KAMPALA, UGANDA - Osama bin Laden, the world's most wanted
terrorist, is buying child slaves from Ugandan rebels and using them
as forced labour on marijuana farms in Sudan to fund his
international terrorism network.

New evidence indicates that bin Laden, who masterminded the
bombings of the American embassies in Kenya and Tanzania last
August, has made Sudan the centre of his global empire.

Sudan, whose Islamic government has close links with bin Laden, is
the long-standing patron of the Lord's Resistance Army rebels who
have abducted at least 8,000 children from northern Uganda since
1994 and forced them to serve as soldiers or sexual playthings.
Others have been sold into slavery in Sudan in exchange for guns
and ammunition.

Brig Katumba Wamala, commander of the Ugandan forces fighting
the rebels, said: We know that large numbers of children abducted
by the LRA are being sold into slavery in Sudan.

Many are bought by bin Laden, via Arab slave traders. Bin Laden is
the main buyer of these children. He has very big marijuana farms
in Sudan and he buys the children as slave labourers, said Brig
Wamala.

Evidence comes from children who have escaped the slave
dealers. We have the testimony of abducted children and we also
have intercepted radio conversations, said Brig Wamala.

Radio intercepts show that bin Laden pays one Kalashnikov assault
rifle for every child he buys. Joseph Kony, the LRA leader, is in
desperate need of weapons and has recently complained of being
cheated.

It is on the record that Kony was complaining about the exchange
rate. Once the Arabs gave him 98 guns for the 100 children he had
given them. He complained very bitterly. It is a very lucrative
business, said Brig Wamala. Ugandan intelligence sources have
tracked the fate of children sold into the Sudanese slave trade. After
being abducted, they are forced to march to Jabelin, the LRA's
headquarters 34 miles south of Juba, the main city in southern
Sudan.

Here a selection is made on the basis of physical appearance,
said the  source. The girls and some of the boys are taken away for
what is called special training. They are sold into slavery, while the
rest are used as soldiers.

Many of the girls are taken to Nsitu camp, 15 miles south of Juba,
from where they are distributed to Arab slave dealers. Once sold,
the children are taken to Juba airport and flown to other regions of
Sudan. Both of these camps are supplied by the Sudanese
government.

According to a source who visited them in July 1997, Nsitu is less
than 200 yards from a Sudanese army base. Within the perimeter of
Jabelin camp, Sudanese government troops are housed alongside
LRA rebels.

Ugandan intelligence has monitored the close links between bin
Laden and the Sudanese government. After being expelled from
Saudi Arabia, bin Laden lived in Sudan from 1994 until 1996, said
an intelligence source. He has a wide range of business interests
there, covering farms, banks, factories and infrastructure. These are
used to fund terrorism in Africa and elsewhere.

The marijuana farms worked by bin Laden's child slaves are located
in the  Nile Valley, north of Khartoum. In the same area, he has
several large sunflower plantations, where slave labour may also be
used.

Ugandan intelligence believes that bin Laden has invested pounds
30 million in front organisations for his terror network.

He has also helped to finance major infrastructure projects in
Sudan.

Uganda believes that bin Laden's web of terror is aimed at toppling
African governments, as well as striking at British and American
interests worldwide.

Sudan has offered itself as a training ground for terrorists. We
know of 17 terrorist training camps and the target is to install Islamic
fundamentalist governments in east and central Africa by 2002,
said the source. That is why bin Laden is helping them to sponsor
rebels and kidnap and enslave our children.

  deed?  Six months in federal prison and an undisclosed
  fine.  Is this a harbinger of things yet to come?
  Unfortunately I believe so.

  As for being released, yes I too would be definitely
  overjoyed at the prospect of my release from this
  oppressive cement box.  But I am afraid that is not going
  to happen if it means compromising my position to fight
  against the scurrilous rot that plagues this country.

  It would have been so very easy just to have copped a
  plea at the outset of this tribulation, thereby affecting
  my release over a year ago.  But I just could not bring
  myself to do so, for there is so much more involved in
  this battle than the mere question of my innocence or
  guilt.

  I know there are a lot of sheeple, patriots and others
  who think that I am crazy, or suffer some inordinate
  desire to be a martyr, but nothing could be further from
  the truth.  The truth is, put simply, I abhor the twisted
  mindset of the sons of dogs whose sick insatiable quest
  for wealth and power methodically destroys the hopes,
  dreams and thereby, lives of countless innocent victims,
  through their stealthy cunning theft of our God given
  rights to freedom and liberty.

  I, like many others before and after, took an oath to
  serve and defend the Constitution of this country against
  all enemies, foreign or domestic, which I considered to
  be a great honor as well as my duty.  I know also that
  many others felt the same way and even died in
  fulfillment of that oath.  Knowing that oath to be good
  for life, I nevertheless reiterated it seven years ago,
  adding to it a vow to do all within my power to stop
  those who's aspirations are to destroy our Constitution,
  thereby enslaving and oppressing the good people of this
  nation, dead in their tracks.

  This fact now leads me to my most current dilemma of know
  many good people within the patriot movement seem to be
  so oblivious to the extreme importance of this case, and
  all the ramifications it entails.  Not only is this case
  proof positive of just how arrogant and corrupt the
  federal government along with it's judicial branch have
  become, but it is a tailor-made opportunity for all
  professed patriotic individuals to publicly get in their
  face and expose the very powers that seek to destroy the
  foundation of our freedom and liberty; Our Constitution
  and Bill of Rights.

  The numerous blatant vicious and heinous anti-
  Constitutional machinations of these globalist tyrants
  are all too apparent when confronted by the detailed
  evidence of their bogus charge, i.e. overall conspiracy
  to defend the United States against UN foreign invasion),
  and actions, the illegal search of my home without a
  warrant, my kidnapping and subsequent initial faux-trial,
  where they shamelessly used perjured testimony to indict,
  tampering with evidence, the knowing use of perjured
  testimony on the stand, on and on add nauseum.

  The next trial will serve to dramatically heighten the
  public awareness to just now far these traitors will go
  to silence those who are insolent enough to expose their
  evil aspirations.  Our power to do so will be in direct
  proportion to those who are also willing to become
  embroiled in this battle.

  Therefor I am earnestly, and most humbly, asking for any
  help that can be mustered for this upcoming battle on
  November 27th.  Please!  And remember, we are also
  dealing with a newly elected administration, which gives
  us a new chance to gain Constitutional ground and show
  them who the real boss in this country is.

 In case you missed this point last night, search the debate transcript
 for "constitution", and you'll find:

 Bush - "I believe
that the judges ought not to take the place of the
legislative branch of government, that they're
appointed for life and that they ought to look at
the Constitution as sacred."

 Gore - "And, in my view, the Constitution ought to be
interpreted as a document that grows with our
country and our history."


 IOW: Bush intends to uphold the Constitution, Gore intends to change
 it. My opinion? It's a no- brainer. "The Constitution wasn't perfect,
 but it's better than what we have now..." and if we hang onto it for
 four or eight more years that at least buys us some time to try to
 turn our country around.

Over the years, Gross had helped draft such Big Government
legislation as the full-employment bills of 1944 and 1945, and the
Employment Act of 1946.

"I sought solutions for America's ills ... through more power in the
hands of central government," Gross admits. "In this I was not
alone.  Almost all my fellow planners, reformers, social scientists,
and urbanists presumed the benevolence of more concentrated
government power."

But they were wrong. Gross realized that centralized power was, in
fact, the linchpin of tyranny. "Big Business-Big Government
partnerships ...," he wrote, "were the central facts behind the power
structures of old fascism in the days of Mussolini, Hitler and the
Japanese empire builders. ... I see Big Business and Big
Government as a joint danger."

If only the Clinton cheerleaders were capable of such introspection.
Gross died in 1997. But his spirit lives on, a fading spark of
leftwing conscience, unsung and unheeded in the mad rush to the
Third Way.

