gold which has caused the Bank of England to withdraw. Veneroso Associates, a well respected analyst of the gold scene, reckon that gold loans are three times higher than the official figures at 17,000 tonnes and estimates the annual supply /demand deficit to be running at 2,000 tonnes. The central banks are therefore between a rock and a hard place and will run out of gold unless the price rises sufficiently to quell demand. Politics then raises its ugly head, and no politics are uglier than when Clinton is involved. He could not resist getting involved in conspiring against gold if it meant that Wall Street benefited. Some months ago the conspiracy was exposed when a Texas group, the Gold Anti-Trust Action Committee accused top Wall Street investment firms of conspiring with the U.S. Federal Reserve Board, among others, to depress the price of gold. In a complaint filed in the U.S. District Court of Boston, Mass., GATA sought compensation for an alleged price-fixing scheme it says involves J.P. Morgan Co. Inc., Chase Manhattan Corp., Citigroup Inc., Goldman Sachs Group Inc. and Deutsche Bank AG. There is no little doubt that the Bush Administration will give any investigation into gold fixing a fair wind and this could bring our very clever Chancellor into the net just before a general election. The sales of UK gold reserves always smelt of politics rather than portfolio realignment which was the official explanation. And the blustering when the damage done to poor gold producing countries was pointed out made this ever more certain. When Clinton beckoned Blair jumped, but it would be embarrassing if the remaining gold sales had to be cancelled with gold soaring above the various prices at which Brown sold the 25 tonne lots.. The suspects were charged with several counts of supporting an official terrorist organization, officials said. An arraignment was expected late on Wednesday in Los Angeles. The charges carry a maximum prison sentence of 10 years per count, officials said. The group is also known as the Mujahideen-e Khalq Organization (MEK). "The MEK is a known terrorist group," said James DeSarno, the assistant FBI director for the Los Angeles office said. "I think the arrests are very significant ... We certainly hope it puts a crimp on their fund-raising activity." DeSarno said the seven Iranian nationals -- six men and one woman who was considered the ringleader -- dressed in business suits and approached travelers, primarily Asians who did not speak good English, arriving at Los Angeles International Airport. After showing them graphic photos of Iranian orphans and alleged atrocities by the Iranian government, they collected up to $10,000 a day which they said was to be spent to aid a charitable group called "The Committee for Human Rights in Iran," which purported to use the money to feed starving children. FBI officials also believe that the accused, aided by an unknown number of volunteers in the Los Angeles area, solicited money from the city's substantial Iranian community, which is one of the largest Iranian expatriate communities in the world. They stressed that the Iranian donors were likely unaware that they were contributing money to terrorists, FBI spokesman Matthew McLaughlin said. The investigation, known as Operation Eastern Money, was initiated by the German National Criminal Police who told FBI officials that members of the MEK were involved in money laundering in Los Angeles. Formed in the 1960s by college educated children of Iranian merchants, the MEK sought to counter what it saw as excessive Western influence in the then-Shah's regime. Following a philosophy that mixes Marxism and Islam the group stresses propaganda and sometimes uses violence. It often uses Iraq as a springboard for attacks into Iran and has several bases equipped with tanks, heavy guns, and helicopter gunships close to the Iranian border. The MEK is one of several groups listed as a "terrorist organization" by Washington. A similar designation was recently assigned to the group by the British government. From the 1970s to the 1990s, MEK staged attacks inside Iran where it killed several U.S. military personnel and civilians. The organization has carried out several rocket attacks and assassinations in Iran's big cities in recent months as part of a campaign to overthrow the Islamic Republic. It also participated in the takeover in 1979 of the U.S. Embassy in Tehran and was responsible for the violent occupation of the Iranian mission to the United Nations in New York in 1992. "None of these (arrested) individuals ... are tied to any terrorist act, either here or in the United States or overseas," DeSarno said. However, he said that money raised was intended to support MEK which is known to have committed terrorist acts. Why did you give lead-story treatment to Clinton's remarks about her brother's role in some disputed pardons while placing the story about Bush's press conference comments on Iraq and a tax cut below the fold? These complaints echoed those that washed over us like a tsunami during the presidential campaign last fall: Why are you running big pictures of Al Gore and little ones of George W. Bush? Why did you have Gore on Page 1 and Bush in the obituaries? Gore/Clinton. Hugh Rodham/Roger Clinton. Hillary/Bill. To Bush partisans, they're all the same: characters from a canceled sitcom who still insist on showing up in prime time, stealing scenes from the new leading man and his ensemble. But this is more than just a partisan complaint. The Pew Research Center for the People and the Press reported last week that 53 percent of Americans felt there had been too much news coverage of Bill Clinton and his works and pomps since he left office. Add in Hillary and Al Gore and the rest of that madcap gang and the figure might get up to two-thirds. So why do the media continue to thrust them all before the public, to the dismay of readers and viewers and to the neglect of "more important" stories, like Bush's tax-cutting plans or his Iraq policy? More specifically, why did the Tribune give such prominence to the Hillary picture and story Friday, to the disadvantage of the Bush picture and story? The latter is the easier to answer. Quite simply, Bush's remarks on taxes, Iraq and the other topics he covered during his first White House news conference were not really new; he had said it all before. Indeed, the news conference story was only marginally a Page 1 story. It was made so mainly by the fact that it was his first as president--the sort of event that ought, at some level, to be memorialized. Hillary Rodham Clinton's press conference, on the other hand, was real news and was about a matter as serious as a heart attack: What did this newly elected United States senator and former first lady know about the circumstances of some foul-smelling pardons granted by her husband? Were pardons in effect sold? Who (besides the people pardoned) benefited and how? Obviously her husband was involved in the business, but what about Sen. Clinton? You can argue about the size of that striking Hillary photo, but not, it seems to me, with the fact that it belonged on Page 1 and, given the potential gravity of the situation she was addressing, that the story of her remarks deserved the treatment it got. As to the larger question--why does the press keep throwing the Clintons and their shenanigans up before the public?--the answer is unsatisfying but inevitable: because it's good for you. I mean that in the same way your mother (and mine) meant it when she told you that your spinach or broccoli or--ugh!--Brussels sprouts are good for you. Every edition of a newspaper involves a balancing of what readers want to know with what they need to know as citizens. And weary of the Clintons though most of us may be, we need to know about this pardon story. As of Wednesday, two principal actors in the story had taken the 5th Amendment. That suggests that they, at least, fear criminal prosecution for their actions. Another principal, Marc Rich, has declined any cooperation with the various investigations. If the Monica Lewinsky brouhaha stemmed from an unfaithful man's attempt to conceal his infidelity, this Pardoner's Tale appears to have grown out of something far more crass and venal and pernicious: the trading of a uniquely presidential favor for money. At least it looks enough like that to have prompted a formal investigation by the Clinton-appointed U.S.attorney in New York. Only 42 people have ever enjoyed the privilege of granting a presidential pardon. With rare exception, nobody has exercised it in so obscene a fashion as Clinton. Yet members of Congress are talking of altering or curtailing the privilege--by altering the Constitution--to prevent such abuses in the future. That's serious, serious business. And it's the reason that, as much as the majority of Americans may want to be done with the Clintons, we cannot be--at least for awhile. The House panel subpoenaed the three aides in its widening investigation of possible influence peddling or links between campaign donations and the pardon of Rich and others on Clinton's last day in office. Rich's ex-wife Denise gave more than $1 million to Democratic causes and $450,000 to the Clinton library. Committee investigators got a brief peek on Wednesday at the names of those donors who contributed more than $5,000 to the library and won an agreement from Clinton attorney David Kendall for a broader review of those donors that investigators suspect might be linked to the pardon of Rich or others. The committee had subpoenaed information on all donors contributing more than $5,000 to the Clinton library fund, and threatened library officials with contempt if they did not comply. Invoking Fifth Amendment Kendall resisted the request, citing privacy concerns, but agreed to allow investigators to see more information, including dates and total donation amounts, on donors selected by committee investigators. The deal means the committee will not call Skip Rutherford, the library foundation's president, to testify on Thursday. But still scheduled to appear before the panel is former Democratic National Committee finance chairwoman Beth Dozoretz, who has informed investigators that she will invoke her Fifth Amendment protection against self-incrimination and refuse to answer committee questions. Grimaldi Washington Post Staff Writer Thursday, March 1, 2001; 12:01 PM A top aide to Marc Rich alluded more than a year ago to seeking a presidential pardon for the fugitive financier in correspondence