Hi

Have you stopped getting emails from this group suddenly? It is highly unlikely 
that your name has been deleted from the list. We do not delete anybody’s 
membership until and unless the person repeatedly spams or sends 
pornographic/crude emails

 you might not be getting your mails is because  your email is on the bouncing 
list. Some members have trouble with bouncing e-mails: Messages that are sent 
out by the group cannot be delivered to their mailboxes and are sent back to 
Yahoo. This can happen for various reasons, for example, when their mailboxes 
are full, or their e-mail addresses have become obsolete, etc. Yahoo doesn't 
tolerate bouncing mails and will deactivate these persons' memberships. It 
will, however, send you a reactivation request. All you have to do is reply 
to that (once you've fixed the problem with your mailbox), and Yahoo will 
resume sending you the messages. We will also send out these requests daily.

Bounced Messages
If you subscribe to a Yahoo Groups discussion group under one of the e-mail 
options (normal or digest), Yahoo Groups will suspend sending mail to you 
after repeated attempts bounce back. To see your recent bounced messages, 
view your Yahoo Groups preferences at http://groups.yahoo.com/myprefs and 
click Bounce history for your e-mail address. For more information on 
bounced-message handling by Yahoo Groups, search Yahoo Groups help for the word 
bounce.

Why does it say my account is bouncing?
If group messages sent to your email address are returned to Yahoo! Groups as 
undeliverable (bouncing), your Yahoo! Groups account may be temporarily 
disabled. 
Messages can be returned for several reasons: 
•   Your mailbox may be full -- try deleting messages from your Inbox. 
•   Your ISP may have a backlog of email to process -- contact your ISP. 
•   Your ISP may be blocking email from Yahoo! Groups -- contact your ISP. 
In many cases, Yahoo! Groups can automatically reactivate your account once the 
delivery problem is solved. However, in some cases you will need to manually 
reactivate your account: 
1.  Visit your My Groups page. 
2.  Look for a bounce alert near the top of the page. 
3.  Click the Alert link to reactivate your account.

that members post on this list

like to remind you that you don't have to leave just to stop us from 
clogging your inbox. 

You have the option of

to see the pictures in this format)
Daily digest ... once or twice a day, you will receive an
email -- text only -- listing all new postings ... just click on the
messages link at the top of the digest to go to the web archive to 
see any
attachments.)



2) or you can view mails directly on the web... and choose the 
option ...
you can see what's new on the website and still keep a clear

After a seven-year-long trial in Africa, scientists have for the first time
developed a vaccine that was succesful in reducing the rate of definite TB
infection by almost 39% among 2,000 HIV-infected patients in Tanzania. 

TB is the biggest killer of HIV-infected patients in the world. In India,
over 60% of HIV-infected patients with a weak immunity system get infected
with TB and ultimately die of it. 

Scientists from Dartmouth Medical School (DMS) have reported results of
their clinical trial of this new vaccine against TB -- Mycobacterium vaccae
(MV) -- in the January 29 online issue of the journal AIDS. The study will
be published in the March print issue of the journal. 

Principal investigator Ford von Reyn from DMS said, Since development of a
new vaccine against TB is a major international health priority, especially
for patients with HIV infection, we and our Tanzanian collaborators are very
encouraged by the results of the study. 

The vaccine is a type known as an inactivated, whole-cell mycobacterial
vaccine and is expected to be economical to produce and distribute. 

Von Reyn described the trial as a significant milestone -- the first to
demonstrate that any type of vaccine can prevent an infectious complication
of HIV in adults. 

He added that the next steps are to improve the manufacturing methods to
support the production of the larger quantities of the TB vaccine needed for
further studies and subsequent clinical use. 

Health ministry officials in Delhi say the vaccine gives tremendous hope to
India which has a huge burden of both TB and HIV patients. 

Of the over two million HIV-infected Indians, over 10% are expected to have
full blown AIDS. Every AIDS patient has 15% chance every year of developing
TB, which shows that every AIDS patient will develop TB some time in his
life. 

That's why under India's latest AIDS control programme, we are dealing with
TB and HIV simultaneously. When people become infected with TB and AIDS, it
is almost always an irreversible formula, ministry officials said. 

Since newly-infected HIV patients risk contracting TB almost immediately,
investigators are targeting a strategy for immunization with MV before
patients need to start taking antiretroviral drugs. 