Alberto Sepulveda is no Elian Gonzalez. When 11-year-old
Sepulveda was shot and killed last week by a SWAT team member
during an early morning drug raid on his parents' Modesto home,
the story barely made the papers. Yet, as did the Immigration and
Naturalization Service raid on the Gonzalez home in Miami in May,
the killing of Alberto Sepulveda highlights a troubling trend in law
enforcement: stealth raids on the homes of sleeping citizens by
heavily armed government agents.

Such raids are the hallmark of police states, not free societies, but
as a growing number of Americans can attest, the experiences of
these two boys are by no means isolated incidents.

Just ask the widow of Mario Paz. She was asleep with her
husband in their Compton home at 11 p.m. in August 1999 when
20 members of the local SWAT team shot the locks off the front
and back doors and stormed inside. Moments later, Mario Paz was
dead, shot twice in the back, and his wife was outside, half-naked
in handcuffs. The SWAT team had a warrant to search a neighbor's
house for drugs, but Mario Paz was not listed on it. No drugs were
found, and no member of the family was charged with any crime.

And then there is Denver resident Ismael Mena, a 45-year-old
father of nine, killed last September in his bedroom by SWAT team
members who stormed the wrong house.

Or Ramon Gallardo of Dinuba, Calif., shot 15 times in 1997 by a
SWAT team with a warrant for his son.

Or the Rev. Accelyne Williams of Boston, 75, who died of a heart
attack in 1994 after a Boston SWAT team executing a drug warrant
burst into the wrong apartment.

SWAT teams, now numbering an estimated 30,000 nationwide,
were originally intended for use in emergency situations, hostage-
takings, bomb threats and the like. Trained for combat, their
arsenals (often provided cut rate or free of charge by the Pentagon)
resemble those of small armies: automatic weapons, armored
personnel carriers and even grenade launchers.

Today, however, SWAT units are most commonly used to execute
drug warrants, frequently of the "no-knock" variety, which are
issued by judges and magistrates when there is reason to suspect
that the 4th Amendment's "knock and announce" requirement,
already perfunctorily applied, would be dangerous or futile, or would
give residents time to destroy incriminating evidence.

California is one of few states that does not allow no-knock
warrants.  But the fate of Alberto Sepulveda--who was shot dead an
estimated 60 seconds after the SWAT team "knocked and
announced"--suggests the problem is not the type of warrant
issued but the use of military tactics.

The state's interest in protecting evidence of drug crimes from
destruction, or even in preventing the escape of suspected drug
felons, does not justify the threat to individual safety, security and
peace of mind that the use of these tactics represents. On this, the
now-famous image of a terrified Elian facing an armed INS agent
speaks volumes. Even when no shot is fired, these raids leave in
their wake families traumatized by memories of an armed invasion
by government agents.

Police officers, too, are shot in these raids, barging unannounced
into homes where weapons are kept. These shootings may appear
to confirm the dangerousness of the criminals being pursued, until
one realizes that they are committed when people are caught by
surprise by intruders in their own homes and not unreasonably, if
unfortunately, grab a weapon to defend themselves. (Suspects also
die in these shootouts. Troy Davis, 25, was shot point blank in the
chest by Texas police who broke down his door during a no-knock
raid in December 1999 and found him with a gun in his hand.
Police had been pursuing a tip that Davis and his mother were
growing marijuana. His gun was legal.)

Using paramilitary units to enforce drug warrants is the inevitable
result of the government's tendency to see itself as fighting a "war
on drugs." This rhetoric makes it easy to forget that the targets in
these raids are not the enemy but fellow citizens, and that the laws
being enforced are supposed to ensure a safe, peaceful, well-
ordered society. If lawmakers in Washington and Sacramento are
genuinely committed to defending the right of the American people
to be safe and secure in their own homes, they would demand an
accounting for the thousands of drug raids executed by SWAT
teams every year all over the country, raids that get little media
attention but nonetheless leave their targets traumatized and
violated. Assuming, that is, that they leave them alive.

It is apparent that Green Party nominee Ralph Nader and Reform
Party nominee Patrick J. Buchanan are not going to be allowed to
appear in the three nationally televised presidential debates, but
that doesn't mean their views will be shut out completely. Voters
can check them out on the Web.

The video-on-demand Internet site FreedomChannel.com has
invited Nader and Buchanan, as well as Natural Law Party nominee
John Hagelin, Libertarian nominee Harry Browne and Constitution
Party nominee Howard Phillips, to submit videotaped answers to all
the questions posed to the major party nominees. The answers will
be posted within 24 to 48 hours of the live debates and will appear
directly alongside Republican George W. Bush's and Democrat Al
Gore's answers on FreedomChannel.com as well as on several
popular news Web sites that syndicate FreedomChannel's content.

Phillips and Browne have agreed to participate and negotiations are
under way with the others.

the sorries and excuses in the world will not bring him back."

Outside the funeral home Monday, Sepulveda held his shaking wife,
Sonia.

"They took a part of my heart, a part of my life away," Sepulveda
said. "He was the happiest child, and they came in and stole his
life."

The family, he said, will return to live in their home on McAdoo
Avenue.

"Everything will stay the same. His room will stay the same,"
Sepulveda said. "My son was happy and we were happy in that
house. ... When we go back he will be there with us."

Sepulveda has refused to answer any questions about the criminal
case against him. On the morning his son died, Sepulveda was
arrested on a federal warrant charging him with conspiracy to
distribute methamphetamine. He was released two days later after
promising to use equity in his home to a secure a $20,000 bail
bond by the end of the month.

Sepulveda has lived in Stanislaus County for 15 years, five of them
in the Highway Village home. He has no felony convictions in
Stanislaus County. City officials said Monday that no drugs or
weapons were found in the house. Cash was found.

Federal drug agents requested the use of SWAT teams to secure
the Sepulveda residence and 13 other locations in coordinated
predawn raids aimed at cracking a major methamphetamine
distribution network.

[CTRL] Violence Against Gun Rights Supporters

At about 10:05 pm today, I appeared on 9 News to discuss a legal challenge in which I'm involved against the gun show (background check) initiative. I had recorded the interview earlier in the day. Apparently, my peaceable, lawful action is too much for some supporters of the S.A.F.E. initiative to bear. The anti-gun lobby group Sane Alternatives to the Firearms Epidemic, the name of which likens gun ownership to a disease, is the sponsor of the initiative which seeks to expand background registrations to private sales at gun shows.
At about 10:07 pm today, I received an anonymous, threatening phone call. When I answered the phone, a male voice said, "Hey Nazi back off," then hung up.
The invective is particularly offensive since I'm a civil libertarian opposed to fascism in all its forms. The term "Nazi" is short for "National Socialism," the German form of fascist socialism led by Adolf Hitler in mid-century. The Nazis were racists as well as fascists and murdered millions of innocent Jews and other persons. Recently, I published an {HYPERLINK "http://www.co-freedom.com/2000/08/neveragain.html"} by Bob Glass about the horrors of the Nazi holocaust which stole the lives of Glass' family members. Leon Uris records many of the Nazi atrocities in his novel Mila 18, in which a brave group of Jews take up arms in a desperate fight against the Nazis. (My first name is taken from another of Uris' novels.)
The invective is ironic since the gun show initiative itself could be considered a fascist proposal. The Austrian economists define fascism as type of socialism in which the state controls nominally private property. The gun show initiative seeks to put private property -- in this case firearms -- under the direct control of state and federal authorities. Thus, it is a step toward fascism, and that is precisely why I oppose it.
Because of incomplete and inaccurate records, background registration checks usually deny lawful citizens their rights to purchase a firearm for self-defense. This violates the civil rights of property ownership, self-defense, and due process.
So what did I say that resulted in a gun opponent threatening me? Adam Schrager of 9 News did his usual excellent job of putting together a fair, well-researched piece. In addition to selecting opposing comments by a S.A.F.E. lawyer, he and the 9 News team used three of my quotes on air:
The anti-gun lobby S.A.F.E. claims they collected 108,000 signatures. But it's easy to collect a lot of signatures if you do it illegally.
We're going to use every means at our disposal to protect individual rights. [The context of this comment was partially lost in the cut; the line was a response to the question of why we're pursuing legal action as well as public education to fight the background registration check initiative.]
If the Supreme Court follows Colorado law then we have a good chance of succeeding on this level.
Directly after those lines aired, my phone rang. Unfortunately, that's not the first time I've been threatened by an opponent of gun ownership. (Of course I assume the S.A.F.E. leadership condemns such threats. We can't know if the anonymous caller is a member of the group or simply supports its initiative.) On {HYPERLINK "http://www.co-freedom.com/2000/05/unsafe.html"}May 3, one S.A.F.E. member told me, "I ought to bash you over the head."
Recently in Fort Collins, a woman who opposes the right of self- defense struck a member of the Tyranny Response Team with a clip board. At a rally in Boulder earlier this year, Robert Howell, vice president of the anti-gun Boulder Bell Campaign, attacked Shariar Ghalam, bloodying his nose. (Ghalam was carrying a concealed handgun but never drew it, not believing his life was in danger.) This summer, supporters of the anti-gun Million Mom March stole supplies from the Second Amendment Sisters and vandalized SAS property. For people supposedly advocating safety, some gun opponents display a surprising level of violent tendencies.
But "back off" is exactly what I won't be doing. Instead, I will redouble my efforts to defend the civil liberties of every individual, including the minority of gun owners. (Fortunately, I am kept safer by gun ownership in my neighborhood, which deters assaults.)
Freedom is not a loophole. The S.A.F.E. background registration check initiative would empower criminals and violate the civil rights of law-abiding citizens. I will help fight it until it no longer threatens our safety and our liberties.

