WASHINGTON — The Justice Department is putting the final touches on  
regulations that could give Atty. Gen. Alberto R. Gonzales  
important new sway over death penalty cases in California and other  
states, including the power to shorten the time that death row  
inmates have to appeal convictions to federal courts.


The rules implement a little-noticed provision in last year's  
reauthorization of the Patriot Act that gives the attorney general  
the power to decide whether individual states are providing  
adequate counsel for defendants in death penalty cases. The  
authority has been held by federal judges.


Under the rules now being prepared, if a state requested it and  
Gonzales agreed, prosecutors could use fast track procedures that  
could shave years off the time that a death row inmate has to  
appeal to the federal courts after conviction in a state court.


The move to shorten the appeals process and effectively speed up  
executions comes at a time of growing national concern about the  
fairness of the death penalty, underscored by the use of DNA  
testing to establish the innocence of more than a dozen death row  
inmates in recent years.


Amid the public debate, the number of people executed in the U.S.  
has declined steadily since the mid-1990s.


California and several other states have moratoriums on lethal  
injections, stemming from legal challenges. Opponents say the way  
the states administer a three-drug lethal cocktail unnecessarily  
risks excessive pain for the inmate and therefore violates the  
constitutional bar against cruel and unusual punishment.


A federal judge in San Jose, citing a lack of training and  
supervision of the execution team, ruled California's application  
of lethal injections unconstitutional. State officials have  
proposed changing procedures to try to address the judge's  
concerns. A hearing is in October.


Prosecutors say many death penalty cases take far too long to  
resolve even when the issue of guilt is clear. Especially in the  
West, where the U.S. 9th Circuit Court of Appeals in San Francisco  
has blocked many executions, cases can take decades to wind through  
the courts. In its most recent term, the U.S. Supreme Court  
restored the death penalty in three cases in which the 9th Circuit  
had reversed the sentence.


One of the cases involved a two-time Arizona murderer who told the  
sentencing judge: If you want to give me the death penalty, just  
bring it right on. He was sentenced in 1990.


Some Arizona officials say the new procedures are long overdue. If  
you are going to have the death penalty at all, it shouldn't take  
20 to 25 years, said Kent Cattani, the chief capital litigation  
counsel in the Arizona attorney general's office. Either get rid  
of it altogether, or try to have a good system in state courts and  
then accelerate it through the federal courts.


On the other side, advocates for death row inmates and some legal  
experts say the rules would make a bad system worse.


It is another means by which people are determined to shut the  
federal courts down to meaningful review of death penalty cases,  
said Elisabeth Semel, director of the Death Penalty Clinic at the  
UC Berkeley law school. The inevitable result of speeding them up  
is to miss profound legal errors that are made. Lawyers will not  
see them. Courts will not address them.


This is the Bush administration throwing down the gauntlet and  
saying, 'We are going to speed up executions,'  said Kathryn Kase,  
a Houston lawyer and co-chair of the death-penalty committee for  
the National Assn. of Criminal Defense Lawyers.


About 3,350 people are on death row in the U.S., including more  
than 600 in California. Most were sentenced in state courts, but  
death cases almost always end up being reviewed by federal judges too.


It is impossible to estimate how many inmates might be affected.  
Some with appeals pending could see their cases shortened.


Cases in the system for 20 years in federal court, it will not  
affect those, said Cattani. But it will prevent those from  
happening in the future.


The procedures would cut to six months, instead of a year, the time  
that death row inmates have to file federal appeals once their  
cases have been resolved in the state courts.

It is urgent that the grassroots make our voices heard in the debate about 
extension/expansion of the PATRIOT Act!  On Tuesday, the Senate Intelligence 
Committee voted to send PATRIOT Act expansion legislation forward, and 
Congressional committees are expected to mark up additional bills the week of 
June 20.  This is moving much too fast.  The reauthorization process is proving 
to be as secretive as the initial passage of the PATRIOT Act.  It will take all 
of us working together to slow the process down, and open it up for vigorous 
public debate.

Now is the time to make appointments with Congressional representatives for the 
week of July 4, when they will be back home in their districts, to show them 
the overwhelming grassroots opposition to extending powers to an unaccountable 
Justice Department.  Groups across the country are already setting up such 
meetings and planning other events for the Patriot Days of Action, including 
July 4th activities, rallies, and ad campaigns.  If you aren’t already 
planning an event, we hope you will join us as we show Congress a burst of 
local fireworks over extension/expansion of the PATRIOT Act!

Here are some updates on Patriot Days of Action resources:

How many violations of the Constitution (Charter of Rights and Freedoms)
can you find in the case of Nicholas as presented last night? The mom said
the Christy Clark ministry (Children and Families) told her the media are
not an option and implied that benefits could be lost if they exercised
their free speech. Of course Christy-the-Coward would not be interviewed
and the bureaucrat you interviewed did the trained seal thing and said

So Nicholas can get $3,000 in support if removed to a foster home (guess
how the foster home people vote?) and only $233 in his own home (so
much for Charter S.7 fundamental justice).

Although OIPCBC is receiving submissions on how the Patriot Act is
effecting BC post-9/11, we need a much broader inquiry. To what extent is
Government-by-Threat now being imposed on BC-Canada and other countries
with the features of coercive programming leading all the way to the
Whitehouse?

Dear Judge Arbour:

The web site below presents the complaint of POC and its 27 citizen
signatories. Further to our recently exchanged communications, Markus
Schmidt, Secretary of the Human Rights Committee has a file record of
these signatures.

If we are correct in our assessment that torture is being used as an
instrument of governance in Canada, then the urgent action
categorization of this complaint is warranted. The more such procedures
are entrenched by time, the more our citizens are endangered. We do not
think that the Supreme Court of Canada judgements on either side in the
Gosselin case meant for Life, Liberty and Security (Charter S.7) to be
systematically violated in government programming so extreme as to fit the
definition of torturous.

The governments of this country at any level could provide a domestic
remedy with ease. They have had such requests presented to them repeatedly
and in various ways. (1) What are the facts of MHR programming, if they do
not accept ours as presented below? (2) In what way do those facts fit or
not fit the definition of torture used by the UN?

Given that they will not provide the necessary information in these two
categories to put this matter to rest, would UNHCHR please do do? A ruling
which says Yes, the MHR procedures are torturous or No, the MHR
procedures are not torturous will not put the matter to rest. All
concerned need to know what facts are used in arriving at the judgement
and why those facts do or do not fit the accepted definition of torture.