with Rich's attorneys, calling it "the unconventional approach which has not yet been tried and which I have been proposing all along," according to one of dozens of documents made public today. Attorneys for Rich have said that the earliest they began discussing a pardon was last fall. But congressional investigators believe they have found a reference to it in an e-mail from Avner Azulay, director of the Rich Foundation in Israel and the leading strategist for the pardon. In February of last year, Azulay rejected the notion of Rich surrendering to authorities in New York in exchange for the dropping of racketeering charges in a 1983 indictment accusing Rich of failing to pay $48 million in taxes and trading with Iran while it held U.S. hostages. "The present impasse leaves us with only one other option," Azulay said of the stalemate with the U.S. Justice Department and the U.S. Attorney's office in Manhattan. The e-mail appears among exhibits released today at the beginning of the fourth congressional hearing on the controversial pardons at the end of the Clinton administration. The House Government Reform Committee opened the hearing at noon, with the first scheduled witness Beth Dozoretz, a Democratic fund-raiser who also pressed Clinton to pardon Rich and his business partner Pincus "Pinky" Green. Dozoretz pledged to raise $1 million for Clinton's library and helped secure a $450,000 donation from Denise Rich, the ex-wife of Marc Rich. While Dozoretz was prepared to assert her Fifth Amendment privilege against self-incrimination, members of the panel expected to hear Clinton's top three White House attorneys say that they told the administration that the Rich pardon was a bad idea. The witnesses include John Podesta, Clinton's chief of staff, Beth Nolan, the White House counsel, and Bruce Lindsey, a long-time aide to Clinton. The committee, chaired by Rep. Dan Burton (R-Ind.), also has obtained information regarding Podesta's personal attorney, Peter Kadzik. Letters released by the committee today reveal that Kadzik lobbied his own client on behalf of Rich, who has been represented by other attorneys in his firm. Azulay's exchange with Rich attorney Robert Fink occurs in February last year. Fink wrote to Azulay that contacts with a prosecutor in New York and a phone call with Deputy Attorney General Eric Holder did not appear to be making any progress. Fink reveals that New York prosecutors were willing to "drop the RICO [racketeering] charge if we wanted, if Marc came in. They would also agree in advance on bail, etc., so that he would not be incarcerated pending trial (although he would have to surrender his passport)." Fink also said that the prosecutors said they would talk to lawyers and Rich's tax professors and "do a full review before proceeding to a trial to make sure that upon careful examination they stood on the strength of their case." This e-mail appears to contradict the testimony and pardon petition written by Jack Quinn, the former White House counsel in the case. Quinn told the House Government Reform Committee last month that the New York prosecutors were intransigent because of "their unwillingness to sit down and meet with the tax professors and review the case and try to come to a resolution of it, at any time in the last decade or so." Meanwhile, Podesta's opposition to the Rich pardon could come under intense questioning. E-mails obtained by the committee indicate that Podesta might have been passing along information about the status of the Rich and Green pardon applications to his attorney, Kadzik. Kadzik, who also is set to testify, works at Dickstein, Shapiro, Morin Oshinsky, where Rich's longtime attorney Mike Green works. Kadzik has told the committee that he was retained to work on the Rich pardon and that he was involved in contacting his client, Podesta. The committee today released a letter dated Dec. 15 to Podesta written by Kadzik. Kadzik refers to an earlier conversation and supplies additional information on the pardon applications of Rich, Green and James B. Coppinger, who was convicted of cocaine distribution and conspiracy to distribute cocaine in Illinois in 1981. Coppinger's primary attorney also works at the Dickstein, Shapiro firm, but Coppinger's pardon application is still pending and was not granted by Clinton. That's because no other president has ever given clemency to a relative. According to constitutional law professor Jonathan Turley of George Washington University, Roger Clinton's pardon also violates the Ethics in Government Act of 1978, which prohibits officials from using their authority for the benefit of family members. Turley systematically dismantled any hint of legitimacy that might have surrounded Roger Clinton's pardon: --In 1984 he pleaded guilty to felony charges of distributing cocaine and conspiracy to distribute cocaine. So he's admitted his guilt without claiming that he was innocent. --There was no suggestion that he was denied due process or that his rights were violated. --There was no question as to an overzealous prosecutor or over-sentencing. Turley notes that Roger Clinton's sentence was actually below the national average for such drug charges. So there was absolutely no basis on which Bill Clinton could grant a pardon to his brother. The couple was accused of using the assets of their bank to give loans to friends. They were convicted of bank fraud in 1982. Edgar Gregory's carnival business suffered because of his felony conviction. Some states wouldn't allow him to run state fairs because of it. The Gregorys applied for a presidential pardon in late 1998 and, after 18 months of waiting, approached Tony Rodham for help. The Justice Department, including the U.S. attorney who prosecuted the case and the sentencing judge, objected strenuously to a pardon for the Gregorys. The Gregorys were unwilling to accept the criminality of their actions. The couple had ignored the warnings of bank regulators and caused two small banks to fail without regard for the impact on other depositors. Justice officials informed the White House that the Gregorys' case was one of the most serious bank fraud cases ever prosecuted in Alabama--and that pardoning them would diminish the seriousness of their crimes. Clinton pardoned them anyway on March 15, 2000. It just so happens that Edgar and Vonna Jo Gregory are major campaign contributors to both Democrats and Republicans--and they contributed to the Senate campaign of Hillary Clinton. Tony Rodham insists he didn't receive payment for his efforts on the Gregorys' behalf...but he does have a substantial financial interest in getting the pardon. Rodham has worked as a consultant to Edgar Gregory, helping him to purchase radio stations and expand his carnival business. The New York State Department of Taxation and Finance said it filed a tax warrant Thursday against Rich, who fled the United States to Switzerland 17 years ago under indictment on a string of fraud and racketeering charges but was controversially pardoned by former President Clinton during his last hours in office Jan. 20. "Mr. Rich has avoided his tax payments in New York for nearly two decades while he was under federal indictment," New York State Commissioner of Taxation and Finance Arthur Roth said in a statement. "It is now time for him to pay the piper," said Roth, who added that the department had not previously filed civil litigation against Rich in order not to jeopardize the federal investigation against him that led to criminal charges. THE E-MAILS, among Rich¹s lawyers and advisers, were subpoeanaed by congressional investigators and are due to be released today at a hearing of the House Government Reform Committee. They appear to show that the campaign to win Rich a pardon was far more elaborateand may have begun much earlierthan was previously known. ³We are reverting to the idea discussed with Abewhich is to send DR on a personal mission¹ to NO1 with a well-prepared script,² wrote Avner Azulay, a former top Mossad agent who now heads the Marc Rich Foundation in Israel, in an e-mail to one of Rich¹s lawyers in New York, Robert Fink, on March 18, 2000. A congressional investigator said last night that the House Government Reform Committee believes Azulay¹s cryptic reference to ³NO1² is in fact code for ³Number One² or President Clinton. ³DR² is a reference to Denise Rich. It was not immediately clear who ³Abe² was. Another Azulay e-mail suggests the former Israeli intelligence official had been contemplating a pardon plea for his boss even earlier than that. In a Feb. 10, 2000, e-mail, Azulay expresses his disappointment that federal prosecutors in New York had rejected an offer to negotiate a plea bargain of Rich¹s 1983 indictment on tax-evasion and racketeering charges while the financier remained overseas in Switzerland. (AFPN) -- The Civil Air Patrol has posted its safest year ever. For 2000, the rate, based on accidents per 100,000 flying hours, was .94. This tops the 1992 record of 1.54. "The best news, however, is no lives were lost," said CAP National Commander Brig. Gen. James C. Bobick. In CAP's Flight Safety Program, all pilots are kept abreast of flight hazards and are encouraged to use risk management techniques to ensure safe flight operations. Across the nation, Civil Air Patrol hosts special flight clinics that emphasize safe operations. In addition, the safety staff assesses challenging flying missions and identifies opportunities to reduce risks during mountain searches and over-water missions. CAP commanders submit current airworthiness directives compliance checklists, weight and balance sheets, and a photocopy of the logbook entry for 50-hour oil changes, 100-hour inspections and annual inspections. They also provide altimeter certification, pitot/static system certification, transponder certification, and verification of emergency locator transmitter battery check. "These actions demonstrate how seriously we consider safe operations while conducting volunteer services," says Bobick. "The nature of our missions demand no less." CAP volunteers are often called upon to conduct airborne operations in more difficult conditions than other pilots typically face. To ensure pilots are prepared to meet these challenges, CAP has instituted other measures to enhance pilot safety. These include a mountain flying course and a video that demonstrates mountain and sea survival topics. This video will be used in CAP's distant learning programs. Mr. Miller, the only Democrat thus far to embrace Mr. Bush's tax cut plans, said that if