products such as "Prison Blues" denim jeans, which are made
exclusively in prison workshops. This slave labor has not yet been
vehemently objected to by either organized labor, civil rights
groups or prisoners rights organizations, though a number of exposes
have been done by the radical press. But an effective coalition must be
built before it will stop.

The upshot of all this is that this is slavery, and even though the
13th amendment to the national constitution allegedly outlaws
slavery, ("except for commission of a crime") it is permitted
because these slaves don't belong to a plantation owner, but to the
state. They are just "rented out" to capitalist corporations. It is
also popular because of the anti-crime hysteria, and putting the
prisoners to work is a popular idea. Yet, nobody is seeing the real
picture.

Although we want to end prison slavery entirely, prisoners' rights
activists, civil libertarians and the Black community generally,
 must demand that these prisoners be given the same rights as
workers outside:  that they be covered by OSHA regulations to
ensure a safe workplace, that they be given the same rights to
organize labor unions, and that they not be exploited by their
keepers with their eyes on a fast buck. They should be paid
the same living wage as workers on the outside.
Ultimately the whole question the outright abolition, or at least of
 a moratorium on the building of prisons has to be factored in, but
this will do for now. Some fairness in the current system.

I have never had any CTRL email freeze my mail system, but the one from William Shannon that you mention got stuck in my new mail folder.  I couldn't delete it even with a hard reboot.  I had to figure out which one of the .pmm files referred to it and delete it through Explorer.  This has happened occasionally with mail from other sources as well.  I don't think it's anything other than an electronic hiccup.

Just FYI however, not all statins are equivalent.  Ask if there is
something in your husbands lipid panel that makes Lipitor the best
choice.

The pediatrician's preference for Zithromax most likely was based
on the proven fact that more people will complete a 5 day course of
treatment than a 10 day course.  Many people start to get better,
stop the antibiotic and contribute to the emergence of a resistant
organism.

step, a judicial panel has hired a former U.S. attorney to investigate
why the chief federal judge in Washington specially assigned the
cases of presidential friends to judges appointed by President
Clinton, legal sources said Tuesday.
Joe D. Whitley, a Republican who served in the Reagan and Bush
administrations as a prosecutor in Georgia and Washington, will
conduct the investigation of U.S. District Judge Norma Holloway
Johnson, according to the legal sources, who spoke only on
condition of anonymity.
Whitley will work for the five-judge panel that is overseeing a
misconduct complaint against Johnson to determine why she
bypassed the normal random case assignment system in a half
dozen prosecutions in the fund-raising and Whitewater
investigations.
In each instance, Johnson, a Democratic appointee, sent cases to
judges appointed by Clinton, and in one instance she urged federal
prosecutors to request a specific judge appointed by him.
The cases included those of presidential friends Webster Hubbell,
a Whitewater figure, and Charlie Trie, a key Clinton fund-raiser.
After The Associated Press first disclosed special assignments in the Trie and Hubbell 
cases last year, Johnson wrote a letter saying her decision was not politically 
motivated and simply was designed to shift complex cas
es to judges with open schedules.
She has repeatedly declined requests for additional comment.
The legal sources at the federal courthouse in Washington say the five judges 
overseeing the probe will work with Whitley to complete the investigation swiftly, 
perhaps in a matter of weeks.
Based on the findings of Whitley and the five judges, the panel will make a 
recommendation to the Judicial Council of federal appeals and district judges, who 
must decide whether to discipline Johnson.
The council's decision could be appealed to the Judicial Conference, the policymaking 
body for the U.S. court system.
Legal experts said the hiring of outside counsel to investigate a judge's conduct is 
relatively rare.
"I can't think of any parallel situation in which it became known that an outside 
investigator has been hired," said New York University law professor Stephen Gillers. 
"Usually it's all done internally."
Whitley declined comment through a secretary at the Atlanta law firm where he works.
He served as U.S. attorney in Macon, Ga., from 1981-87, then moved to the Justice 
Department in Washington where in 1989, he became acting associate attorney general, 
the department's No. 3 post. From 1990-93, Whitley ser
ved a second stint as U.S. attorney in Atlanta.
According to courthouse sources, Whitley will interview Johnson and others about why 
she bypassed a computer system that randomly assigns criminal cases. Johnson's 
bypassing of the random system disturbed some of her coll
eagues, and they have since discarded the rarely used court rule that allowed the 
special assignments.
The sources said it was unclear whether a separate matter – closed meetings among 
Clinton-appointed judges at the courthouse – also will be investigated.
Judicial Watch, a conservative legal group, has filed a formal complaint against 
Johnson. The group released a letter from the federal appeals court stating that the 
allegation of secret meetings "remains under advisement
."
Pressure also is mounting from Capitol Hill. Rep. Dan Burton, R-
Ind., has asked Johnson to testify May 17 before his House
Government Reform Committee. That committee still has not been
told whether Johnson will accept the panel's invitation.
Johnson, an appointee of President Carter, assigned the tax
evasion case against Hubbell and the fund-raising prosecution of
Trie to judges recently appointed by Clinton.
She also assigned four other fund-raising cases to Clinton judges,
including that of Howard Glicken, a former fund-raiser for Vice
President Al Gore. Glicken was sentenced to community service.
In that case, Clinton confidant Vernon Jordan wrote the judge
pleading for leniency.
Initially, the complaint against Johnson for the Trie and Hubbell
cases was dismissed by a federal appeals judge. But when Rep.
Howard Coble, R-N.C., disclosed the additional cases, the Judicial
Council named the five-judge panel to take a closer look.

big study they ballyhooed, called the M.T.A. study. The N.I.M.H. spent
multi-millions of dollars on it, and they’re going to do the same
thing now with little kids. And despite the millions spent, the
N.I.M.H. study wasn’t even conducted according to accepted scientific
procedures and is basically worthless.

Savage: Doctor, this reminds me of the sad state of experiments done
on little children by Kinsey. Kinsey, as you well know, was a complete
whacko. Most of his studies have been shown to be false.