But hopefully, the offices cc'd above can send this communication to their
experts who will save UNHCHR as well as Part of Citizens further time and
trouble.

What Patriotism Means to Ashcroft

Last year, hacker extraordinaire Adrian Lamo broke into The New York Times web site. For his trouble, he faces a two-count federal indictment in New York, unauthorized access of a computer and unauthorized possession of "access devices" (LexisNexis database passwords).
Don't cry for Lamo, but cry for how the FBI and the Department of Justice are using the USA Patriot Act --surprise!-- to threaten journalists and obtain data under the USA Patriot Act.

The FBI has sent out letters to reporters who wrote about the Lamo case. The letters warn that subpoenas under the USA Patriot Act will be forthcoming for all of their notes, emails, interviews, content of conversations and investigations, and expense and travel reports related to stories they wrote about Lamo. The journalists are ordered to preserve these records for three months -- this in spite of the fact that the articles were written a year ago.

Using the Patriot Act for forthcoming subpoenas is an effort to circumvent journalists' privilege of preserving confidential sources under the First Amendment. Furthermore, reporters who talk to anyone --including their editors or lawyers (!)-- about the subpoenas will be subject to criminal prosecution under the Act. The gag order that violates the 1st Amendment right of speech, the 5th Amendment right to due process, and 6th Amendment right to counsel. 

The demand that journalists preserve their notes is being made under
laws that require ISP's and other providers of electronic communications services to preserve, for example, e-mails stored on their service, pending a subpoena, under a statute modified by the USA-PATRIOT Act.

You thought the USA Patriot Act was just to be used to prosecute "terrorism"? Wrong! The Patriot Act was an Executive branch power grab that took place in an atmosphere of hysterical reaction to the September 11 hijackings. Ashcroft seized the day, while the Congress slept. 

The dirty little secrets of the extent of the Administration's intentions for the law are only just now coming to light.

More than likely, you won't know when the law is being used against you.

We only know about these subpoenas because a Wired News reporter reported that the FBI contacted him, no doubt trying to get the word out before the gag order kicks in. 

Secret subpoenas, secret evidence, secret trials. That's patriotism today.

In his evening commentary on ORT, Mikhail Leontev -- who is
known for his hostile attitude toward the United States -- said the
most important issue is not Iraq itself, but the role of the United
Nations. The UN will be dead in any case. It will be suicide if it
approves [a U.S.-led military action], and it will be its death if it
does not approve [such an action] and its decision is ignored,

Feb. 25 2003, 1800 PST (FTW) -- With more than twenty U.S. cities having
passed resolutions openly opposing the multiple civil liberties violations in
the 2001 Patriot Act, and as the state of New Mexico debates
legislation that would encourage police agencies to avoid violations of the
First Amendment, the recent leak of a secret Bush
administration bill that would further erode civil liberties has provoked a
bizarre tale of denials and non responses by the administration. Thus
far the saga of the Domestic Security Enhancement Act of 2003 - commonly known as Patriot II - suggests
that the leak of the proposed legislation was possibly a trial balloon
or tester to gauge both public and congressional reaction to a
bill that, if passed, would grant the federal government drastic new powers in
a continuing erosion of the Bill of Rights. 



Patriot II has not been officially introduced in
either house of congress and thus has no official standing. It has, however,
been officially transmitted by the Bush Justice Department to Vice President
Cheney (President of the Senate) and House Speaker Denny Hastert, R-Illinois. 



The bill has already been given a clandestine odor
and the Bush administration has violated standard congressional protocols in
its handling. In fact, the administration has been caught in outright lies
about the bills actual status. In official comments dated February 10,
ranking Senate Judiciary Committee member Patrick Leahy, D-Vermont, stated, For
months, and as recently as just last week, Justice Department officials have
denied to members of the Judiciary Committee that they were drafting another
anti-terrorism package. There still has not been any hint from them about their
draft bill.



John Conyers, D-Michigan, ranking member of the
House Judiciary Committee, which has jurisdiction over proposed anti-terrorism
legislation, in a Feb, 10th letter to Attorney General John Ashcroft -- signed also by Representatives
Robert Scott, D-Virginia, and Sheila Jackson Lee, D-Texas, wrote:



We write to express my profound disappointment
about your Departments handling of anti-terrorism policy. Recent reports
irrefutably indicate that the Department of Justice has been working on a
successor bill to the USA Patriot Act for some time. Notwithstanding the
Judiciary Committees jurisdiction in this matter and outstanding record

Chairmans spokesman there have been no consultations with the Committee

Your Spokesperson, Barbara Comstock, claimed in a
February 7, statement (attached) that the new draft bill was still in internal
deliberations within the Department and still being discussed at staff
levels and has not been presented to the White House.
This is blatantly false in several respects, yet the Department of Justice Control
Sheet (attached) plainly indicates that the bill was forwarded to the
Speaker of the House and Vice President on January 10 



Conyers specifically requested that the Attorney General reply to his letter no later
than February 15, 2003. A Conyers spokesperson told FTW today
that not only has the Justice Department not replied to Conyers letter
but that they have not even acknowledged receiving it.

The Bush administration is preparing a bold, comprehensive sequel to the USA Patriot Act passed in the wake of Sept. 11, 2001, which will give the government broad, sweeping new powers to increase domestic intelligence-gathering, surveillance and law enforcement prerogatives, and simultaneously decrease judicial review and public access to information. The Center for Public Integrity has obtained a draft, dated Jan. 9, of this previously undisclosed legislation and is making it available in full text at its website at www.publicintegrity.org 

The bill, drafted by the staff of Attorney General John Ashcroft and entitled the Domestic Security Enhancement Act of 2003, has not been officially released by the Department of Justice, although rumors of its development have circulated around the Capitol for the last few months under the name of "the Patriot Act II" in legislative parlance. 

"We haven't heard anything from the Justice Department on updating the Patriot Act," House Judiciary Committee spokesman Jeff Lungren told the center. "They haven't shared their thoughts on that. Obviously, we'd be interested, but we haven't heard anything at this point." 

Senior members of the Senate Judiciary Committee minority staff have inquired about Patriot II for months and have been told as recently as this week that there is no such legislation being planned. 