The scientific team at Dartmouth began Phase-I human studies with MV in the
United States in 1994 and demonstrated that a multiple-dose series of MV was
safe in both healthy subjects and patients with HIV infection. 

The group then conducted Phase-II studies in larger groups of adults in
Zambia and in Finland. In the Zambian trial, researchers found that MV
boosted immune responses against TB that had first been primed in childhood
with the current TB vaccine, BCG. 

Subsequently, the DarDar group received NIH funding to conduct the large
Phase-III efficacy trial among HIV-infected patients with prior BCG
immunization in Tanzania. 

HIV patients are particularly vulnerable to TB because their immune systems
are compromised. The vaccine works by boosting the immune responses of
patients who have already been given the BCG vaccine earlier in life.

A PIL does not need a locus standi. Any bona fide citizen of the country or any 
Indian organization can file a PIL a court of law (not lower than a High Court) 
for any public cause if it finds that a law is being violated by anybody; by

being affected by such violation of law or not. If there is a law that all poor 
people will have to be given free food by the government, and a billionaire 
finds that the local administration is not giving free food to poor people in 
his area so that they remain hungry, he can file a PIL and sue the government 
for violating the law. The court has no business to ask him why he is filing 
his petition since he himself never remains hungry. It is the duty of the court 
to admit his petition and correct the situation.

Even a school dropout can understand this but not our Hon’ble Delhi High Court. 

Was it the first PIL which DHC came across? Had it never encountered any PIL 
before? Don’t our High Courts know that there is a system of PIL’s in most 
civil societies to force the government to implement, or stop the violation of, 
laws or the constitutional rights? Should we start training classes in 
preliminary law for our High Courts? Should we start a nursery school for our 
High Court judges? Or a pre-nursery?

If the petition was rejected only because it did not have a locus standi, then 
why did DHC sit over the petition for full three years before it could find 
this simple thing out (from September 2001 to September 2004)? Why was the 
petition not returned the very next day? Why was there a need to ask the 
government to submit its affidavit on the issue?

If DHC could not find locus standi in the petition, then how could Supreme 
Court find it on 3rd February 2006, the day it ordered DHC to hear the petition?

It is the biggest lie to say that the petition did not have a locus standi. If 
the person filing a PIL it is a bona fide citizen of India or any valid Indian 
organization, the PIL always has locus standi. Of course, if a foreign national 
files a PIL, it will not have a locus standi.

The exact words of DHC while dismissing the petition were – “Since there is no 
cause of action and just for testing the legislation, a petition cannot be 
filed. Therefore this petition is dismissed.”

The words which the Supreme Court used to order DHC to hear the petition were 
also equally strange – “This is not an academic question”.

Are the above sentences anything more than grammatically correct sentences? Do 
they have any content what so ever? They reject an issue concerning the lives 
of 10% of the population of a most populous country of the world (more than 10 
crore people) by using such sentences? Why is there no punishment prescribed 
for the judges for giving an incorrect verdict? When everybody is punished for 
their mistakes or for violating the law, why are the judges exempted? Why can’t 
we hang these judges by their neck till death? If a person tells a lie in a 
court of law, it is considered as a crime. It makes a criminal case against 
him. But what happens when a judge tells a lie in his verdict? Nothing?

Shri Ashok Row Kavi, it was not expected of a person of your stature to try to 
misguide me on when a case is rejected on its merits and when on a procedural 
issue. I may not have read law, but I can understand simple things, which, as I 
said before, even a school dropout can do.

The long arms of the law of the land

Change has been sweeping through the subcontinent in recent years. Nepal set
the precedent in embracing its LGBT citizens. India is slowly following. But
what of our neighbours Sri Lanka, Pakistan and Bangladesh?


Aditya Bondopadhyay, director of programmes, National MSM-Task Force, India,
which provides legal aid to community-based organisations to prevent
harassment of MSMs considers the question. “Barring India and Nepal, we find
active criminalisation in South Asia. For instance, Sri Lankan society poses
another challenge for activists who are trying to defend the rights of LGBT
individuals. It is a pity that Sri Lanka has taken a regressive step and
criminalised lesbian sexuality along with homosexual behaviour among men.”
Joining the debate, Shivananda Khan, Chief  Executive and founder of Naz
Foundation International that works to promote the sexual health of MSMs in
South Asia, says decriminalising homosexual behaviour among consenting
adults makes MSMs more socially acceptable.
Khan says, “The impact is visible. Some members of the government, civil
society and human rights organisations are beginning to initiate a dialogue
on how to replicate the Indian breakthrough. If you look at Pakistan and
Bangladesh, there are too many religious sanctions for civil society
interventions. It’s too risky to talk about the issue of MSMs in either
Pakistan or Afghanistan. It’s changing in Bangladesh now. There have been
small closed meetings in Pakistan but never a formal conference. I plan to
hold a conference in Pakistan this year.’’ Will more MSMs stand up now to
assert their rights?