Breggin: Yes, I know. He was sexually abusing those children and had
sex

abusers working for him to stimulate the babies.

Savage: He was a nut case who was using children as sex objects and
then

writing books about it to make it look legitimate. Yet his work is

quoted today as if it’s the gospel. The same mentality now prevails in

to save our children by abusing them with drugs.

Tell us, Doctor, what can we do to protect active children. I
guarantee it; if I were a child today, they’d put me in a chemical
straightjacket. What could my mother do if they told her, " Your son
has A.D.D. according to our test, and we’re going to prescribe
medication for him"?

Breggin: I think the first thing parents need to start doing is
absolutely
refuse to cooperate with any psychological evaluation of children in
school. Schools should not be mental hospitals. Parents should say
that the only

tests they want their children to have are those respecting their
academic subjects and nothing else.

Savage: That’s interesting. You’ve basically implied that they’ve
turned our schools into something other than schools. What do you
think the government has in mind by turning our schools into little
clinics?

Breggin: It’s going to get even worse if Hillary follows her plan that
I

describe in Reclaiming Our Children. But even now in many, many
schools the nurses are giving out more drugs than were given out in
children’s mental hospitals when I was in training. You can go into a
school today and find that ten or twenty percent of the boys are on
drugs given by the school nurse. I just recently visited a school
where over half of the children were being given drugs.

The teachers are given something called the Connor’s Scale for the
students. Connors for decades has been trying to find ways to
control
kids with drugs. He goes right back to the sixties.. His scale is
basically a psychiatric

rating which is used to diagnose A.D.D. and A.D.H.D. Teachers
use this
scale in the classroom. They give the results to the school
psychologist, and then the parents are called in to face a team of
five people telling them that their child has A.D.H.D.

As I said, parents must refuse to cooperate with any psychological
evaluation of their children in school.

Savage: It’s a war to control our children. State control through
drugs,

just
as practiced in the Soviet Union. With Hillary and Tipper leading the

WASHINGTON (AP) - A federal judge ruled today that President
Clinton
``committed a criminal violation of the Privacy Act'' by releasing
private letters to cast doubt on the credibility of a woman who
accused him of making a sexual advance in the White House.

U.S. District Judge Royce C. Lamberth ordered White House
lawyers to
answer questions they previously refused in a lawsuit brought by
the
conservative legal group Judicial Watch, which has filed numerous
suits against the Clinton administration.

``This court finds that the plaintiffs have presented facts that
establish a criminal violation of the Privacy Act,'' Lamberth ruled.

Such a violation is a misdemeanor.

The judge, a Republican appointee, added that evidence in the case
``established that the president had the requisite intent for
committing a criminal violation of the Privacy Act'' when he
authorized the release of the letters in the midst of the 1998
criminal investigation that led to his impeachment and acquittal.

The White House released Kathleen Willey's letters the morning
after a
1998 TV appearance in which she alleged the president made an
unwanted
sexual advance next to the Oval Office in 1993.

Presidential aides used the letters to cast doubt on Willey's
allegations, saying the letters showed she remained friendly with
Clinton after the alleged incident. Clinton has denied any
wrongdoing.

The White House and the Justice Department were reviewing the
ruling
today and had no immediate comment.

Lawrence Barcella, a veteran Washington lawyer, questioned
whether a
violation occurred.

``I'd be shocked if then-White House counsel) Chuck Ruff hadn't
done a
complete legal analysis of this issue before the letters were
released,'' said Barcella. ``And in Clinton's case, he appears to be
relying on the advice of his legal counsel. Differing legal opinions
don't always equal a violation.''

Lamberth's ruling comes in a lawsuit over the White House
gathering of
hundreds of FBI background files on Republican appointees. The
judge
allowed Judicial Watch wide latitude in exploring the issue of
whether
the White House routinely gathered and released damaging
information
about its political opponents.

As part of the discovery process, the group was allowed to ask
extensive written questions about the release of the Willey letters
even though Willey is not a party to the suit. Presidential aides
refused to answer some of those questions, prompting Lamberth's
ruling.

Lamberth held that the White House was informed by one of the
judge's
own rulings, nine months before the release of the Willey letters in
1998, that the White House was covered by the Privacy Act.

The White House maintains ``that the president did not act willfully
because the Department of Justice has, in the past, taken the
position
that the White House office is not subject to the Privacy Act,'' the
judge noted.

``This court, however, has already rejected this argument in this
same
case,'' Lamberth added. ``When the president and EOP (executive
office
of the president) released the letters they were fully aware of this
court's ruling that the Privacy Act was applicable and that the
disclosure of the letters was therefore prohibited.''

Lamberth said three top presidential aides - Deputy Counsel Bruce
Lindsey, former Counsel Charles F.C. Ruff and former Deputy
Counsel
Cheryl Mills - engaged in discussions that led to the release of the
letters.

The ruling notes the senior lawyers ``had their discussions about
whether the letters should be released'' and ``ultimately
recommended
their release to the president.'' Clinton ``concurred in this
recommendations,'' the judge said.

``The plaintiffs have established that the president committed a
criminal violation of the Privacy Act,'' the judge ruled.

Lamberth rejected the White House claim that Lindsay and four
other
White House aides did not need to answer questions about the
letters
because of attorney-client privilege.

``The discussions regarding the release of the Willey letters, even if
initially protected by the attorney-client privilege, fall squarely
within the crime-fraud exception to this privilege,'' he ruled.

Lamberth's ruling simply clears the way for Judicial Watch to press
the White House to answer additional questions about the Willey
letters.

However, the Justice Department has an open investigation into
another
impeachment-related release of damaging information about a critic
-
the Pentagon's release of data from Linda Tripp's personnel file.

In grand jury testimony in August 1998, Clinton denied Willey's
allegations and referred to the release of the letters, telling
prosecutors: ``You know what evidence was released after the `60
Minutes' broadcast that I think pretty well shattered Kathleen
Willey's credibility.'

Janet Reno would curb press freedom on line
Constitutional protections of the press are getting in the way of
cyber-crime prosecutions and may have to be reconsidered, a
White House committee chaired by US Attorney General Janet
Reno believes.
"With the advent of the Internet and widespread computer use,
almost any computer can be used to 'publish' material. As a result,
the [Privacy Protection Act of 1980 (PPA)] may now apply to
almost any search of any computer," the committee's report
laments.
The act in question protects the freedom of American journalists,
scholars and writers to publish freely by prohibiting all law
enforcement agencies from searching for or seizing "any work
product materials" or any related "documentary
materialspossessed by a personwith a purpose to
disseminate to the public a newspaper, book, broadcast, or other
similar form of public communication," [42 U.S.C. §2000aa].
Under those circumstances, the Feds would be forced to find some
gizmo or technique to copy only those portions of a suspect
journalist's hard disk which might pertain to a crime, and do it
without interrupting the work in progress; or, failing that, rely on the
suspect himself to turn over the relevant files.
It's a formidable technical challenge, as the Feds must not seize,
or even examine, data meant for publication, and its supporting,
documentary information such as notes, transcripts and related
research materials.
The Reno Department of Justice (DoJ) apparently finds this an
intolerable burden, especially while the precious life of an innocent
child kidnapped by rogue chemistry professors could hang in the
balance.
"Because computers now commonly contain enormous data
storage devices, wrongdoers can use them to store material for
publication that the PPA protects while simultaneously storing
child pornography, stolen classified documents, or other
contraband or evidence of crime," the report warns.
We may joke about rogue professors, but we're only covering up
the chill we feel in contemplating the way Internet superstition and
Reno's relentless child-protective hype might give the Feds the
excuse they've been waiting for to do an end-run around the PPA.
It appears that this is exactly what Reno has in mind. "Features of
the Internet that make it different from prior technologies may
justify the need for changes in laws and procedures that govern the
detection and investigation of computer crimes," the committee
notes ominously.
The committee's report, "The Electronic Frontier: The Challenge of
Unlawful Conduct Involving the Use of the Internet" is due to be
released in final form this month. A draft copy obtained by Wired