Mark Corallo, deputy director of Justice's Office of Public Affairs, told the center his office was unaware of the draft. "I have heard people talking about revising the Patriot Act, we are looking to work on things the way we would do with any law," he said. "We may work to make modifications to protect Americans," he added. 

When told that the Center for Public Integrity had a copy of the draft legislation, he said, "This is all news to me. I have never heard of this." After the center posted this story, Barbara Comstock, director of public affairs for the Justice Department, released a statement saying that, "Department staff have not presented any final proposals to either the Attorney General or the White House. It would be premature to speculate on any future decisions, particularly ideas or proposals that are still being discussed at staff levels." 

An Office of Legislative Affairs "control sheet" that was obtained by the PBS program "Now With Bill Moyers" seems to indicate that a copy of the bill was sent to Speaker of the House Dennis Hastert and Vice President Richard Cheney on Jan. 10. "Attached for your review and comment is a draft legislative proposal entitled the 'Domestic Security Enhancement Act of 2003,'" the memo, sent from "OLP" or Office of Legal Policy, says. 

Comstock later told the center that the draft "is an early discussion draft and it has not been sent to either the Vice President or the Speaker of the House." 

Dr. David Cole, Georgetown University Law professor and author of "Terrorism and the Constitution," reviewed the draft legislation at the request of the center, and said that the legislation "raises a lot of serious concerns. It's troubling that they have gotten this far along and they've been telling people there is nothing in the works."

Congressman Ron Paul (R-Tex) told the Washington Times that no member of Congress was allowed to read the first Patriot Act that was passed by the House on October 27, 2001. The first Patriot Act was universally decried by civil libertarians and Constitutional scholars from across the political spectrum. William Safire, while writing for the New York Times, described the first Patriot Actâs powers by saying that President Bush was ãseizing dictatorial control.   

On February 7, 2003 the Center for Public Integrity, a non-partisan public interest think-tank in DC, revealed the full text of the Domestic Security Enhancement Act of 2003. The classified document had been leaked to them by an unnamed source inside the Federal government. The document consisted of a 33-page section by section analysis of the accompanying 87-page bill.   

*Note: On February 10, 2003 I discovered that not only was there a house version that had been covertly brought to Hastert, but that many provisions of the now public Patriot Act II had already been introduced as pork barrel riders on Senate Bill S. 22. Dozens of subsections and even the titles of the subsections are identical to those in the House version. This is very important because it catches the Justice Department in a bald-faced lie. The Justice Department claimed that the secret legislation brought into the House was only for study, and that at this time there was no intention to try and pass it. Now upon reading S. 22, it is clear that the leadership of the Senate is fully aware of the Patriot Act II, and have passed these riders out of their committees into the full bill. I spent two hours scanning through S. 22 and, let me tell you, it is a nightmare for anyone who loves liberty. It even contains the Our Lady of Peace Act that registers all gun owners. It bans the private sale of all firearms, creates a Federal ballistics database, and much more.   

The bill itself is stamped 'Confidential ö Not for Distribution.' Upon reading the analysis and bill, I was stunned by the scientifically crafted tyranny contained in the legislation. The Justice Department Office of Legislative Affairs admits that they had indeed covertly transmitted a copy of the legislation to Speaker of the House Dennis Hastert, (R-Il) and the Vice President of the United States, Dick Cheney as well as the executive heads of federal law enforcement agencies.   It is important to note that no member of Congress was allowed to see the first Patriot Act before its passage, and that no debate was tolerate by the House and Senate leadership. The intentions of the White House and Speaker Hastert concerning Patriot Act II appear to be a carbon copy replay of the events that led to the unprecedented passage of the first Patriot Act.   

There are two glaring areas that need to be looked at concerning this new legislation:   
1. The secretive tactics being used by the White House and Speaker Hastert to keep even the existence of this legislation secret would be more at home in Communist China than in the United States. The fact that Dick Cheney publicly managed the steamroller passage of the first Patriot Act, insuring that no one was allowed to read it and publicly threatening members of Congress that if they didnât vote in favor of it that they would be blamed for the next terrorist attack, is by the White Houseâs own definition terrorism. The move to clandestinely craft and then bully passage of any legislation by the Executive Branch is clearly an impeachable offence.   

2. The second Patriot Act is a mirror image of powers that Julius Caesar and Adolf Hitler gave themselves. Whereas the First Patriot Act only gutted the First, Third, Fourth and Fifth Amendments, and seriously damaged the Seventh and the Tenth, the Second Patriot Act reorganizes the entire Federal government as well as many areas of state government under the dictatorial control of the Justice Department, the Office of Homeland Security and the FEMA NORTHCOM military command. The Domestic Security Enhancement Act 2003, also known as the Second Patriot Act is by its very structure the definition of dictatorship.   

I challenge all Americans to study the new Patriot Act and to compare it to the Constitution, Bill of Rights and Declaration of Independence. Ninety percent of the act has nothing to do with terrorism and is instead a giant Federal power-grab with tentacles reaching into every facet of our society. It strips American citizens of all of their rights and grants the government and its private agents total immunity.

LOS ANGELES, Jan. 30 — Tens of thousands of pieces of mail come into
the huge Immigration and Naturalization Service data processing center in
Laguna Niguel, Calif., every day, and as at so many government agencies, it
tends to pile up. One manager there had a system to get rid of the vexing
backlog, federal officials say. This week the manager was charged with
illegally shredding as many as 90,000 documents.

  Among the destroyed papers, federal officials charged, were American
and foreign passports, applications for asylum, birth certificates and other
documents supporting applications for citizenship, visas and work permits.

  The manager, Dawn Randall, 24, was indicted late Wednesday by a
federal grand jury, along with a supervisor working under her, Leonel
Salazar, 34. They are accused of ordering low-level workers to destroy
thousands of documents from last February to April to reduce a growing
backlog of unprocessed paperwork.

  Ms. Randall was the file room manager at the I.N.S. center. Mr.
Salazar was her file room supervisor. The Laguna Niguel center handles
paperwork for residents of California, Arizona, Nevada, Hawaii and Guam and
is one of four immigration service centers around the country operated by
private contractors under I.N.S. supervision.