his party continues to play polarizing politics on the tax-cut issue "the voters are going to skin us alive" in the 2002 midterm elections. The Georgia senator said he did not like the tactics being used by House and Senate Democratic leaders to discredit Mr. Bush's tax-cut proposals. He also denounced the language being used by Democratic National Committee Chairman Terry McAuliffe as "over the top." "I think the Democratic Party could not have made a worse choice in choosing Terry McAuliffe as chairman of the DNC. He stands in the shade of Bill Clinton," Mr. Miller said in an interview with The Washington Times. Mr. Miller said he was particularly disturbed by the harshness of Mr. McAuliffe's rhetoric. The DNC chairman has accused Mr. Bush of pushing a "radical right-wing agenda" and continues to insist that Al Gore won the election and that "the wrong man is sitting in the White House today." After Mr. Bush's address to Congress Tuesday night, Mr. Miller said he had the feeling that the voters think "that this president is reaching out and trying to solve problems." "And it looks like the Democrats are not reaching back like they should. And I think that's bad for the country and bad for politics," he said. The hysterical anger and political maneuvering that prevented a final tally of the votes in Florida's presidential race was for naught. According to a recount of Miami-Dade County, led by the Miami Herald, a hand recount would have given Gore only another 49 votes there. EVEN WHEN added to the Gore vote tallies in Volusia, Palm Beach and Broward counties, Bush still comes out ahead by 140 votes. You would think this figure would finally end the 2000 election controversy. You would be wrong. The Herald and its parent company, Knight Ridder, retained a public accounting firm, BDO Seidman, LLP, to conduct the review. Spending more than 80 hours during a three-week period, the reporters and accountants examined every "undervote" separately and recorded their findings. Of course, each time the votes were counted they changed ever so slightly. The Heisenberg uncertainty principle is never so true as in the necessarily subjective case of vote counting. Hanging chads fall off, pregnant chads give birth, writing becomes smudged, etc. UGLY LESSONS Unfortunately, the Herald recount proves only one thing: Al Gore and his campaign pursued a remarkably foolish and self-defeating post-election strategy. In picking only five counties in which to ask for a recount, the Gore campaign made two fatal mistakes. First, they gave the impression that they were hoping to cherry-pick the result by asking for recounts only in those counties where they had the most to gain. This played into Republican accusations that Gore was no more interested in a fair vote count than was Florida Secretary of State and Republican insider Katherine Harris; rather, Gore was arguably trying to lawyer himself into the presidency by hook and by crook. Second and most damning, this strategy was not only counter-productive from a public relations standpoint; it was destined to lose. Had Gore won with a five-county undercount-only strategy, this victory would likely have been overturned by the Florida legislature, or if necessary, the U.S. House of Representatives. And as we saw in the end, the Supreme Court was also willing to place its own credibility on the line in the end if there were no other way to overturn a questionable Gore victory. The only way for Gore to address all of these potential pitfalls would have been to undertake the strategy suggested in this space when the battle was still raging: to call for a full hand recount in Florida. A call for a complete recount would have provided a masterstroke of favorable publicity for the Gore team. What's more, according to the evidence available so far, it would have worked. When the Supreme Court made its final election ruling last December, one argument it gave for overturning the Florida high court's pro-Gore decision was the Florida court's refusal (at the Gore's team's request) to consider the 110,000 "overvotes," where a machine count recorded more than one vote for president. When examined by hand, however, many of these votes turned out to be legal, as both the punch card (or check mark) matched the name of the candidate written in. In late December, the Orlando Sentinel took a look at about 3,000 overvotes in Lake County. The paper found more than 600 valid ballots that had been ignored by the machines, with Gore picking up 130 even in this heavily pro-Bush county. In late January the Chicago Tribune reported that in 15 Florida counties with a particularly high rate of overvotes, more than 1,700 votes that showed a clear choice had been discarded. Most of the counties in the Tribune's study were small, rural and predominantly Republican. Yet even so Gore's net gain was 366 votes. And a Washington Post review of the computer records of 2.7 million votes in eight of Florida's largest counties reported that overvotes trended toward Gore at a rate of three to one. EXPENSIVE WASTE OF TIME Add these together, even with the new undervote count, and Bush is back cutting brush in Crawford, Texas, while Al Gore is your new president. But because it chose to ignore these legal votes in its own recount, the Herald/Knight Ridder effort is an expensive waste of time, useless for everyone but Bush/Republican propagandists. The flamboyant songwriting socialite met with prosecutors in Manhattan U.S. Attorney Mary Jo White's office at least twice during the past few weeks, said a source. "She has been talked to on more than one occasion," said the source, adding Rich attended the meetings with her lawyers. The source would not say whether Rich has worked out a deal to cooperate â and emphasized there is no indication that she has agreed to testify against her ex-husband, Marc Rich, or to admit to any wrongdoing. The meetings have been what one source described as "proffer" sessions. That means a witness tells prosecutors what he or she knows in the hopes of working out a deal to avoid prosecution. Prosecutors can agree not to use the information against the witness unless the witness is caught lying. Proffer sessions often result in a witness either getting immunity from any prosecution â or agreeing to plead guilty to a crime in exchange for leniency at sentencing. The source, who is familiar with the investigation, could not say whether Denise Rich and her lawyers have reached any agreement with White's office on the question of immunity. A spokesman for White, Marvin Smilon, and Denise Rich's lawyer, Martin Pollner, declined to comment last night. Rich's spokesman, Howard Rubenstein, also had no comment. But Denise Rich's lawyers informed House of Representatives investigators that she would invoke her Fifth Amendment right not to incriminate herself when they asked her to appear before a committee looking into the Marc Rich pardon. That was an indication that she was trying to work out an immunity deal with White. Within the last two weeks, White has convened a grand jury that meets inside Manhattan Federal Court to examine the circumstances surrounding Marc Rich's pardon. The pardon came after Denise Rich donated $1.1 million to the Democrats, including Clinton and his wife, Hillary; gave $450,000 toward the Clinton library, and visited the White House at least 13 times during Clinton's two terms. White wants to determine from Denise Rich whether Marc Rich, who renounced his U.S. citizenship while he was a fugitive, made secret political donations through her in an effort to win the pardon. FBI: Airport Solicitors Funded Terror NewsMax.com Wires Thursday, March 1, 2001 LOS ANGELES (UPI) â A well-dressed group of Iranian expatriates who solicited Asian travelers at the Los Angeles airport for donations to humanitarian relief were funneling money to a violent terrorist group in Iraq, the FBI said Wednesday in announcing the arrest of seven people. The group of seven that represented itself in the corridors of Los Angeles International Airport, or LAX, as Committee of Human Rights in Iran was actually a cell of the Mujahedin-E Khalq, or MEK, which raised as much as $10,000 a day to buy weapons, the FBI announced. "Our investigation uncovered this cell of the MEK and led to yesterday's arrest," FBI Special Agent James V. Desarno told reporters. MEK has been in existence since 1965. It opposed the government headed by the Shah, which was overthrown in 1979, and the Islamic regime that seized power that year in Tehran. "From the 1970s through the 1990s, the MEK staged terrorist attacks inside Iran and killed several U.S. military personnel and civilians," the FBI said in a release. "The MEK also participated in the takeover in 1979 of the U.S. Embassy in Tehran." More recently, MEK has been based in neighboring Iraq and has been concerned more with propaganda rather than its occasional commando raids inside Iran. Desarno said that MEK was a terrorist organization, and the money raised by the Los Angeles suspects allegedly was used to buy mortars, rocket-propelled grenades and other munitions. Travelers landing at LAX, mainly people of Asian origin, were approached by the suspects, who were dressed in business suits and carried photographs of starving children and victims of atrocities allegedly committed by the Iranian government. Desarno said the unwary travelers were "aggressively solicited" for donations for humanitarian aid. "They also aggressively solicited members of the Iranian community for donations," he said. Desarno said it was possible that the suspects, who were arraigned in federal court Wednesday, did not know the money they collected was used for alleged terrorist activities. However, the fact they were acting on behalf of MEK put them on the wrong side of U.S. law. "They are part of the same organization," Desarno said. "Anyone involved in the support of a terrorist group is, in fact, a member of the terrorist group." The arrests were the result of an investigation, dubbed Operation Eastern Money, that began three years ago as an offshoot of a money-laundering probe by German police, Desarno said. The group allegedly transferred more than $1 million to two Turkish bank accounts, while $400,000 was wired to an auto parts store in the United Arab Emirates. "This transfer did not appear to be related to humanitarian relief," the FBI said. The suspects, all from Los Angeles, were identified as Tahmineh Tahamtan, 39; Mustafa Ahmady, 46; Hossein Afshari, 43; Ali Reza Moradi, 30; Hassan Rezai, 46; Najaf Eshkoftegi, 