I just got off the cell phone with my wife.  We own a house in
San

Clemente that was just sold.  Escrow doesn't close until after the
CDC, so she went down to water the yard.  While she was there
she
decided to make a run to Mexico and pick up some more
antibiotics and
prescription drugs for our preps.
The main point is that her cousin is a civilian construction
worker in
San Diego.  He tells her that he is building "barracks" on San
Clemente Island.  For those of you who don't know, San Clemente
Island
is used for bombing practice by the Marine Corps.  He says that
they
have stopped bombing there and he has been contracted to build
quite a
few barracks on the island.
 He says that they are also building a number of new barracks near
 Camp
Pendleton.
This sent up red flags for me because San Clemente Island is
not a

practical location to house marines.  It is much to far from the
mainland.  In addition, I can't imagine them building new wooden
barracks at Pendleton, especially since the size of the military is
getting smaller not larger.
What makes more sense is that these may well be detention
centers.
 The
contract is a rush job.  He and his crew are flown out to the island,
where they stay for a week and then flown home on weekends.
Anyone else heard anything about this?

the very site of governmental brutality and torture of dissenters.
Norman Pearlstine tells me that since I have not been in China, I
am not aware that "China is demonstrably more free today than it
was 25 years ago." I told him that a Catholic priest who refuses to
renounce the Vatican had his legs broken by police last December
in Hebei just after being released from a labor camp. How does
Pearlstine define "freedom"?
The Committee To Protect Journalists informs me that it "is
extremely concerned about China's abysmal record on press
freedoms . . . and wishes that any group meeting in China would
address head on" that issue.
In its statement, the committee did not mention its choice of
Norman Pearlstine to be chairman of its November 23 Freedom
Awards dinner.

The FBI is busy trying to convince Americans that the republic is
threatened by unspecified but dangerous groups of paranoids,
religious
fanatics, militias and, of course, the obligatory "white supremacists"
who might become violent in connection with the coming of the new
millennium.

   Last week the FBI announced a new program alerting local police of
the threat from these"extremist" groups who are targeting  non-whites,
Jews and the Federal government.  The connection between race and the
end of the millennium is not spelled out.

   The program was dubbed "Project Megiddo" which is the biblical site
of the battle of Armageddon, the final clash between the forces of
good and the forces of evil. Presumably, the FBI sees itself as the
forces of good.

   In a subsequent statement intended to clarify its first
   announcement
of
Project Megiddo the FBI softened its language in regard to the
militias.

The majority of militias, the FBI said, "engage in and support law
abiding activities."  This conciliatory tone was apparently meant to
protect the

FBI's attempt to establish a rapport with the militias, a program the
agency announced several weeks ago.  The purpose, they said, was to
demonstrate to militia members that Federal agents are human beings
and Americans and that we all believe in the same things. This is a
program militias would be advised to be cautious about because while
the FBI agents are establishing all that rapport they are also
collecting names, addresses and personal data and information about
armaments.

   The clarifying statement also contained additional information
   about
Project Megiddo which was described as the product of extensive
research

about individuals and groups  who attach "special significance" to the
year 2000.  This significance, the FBI said, is based on their
"apocalyptic"religious beliefs or a "conspiracy theory" about the New
World Order.

   Throughout history, governments have been suspicious of religion,
which diverts loyalty and allegiance from the government. It is also
an alternative and competing source of authority.

There is no reason to believe the government of the United States is
any

different.  If it were we could safely repeal the First Amendment.

   And when it comes to "apocalyptic" beliefs, the FBI can bat in
anyone's league. The agency warns of "violent white supremacists who
seek to initiate a race war, apocalyptic cults which anticipate a
violent Armageddon, radical elements of private citizen militias who
fear that the United Nations will initiate an armed takeover of the
United States and establish One World Government, and other groups.
That's quite a list of horribles without a

single name of a person or organization that would allow an interested
or skeptical citizen to check or verify.  And of course, naming a
person or groups would permit someone to respond to these accusations.

   We are left to take it on the word of the FBI that these groups and
individuals are out there and plotting dreadful things and we should
welcome whatever the FBI does to counteract them.

   But to do accept thee claims as gospel, we have to ignore the fact
that for six years the FBI lied to us about incendiary device at Waco,
or the

fabricated reports of a drug laboratory that were used  to justify the
use of military equipment and training at Waco.

   And we would have to forget the deceptive tactics they used against
Richard Jewell, the suspected Olympic bomber. They told him they were
making training film and he was to role play a suspect who waives his
rights. Fortunately, the ruse did not work and Jewell avoided being
framed by the FBI.

   And about that One World Government concern.  If they really want
   to
convince people otherwise, instead of demonizing unnamed people,  they
might advise Under Secretary of State Strobe Tallbot to put a cork in
it because he recently predicted that in the coming century nations
will be abolished and "single, global authority" will be established.

   Should Americans be characterize as dangerous paranoids for paying
attention to what high level government officials tell us?

   This latest announcement from the FBI follows by several months the
disclosure of a mobilization program in the Pacific northwest which it
described by the special agent in charge in Seattle as the locale of
many incidents of terrorism. Presumably, she was not including the
murder by Federal agents of Randy Weaver's wife and son, but that
doesn't mean we can't.

   As in the more recent announcement, there were references to

Boca may stub out smokers

BOCA RATON -- Marlboro men need not apply.

 The city is aiming to ban the hiring of smokers for all jobs, and new
employees caught smoking on or off duty would be fired.

 The anti-smoking rule -- already in effect for about 700 city
 employees

through union contracts for police, firefighters and blue-collar
workers -- is expanded to all 1,100-odd employees in revamped
personnel policies to be reviewed by city council members Tuesday.

 Smoking is already off-limits in Boca Raton government buildings and
one city park, but the new rule would extend into an employee's home
and entire life. Workers already on the payroll may continue to smoke
on their free

time. As may council members: Mayor Carol Hanson is a longtime smoker,
and at least two other council members smoke occasionally.

 Officials are proposing the citywide ban because fewer smokers means
lower health insurance premiums for all employees. While such a
measure is not

common among municipal governments, it is practiced in several cities
including Coral Gables, North Miami and Clinton, Iowa.

 The American Civil Liberties Union contested the no-more-smokers rule
in North Miami as a violation of state privacy laws, but the Florida
Supreme Court upheld the rule. The court said the lower insurance
costs outweighed the privacy issue.

 "The ACLU's position is that it's improper for the government to
 punish

people for a perfectly legal activity conducted in the privacy of
their own home," said Andy Kayton, legal director of the ACLU of
Florida. "Where does the line get drawn when you're talking about
legal activities?"

 Jackie Miller of St. Petersburg, president of Florida's Smokers'
 Rights

Association, agreed: "I don't think it has any bearing on how a person
does their job. It's an outrageous idea."

 Kayton said the policy opens the door to ban people who have consumed
alcohol, are overweight, had unprotected sex or even ate red meat in
the

last year. Although it may sound farfetched, newspaper reports show
one city -- Athens, Ga., contemplated banning applicants with high
cholesterol.

 Boca Raton police officer and union President Rick Barnett said the
no-smokers policy is for the best in the long run, but it does limit
the

pool of applicants.

 Boca Raton lost a good police officer because of the ban, Barnett
 said.
An
experienced officer left the department to work at a private business
and later returned to town and reapplied. But because he had smoked a
cigar at a function, he wasn't eligible because he had not been
smoke-free for a year.

 The expanded rule to be considered Tuesday doesn't say how long new
hires must be smoke-free.

 "We would love to see a number of places become smoke-free because it
would protect people from . . . second-hand smoke," said Sonja
Bradwell, a program specialist with the state Department of Health
office. But she said the hiring policy seems drastic. "To me, it
sounds like it could be a case of discrimination."