  According to the federal indictment, Ms. Randall ordered her
subordinates last January to count the number of unprocessed papers in the
filing center. They reported that about 90,000 documents were waiting to be
handled. In February, the government says, she ordered at least five
night-shift workers to begin shredding many boxes of papers.

  By the end of March, the backlog had been cut to zero, and Ms. Randall
ordered her subordinates to continue destroying incoming paper to keep
current, the government says.

  There was no I.N.S. policy that required this, nor was she ordered to
do it by any superior, as far as we know, said Greg Staples, the assistant
United States attorney handling the case. The only motive we can think of
is just the obvious one of a manager trying to get rid of a nettlesome
problem.

  Mr. Staples said one frustrating thing about the case was that most of
the evidence had been carted out with the trash and that it was impossible
to identify all of the victims.

  It's like a murder case without a body, he said. We will never
really know what was destroyed.

  The shredding was discovered in April by an agency supervisor who
witnessed what appeared to be unauthorized destruction of documents. The
I.N.S. office of internal audit, the Justice Department's inspector general
and the United States attorney's office for Southern California conducted
the investigation that led to this week's indictments.

  Ms. Randall and Mr. Salazar were each charged with conspiracy and five
counts of willfully destroying documents filed with the I.N.S. The
conspiracy charge carries a maximum penalty of five years in federal prison.
Each of the other counts can bring three years in prison.

  Their subordinates were not charged because they were low-level
workers acting on instructions, the government said.

  After the shredding was discovered, the immigration service opened a
hotline for people who suspected their paperwork had been destroyed. Agency
officials helped petitioners reconstruct their files and gave applicants the
benefit of the doubt if they could not replace the documents they had
submitted, said Lori Haley, a spokeswoman for the I.N.S.'s western regional
office.

  She said the agency made an effort last year to publicize the problem
and was confident that it had rebuilt most of the lost files. She also said
that additional staff members had been hired at the center and that
oversight had been tightened.

  Monitoring of the activities of the support services contractor has
been enhanced at the service center, Ms. Haley said. All materials to be
shredded or destroyed are reviewed first by I.N.S. personnel to make sure
that no unauthorized materials are destroyed.

  Ms. Randall's lawyer, Joseph G. Cavallo, said today that he had not
read the charges and would not comment. He said, however, that Ms. Randall
would plead not guilty at her arraignment on Monday. Mr. Salazar's lawyer,
Tom Brown, did not return calls seeking comment.

  The four document processing centers are operated under a $325 million
contract with JHM Research and Development of Maryland, which in turn
subcontracts the operations to two other companies. John Macklin, president
of JHM, was unavailable for comment.

PROPHET,  PATRIOT,  PLAYER,  OR PHONY?

In November of 1990, I received a call from Bill Hamilton, the owner of the
Inslaw Corporation.  Inslaw was, at that time, involved in a nasty legal
fight with the Department of Justice over allegations that the Department of
Justice had stolen Inslaw's proprietary software called Promis[e]  One of
the chief witnesses in the case was a mysterious genius named Michael J.
Riconosciuto.  Riconosciuto was preparing a declaration to submit in the
Inslaw case; he was receiving threats from Department of Justice officials if
he filed his statement with the court.  Hamilton was aware that I had
researched the Riconosciuto family connections in the State of California.
He wanted background information on his star witness.

In January of 1991, Riconosciuto filed his declaration and he was immediately
arrested and jailed on drug charges in the State of Washington.  The
prosecutor in this drug case was Michael T. Hurley whose name also surfaces
in the downing of Pan Am 103 over Lockerbie, Scotland in December of 1988.
Hamilton wanted to know if I would accept collect calls from Riconosciuto
while he remained in jail in Washington.  I told him I would and so began,
what Riconosciuto calls, the great adventure

Riconosciuto asked me if I had a fax machine; I replied in the affirmative
and he requested that I keep it fully loaded with paper.  The first fax I
received simply stated, Welcome to the adventure.  The second fax was
signed by Ray Lavas and contained a fax number to respond to if I had
questions.  Over the next four months my fax machine spat out over 2500 pages
of documents independently confirming what Riconosciuto told me in many tape
recorded conversations.

Reporters dealing with a wide array of subjects called me constantly, telling
me that Riconosciuto had asked them to call.  Suddenly I was receiving a fast
track education on satanic cults, small arms trafficking, the covert use of
Indian reservations nationwide, bio-mass burning plants, Trojan horses
installed in computers, the Nixon/Reagan/Bush mafia, money laundering through
the national HUD agency, the CIA/mafia bust out of savings and loans, sexual
slaves used to compromise power mongers, Vietnam drug money laundered to CIA
banks, fuel explosives, [and] chemical and biological warfare weapons.  When
fellow reporters questioned the reality of Riconosciuto's statements, I would
convey their doubt.  Within hours more documents would arrive that would
verify the truth of his allegations.

When Riconosciuto made allegations that the United States had developed a
gene specific biological warfare weapon that could be used to eliminate
specific races, he was laughed at by the few reporters still contacting him.
By this time few journalists could afford his collect calls from jail;  fewer
still considered the story important.  Most correspondents considered him
crazy or a pathological liar.  They had bought the government line. No one
thought his story about biological weapons was true.

Then my fax machine spat out  a two page letter dated January 20, 1983
addressed to Dr. Harry Fair of Tactical Technology in Arlington, Virginia.
The letter was signed by CIA operative John P. Nichols (Who is Nichols? Click
p. 1, Click p.2, Click p.3.) and was on the letterhead of Cabazon Arms, a
joint venture between the small Cabazon Band of Mission Indians and the giant
Wackenhut Security firm of Coral Gables, Florida often called the CIA's
CIA.   In page one, paragraph two, the following statement:



On February 15, 1983, I will be forwarding to you a unique list of agents

David Brock was the lead gun on The American Spectator's
anti-Clinton
hit squad -- that is, before he switched sides.  Now he says Ted
Olson,
Bush's lawyer, was, too.  Should we care?

If you're a Salon.com reader, you may be wondering why Ted Olson
isn't
in jail by now.  Despite his evasive disavowals, blared a
recent
headline in the on-line magazine, Salon investigations showed
the
right-wing consigliere was deeply involved in a sordid plot to
bring
down President Clinton. According to evidence assembled by an
investigative team, for a time in the nineties, Ted Olson did
legal work
for The American Spectator -- a magazine that published articles
critical of Bill Clinton.  And that's not all.  On at least one
occasion, Olson himself wrote a story hostile both to Clinton and
to his
wife.