50, and Mohammad Omidvar, 44. What is that? I wondered if she played the piano in Europe. I believe she meant that her studies had focused on Europe and she considered herself an expert on Europe. I am American living abroad. Both sides of my family are deeply rooted in America and I have lived in nine states. I love America. I am married to a Canadian who is also a European. I have lived in Europe twice, a total of fourteen years and I have lived in Canada once for five years. Our sons have been educated in European and Canadian schools. I have many European friends, family members, acquaintances and contacts. The Europeans, as do the Canadians, teach me a lot about how America is perceived from the outside. It is surprising to a friendly, open, swashbuckling American to feel the contempt that so many others feel for us. I think you have to be on the outside of the country to understand what I am referring to here. The Canadians let me know shortly after I landed there, that I was not to consider myself a Canadian. After some years I understood why. They had always been kind of folded into America in most American minds. Many Americans view Canada in the same way they view California as a state, but one that is different, set apart. I grew to love Canada. They seemed to have the best of both Europe and the U.S. with the American sense of vastness and possibility and the European sense of social responsibility. Americans have a very limited notion or regard for world history and geography. The outsiders consider us dumb. Oh sure, we have our technology and bravado and friendly service, but most of us cannot separate the Balkans from the Baltics or Palma from Palermo. Is Jakarta close to Madagascar? I daresay, in the shrinking world, we have done ourselves a disservice. The media's dumb-down has not been very helpful either. When I first resettled in Europe twelve years ago, I began language classes. I was the only American in my class. Each of us was from a different country. I sunk quickly to the bottom of the class. The others were learning their third or fourth language. I was a hopeless beginner. They were kind to me and helped me along with cheerful encouragement. Our topics of conversation were eye opening as I learned how very differently we perceived an issue or an event, coming from different cultures. When the teacher put the topic of "Do you consider the Dutch to be dirty?" forward, I was stunned at how the entire group turned to me with real anger about the excesses of the Americans in this regard. Did I understand how much of the world's resources we use and how unnecessary daily showers are? And, Why do we do that? And, What was I going to do about that? Gradually, I became good friends with more than a few Europeans and I came to understand and respect the differences. In friendship, one becomes privy to inner thoughts and foibles. Just as Americans experience the Americanization of newcomers to our country, this new culture began to seep into me. When I go to a tourist magnet, like Lago Maggiore or Paris or Bruges, I notice the Americans who usually huddle against the foreignness of their strange environment. The glories of Rome go unnoticed if ice is unavailable for the Diet Coke. They are often full of complaints that the place is not America and they make matters worse by demanding that it cater specifically to their American idea of how things should be. There is a very real difference in attitude to money and the Americans cannot believe that profit doesn't hold the same motivational internal whir. The Europeans believe it is crass to flaunt wealth. It takes a while to pick up on the nuances of culture. In contrast, the Europeans are very aware of America and probably even speak our language. The balance is off because of this. We still condescend to all cultures as if they were lesser, and it does not make us very likeable. My European friends and contacts, almost to the man, were in support of Al Gore winning this election. I have asked more than a few of my friends who are located in other parts of Europe and they report the same phenomena. I do know that straw polls gave Bush and Ralph Nader each seven percent. Most of the Bush-supporter spottings have been in England. England is not really full-heartedly a supporter of the European Union and their ties to America have always been special. Shortly after the Revolution ended, the British shook hands and got back to the business of trading and envoying with our country. The Atlantic Ocean, for them, has often been narrower

Get rid of Capitalism and you can decentralize economic power, thus returning democratic power to more people in the developed countries. Once these countries are democratically controlled, other countries could develop as they need to and see fit. The ONLY VOLUNTARY proven and demonstrable weapon against overpopulation, IS ACHIEVING MIDDLECLASS-HOOD. This is not possible in a system which encourages concentration of wealth. Where, as in the US, 1% of the population owns 40% of its wealth. But the beneficiaries of such a system won't give up their spot at the trough. So instead, they try every other available method to reduce the numbers of poor. None of which achieve the desired effect. You simply can't have Capitalism AND a livable planet with 9.3 billion inhabitants. Our children and grand children. Will they bless or curse your memory? It depends on what you leave them. Over the next 50 years, the world's population will likely soar to 9.3 billion from 6.1 billion, although it could be as high as 10.9 billion or as low as 7.9 billion, said Joseph Chamie, director of the U.N. Population Division. Of the total, 88 percent, or 8.2 billion people, will live in developing nations, compared to 80 percent, or 4.9 billion people, today, Chamie told a news conference. Most of the growth will come in Asia and Africa, while the world's wealthy nations, where about 1.2 billion people now live, are expected as a group to remain about the same size or even shrink a bit as birth rates stay below replacement level, he said. Therefore, the richest nations' share of the global total will shrink to 12 percent by 2050 from the current 20 percent, Chamie said, elaborating on his division's latest report on ''World Population Prospects.'' Just six African and Asian nations, India, China, Pakistan, Nigeria, Bangladesh and Indonesia, will account for half the world's growth between now and 2050, he said. Within the group of industrialized nations, however, there are sharp divergences. In contrast to most other wealthy nations, the United States will grow rapidly over the next five decades, soaring to 400 million people from 283 million last year because of a relatively high birth rate and a steady flow of immigrants. Canada and Australia are also expected to increase in size, while Japan and Europe will be shrinking, Chamie said. Although AIDS is having a devastating impact on life expectancy and population loss in the 45 mostly African countries hardest hit by the epidemic, those countries' overall population will nonetheless grow steadily over the next 50 years. Growth is predicted even in Botswana, where the AIDS infection rate is 36 percent, and in Swaziland and Zimbabwe, where infections rates hover above 25 percent. But South Africa, whose fertility rate is lower than its neighbors, will shrink between 2010 and 2025 before growing again between 2025 and 2050. Ranks Of The World's Elderly Will Mushroom The ranks of the world's elderly will mushroom over the next 50 years, with the number of people age 60 or older jumping by 2050 to nearly 2 billion, 33 percent of the total population, from 606 million, or 20 percent, today. The number of people age 80 or over will rise to 379 million by 2050, accounting for 4 percent of the total world population and more than five times as numerous as the 69 million people aged 80 or over alive in 2000. This trend will hit the rich nations hardest, causing labor shortages and sending health care and pension costs through the roof in Europe and Japan, Chamie said. But the labor market will be less affected in the United States because it welcomes about 1.1 million immigrants a year. With the population growing so rapidly in the developing world, Africa and Asia will be more urbanized, ``with mega-cities growing largely in developing countries,'' Chamie said. ``And finally, we will see a world more ethnically and culturally diverse than today,'' he added. ``Rapidly growing populations have less time to prepare for change,'' Chamie said. ``These pressures and strains are creating all kinds of challenges for governments,'' he said, ranging from reassessments of pension requirements and the retirement age to health care budgets and immigration policy. JNF is a quasi-government agency whose main function is to legitimize Israeli's theft of Palestinian land. In January, Lauder was the key speaker from the US at a rally in Jerusalem, organized by right wing Israeli politician Natan Sharansky. The rally was organized to oppose the mere consideration of Jerusalem as a negotiation item. Lauder addressed 300,000 Israeli extremists at the gates of Haram Al-Sharif (the Noble Sanctuary, one of Islam's three holiest sites). Some of the protesters tried to break into the holy site. Khalid Turaani, AMJ's Executive Director said "this boycott of Estee Lauder will send a clear message that people of conscience refuse to do business with corporations supporting Israeli apartheid policies which violate internationally-recognized human rights". In 1993, Lauder co-founded a think tank called the Shalem Center with Yoram Hazony, a former Netanyahu aid. The Israeli Education Ministry has said the center is "a research institute whose leanings are extreme right-wing and even fascistic." Hebrew University professor Yisrael Bartal describes Hazony as a right-wing extremist. A columnist for the Israeli newspaper Ha'aretz (9/14/2000) wrote that Hazony is a sympathizer of the slain radical Jewish leader Meir Kahane, who called for the expulsion of all Arabs from Israel. The goal of Hazony, wrote the columnist, is to find new ways of "breathing life into Kahane's racist, totalitarian, intolerant ideology." Ronald Lauder's Jerusalem-rally speech came at a time when the Israeli government was waging a campaign of siege and starvation against the entire Palestinian population. While Mr. Lauder supports some legitimate charitable causes in the US, he shows his true colors when abroad by supporting fanatic causes that seek to uproot an entire