 Boca Raton Councilwomen Wanda Thayer and Susan Whelchel said Friday
they support the idea.

 "It's probably a prudent step," Whelchel said. "Does that make
 smokers
happy? Probably not. It's like saying I can't hire you if you don't
type. Then don't apply."

In the Senate, the leading campaign finance bill is S. 1593,
sponsored by Sens. McCain (R-AZ) and Feingold (D-WI).   CDT takes no
position on the campaign finance issue per se or on S. 1593. However,
when the bill comes up in the Senate, as early as the week of October
11, Sen. Mitch McConnell (R-KY), chairman of the Senate Rules
Committee and a First Amendment advocate, will sponsor an amendment to
protect peoples' right to the use Internet to express political views.
 Sen. McConnell's amendment will be criticized by proponents of
campaign finance reform, and the overall fate of S. 1593 is uncertain,
but the Senate debate will mark the opening of another front in the
fight for Internet freedom.

  Which news network is Bill Clinton's favorite?

  That would be CNN, according to Dick Morris, the twenty-year
  Clinton confidant who described the President's attitude toward
  several different reporters who covered him for Fox News Channel
  Tuesday night.

  "CNN, [Clinton] felt, was on his side. He felt [Wolf] Blitzer
  was annoying, but he felt CNN was basically favorable."

  Morris ran down the short list of Clinton's picks and pans for
  Bill O'Reilly on Fox's "The O'Reilly Factor."

  "[NBC's] Lisa Myers he thought was a real enemy," said Morris.
  It was Myers who convinced alleged Clinton rape victim Juanita
  Broaddrick to go public with her story in January.

  The President doesn't like the Fox News Channel but believes
  that the news anchors for the big three networks have no
  particular political axe to grind.

  "[CBS's Dan] Rather and [ABC's Peter] Jennings, I don't think he
  felt, had a bias," said Morris. "I think he felt that they just
  played it straight, but he felt that they all were attracted to
  scandal."

  Clinton views the prestige print press "very hostiley,"
  according to the former White House political guru, especially
  New York Times editorial page editor and son of the South,
  Howell Raines.

  "He once screamed at me that 'Howell Raines hates me and he
  writes negative stories about me because I'm a Southerner that
  didn't have to leave to make good.'...He sees the press as
  jealous of him, as fellow baby boomers who are envious of where he's
  gotten, and it's a very personal thing."

  The President doesn't actually watch television news and Morris has
  never seen him read a newspaper. Instead Clinton depends on
daily
  White House press summaries and often pays little attention to
even
  those. "He kind of feels he's making the news so he doesn't need
to
  read it."

  The First Lady is another story. "Hillary reads everything;
  she's omniverous," Morris told O'Reilly. "She's sensitive to
  everything, she resents everything, she doesn't like the press
  and she's on top of the spin moment by moment."

  The President's view of the news media is less overwrought. In
  fact, according to Morris, Clinton thinks the White House press
  corps is basically "stupid" and that distracting reporters from
  damaging stories is like "taking candy from a baby."

Expert Concludes FBI Fired Shots During Waco Siege

   An expert retained by the House Government Reform Committee
said
yesterday that he believes an FBI agent fired shots during the
bureau's 1993 siege of the Branch Davidian compound near Waco,
Tex., a
view that is at odds with the FBI's consistent position that none of
its agents fired at any time.

Carlos Ghigliotti, an expert in thermal imaging and videotape analysis
who has done work for the FBI, said he has spent hundreds of hours
reviewing

various tapes of the siege, including a newly released FBI audio
recording
that was part of a videotape turned over to Congress recently in
response
to a subpoena.

Based on his review, Ghigliotti said he is convinced that during the
final assault on April 19, 1993, an FBI agent shot in the direction of
the Branch Davidian compound.

"I conclude that the FBI fired shots on that day," Ghigliotti said in
an

interview yesterday. "I conclude this based on the ground-view
videotapes
taken from several different angles simultaneously and based on the
overhead thermal tape. The gunfire from the ground is there, without a
doubt."

After being briefed yesterday by Ghigliotti, Rep. Dan Burton (R-Ind.),
chairman of the committee that retained Ghigliotti as a witness, said:
"What we have heard from this expert is troubling, but we think it is
premature to make any final determination. We don't want to go off
half-cocked. As soon as we get all the necessary information, we will
hold hearings and present the information to the American people."

Ghigliotti, owner of Infrared Technologies Corp. in Laurel, said the
tapes also confirm that the Davidians fired at FBI agents repeatedly
during the assault. Although FBI agents were operating under rules
that permitted them to return fire, bureau officials have maintained
that no agents fired any shots, a position that has not changed since
the day of the raid.

About 75 Branch Davidians perished in a fire that erupted during the
assault. Ghigliotti is not asserting that any injuries or deaths were
caused by FBI gunfire.

For years, there have been allegations that federal agents fired
automatic
weapons at the Branch Davidians from behind the compound, an area that
was not visible to the media. These assertions were popularized in the
1997 documentary "Waco: The Rules of Engagement."

Ghigliotti said he has not arrived at any conclusion on those
allegations.
Rather, he has focused on three videotapes taken by news agencies that
day and on the new audio tape, which is part of an FBI surveillance
video.

The newly released FBI recording indicates that someone was firing
shots

about 12:44 p.m. and includes expressions of surprise from FBI
employees

circling in a plane overhead. "You can hear it," one FBI employee in
the

plane says of the gunfire, which federal agents believed was coming
from a man with a handgun north of the compound. However, the tape
does not make clear who was firing, and an FBI effort to locate the
gunman was unsuccessful.

Ghigliotti said he believes the gunfire came from an FBI agent and was
picked up by his microphone as he fired. He said the videotapes he
reviewed show gunfire toward the compound at the time that the audio
is picking up the shots. Several armored vehicles were clustered in
the area of the gunfire, according to Ghigliotti.

From 1991 to 1995, Ghigliotti, 42, was paid by the FBI as a thermal
imaging expert on an array of environmental dumping cases, according
to an FBI document. Ghigliotti "performed reliable work for the FBI,"
the 1995

document states.

In 1993, Ghigliotti was sentenced to 18 months of unsupervised
probation

and fined $250 for assaulting the owner of a dump site. Ghigliotti,
who had prepared documents for a Maryland environmental agency,
alleged that the

dump site owner duped him by posing as a county watchman to improperly
gain access to the documents.

Ghigliotti's allegation of FBI gunfire came as former Missouri senator
John C. Danforth met yesterday in Texas with attorneys for families of
Branch

Davidians who died in the siege, who have filed a wrongful-death suit.
Danforth was appointed Waco special counsel last month by Attorney
General Janet Reno, who directed him to answer a number of key
questions, including whether FBI agents fired their weapons.

Michael Caddell, the lead lawyer in the $100 million wrongful-death
suit, claimed that he also has new information relating to possible
FBI gunfire and said that he intends to give it to Danforth. Based on
clearer, newly

released FBI infrared surveillance tapes, Caddell contends that
there
was a gun battle between Davidians and federal agents on April 19
and
that gunfire was coming from at least three government positions.

to students since it takes the student a long time to decipher a
code. In most instances, the student wouldn't have time to decode
the encryption unless another student let him.
Commenting on the school's policy, Marc Rotenberg, director of
the Electronic Privacy Information Center, said, "I think it's a
terrible idea to be treating high school students like they're prison
inmates. I don't think the need has been established. I think it's
significant that even at Columbine where they had a terrible
tragedy, parents resisted a lot of the proposals for very invasive
monitoring and police presence at the high school."
Analyzing the policy as to how it relates to high school students,
Dean said policies such as these start with harmless bits of
information on a card. The student is led to believe the card is a
good idea when trips through cafeteria lines and book checkouts in
the library go faster. Thus, they readily accept the card policies
without even considering what may be coming down the road.
"That's generally how these things start," said Dean. "It's a
convenience or an efficiency and so on ... Before you know it, the
frog is boiling."