Naturally, it was only a matter of time before the scoop --
evidence of
Olson's deep involvement in an evil plot to produce unflattering
magazine articles -- was noticed on Capitol Hill.  The time came
in
April, when President Bush nominated Olson to be the U.S.
solicitor
general.  Olson had seemed a natural choice for the job.  He was
generally well regarded in Washington.  Most significant, he had
argued
many times before the Supreme Court, including on behalf of the
Bush
campaign during the Florida recount.  He was considered
reasonably
scholarly and reliably conservative -- just what you'd want if
you were
George W.  Bush and in the market for a solicitor general.

Then the Salon.com bombshell dropped.

Democrats on the judiciary committee asked Olson pointed
questions about
his affiliation with The American Spectator.  Pat Leahy of
Vermont was
particularly eager to discover what Olson might know about the
Arkansas
Project, the Spectator's investigation into Clinton's behavior
as
governor of Arkansas.  Were you involved in the so-called
Arkansas
Project at any time? Leahy wanted to know.  When and how did
you first
become aware of the Arkansas Project?

Olson's replies were straightforward.  Pointing out that he was
not an
employee but a member of the magazine's board, Olson said he had
no
direct role in the Arkansas Project.  He said that he first
became aware
of the project sometime in 1998.  The one Clinton story he wrote
for the
magazine had nothing to do with it.

The story might have ended here if the judiciary committee hadn't
heard
from David Brock.  Brock used to work at the Spectator.  He had a
different memory.

According to Brock, Ted Olson's role in the magazine's
anti-Clinton
stories was larger than he had admitted.  As Brock later told the
Washington Post, Olson attended dinners at the home of Bob
Tyrrell, The
American Spectator's editor-in-chief.  Some of those dinners,
Brock
alleged, were actually editorial planning sessions, on articles
on the
Clintons in Arkansas.

Senator Leahy was appalled.  He demanded that Olson turn over
any
minutes, audits, or records pertaining to anti-Clinton articles
and the
Arkansas Project.

And he suggested that investigators from the judiciary committee
obtain
information firsthand from writers and editors who worked at the
Spectator during the years Olson served on the board.  In the
meantime,
Olson's journey to the solicitor general's office stalled.

There are two striking things about Ted Olson's recent
experiences in
the Senate.  One is that so far, hardly anyone on Olson's side --
or,
for that matter, at the ACLU or on the Washington Post's
editorial page
-- has cried McCarthyism.

Olson has not been charged with a crime.  He stands accused of
being in
the company of journalists who dislike Bill Clinton.  This
shouldn't be
enough to derail a nomination.

The other thing is that Brock was able with a straight face to
describe
any dinner at Bob Tyrrell's house as an editorial planning
session. To
anyone who has ever eaten dinner with Bob Tyrrell (and I have a
number
of times), this is ludicrous.  A sober Tyrrell sitting at the
table,
sharing his editorial vision, listening as story ideas are batted
around?  Impossible to imagine.  Perhaps Brock was using
editorial
planning session as an amusing euphemism.

But he almost certainly wasn't.  Which is part of the reason the
entire
sordid plot theory is so ridiculously improbable.  Bob Tyrrell
was
never at the center of a powerful conspiracy.  He was a buffoon.
The
Arkansas Project never came close to bringing down the president.
The
investigation didn't even produce a credible magazine story.
Indeed,
the Arkansas Project -- wasteful, misguided, and
credibility-sapping --
is one of the main reasons The American Spectator no longer
exists in
recognizable form.  It's now a business magazine.  The Arkansas
Project
didn't destroy Clinton.  It destroyed The American Spectator.

So, was Ted Olson, as a member of the board of a small
conservative
magazine, a threat to American democracy?  Even Pat Leahy must
know

Bay to secure the release of Dr. William Beanes, who had been captured after
the burning of Washington, D.C. The release was secured, but Key was detained
on ship overnight during the shelling of Fort McHenry, one of the forts
defending Baltimore. In the morning, he was so delighted to see the American
flag still flying over the fort that he began a poem to commemorate the
occasion. First published under the title “Defense of Fort M'Henry,” and later
as “The Star-Spangled Banner,” the poem soon attained wide popularity as sung
to the tune “To Anacreon in Heaven.” The origin of this tune is obscure, but it
may have been written by John Stafford Smith, a British composer born in 1750.
“The Star-Spangled Banner” was officially made the National Anthem by Congress

Is 'The Patriot' patriotic

The furor over "The Patriot," the "patriotic" movie that enshrines honor,
family, liberty, gore and banality, raises yet again the question: What do we
know about our birthright, as sons and daughters of the Revolutionary War?
One school of thought, in a comfortable sedentary way, says: Why all the fuss?
Everybody knows "The Star-Spangled Banner" version of American history.
These assumptions are not safe, not even professionally. A consequence of
holding to that position was drastically suffered by a young columnist in
Boston. Conservative Jeff Jacoby, writing his biweekly column for The Boston
Globe, filed a piece in which he recounted the future lives of the 56 signers
of the Declaration of Independence: X number imprisoned, Y number killed in
action, Z number dispossessed.

Most of us first heard about the ill-fated Founders at age 6, and again every
year or two since then. But lo! Mr. Jacoby neglected to introduce his column on
the Founders' fate by acknowledging that it was old stuff -- and he got
suspended! On hearing this, one had the feeling it would be deceptive to relay
in a column the arguments of "Areopagitica" without first confessing that John
Milton had first come up with them.

So then: We have a movie. It is written by Robert Rodat, who gave us "Saving
Private Ryan," and it is directed by Roland Emmerich, who gave us "Independence
Day" and "Godzilla." The hero is Mel Gibson, the villain is Jason Isaacs. The
plot is the South Carolina chapter of the Revolutionary War. The contested
parts of the movie have to do with British conduct during the war, and with
slavery.

Question: Is it believable, let alone true, that British officers would
incinerate an entire congregation of men, women and children trapped in a
church during Sunday services? Was the British attitude toward life
indistinguishable from that of Nazi Germany and the Soviet Union?