population from its native land. Lauder is also opposed to permitting Palestinian refugees to return to their homes. "For Israel to allow these people to return would be national suicide," he said in a statement last September. -Caveat Lector- Subject: PEACEWATCH #309: ASSESSING POWELL'S TRIP TO ISRAEL AND THE PALESTINIAN AUTHORITY THE WASHINGTON INSTITUTE'S SPECIAL REPORTS ON THE ARAB-ISRAELI PEACE PROCESS Number Three Hundred and Nine February 27, 2001 ASSESSING POWELL'S TRIP TO ISRAEL AND THE PALESTINIAN AUTHORITY By David Makovsky While the main purpose of Secretary of State Colin Powell's first foray into the Middle East was to discuss Iraq, he also visited Israel and the Palestinian Authority and injected a dose of what some would call "evenhandedness"--giving each both something to be pleased about and something to be unnerved about. Powell did not please Israelis completely as he did not specifically endorse Israel's policy of closures to handle the intifada, and he used Palestinian terminology in calling for a "lifting of the siege." Moreover, he did not assign blame for the ongoing violence, nor did he distinguish between the types of killing. Israel says there is a difference between, on the one hand, selectively targeting Hamas, Hizballah, or Tanzim activists who are responsible for killing innocent civilians and, on the other hand, the actions of a Palestinian bus driver who plowed into a bus stop full of unsuspecting travelers. Israeli officials privately --so far not publicly, in order not to offend Powell--term such an approach of failing to distinguish between these acts as one of moral equivalence. At the same time, the Palestinians could not be happy that Powell accepted Israeli sequencing in the peace process, whereby he declared a reduction of violence was a precondition for resumption of peace negotiations. This position was at odds with the Clinton administration, and the Barak government for that matter, which pressed talks further despite the ongoing violence. Taken together, these two principles could show the embryonic form of the Bush administration's policy on the peace process: siding with the Palestinians on economic--and perhaps even symbolic--matters, while siding with Israel on the proper context of diplomacy. Some of the main points of the Powell visit include: Evenhandedness While the intifada is heading into its sixth month, Israel has viewed the Palestinian violence as an illegitimate effort orchestrated by the Palestinian Authority (PA) to use force as a means to alter negotiating terms for final status negotiations. In recent weeks, Israel has reportedly brought substantial evidence to the CIA and other branches of the U.S. government to back up its contention that the PA stands behind the killings. On the other hand, the PA has publicly claimed that the intifada is a popular uprising that expresses frustration with Israeli occupation. The two sides differ both on motives and source of the violence, and even on whether the killings of the two sides are comparable. Powell apparently decided to avoid all these issues of contention. During his Middle East trip, Powell consistently bemoaned the ongoing violence, but never went beyond his call for both sides to avoid an "escalation of violence." The Palestinians view this as a victory that they hope represents a departure from the policies of the Clinton administration, which they have called "one sided." Furthermore, Powell made clear that he was not happy with Israel's closure policy in the territories, and in honor of Powell's arrival, Israel lifted some check-posts that divided the Gaza Strip. (The check-posts were imposed last week after mortar shells were fired at a Jewish settlement in Gaza.) At his joint press conference with Chairman Yasir Arafat, Powell said, "I also want to express my deep concern for the dire economic situation that everyday Palestinians must bear. . . We discussed how it is necessary to lift the siege as soon as possible so that economic activity can begin again in the region." Israel has imported 30,000 foreign workers over the last few months to make up for the shortage of Palestinian workers. Lowering Violence as a Precondition for Negotiations Yet, Powell did not just side with Palestinians. Speaking to reporters on the plane to Kuwait on Monday, Powell made clear in blunt remarks that he accepts Israeli prime minister-elect Ariel Sharon's condition that peace talks must be preceded by Palestinian efforts to quell intifada violence. Powell said peacemaking "does begin with a lowering of the violence. We are at the beginning of a long hallway. . . and at the end is the negotiations for peace." He added, "it's going to be some time before they can get back to the negotiations, it seems to me." Powell said a reduction in violence is "really the sine qua non to moving forward." During his visit, Powell repeatedly called for a restarting of security cooperation between Israel and the Palestinians. In contrast, the Palestinians have actively opposed any conditionality between halting violence and resuming peace talks. The

' By Pavel Felgenhauer Last week FBI agent Robert Philip Hanssen was arrested in the United States and charged with spying for the Soviet Union and Russia for the last 15 years. A spokesman for Russia’s Foreign Intelligence Service, Boris Labusov, told Russian State Television: "We never comment on whether any specific person has or has not a relation to Russian special services." While speaking Labusov noticeably smirked and added that "the greatest achievements of intelligence services become public knowledge only after an exposure." If Russian officials are trying to hide their alleged connection with Hanssen, they are doing a pretty lousy job of it. In fact, they seem to be quite proud of the idea that they had such an agent. In the ’80s and ’90s, the Russians apparently managed to operate two highly successful moles, one in the FBI and one in the CIA: Hanssen and Aldrich Ames. Moscow obtained quite a lot of sensitive information from Ames and, allegedly, from Hanssen as well. It’s also virtually certain that Ames and Hanssen were not the only well-placed moles that Russia had in the West. Soviet intelligence was not only highly professional, but also remarkably successful. So why then did Moscow lose the Cold War? A retired Russian intelligence official once told me that in the late ’70s, Russian military intelligence managed to acquire a package of highly secret documents revealing the true maximum production capacity of all U.S. heavy arms-making industrial plants. It turned out that the United States could not grossly expand tank and other heavy-weapons production even if the economy were put on a war footing and that the Soviet Union had a towering advantage in this field. The spies who came up with this important intelligence were expecting bunches of medals, but were harshly reprimanded by their superiors instead. The documents were suppressed by the military chiefs and never reported to the Politburo. The Soviet military-industrial chiefs were at that time conjuring a massive Western military threat in order to frighten the Kremlin into spending more on defense. They were deliberately fabricating yarns about U.S. military might and did not need any true information about American weaknesses. The same thing was happening on the other side of the Cold War divide. At the end of the ’80s, the CIA estimated Soviet gross domestic product as almost 60 percent of America’s. The agency portrayed Moscow not only as a military superpower — which it was in many aspects — but also as a modern industrial power, which it was not. As a result of such intelligence, the sudden political, military and industrial implosion of the Soviet empire came as a total surprise to the West. Throughout the Cold War, both countries spent billions of dollars recruiting moles that were used to find and "neutralize" enemy moles, while truly important information was shoved aside as insignificant. In 1995, for instance, the CIA produced a report that stated that no "rogue" state could develop intercontinental ballistic missiles within 15 years, and that if a threat of rogue ICBMs did develop, U.S. intelligence would detect it years in advance. This report disturbed many Washington decision-makers, so Congress formed a special commission headed by Donald Rumsfeld, who is now secretary of defense. The purpose of this commission was to conjure a rogue ICBM threat out of thin air. In 1999, the Rumsfeld commission concluded that "North Korea and Iran will have an ICBM force to attack the U.S. in five years" and Iraq will have an ICBM force ready to attack the U.S. in 10 years or sooner. Now, almost two years later, it’s obvious that the Rumsfeld report is a sham and that the original CIA estimates are correct. But who cares? Rumsfeld was appointed defense secretary because he is a good apparatchik who knows that the truth is whatever the party says it is. For almost a year now, the Moscow elite has been anticipating, in accordance with intelligence reports, that the new Bush administration would be Russia’s best friend no matter what happened here. At the same time, the West is still waiting for President Vladimir Putin to reveal himself as the true liberal that he must be at heart. By now, though, both East and West must have disappointedly returned to the drawing board to think up new policies — which no doubt are based on the latest reports of their respective intelligence services. KIRKPATRICK IN BROTHERS TO THE RESCUE SHOOTDOWN: http://www.miami.com/herald/content/opinion/opcol/digdocs/053380.htm U.S. shares the blame Last Thanksgiving Day I flew my small plane to Cuba loaded with medical donations from the United States. To get permission, I had to overcome considerable nervousness from Cuban authorities. They feared my flight would open a way for more U.S.