So, you're still a liberal after seven years of Bill Clinton and
decades of liberal activists making your life miserable from the
bully pulpits of the bureaucratic agencies? That's too bad; maybe
this story will finally change your mind.
According to the Associated Press, the San Francisco Unified
School District is ready to embark on another nonsensical policy to
further integrate and "diversify" their public schools.
The concept is called a "diversity index," and it is designed to
make sure that an equal number of ethnic groups are represented
at each school. Students are screened upon -- among other things -
- their ethnicity, income, test scores and English proficiency.
"A student whose 'individual profile will contribute to increasing the
diversity of (a) school will have priority for assignment/admission to
that school,' according to the plan, worked out over the summer by
a 27-member committee of district employees," wrote AP. Now, a
federal judge (no, not a state judge) will consider this proposal at a
Nov. 5 hearing.
This plan will replace earlier school integration policies, which
barred schools "from having more than 45 percent of students from
any one ethnic group and required (schools) to have at least four
ethnic groups represented."
That policy, according to AP, was initially created because the
NAACP -- sensing that blacks weren't afforded equal opportunities
to go to certain public schools -- sued the school district and won.
But that suit "also prompted another lawsuit, filed in 1994, in which
several Chinese-American families claimed their children were
being unfairly excluded from some schools -- including one of the
city's most prestigious," the report said. "School officials, the
NAACP and lawyers for Chinese-American students and parents
agreed to a settlement in February which said, in part, that 'race or
ethnicity may not be the primary or predominant consideration in
determining ... admissions criteria.'"
And yet, the new rules -- if ordained by a High and un-Holy Federal
Judge -- will force the school district to do precisely what these
group leaders have said they wouldn't do, which is admit students
based on a racial and ethnic set of realities.
"Ethnicity, English proficiency, test scores, and income." Oh, heck
no -- there's not going to be any bias in determining those factors,
unless you're white or you speak English well.
Flaming liberals have infested our government schools at every
level of leadership. But that wasn't good enough because now
some of their own are still challenging every damned thing they do.
If it weren't so sad, it'd be funny.
Liberalism in this country has fostered lawsuits like this one --
mostly from other liberals -- and has created an environment where
the insanity of pure democracy (everyone has an equal say) has
been fully implemented. Such circumstances turn very simple
concepts (like attending school) into legal quagmires and public
relations nightmares because the reality is you simply cannot
accommodate everyone all the time.
Getting an education in this country shouldn't be a political issue,
nor should it be an issue driven by a selfishly grandiose agenda or
statistical data. It's no wonder Americans are getting their kids out
of public schools when they can.
All of this serves the liberals right -- they created this mess. But
unfortunately all kids involved in the incubus of today's public
education system are suffering from the stupidity of liberal parents
and adult education peers. This is yet another example of how
socialistic liberals create more problems than they ever solve --
especially when they upset the natural order of things.

tough job, because I think Kofi Annan has lost his mind.
In a story published yesterday, the U.N. leader pronounced that he
foresees increasing international intervention in trouble spots like
East Timor as the world moves "from a culture of reaction to a
culture of prevention."
Stupid me; I still believed the world was mostly filled with nations
who'd rather take care of their own problems -- just like the
hypocrite western nations who champion this lunacy called
"globalism" and who would never allow, say, China, to deploy their
"peacekeepers" in our streets.
In a speech delivered to the U.N. body on Monday, Annan said
state sovereignty is being redefined by the forces of globalization
and international cooperation and declared, "The state is now
widely understood to be the servant of the people, and not vice
versa." In his dreams.
Traditional considerations of national sovereignty will no longer be
taken into account, Annan said, and governments "must not allow
divisions within the Security

Expended military illumination flares fired by U.S. government
personnel have been discovered in the tons of evidence recovered
from the Branch Davidian compound, the head of the Texas
Department of Public Safety said Tuesday night.
Texas Rangers searching a Waco storage facility Friday for
missing pyrotechnic tear-gas grenades discovered one of the
military devices, a star parachute flare. Evidence logs indicate that
more of the flares were recovered in the weeks after the compound
burned following an FBI siege and tear-gas assault April 19, 1993,
said James B. Francis Jr. of Dallas.
"These flares are potentially a very important issue, inasmuch as
the government had enormous spotlights trained on the compound
throughout the standoff," Mr. Francis told The Dallas Morning News.
"They didn't need these flares to light the compound. One or more
was fired. For what purpose or reason would these rounds be
used?" he said. "I can't tell you whether they were [shot by] the
military or FBI, but certainly, they were fired by government
officials."
FBI spokesman John Collingwood said he could not flatly rule out
FBI use of illumination rounds at Waco. "Several times during the
standoff they had people sneaking in or out of the compound at
night. Whether they ever used them then, I don't know," he said.
"But I can say categorically, we did not use illumination rounds on
the 19th."
The discovery of the incendiary illumination rounds raises new
questions for federal officials already scrambling to explain why it
took six years for the FBI to admit that its agents used pyrotechnic
tear-gas rounds against the Branch Davidians on April 19, 1993.
The government made that admission only after a former senior FBI
official told The News that the use of the flammable rounds in
Waco was "common knowledge" within the bureau's hostage
rescue team.
Attorney General Janet Reno has said that its use violated her
strict instructions that nothing capable of sparking a fire be used
during the FBI tear-gas assault.
What next?
With the discovery of the spent illumination round, Texas law
enforcement officials said they are concerned about what else may
be found in the 24,000 pounds of evidence recovered after the
compound burned.
The Rangers, who were asked to develop a criminal case after the
siege began, were asked by the U.S. Justice Department to keep
all evidence needed for the prosecutions of Branch Davidians that
followed.
But tons of other debris, including more than 300,000 rounds of
ammunition and other ordnance stockpiled by the sect, has been
kept in Waco.
"There is a big semiwarehouse of spent munitions that has not
been investigated," one Texas official said. "Nobody knew what
they were looking for before now. Nobody was hunting for
incendiary devices."
A government investigator said Tuesday that a General Accounting
Office investigation on military involvement during the siege was
unable to resolve questions about the FBI's acquisition of high-
explosive 40 mm military rounds during the standoff or the number
of U.S. Army Special Forces personnel sent to Waco.

rounds were acquired along with the illumination rounds from
nearby Fort Hood during the standoff.

Government officials have long maintained that the fires were
deliberately set by the Branch Davidians.
Federal officials also have insisted that the pyrotechnic tear-gas
rounds were fired into a bunker away from the compound and were
used more than three hours before the fire began.
But where or when those devices, known as M-651 CS rounds,
were acquired by the FBI is unclear.
Mr. Francis said Texas Rangers on Tuesday obtained two unfired
M-651s from the same manufacturing batch as those used at
Waco from Redstone Arsenal in Alabama and Pine Bluff Arsenal in
Arkansas. Mr. Francis said Rangers have traced a shell casing in
their custody to a batch made for the U.S. military in the late
1960s.
Defense denials
Some recent news reports have included Defense Department
denials that any pyrotechnic gas used at Waco came from U.S.
military stores.
Mr. Francis said Texas Rangers plan to return to Waco in the near
future to search for a second parachute flare listed on evidence
logs and other questioned items.
"They have no military value other than to be an incendiary flare,"
he said of the flares. "The question this raises is how many are still
to be discovered."