David Horowitz, the distinguished author and bellicose critic of wanton anti-
Americanism, weighed in heavily on the whole question in his important and
lively FrontPagemag.com Web site. He begins by reminding us that the extent of
historical ignorance in America is, well, unbelievable. A recent survey of 55
leading colleges and universities revealed that 80 percent of seniors are
virtually illiterate in the subject. They could not, for instance, identify
Patrick Henry. (If Mr. Jacoby, when he resumes his column, reveals that Patrick
Henry was the man who said "Give me liberty or give me death!" he should
remember to cite his sources.)

Mr. Horowitz defends persuasively the conviction that the Revolutionary War
brought on a crystallization of the ideals of the Founders. By no means
complete -- the abolition of slavery, the enfranchisement of women were years
ahead -- but to ignore the war's idealistic contribution to the idea of freedom
and equality is greatly to disserve it, as also the sacrifices endured.
Granted that most men of the soil will fight to resist oppressors, whether
Americans, Nazis or communists, wars can nevertheless be distinguished from the
mere genus-war when a strategic goal in sight is such as the goals of freedom
and liberty enunciated in the Declaration of Independence.

In 1774 an old statute imposed on a slaveowner who killed his own slave the
trivial sentence of one year in jail. Mr. Horowitz reminds us that "Eight years
later, when the revolution had been won, the North Carolina legislature changed
the law, saying the old law was 'disgraceful to humanity and degrading in the
highest degree to the laws and principles of a free, Christian and enlightened
country' because it drew a 'distinction of criminality between the murder of a
white person and of one who is equally

British troops. Does this movie have an ulterior motive?

the British press lit up with furious headlines. "Truth is first casualty in
Hollywood's War," read one in the Daily Telegraph. Another story, about the
historical model for Mel Gibson's character was titled, "The Secret Shame of
Mel's New Hero." The accompanying articles complained that the new
Revolutionary War epic portrays British redcoats as "bloodthirsty and
unprincipled stormtroopers" and "bloodthirsty child-killers."

The prizewinning historian and biographer Andrew Roberts called the film
"racist" in the Daily Express, and pointed out that it was only the latest in
a series of films like "Titanic," "Michael Collins" and "The Jungle Book"
remake that have depicted the British as "treacherous, cowardly, evil [and]
sadistic." Roberts had a theory: "With their own record of killing 12 million
American Indians and supporting slavery for four decades after the British
abolished it, Americans wish to project their historical guilt onto someone
else."

I can only imagine how much angrier Fleet Street's pundits will be after they
have actually seen the movie. "The Patriot" will not open in England until
August, but when it does, Brits will see a supposedly authentic historical
epic that radically rewrites the known history of the Revolutionary War. It
does so by casting George III's redcoats as cartoonish paragons of evil who
commit one monstrous -- but wholly invented -- atrocity after another. In one
scene, the most harrowing of the film, redcoats round up a village of
screaming women and children and old men, lock them in a church and set the
whole chapel on fire. If you didn't know anything about the Revolution, you
might actually believe the British army in North America was made up of
astonishingly cruel, even demonic, sadists who really did do this kind of
thing -- as if they were the 18th century equivalent of the Nazi SS. Yet no
action of the sort ever happened during the war for independence, but an
eerily identical war crime -- one of the most notorious atrocities of World
War II -- was carried out by the Nazis in France in 1944.

As a film critic for the New York Post, I found "The Patriot" well made and
often exciting. But I also found it disturbing in a way that many weaker,
dumber films are not. It's not just that it willfully distorts history in a
manner that goes way beyond the traditional poetic license employed by
Hollywood, it's the strange, primitive politics that seem to underlie that
distortion.

"The Patriot" is a movie that doesn't "get" patriotism -- in either a modern
or the 18th century sense of the word. The only memorable, explicit political
sentiment voiced comes when Gibson's character makes the rather Tory comment
that he sees no advantage in replacing the tyranny of one man 3,000 miles
away for the tyranny of 3,000 men, one mile away. The deliberate lacuna
demonstrates a total lack of understanding of, or even a kind of hostility
to, the patriotic politics that motivated the founding fathers.

You could actually argue without too much exaggeration that "The Patriot" is
as fascist a film (and I use the term in its literal sense, not as a synonym
for "bad") as anything made in decades. It's even more fascist than "Fight
Club," that ode to violence, barely repressed homoeroticism and the rejection
of consumer capitalism.

"The Patriot" presents a deeply sentimental cult of the family, casts
unusually Aryan-looking heroes and avoids any democratic or political context
in its portrayal of the Revolutionary War. Instead of such context, it offers
a story in which the desire for blood vengeance -- for a son shot by a
British officer -- turns Gibson's character into a "patriot." Meanwhile, the
imagery piles up:


In one scene towheaded preteens are armed by their father and turned into the
equivalent of the Werwolf boy-soldiers that the Third Reich was thought to
have recruited from the Hitler Youth to carry out guerrilla attacks against
the invading Allies.

In the film's most exciting sequence, Gibson is provoked by the foreigner
into becoming one of those bloodied, ax-wielding forest supermen so beloved
in Nazi folk-iconography: an 18-century equivalent of the Goth leader
Arminius (aka Hermann the German) who annihilated two Roman Legions in the
Teutoburger Forest.

The black population of South Carolina -- where the film is set -- is
basically depicted as happy loyal slaves, or equally happy (and unlikely)
freedmen.
But the most disturbing thing about "The Patriot" is not just that German
director Roland Emmerich (director of the jingoistic "Independence Day") and
his screenwriter Robert Rodat (who was criticized for excluding British and
other Allied soldiers from his script for

Can't speak for any potential 'ulterior motive', but the British in the
southern campaign, especially "Butcher" Tarleton, were especially
savage, so much so they began to alienate their loyalist supporters...

Revolutionary War utilized native Americans, most notably the Iroquois
nation, in its campaign against the American forces...and the troops
containing the native Americans perpetrated some God-awful
atrocities

Of course, so did the Americans...that was the way it was, each side
committed atrocities, and that was true whether it was between Great
Britain and its troublesome colonists to the west, or a war between
neighboring Indian tribes or one between neighboring European
nations...

It wasn't until after WWI that nations considered anything along the
lines of a "Geneva Convention" delineating 'rules of war'...before
that, anything went, and usually did...

roaming the Carolina countryside with his troops, setting fire to
various rebel establishments, they came upon a band of rebels who
sought to surrender.  Instead of accepting their surrender like a
gentleman, he and his troops set upon their victims with their
bayonets, and continued the slaughter for over a quarter of an hour,
circling back and repeatedly stabbing those they'd already downed,
making sure no one was left alive...