-sponsored provocation by private pilots, such as the events that led to the shootdown of two planes by Cuba in 1996. Although a United Nations investigation faulted Cuba for not using means, such as more-effective radio communication, to avoid the shootdown, what has not been widely re- ported is how the U.S. government might have prevented the shootdown by enforcing its own laws. Now, five years later, the case is in a Miami courtroom, where defense attorney Paul McKenna says that his client, accused Cuban spy Gerardo Hernn- dez, is a scapegoat in the shootdown and that Jos Basulto, the leader of the Brothers to the Rescue, is really to blame. If convicted, Hernndez could receive a life sentence. ILLEGAL EXPLOITS The American public deserves to know all the facts about the shootdown. On July 11, 1995, the Federal Aviation Administration met with Basulto and warned him that if he violated Cubas territorial airspace, he would suffer ``serious consequences'' and that any violations would be ``vigorously investigated.'' Yet two days later, Basulto was on Miami television bragging about his illegal exploits, calling them ``civil disobedience.'' Viewers saw him ``roaring over Havana at rooftop level,'' as described by the on-board TV reporter, dropping propaganda leaflets and religious medals, which seriously could have injured people below. A Cuban fighter plane flying above him took no action, even though Basulto was flying in a manner later described by the FAA as reckless or careless ``so as to endanger the life and property'' of others. Unfortunately, the FAA failed to carry out any of its warnings. For example, it delayed the investigation for more than a month while it translated Cubas documentation of the incident, and it never contacted the journalist on board Basultos plane. We may never know if the tragic shootdown seven months later might have been averted had the FAA exercised its authority to revoke Basulto's pilot's license or seize his aircraft. Despite Cubas numerous warnings that it would shoot down any intruding aircraft, the Brothers continued their efforts to destabilize the Cuban government by flying into airspace controlled by Cuba and dropping political leaflets into the island. TOWARD HAVANA On that ill-fated day, the pilots deviated from their filed flight plan without notifying the aviation authorities. This deviation in flight plan made the Cubans nervous because the aircraft were heading directly toward Havana instead of along the coastline of Cuba as they had promised. According to the U.N. report, the pilots acknowledged that they were warned in Miami through the FAA and in the air by the Cubans that they would be flying into airspace under Cuban control and ``activated'' by Cuban military during that period. Although all three aircraft were equipped with sophisticated GPS navigational systems, they intruded directly into the activated area. Basulto told the U.N. investigators that he did not violate Cuba's territorial airspace, but the U.N. report states that radar recordings from both countries showed otherwise. Basulto managed to evade a shootdown by the Cuban military aircraft, but the other two aircraft were not as fortunate. Rather than point the finger at the Brothers or the FAA for the shootdown, the United States called on the U.N. to condemn Cuba, citing a provision calling for countries to refrain from using weapons against civil aircraft. That same provision was used to condemn the United States in 1988 for shooting down an Iranian airliner, killing 290 passengers. But the United States itself refuses to ratify the provision. Why? It would require this country to prevent private pilots from using their aircraft to carry out acts of aggression against other nations. Cuba ratified the provision on Sept. 28, 1998. What if the table were turned? Suppose that a known enemy from abroad was to enter U.S. airspace in a small private plane heading toward Washington, D.C. As several ``administration officials'' told The Washington Post, such an intruder is likely to be shot down quickly over water before it enters the United States because shooting down the plane over a populated area would create ``significant risks to large numbers of innocent bystanders.'' Like the aviation incident, the United States is two-faced on health care, too. Why did I fly more than $1 million in medical donations to Cuba? -Caveat Lector- Brothers plane shoot-down a Castro trap? http://www.miami.com/herald/content/news/local/dade/digdocs/074817.htm BY ALFONSO CHARDY [EMAIL PROTECTED] Five years after the downing of two Brothers to the Rescue planes by a Cuban MiG, evidence is emerging in a Miami courtroom suggesting the shoot-down was no crime of opportunity, but part of a carefully plotted trap meant to discredit and destroy the anti-Castro group. Today marks the fifth anniversary of the shoot-down -- a moment that comes just as testimony in the Cuban spy trial begins to underscore the deep suspicions Castro foes in Miami long harbored about Cuban government intentions. Documents submitted by federal prosecutors as evidence, like once-secret computer and radio messages between the alleged spies and their Havana handlers, chronicle efforts by Havana's agents to sabotage Brothers to the Rescue and pave the way for an ambush in which two Brothers pilots and two rafter spotters were killed. CONSPIRACY? In fact, U.S. prosecutors say, evidence points to a conspiracy involving Havana and one of the alleged spies to set up the Brothers pilots. The charge also seems to validate a theory initially floated by Brothers leader Jos Basulto days after the shoot-down that the event was the outcome of a Cuban covert operation to connect Brothers to anti-Castro terrorism. According to Basulto, Cuba had planned to claim that the Brothers planes had been shot down while en route to an airstrike on Cuba. Basulto is a witness in the trial in which five alleged Cuban spies are fighting charges of trying to infiltrate U.S. military installations and Cuban exile organizations including Brothers to the Rescue for the purpose of harming U.S. national security. ``What is clear from the trial is that Brothers to the Rescue were set up and that murder was committed,'' said Joe Garcia, executive director of the Cuban American National Foundation, which also was allegedly targeted by the spy suspects. ``The trial shows an ongoing effort by the Cuban government to create dissension and strife among those who fight for freedom and democracy for Cuba.'' FIGHTING TERROR The accused spies claim they were merely working to protect their homeland from acts of terrorism by the Brothers. One of the defendants, Gerardo Hernndez, is charged with conspiracy to commit murder in the shoot-down. Attorneys for Hernndez and his co-defendants do not dispute that their clients worked for the Cuban government. But they told jurors that the men spied on military installations and infiltrated exile groups to protect Cuba -- not to compromise national security. One of Havana's spies inside Brothers, Juan Pablo Roque, reported to one of his Cuban handlers and the FBI that Basulto had mentioned plans to manufacture a ``secret weapon'' for delivery to island-based anti-Castro foes, according to prosecution evidence. The court document says neither Cuba nor the FBI took the report seriously. Most of the evidence submitted by the prosecution portrays Brothers to the Rescue as a target for the Cuban government. The recently declassified computer and radio messages between the alleged spies and their Havana handlers, for example, detail elaborate efforts to set up Brothers for the shoot-down -- including arrangements for Roque's secret return to Cuba on the eve of the shoot-down. SIMILAR TO THEORY The operation laid out in the messages resembles Basulto's theory that Cuba shot down the Brothers planes to smear the group's reputation. Basulto says Cuba had planned to present Roque, the infiltrated Brothers pilot, as sole shoot-down survivor and have him describe details of the ``terrorist'' mission. The only reason the plot failed, Basulto said, is that he survived the shoot-down by turning off his plane's transponder and flying into a cloud to evade a pursuing MiG. Roque disappeared from Miami on the eve of the Brothers' fateful flight -- reappearing in Havana after the shoot-down and disclosing that he had infiltrated Brothers to the Rescue. Roque is now a fugitive in the spy case. As it unfolds, evidence emerging suggests that Cuba may have dispatched spies to South Florida after concluding that Washington was not taking seriously its demands to crack down on exile ``terrorists'' and incursions into Cuban airspace by Brothers planes. CUBAN FEARS The creation of Brothers to the Rescue in early 1991 and Basulto's role in the group played a major part in Havana's fears. Many exiles who had received paramilitary training in the early 1960s when the CIA financed the ill-fated Bay of Pigs invasion went into action again in the 1990s. Some sponsored raids against the Cuban coast. Others staged attacks at tourist sites. Still others opted for nonviolent protests such as pro-democracy flotillas -- and among organizers of the first flotilla on May 20,1990 was Basulto -- a Bay of Pigs veteran. When pressed on January 19, 2001 by ex-Clinton White House Counsel Jack Quinn to support the Rich pardon, Deputy Attorney General Holder was most accommodating. He told Quinn he was "neutral, leaning towards favorable" on the Rich case. Holder's remark was used by Quinn, and later Bill Clinton, to, in part, justify the president's pardon of Rich. Holder now says that "If I had focused on this in a way that I could have, should have, the recommendation I would have given him would have been, 'Don't do this Mr. President.'" Poor Eric Holder. He's just another wonderful person who got caught up in the Clinton sleaze machine, or at least that's what the Washington Post wants us to believe. The fact is that during his three-year tenure as the second highest-ranking official at the Justice Department, Holder was no innocent bystander. He was one of the Clintons' most loyal, partisan, and aggressive defenders. In his outstanding new book, Absolute Power, David Limbaugh provides a meticulously researched journey through the corruption that was the Clinton-Reno Justice Department. Among other things, he reminds us that just weeks before then-Independent Counsel Kenneth Starr forwarded his impeachment referral to the House of He was one of the Clintons' most loyal, partisan, and aggressive defenders. Representatives, it was Holder who pushed for a politically motivated criminal investigation of Starr, philanthropist Richard Mellon Scaife, and The American Spectator magazine. Of course, the probe turned up no wrongdoing, but that wasn't its purpose. The objective was to undermine Starr's credibility during this key period with allegations of prosecutorial misconduct. Holder also intended to besmirch Scaife's reputation and intimidate the investigative reporters at The American Spectator. Holder was also one of the top architects of the frivolous and now discredited Secret Service protective function privilege claim, which was asserted to undermine and delay