Guys I feel that here we are dealing with an aversion to sex, people when are in the process of the trauma of coming in terms with their identity as a gay person do tend to think that sex is horrible. They feel that by rejecting sex or the biologcal needs of the body they are in some manner raitonalising themself. Its a state of self denial. Its part of the battle and we have to be supportive. The bill replaces a previous law on registered partnership that was struck down by the Constitutional Court in December 2008 just weeks before its supposed entry into force. As opposed to the previous version, the new bill introduces the institution of registered partnership only for same sex couples, however, it also introduces a different scheme of domestic partnership registration for both same sex and different sex couples. Support for the bill in the Parliament is still an open question. Two months ago, on December 15, 2008 the Hungarian Constitutional Court ruled that the law on registered partnership adopted by the Hungarian Parliament a year earlier was unconstitutional. The Court found that the solution chosen by the legislator – i.e. creating an institution similar to marriage for both same sex and different sex couples – duplicates the institution of marriage for different sex couples, and thus contradicts the special protection of marriage enshrined in the Constitution. On the other hand the Court also held that same sex couples have the right to an institution similar to marriage. Within a day Prime Minister Ferenc Gyurcsány instructed the Minister of Justice and Law Enforcement to prepare a new bill on registered partnership taking into account the opinion of the Court. After consultations with various LGBT organizations, the Ministry prepared a new bill that has been approved by the Government today. The new bill retains much of the content of the previous bill with one exception: the institution of registered partnership would only be available to same sex couples. Establishment and dissolution of registered partnerships would be the same as for marriage, and registered partners would be entitled to most of the rights available for married couples. Notable exceptions are the right to take the partners' name and the right to adopt children. Besides introducing registered partnerships for same sex couples, the bill would also introduce a new scheme for registering domestic partnerships. Unlike registered partnership, this new opportunity would not grant any new rights or duties to couples cohabiting without marriage, but would only make it easier for them to prove the existence of such a relationship. This second registration scheme would be available to both same sex and different sex couples. Although the Government fully supports the new bill, its adoption by the Parliament is still an open question. Hungary currently has a minority government after the liberals left the government coalition early last year. Conservative opposition parties heavily criticized the previous bill on the account that it introduced same sex marriage under a different name. It is yet to be seen whether their position has changed as a result of the Constitutional Court declaring such an institution a constitutional right. Based on parliamentary mathematics the bill has a high chance of being passed: governing parties hardly ever vote against proposals by their own government and the liberals fully support the new bill. It is, however, very hard to predict how delicate negotiations involved in running a minority government will affect voting on the bill. *Portugal**: important steps towards equal access to marriage * *by Paulo Corte Real, Associação ILGA Portugal* There is an upcoming election for Parliament in Portugal this year and same-sex marriage is currently a key political issue. In Portugal, unregistered civil unions are available for all couples (including same-sex couples) since 2001; and the Portuguese Constitution explicitly forbids discrimination based on sexual orientation since 2004. This constitutional provision and the resonance of the Spanish example have been particularly relevant in the fight for same-sex marriage in Portugal, that has included several initiatives, such as: - a Petition promoted by Associação ILGA Portugal, that was recently discussed in Parliament - a court case regarding a lesbian couple that tried to get married; the case has now reached the Constitutional Court and also generated the publication of several books by legal experts on same-sex marriage; - bill proposals by two minority parties, Bloco de Esquerda and Partido Ecologista “Os Verdes”, that were recently rejected in Parliament. Gays and lesbians faced discrimination in all areas of society, including family, work, and education. Activists reported that in most cases, homosexuals who did not hide their orientation were fired from their jobs. Homosexuals also faced physical attacks, rape, and blackmail. Police committed crimes against homosexuals and used the threat of arrest to coerce victims into not reporting the incidents. Voices Against 377, a high profile campaign to overturn Section 377, which outlaws homosexuality, continued its efforts during the year. On August 27, the Law Ministry rejected the demand of the Health Ministry to legalize homosexuality. In 2006 the Supreme Court ruled that the Delhi High Court should not have dismissed an earlier case challenging Section 377 brought by two NGOs and returned the case to the Delhi High Court, which began hearings on September 18. The government opposed the case based upon the Ministry of Home Affairs' view that homosexuality is morally wrong. On November 7, the Delhi High Court allowed litigants one week to present final statements. The case continued at year's end. On May 21, 40 gay and transgender groups collaborated on a bid for funding from the International Global Fund for AIDS, Tuberculosis, and Malaria (GFATM). The occasion marked the first time the groups had formed a united front to secure benefits for their cause. On August 28, the Home Ministry informed the Delhi High Court that it was not empowered to issue directions to treat transsexuals as a special class entitled to jobs and other benefits. The Ministry was responding to the Public Interest Litigation regarding the dismissal of Sanju Behra from the CRPF on the grounds of gender ambiguity. Notices were issued to the CISF, Home Ministry, Ministry of Women and Child Development, and the Health Ministry during the year. In December the central government submitted a report which asserted that legalizing homosexuality would lead to more cases of HIV/AIDS. In March 2007 the UN Development Program released a report on launda dancers, young men and boys hired to dance in women's clothing at various events in Bihar and Uttar Pradesh. Dancers were vulnerable to exploitation by being cheated of earnings or being forced into prostitution. Sexual assault and gang rape were frequent, and dancers were at high risk of contracting HIV/AIDS. Some laundas who had illegal castrations to join the hijra (traditional transvestite) community suffered from post operation complications due to inadequate medical care. According to the National AIDS Control Organization (NACO), the government agency responsible for monitoring HIV/AIDS, there were approximately 2.3 million persons living with HIV/AIDS in the country, and according to the International Labor Organization (ILO), 70 percent of persons suffering from HIV/AIDS faced discrimination. HRW reported that many doctors refused to treat HIV-positive children and that some schools expelled or segregated them because they or their parents were HIV-positive. Many orphanages and other residential institutions rejected HIV-positive children or denied them housing. NACO, with support from UNAIDS and the WHO, produced revised AIDS estimates that showed as of December 2007 approximately 2.31 million persons were living with the virus and that HIV prevalence among adults was around 0.36 percent. Estimates for previous years (since 2002) have also been revised. On February 14, an AIDS victim's body was denied cremation in Kendrapara district, Orissa, due to fears the smoke from the funeral pyre would spread the virus. On August 13, Kerala became the first state to reserve government jobs for HIV-positive candidates. On August 14, an initiative to provide insurance to persons with HIV/AIDS was launched in Karnataka. The state estimated that 250,000 residents were infected with HIV/AIDS; however, only 22,000 were registered with the main HIV/AIDS NGO, the Karnataka Network for Positive People. If you feel flustered and feel that there are too many emails, I'd like to remind you that you don't have to leave just to stop us from clogging your inbox. You have the option of 1) getting your mails in digest form (however you will not be able to see the pictures in this format) Daily digest ... once or twice a day, you will receive an email -- text only -- listing all new postings ... just click on the messages link at the top of the digest to go to the web archive to see any attachments.) 2) or you can view mails directly on the web... and choose the option ... you can see what's new on the website and still keep a clear mailbox. You will never receive mail from us if you do that. YOU choose when to visit us ... and you can check out what you like and can skip over what doesn't interest you. 3)no email option I hope this helps.