The British in the northern campaign were relatively more civilized...

He was much better in Braveheart. He does action scenes well. But this
role required ACTING in closeup, and he just can't do it. He ruined the
movie.

He probably made 15 or 20 Mil for this picture.
Only in an economic system like this could a bad
actor be paid that kind of money for such shoddy
work.

 is from New York State, but my memory is hazy on that...

I Just saw The Patriot. This is one of the worst movies I've seen in years.
And I see lots of movies.

Mell Gibson ruins every scene he is in. With all the money he makes for
such incompetent work, you would think that he would invest in acting lessons.

Every single actor in the movie turns in a better performance than he does.
That includes some very young children.

The movie is beautiful to look at and the production is impressive, but the
script consists of strung together clichés punctuated by very bad acting by
the lead. Even the supporting cast couldn't protect The Patriot from foreign
invader Mel Gibson.

is from New York State, but my memory is hazy on that...

  violence), that is only a few thousand off.  But you are not allowed to
  question his story or you are a no-good that needs to be controlled.

  of sounds like another leader we hear so much about who runs a small
island
  called Cuba.

  Clinton fired back with his old," lets ask the parents of the slain
  children" thing.
  Well once more he was talking and not paying attention to what the people

  are saying.
  The parents already said it wasn't the gun and the regulations he was
  asking for wouldn't have prevented what happened.  My question is, why
  isn't someone asking Clinton about all the children he has killed.  I
think
  there were several in the Compound at Waco who died.  However he also
  killed their parents, so who was left to complain?

  Once in the country we had an actor who became president.  He wasn't a
  great actor but he was a fair president.  Now we have a president who is
a
  great actor.  His only short-coming is that he lies then forgets to get
the
  facts for the next lie.
  However, you are not allowed to say anything because then you are picking

  on him and that's not allowed.
  I have said it many times and I will say it again, crime and guns don't
  have any connection other than being a tool - like a knife, car,
  screwdriver, or any other tool that a criminal will use.  When laws are
  passed, they only affect law abiding citizens - criminals don't obey the
  law.  Our government is after control of our land and our lives, and the
  only way to get total control is by disarming us.  That is the only
  agenda.  Look at what happened to the crime rate in England and Australia

  after they took all the firearms.  You have to be blind not to see what
  that did.

  Mr.  LaPierre, unlike Clinton, is speaking for 3.8 million NRA members
and
  80,000,000 gun owners, He is also speaking of our Constitution and the
  rights we as Americans enjoy to remain free people.  Clinton is speaking
  for whoever pays him the most money and gives him the most power, and he
  sure doesn't speak about the Constitution or your rights.  Clinton
doesn't
  like the Constitution and has said so on many occasions.  Clinton thinks
  our rights are there only to get in his way and keep him from his agenda
of
  Socialism.  It's the old "trust me I know what is best for you" story all

  over again.

  I saw a movie once where they built a wall around New York City and
turned
  it into a prison.  I think this is one time when life should imitate art
  and we could put the Clintons in there to take control and run that
prison
  all they wanted to.  I would volunteer to be a guard as long as we could
  shoot anyone trying to escape.

  America needs to get back to what it has always been: land of the free
and
  home of the brave.  We need our president and all elected and appointed
  officials to quit wasting our time and theirs, our money and theirs, on
  this stupid agenda of the Presidents.  There is no excuse for stupid,
  remember that.  There is also no way you can ever trust a liar or a draft

  dodger, unfortunately we have one in the White House.  Now Mr.  Clinton,
  tell me which part isn't true.

  On March 13, the last day available to sue for judicial review, I filed a
  petition in chancery court in Davidson County (Nashville) asking that an
  adverse ruling in a kangaroo court, better known as a judicial hearing,
he
  overturned and that Tennnessee Department of Safety Commissioner Mike
  Greene be ordered to renew my driver's license, absent a social security
  number on my renewal slip.

  A compromise proposal sent a week before had gone unanswered. I believe
  that an end to this conflict will emerge from the concepts outlined
there.

  I am a religious objector to social security, a Christian who separated
  myself from social security by a lawful action in recission, and refuse
to
  enter into social security so that driver license officials can have a
  number on the license renewal blank. My license is said to have "expired"
  in the course of my legal proceedings against the commissioner over this
  issue. A petition for writ of mandamus in the matter was recently
dismissed.

  Let me briefly describe the nature of this settlement offer, as it may
shed
  light on how one who has rescinded from social security might view the
use
  by civil authority of his revoked number.

  U.S. appellate decisions in Bowen v. Roy, 476 U.S. 693 (1986) and Leahy
v.
  District of Columbia, 833 F.2d 1046 (D.C. Cir. 1987), make clear that one
  cannot have a religious objection to an internal operation of government,
  such as the color of its filing cabinets or the use or content of its
  internal records.

  Tennessee civil authorities my former social security number on file. I
may
  have given an SSN in the late '80s to the Department of Safety. In past
  years I filed tax returns with the Department of Revenue containing the
  number.

  I cannot, under these controlling rulings, have any religious objection
to
  the use of this former number. Such a number is a matter of government
  record; it is not my property and I have no interest in it. And, in fact,
I
  do not have any religious objection to its use.

  My constitutionally protected religious objection throughout this
conflict
  has remained consistent. I object to the commissioner's demand that I go
  out and enter a contractually binding application with social security.
  Neither can I, under penalty of perjury, present my rescinded social
  security number, which I stopped using since my December 1996 recission
and
  revocation filing.

  My proposal was as follows: that the commissioner attach to my renewal
form
  a number of his choosing to make my application for driver's license
  renewal acceptable to him. He would accept my truthful, good-faith answer
  to the renewal form's "SSN" question, that answer being "religious
  objector." By this means the commissioner could be satisfied that he has
  accomplished his duty in recording a suitable number for the licensee.

  I am confident of obtaining relief at some point, almost certainly under
  the Leahy doctrine, which came into play in a similar case in the early
  1990s.

  For all the words I am offering here about the merits of my claim, what
  matters most is not their efficacy or verity, but the mercy of God on His
  people.