Starr's investigation. Limbaugh reports that Holder admitted to one of Starr's deputies that Justice had no more than a 5 percent chance of prevailing on this claim. Holder's failure to object to Clinton's pardon of Marc Rich is simply the latest in a long list of disgraceful actions he took on behalf of Bill Clinton, to the detriment of the rule of law. According to an Associated Press report: A federal appeals court rejected Tucker's contention that a juror was biased in the 1996 trial in which he was convicted along with former President Bill Clinton's Whitewater business partners James and Susan McDougal. Because Tucker completed serving the sentence of 18 months under house arrest, his appeal was an attempt to get a court to clear his name. Tucker charged that juror Renee Johnson was biased, due to her marriage to Charles Hayes a week into the trial. As governor, Tucker had denied clemency for a 40-year drug conviction to Hayes, whose uncle had distributed crude political fliers ridiculing Tucker. The juror failed to list her new husband on a juror questionnaire that asked about criminal cases involving family members. National Review Online March 1, 2001 6:05 p.m. By Byron York Former deputy White House counsel Cheryl Mills, who played a prominent role in President Clinton's impeachment defense and now serves as a trustee for the Clinton library foundation, took part in an Oval Office discussion with the president about the Marc Rich pardon the night Clinton made his last-minute decision to grant clemency to Rich, according to testimony and documents made public today by the House Government Reform Committee. Mills left White House employment in the fall of 1999. Several witnesses at today's hearing former White House chief of staff John Podesta, former White House counsel Beth Nolan, and former top Clinton adviser Bruce Lindsey testified that Mills was often at the White House in the year and a half after she left to become a senior vice president at Oxygen Media, a television and internet firm devoted to women's programming. "She continued to be a trusted adviser to the president," Nolan told the committee. Nolan said that in the last weeks of the administration, Mills was at the White House frequently for end-of-term parties and other events. On the chaotic evening of January 19, Clinton called several advisers to the Oval Office to discuss his plans to pardon a number of people who had been convicted or pled guilty in the Whitewater, Mike Espy, and Henry Cisneros independent counsel investigations. "I invited Ms. Mills to join that conversation," said Bruce Lindsey, former close adviser to the president, citing Mills' expertise on independent counsel issues. Lindsey testified that at the meeting, Clinton raised the Rich pardon issue and that Mills took part in that discussion, too. "I do not believe she took a position on it," Lindsey said, referring to the Rich case. But it appears that Mills' involvement was greater than simply participating in one meeting. Republicans on the committee also revealed that Roger Adams, the pardons attorney in the Justice Department, has told the committee he called the White House to discuss the Rich matter and ended up discussing it with Mills, who spoke authoritatively on the matter. Adams was apparently somewhat bewildered that a former White House employee would be involved in pardon discussions. In addition, the committee released a January 5, 2001 e-mail from Robert Fink, a lawyer for Marc Rich in New York, to two other members of the Rich team. "Here is the letter Jack [former White House counsel Jack Quinn] just sent to the White House," Fink wrote. "As you may notice his secretary said that Jack sent copies to Beth Nolan, Bruce Lindsey and Cheryl Mills. April said they have clearance to deliver it to the WH [White House], so it will get there this evening, presumably before POTUS leaves for Camp David." Quinn told the committee that he brought Mills into the case in an effort to help convince Clinton to pardon Rich. Earlier in the hearing, former Democratic National Committee finance chair Beth Dozoretz appeared briefly before the committee. Connecticut Republican Christopher Shays read to her from a January 10, 2001 e-mail from an associate of Rich's to Quinn. "DR [Rich's former wife Denise] called from Aspen," the e-mail began. "Her friend B [Dozoretz] who is with her got a call today from potus who said he was impressed by JQ's [Quinn's] last letter and that he wants to do it and is doing all possible to turn around the WH counsels." Shays asked Dozoretz why she discussed the Rich case with the president. "Upon the advice of my counsel, I respectfully decline to answer that question," Dozoretz said, citing her Fifth Amendment right against self-incrimination. Shays asked whether she would refuse to answer all questions on those grounds. She said yes. Georgia Republican Bob Barr asked Dozoretz whether she would at least tell the committee whether she intends to cooperate with the criminal investigation being conducted by federal prosecutors in New York. She declined to answer that, too. On another topic, the committee released information casting doubt on one of Quinn's main arguments in favor of the Rich pardon. On February 8, Quinn testified that he was frustrated at the "intransigence" of federal prosecutors in New York who, Quinn said, were unwilling to discuss the case with Rich. Quinn also testified that the prosecutors' use of RICO, the racketeering statute, was the "sledgehammer" that resulted in Rich's decision not to return to the United States to face charges. Now it appears that prosecutors were not as inflexible as Quinn contended. In his opening statement, committee chairman Dan Burton announced that in 1999 the government offered to drop the RICO charges against Rich if he would return to the U.S. to face trial. But it said it would retaliate if forced to do so. "If the international community does not join Macedonia in overcoming violence, a division of the Balkans on religious grounds will be provoked due to Macedonia's geo-strategic position, which will seriously affect Europe," Defense Minister Ljuben Paunovski told Reuters in an interview. He was echoing international concerns of a looming new Balkan crisis, given that ethnic Albanians comprise a third of Macedonia's two million population and have had sometimes tense relations with the majority Slavs. A two-hour gunbattle between Macedonian security forces and what Skopje describes as ethnic Albanian "terrorists" at the Macedonian village of Tanusevci on the border with Kosovo two days ago prompted President Boris Trajkovski to seek support from the United Nations and NATO for a crackdown. "The armed group is using the village as a base and our security forces can take them out very quickly. But first we have to use all political and diplomatic means to solve the situation," Paunovski said as reports of new shootings came in. A NATO delegation arrived in Macedonia on Wednesday and went straight into crisis talks with Macedonian officials. NO PLAN TO ENTER KOSOVO Paunovski said Macedonia's plan of action did not include crossing the border into Kosovo. "If there is action, we will go only to the border, we must stop there. But any action will be coordinated with KFOR (NATO-led peace force in Kosovo)," Paunovski said. He said Macedonian forces had shown extreme restraint an effort to prevent an outbreak of a local inter-ethnic conflict. "If they have occupied a village in Macedonia, it's obvious that their political goals are to take that territory. We can not exclude the possibility that they might find support in some circles in Macedonia," he said Paunovski said the armed group of ethnic-Albanians had support from the other side of the border and were connected with other armed groups in Kosovo, some of which he said were involved in contraband and crime. Skopje signed a long-delayed border demarcation agreement with Belgrade last week, which officials said would curb a flourishing smuggling businesses in the area in the long term. Paunovski welcomed statements from ethnic Albanian political parties in Macedonia and Kosovo expressing support for a diplomatic solution to the crisis. He strongly rejected reports of harassment of villagers by Macedonian forces and accused the ethnic Albanian fighters of driving the villagers away to escalate violence. Macedonian Prime Minister Ljubco Georgievski said earlier he had received unconfirmed reports that Albanian guerrillas were holding residents of Tanusevci as hostages to prevent the Macedonian forces from taking control of the village. Paunovski said the reports were hard to corroborate since the army and police had not set foot in the village for a week. "We cannot go there to check, because any attempt to check the village for civilians will mean armed conflict with the terrorists. That is the biggest dilemma," he said. Quoting government and industry sources, the Post said seed companies detected the contamination while testing their stocks to make sure the seed was free of the engineered corn, known as StarLink, approved in the U.S. only for animal feed. StarLink is not approved for human consumption because of concerns about potential allergic reactions. It was found in taco shells in September, leading to an eventual recall of more than 300 food products. The Post said the newly discovered contamination does not pose any immediate public health threat because none of the seed has been planted. But if the contamination is found to be widespread, farmers and grain exporters fear it could be devastating because major buyers of American corn in Europe and Asia have said they will refuse to buy any corn suspected of being tainted by StarLink, the Post said. Representatives of the seed industry and other corn and food industry officials were scheduled to meet Thursday with officials from the three federal agencies that oversee agricultural biotechnology, the Post reported. ``There may be low levels of the StarLink protein in some non-StarLink hybrid corn seed,'' an Agriculture Department official told the Post. Those attending Thursday's meeting will ''look into the issue and further evaluate what steps may be necessary to address it,'' the newspaper said. Industry sources told the Post that it was unclear how the seed corn came to contain the StarLink protein, called Cry9c. The sources were also quoted as saying the level of Cry9c being found in corn seed is very low. StarLink's developer, Aventis CropScience, a unit of Franco-German life science firm