Bill Clinton, Janet Reno, or Chuck Schumer. ...
Defenders of the indefensible can't understand why so many of us
don't trust our government to be honest, fair, or reasonable. Gee, it
is well documented our president has repeatedly lied; our attorney
general is either incompetent, or chin deep in multiple, major cover
ups; Congress had displayed the strength of a cobweb in a
tornado; and chronic violation of oaths has become standing
operating procedure.
Twenty-nine members of Congress have been accused of spousal
abuse, seven have been arrested for fraud, 19 have been accused
of writing bad checks, 117 have bankrupted at least two
businesses, three have been arrested for assault, 71 have credit
reports so bad they reportedly can not qualify for a credit card, 14
have been arrested on drug-related charges, eight have been
arrested for shoplifting, 21 are current defendants in lawsuits, and
just in 1998, 84 were stopped for drunk driving, but released after
they claimed congressional immunity. Such are the men and
women who have sworn a sacred oath to "... preserve and protect
the Constitution. ..."
The unnecessary tragedy of Waco is unraveling like a cheap rug.
Janet Reno is metamorphosing from "I take full responsibility" to
"Gosh, my subordinates lied to me. ... It's not really MY fault."
Reno's pursuit for the truth of Waco is rivaled only by O.J.'s search
for the "real" killers of Nicole and Ron. So how come a federal
judge was required to resolve a dispute with the Texas Rangers
over evidence? As the New York Times reported, "A federal judge
was forced to intervene Friday after federal officials tried to block
Texas Rangers from entering a Waco storage facility to search for
evidence that pyrotechnic devices were fired at the Branch Davidian
complex. That brief skirmish came the same day FBI officials in
Washington released the second of two newly discovered aerial
videotapes that include conversations between FBI commanders
about the use of combustible teargas canisters."
Janet Reno should resign, be fired "with prejudice," impeached for
either incompetence or conspiracy, or sued under Title 18, Chapter
13, Section 242, which addresses the subject of deprivation of
rights under color of law:
Whoever, under color of any law, statute, ordinance, regulation, or
custom, willfully subjects any person in any State, Territory,
Commonwealth, Possession, or District to the deprivation of any
rights, privileges, or immunities secured or protected by the
Constitution or laws of the United States, or to different
punishments, pains, or penalties, on account of such person being
an alien, or by reason of his color, or race, than are prescribed for
the punishment of citizens, shall be fined under this title or
imprisoned not more than one year, or both; and if bodily injury
results from the acts committed in violation of this section or if
such acts include the use, attempted use, or threatened use of a
dangerous weapon, explosives, or fire, shall be fined under this title
or imprisoned not more than ten years, or both; and if death results
from the acts committed in violation of this section or if such acts
include kidnapping or an attempt to kidnap, aggravated sexual
abuse, or an attempt to commit aggravated sexual abuse, or an
attempt to kill, shall be fined under this title, or imprisoned for any
term of years or for life, or both, or may be sentenced to death.
The above is not the rantings of any radical right wing nut -- it is
verbatim from United States Code Title 18, Chapter 13, Section
242. Gosh oh gee golly ... maybe it's just me, but it does kind of
sound like it was specifically written for the kind of gross abuse of
power under the color of authority that resulted in the Waco
tragedy.
Last week the FBI finally uncovered a Feb. 15, 1996 internal memo
acknowledging they DID use a few military gas rounds. An
anonymous FBI mouth said the memo stated no military teargas
was fired "directly" at the compound "due to the potential for
causing a fire." According to the General Accounting Office, the
FBI had 50 40mm "illumination rounds" (flares) and 250 40mm
"high explosive" rounds from the U.S. Army. What the hell was the
FBI doing with H-E (high explosive rounds)? One official who spoke
only on the condition he would not be identified said, "But why they
had the H-E rounds, I don't know. ..."
Reno is now trying on the hat of victim. She said, "What I asked for
were assurances -- and I received assurances -- that we would not
use incendiary devices or pyrotechnic means of delivering
incendiary devices." According to a tape released last Thursday, a
radio transmission in which the FBI's hostage rescue team
commander, Richard Rogers,

Clinton Picks Tried Hubbell, Trie

WASHINGTON (AP) - The chief judge of the U.S. District Court
bypassed the traditional random assignment system to send
criminal cases against presidential friends Webster Hubbell and
Charlie Trie to judges appointed by President Clinton, according to
court officials.
U.S. District Judge Norma Holloway Johnson's decision to abandon
the longtime random computer assignment for the high-profile
cases has raised concerns among several other judges, according
to Associated Press interviews with them.
The judges also raise concerns about an appearance of possible
conflicts of interest, because judges who got the cases were
friendly with key players - presidential confidant Vernon Jordan and
defense lawyer Reid Weingarten - and made rulings that
handicapped prosecutors.
Half a dozen judges, Republicans as well as Democrats, said they
have high regard for the ethics and work of the two judges involved,
Thomas Friedman and James Robertson, and do not believe they
were improperly influenced.
But the judges, who spoke on condition of anonymity, said they
have discussed among themselves the public perception of ignoring
the random draw - which is used in almost all cases - and passing
over more experienced judges appointed by presidents of both
parties.
One judge said his colleagues have discussed whether assigning
cases directly rather than using the random lottery raises ``an
appearance problem at least'' and ``whether there has been
impartial administration of justice.''
Johnson, Friedman and Robertson all declined repeated requests
for interviews.
The airing of the behind-the-scenes controversy provides a rare
window into a court process sealed from public view.
Johnson, an appointee of President Carter, assigned:
-Friedman the Trie case, the first major prosecution from the
Justice Department probe of Democratic fund raising. Clinton
nominated Friedman, a former president of the local bar, in 1994.
-Robertson the Hubbell tax case, Independent Counsel Kenneth
Starr's first prosecution in Washington. Robertson is an ex-
president of the local bar and a former partner at the law firm of
former White House counsel Lloyd Cutler.
Robertson was nominated by Clinton in the last days of Cutler's
tenure as counsel in 1994. Robertson donated $1,000 to Clinton's
1992 presidential bid and has said he ``worked on the periphery'' of
that campaign.
When Johnson bypassed the random draw for these cases, there
were 12 full-time judges on the federal court, seven of them Clinton
appointees. Four were Republican appointees. The court also has
a number of senior judges who work part-time.
Experts said the assignments to Clinton-nominated judges did not
violate any rules, but could shake public confidence.
``As far as assigning a recently appointed judge of the same party,
it's dangerous, it's risky, it's hazardous because the outcome
might support the cynical view that the judge did not decide the
matter on the merits even though that may be the furthest thing
from the truth,'' Columbia University law professor H. Richard Uviller
said.
New York University law professor Stephen Gillers said, ``If the
case is high-profile, that should increase the presumption in favor of
random selection.''
The assignments were confirmed to AP by several court officials
with access to parts of the court computer system not available to
the general public.
Local court rules give Johnson the right to assign ``protracted''
cases to specific judges, although nearly all the cases in U.S.
District Court here are assigned by lottery, court officials said.
The Judicial Conference, the policymaking body for the federal
judiciary, recommends that federal courts randomly assign cases.
In March, the conference rescinded its 28-year-old policy which
recommended giving chief judges latitude to make special
assignments of ``protracted, difficult, or widely publicized cases.''
Actual practice varies from court to court.
In the Southern District of New York where there are more than two
dozen full-time judges, Court Executive Clifford P. Kirsch said, ``It's
all been by a blind draw ... so it doesn't appear anyone is pre-
selecting or favoring one judge over another judge.''
Johnson garnered headlines for her rulings against Clinton in the
Monica Lewinsky scandal, rejecting privilege claims by the
president and ordering White House lawyer Bruce Lindsey and
Secret Service personnel to testify.
Robertson dismissed the tax case against Hubbell, who eventually
pleaded guilty to a misdemeanor when an appeals court reinstated
the case. Johnson allowed a later indictment - charging Hubbell
with lying to federal regulators - to be assigned at random by
computer. By coincidence, the computer picked Robertson, who
threw out the central felony count in the case. Hubbell pleaded
guilty to that same felony count June 30 after an appeals court

This is reportedly a hoax. Sixty Minutes and JR's staff both deny
that she has ever appeared on Sixty Minutes.  On the other hand, I
have heard from people who claim to have seen the program where
this was said.  Maybe she did say this but it was another show?  If
