  Since Cheney changed his residency in July of this year in order that he
might reside in Washington D.C., it hardly seems compatible with Wyoming's
requirements for residency.

Suit over Cheney's residency tossed out

Efforts to prevent Republican vice presidential nominee Dick
Cheney from receiving Texas' 32 electoral votes hit a major legal
hurdle Friday.

A federal judge in Dallas dismissed a lawsuit that claimed Cheney
-- who has lived in Texas since 1995 but recently re-applied for
a Wyoming driver's license and voter registration -- is still an
inhabitant of Texas and constitutionally ineligible to receive
the votes as the running mate of another Texan, George W. Bush.

Judge Sidney Fitzwater ruled that the plaintiffs, four Texas
citizens, had no standing to file suit since they can't
demonstrate any injury from Cheney's candidacy. He also ruled
that the claims had no merit and that Cheney, a former defense
secretary who represented Wyoming in Congress, is no longer a
Texan.

"The record shows that Secretary Cheney has both a physical
presence within the state of Wyoming and the intent that Wyoming
be his place of habitation," Fitzwater, who was appointed by
President Reagan, wrote in his 13-page opinion.

Plaintiff's lawyers are expected to appeal the ruling. A civil
rights lawyer who has filed a similar suit in Austin on behalf of
nearly 2,000 voters questioned Fitzwater's finding that voters
could not demonstrate any injury.

"I thought it was pretty amazing for the judge to say citizens
didn't have the right to sue," James Harrington said. "What is
more fundamental to an American citizen than who the president
is?"

Harrington and his fellow lawyers will decide this weekend
whether to request an immediate hearing in their suit.