Aventis SA, maintains the corn is safe for human consumption. The Federal Bureau of Investigation (FBI), for example, said its technology-based case load has nearly tripled over the past three years. In October 1997, it had around 453 pending investigations into such areas as computer intrusions and viruses. It now has more than 1,200 such cases, which do not even include other internet-related crimes, including fraud or child pornography. The spectre of digital crime has also got the UK government worried enough to dedicate pounds 25m over three years to establish a new National Hi-Tech Crime Unit, which will be launched in April. The unit, which is currently looking for a chief superintendent to head a team of 40 dedicated "cybercops", will investigate internet crime, including the highest profile offences: credit card fraud, paedophile rackets and hacking. Credit card fraud receives almost as much media scrutiny as the seedy world of internet pornography. According to the Association of Payment Clearing Services (APACS), "card not present fraud"- which includes internet purchases as well and phone and mail order - amounted to pounds 47.2m in the first 11 months of last year, an increase of 80pc on the previous year. It is estimated that 15pc of "card not present fraud" is conducted over the Net. Hacking, the term widely used for illegally breaking into a computer system, also appears to be growing sharply. Last year, the US computer giant Microsoft called in the FBI to investigate a hacker who had penetrated its computer systems and accessed top secret information on its software. JANET-CERT, a report into malicious attacks on computer systems in academic institutions, said there were 944 reported attacks last month, compared with 206 in January 2000. If academic institutions don't seem like an obvious target for high-tech criminals, financial institutions do. Predictably, there have been only a few reported cases of criminals hacking into banks' computers as the banks only like to talk about security to explain how safe their systems are. But the secure image that the financial industry likes to cultivate is not the full picture. In 1994, hackers penetrated Citibank's computers and extracted around $10m ( pounds 6.7m). The bank claimed that the size of the withdrawal was because it allowed a series of hacks to co-operate with law enforcement authorities. Citibank, however, still admits to losing $400,000. Michael Vatis, director of the FBI's National Infrastructure Protection Centre, says: "Banks often have relatively good security, but even they are not immune from attack. We have seen intrusions into banks in the US and abroad which are still under investigation." Other banks have proved to be as impregnable as a wendy house, even to the point that criminals can literally walk in off the street and remove their computer systems. Since last autumn, police have been chasing a gang of thieves who hit a number of top City investment banks, including one bank that was targeted more than once, as well as other businesses around the UK and mainland Europe. Americans bear the highest peacetime tax burden in history. In the face of a possible economic slowdown, Uncle Sam continues to grossly overcharge taxpayers." If that is the case, then why does Senate Minority Leader Tom Daschle, D-S.D., say "the rich would be able to buy a Lexus, while the poor could purchase only a muffler for a used car" if a Bush tax cut passes? It really seems that the super-rich like Bill Gates and Warren Buffett and certain members of Congress believe anyone making over 75 grand a year should be paying taxes out the nose. If they have an estate worth more than $650,000, that should be taken from them at a better than 80 percent rate of confiscation. The ghoulish death tax is one of the most unfair taxes of all. The income of the semi-rich or even the barely rich has already been taxed several times over. The death tax is the finger in the eye of those who have worked hard, invested, and want to pass on a little of their hard work to their heirs or to keep the companies they have built afloat. What is behind the rhetoric of Tom Daschle, the super-rich, the foundations and the leftist media? Do they really believe that Bush's tax cut and abolishing the death tax would somehow be unfair to the "poor" or working middle class? Or does it go deeper than that? Is the tax debate really, in fact, a power struggle which in the end will only benefit the continued growth of government and the financial health and interests of a relatively few super-rich foundations and individuals. It should be obvious to Americans that there is more to wealth creation than a healthy stock portfolio. The creation of capital goods and investment in land or real property or the creation of real property is also wealth creation. The 401K does not just depend on someone signing up with Ameritrade, it also depends on people making real stuff to sell to other real people. Paper wealth is not worth the paper it is printed on if there is no real wealth in kind behind it. Coca-Cola stock is not what the 'real' wealth is. Rather, it is the product, the plant and those who create and build it that is more important to economic good health than a stock market over 10,000. You can manipulate or create more greenbacks, gold, stock, or other forms of wealth. However, it is pretty hard to manipulate the long-term buying and selling of real goods in a free market. Supply and demand still work, although politicians and government want to central-plan it to death and turn those concepts on their head. When Nixon put in place price controls in the '70s it did nothing but skew the economy and put off the inevitable while it made a few people "feel" good. Californians are finding out what happens when you manipulate energ y markets, where real deregulation never took place and now ordinary people are paying the cost of environmental or corporate policy which messed with the free market and destroyed commonsense environmentalism by regulati ng it and litigating it to death. In the real world of the here and now, the up-and-coming Coca-Colas, the new businessmen and businesswomen, the small entrepreneur is being taxed and regulated to death. With central planning emanating from D.C., the pote ntial millionaire or billionaire finds his own tax money used against him, tax money he might otherwise be reinvesting. The small businessmen are boxed in by a tax and regulatory system that is funded by the taxpayer. It is a system heralded as economic "justice" by professional politicians, the super-rich and their foundations. But there is no justice in that notion. Ensconced in their tax-free foundations, members of the super-rich oligarchy have no problem saying that "fairness" is taking to the cleaners the top 1 percent of taxpayers, who are paying about one-third of all income ta xes. Nor does it bother them that the top 5 percent pay more than half and the top 10 percent pay nearly two-thirds. The top 25 percent pay more than $4 of every $5 that goes to the taxman but who cares. The oligarchs a re so rich and have so much influence and hide their money so well, they can afford to beat up on the merely semi-wealthy. Add that to the power that Alan Greenspan has wielded over the economy in recent years and this continuation of top-down economic feudalism continues apace. It becomes more apparent that too much power is in too few hands . It is not in the hands of the small- to medium-sized businessman or even subject to the cleansing effects of the free market. But it is a function, as often as not, of monolithic government and multinational corporatism , which we could call fascism OR federal feudalism. The free market or individual

March 1, 2001 To: Ms. Haruko Fukuda Chief Executive Officer World Gold Council 45 Pall Mall London SW1Y 5JG United Kingdom Dear Ms. Fukuda: Last Friday there was an article in The Wall Street Journal by Neil Behrmann titled, "World Gold Council Hopes to End Gold Price's 20-Year Bear Market." The article mentions Reginald Howe's complaint filed in U.S. District Court in Boston and the Gold Anti-Trust Action Committee, stating, "The complaint 'for damages and injunctive relief' alleges manipulative activities in the gold market by central banks and bullion banks to depress the gold price from 1994 to the present." It goes on to say the World Gold Council is distancing themselves from the allegations: "'We've thoroughly researched the allegations and don't find any evidence of manipulation in both the gold and gold derivatives markets,' said Ms. Leyland and Mr. Cruikshanks of the council." On behalf of GATA, I recently toured South Africa, visiting Johannesburg, Cape Town, Durban, and Pretoria. I met with the president of the National Union of Mineworkers; the South African minister of minerals and energy and her staff; the king of the Zulus, Goodwin Zwelithini; the South African Chamber of Commerce; business leaders; 11 senior gold analysts; political officials; gold producer executives; and officials of the Reserve Bank of South Africa. All were impressed by the evidence GATA presented about manipulation of the gold price. All seemed curious to know more, because, if GATA's allegations are verified, the gold price will soar and the economy of South Africa will benefit from the return to work of more than 100,000 miners. In turn, money will be freed to combat the terrible crime and epidemic disease afflicting South Africa. GATA and its supporters have worked hard for more than two years to expose the truth about the gold market. That is what will come out when Howe is allowed to ask questions under oath of the defendants in our lawsuit during the pre-trial discovery process. Support that the Howe/GATA complaint should be heard is growing around the world. Unfortunately, disturbing comments from the World Gold Council, such as the one above, retard the truth-seeking process. Since you have done so much research about our claims and can find no evidence for them, would you please publish your findings, in fairness to the many who are harmed by your comments? While there are those in the gold world who do not agree with us, they never specify what they dispute in the massive body of evidence we have documented. If The Wall Street Journal article was in error about the World Gold Council's position on GATA, we and the council deserve a correction. After all, it is in the interest of your members' shareholders that GATA has toiled these past two years. Thank you for your consideration.