  I am throwing myself upon God's providence, knowing that He is my
advocate,
  and that there is no stronghold that He is unable to tear down if He
  chooses, so that all Israel will roar, as they did when Elijah confronted
  Ahab on Mount Carmel, "The LORD, He is God! The LORD, He is God!"

  I am not presuming on the Lord to give me victory. He may consign me to

  of the latest issue (about 8 weeks old).  On a related front,  Ohio
  currently is in the process of getting 5 - 50 man anti-terrorist

  (Columbus) and the Akron/Canton/Youngstown area.  These units are
  funded via a separate channel and are not funded by the state

  not being informed of these unit activations, the reason given is the
  usual "need to Know" excuse.

  These units have training from and are rotating out of Rangers, Delta
  (Combat Applications Group), SOCOM, and other 'snake-eater' groups.
  This has been in the works for the last couple of years.  Originally
  each state was supposed to get one 50 man unit.  Ohio requested, and
  apparently obtained, a total of 5 (250 men total). Other states have
  at least one 50 man unit with some states getting additional teams as
  needed or requested.  These state groups are not to be confused with
  the unit that is featured with the above shoulder patch.  That
  apparently is a national or federal antiterrorism team.

  It should be obvious that everyone should be concerned over the
  constitutional questions as to the legality of such military teams
  acting domestically.  Of equal concern to me is that due to the cult
  of secrecy of our military forces, it is very unclear just what role
  and power these new units have or will have.  I'm especially
  concerned that in an age of decreased domestic terrorism (The US is
  currently at a 20 year low) the rapid and ill defined expansion of
  police state groups such as this will cause more domestic incidents
  such as the bungled raid at Waco.  When the only tool you have is a
  hammer every problem looks like a nail.

  interesting about it is that its logo indicates that it is a Dept of
  DEFENSE patch ... *not* a patch of *civilian* law enforcement -- Dept of
  Justice, FBI, ATF, etc.

  Thus, the *real* questions are crucial *Constitutional* questions:

  1.  Does this patch imply that *domestic* counter-terrorism efforts in

  *civilian* sector are now under the direction and control of a *military*
  task force in the Dept of Defense, rather than under control of

  domestic law enforcement agencies?

  2.  Are there parallel Anti-Terrorism Task Forces in the *civilian* Dept

  redundancy, turf-wars and information-hoarding?  Of if they are

  *military* anti-terrorism officers and staff active in *civilian*

Is There Evidence That A Missile Might Shoot Down Air Force One?
Keep Your Friends and Family Off That Plane!!

Aptos,CA  (RMnews)-- President Clinton, leaves an uncertain fate behind as he
departs  Saturday morning on a trip to Israel.

The officially stated reason for the trip is to bolster the faltering Wye
River peace accords that were signed by President Netanyahu and Yassar Arafat
last month. The peace talks which were held on the Wye River Plantation, about
an hour out of Washington, DC, were brokered by President Clinton. When the
peace talks ended, it appeared that the President had been successful in
bringing peace to the middle east.

However, the peace accords starting falling apart the moment they were over.
Now President Clinton. In the middle of impeachment hearings, is traveling to
Israeli to try to put the peace accords back in place.

The President is taking about 20 members of Congress with him to Israel,
including 3 Republican moderates who have not yet  decided how they will vote
on impeachment, and will surely be strong armed on the trip to vote against
impeachment.

Back in Washington, the Democrats have issued orders that all of the House of
Representatives MUST be in Washington for the impeachment vote. Travel,
sickness, family emergencies and hospital stays will not matter. All
Democratic members have been ordered by the White House to be on the floor for
the impeachment vote.

A battery of Patriot Missiles has been shipped to Israel and will be in place
before the President arrives. Pentagon Spokesman, Ken Bacon, (the same man who
authorized release of Linda Tripp's private defense personnel file) was vague
on the reason the Patriot missiles were shipped to Israel at this particular
time.

Does the military or our intelligence agencies have information that the
President's plane might be in danger in Israel? Could there be people who
believe that Saddam Hussein might try to shoot down Air Force One?

And if this kind of intelligence has been released, how can the President's
handlers justify his going to Israel at this particular time?

RMNews Conspiracy theories:

1. The President never lets anyone know which plane he is going to fly in. At
one time, when he was afraid that members of the United States military might
sabotage Air force One, he was actually letting a double fly on board AF1 and
he was flying in the back-seat of a Navy fighter. Could the President be
planning to set up the 3 Republican members of the House, and let them be shot
down on Air Force 1?

2. Who else is going to be on board that plane? Are there any potential grand
jury witnesses, like Harold Ickes, who are going to be on board?  would the
crash of the airplane put all the investigations behind him, just like the
crash of the Ron Brown plane in Yugoslavia, put all of the Ron Brown
investigations behind the President. If Ron Brown had lived, he would surely
have provided, according to his own words, evidence that the President had
profited from illegal gas line business deals. Ron Brown was also the head of
the Democratic National Committee at the time the Chinese money was flowing
in. What could Ron Brown have told us about the president's involvement in
this? Who is leaving Saturday morning on board Air Force One with the
President? Whose voice could be silenced if AF1 is shot down by a missile?

3. The impeachment hearings would be forgotten if AF1 was shot down.

4. Could the President be planning to fake his death and disappear so he
doesn't end up in prison or drawn and quartered like the Canadians want to do
to him. If you haven't heard about this angle yet, you need to start reading
about the Arkansas blood scandal. governor Clinton okayed a scheme to sell
tainted prisoner blood to Canada. Now Canadians are contracting Hepatitis C
and HIV. They are ready to draw are quarter our President. I wonder what would
happen to the President if he visited Canada instead of Israel right now? If
the President is afraid that more and more information is about to come out on
him that will destroy his reputation in history forever, maybe he is getting
ready to fake his death.

5. If the President fakes his death, who will be the major winner? Hillary, of
course. The roar of the public will demand that Al Gore appoint her as vice
President. Soon the Gore scandals will force  President Gore to resign, and
then we will have President Hillary. She will be reelected by a landslide in
the year 2000. There is virtually nothing that could stop this landslide vote.

6.  If the real plan for the Israeli  visit is to fake the death of the
President so Hillary can become President, then someone better warn Bill to
put aside some insurance policies to insure that Hillary doesn't see to it
that he death is not faked? In other words, if Hillary is better off with him
dead than alive, do you