The Naz Foundation International founder thinks that some will be able to
come out. “Others will not because of family and neighbourhood. We need to
change our attitude towards gender stereotypes and accept sexual diversity.”


Khan counts himself as being lucky since he comes from “a family that is
extremely tolerant, accepting, loving and caring. My mother found out when I
was 14-years-old but she said, “You are my son.” Her only apprehension was
that I would cross dress in public” he recalls.


“I never indulged in canopy behaviour. I don’t personally accept stigma
because I don’t allow it to affect me. I don’t let the attitude of other
people affect my life. Over time, I am very hopeful that homosexuals will
become more accepted. This has happened in all other countries where they
have changed the law. Its a slow education process at all levels.’’


It’s worth looking at laws related to homosexuality in the neighbouring
countries. In Nepal, the new government in 2007 legalised homosexuality
along with the introduction of new set laws. In late 2008, the Supreme Court
of Nepal directed the government to enact laws relating to equal rights to
LGBTIs. The ruling asked the government to form a committee to look into
same-sex marriages as well. A bill for this is expected to be introduced
this year.


Nepal’s Election Commission has also begun a massive project to grant
recognition to voters who are neither male or female but transsexuals and
transgenders. The next general election in Nepal will see a voter being
registered as male, female or third gender.The first country in South Asia
to recognise the rights of the LGBTI, the nation’s Central Bureau of
Statistics is  ontemplating including the third gender in the 2011 Census.


In Bangladesh, male to male sexual activity is still illegal and there are
no anti-discriminatory laws to protect MSMs. Sri Lanka is no better as there
is a total absence of non-discrimination laws or regulations which specify
protection for MSMs.


Coming to the transgender community — not much has changed in India despite
the fact that the Election Commission has given the community an independent
identity by letting them choose their gender as “other’’ on ballot forms.
There are still those who continue to react to the community in a sub-human
manner. Beauty pageants for transgenders make good human interest stories
for the media but what transgenders need is breathing space to earn their
livelihood and live with dignity.

New Delhi: The All India Muslim Personal Law Board on Monday challenged the
landmark Delhi High Court judgement decriminalising homosexuality in the
Supreme Court.

In its petition in the Supreme Court, the Muslim Law Board has argued that
decriminalising homosexuality poses a threat to Indian society and culture.

It is not the first time the ruling has been challenged in the apex court.

In 2009 astrologer Suresh Kaushal, too, had appealed against the judgement.
But the Supreme court refused to stay the High Court order.

The Delhi High Court had on June 2, 2009, decriminalised homosexuality. The
ladmark judgement was given by a two-judge bench comprising Chief Justice AP
Shah and Justice S Muralidahr.

The order said that criminalisation of gay sex among consenting adults
violated of fundamental rights.

The High Court observed that any kind of discrimination was the anti-thesis
to the right to equality while quashing Section 377 of the Indian Penal
Code., and was obstructing HIV/AIDS prevention efforts among high-risk
groups.

Section 377 of the Indian Penal Code (IPC) said an individual who
voluntarily has carnal intercourse against the order of nature with any
man, woman or animal shall be imprisoned for life or for a term exceeding
10 years and be liable to pay a fine

Love is in the air thanks to a magic potion whipped up by an
imaginative student in this playful independent comedy with music.
Timothy is a bright young man who is attending an upscale private
high school, Morgan Hill, thanks to the hard work and sacrifice of
his mother. Timothy is also gay and doesn't care who knows it,
which doesn't make him popular with his classmates; his closest
friends, a girl nicknamed Frankie and her boyfriend, Max, attend
another school.


Timothy has a serious crush on Jonathon, but Jonathon isn't
interested in boys, to Timothy's chagrin. Timothy is cast as Puck
in the school's spring musical, a musical adaptation of William
Shakespeare's A Midsummer Night's Dream, and inspired by his
character's machinations, Timothy tries to recreate the love
potion used in the play. Miraculously, Timothy arrives at a
formula that actually works, and after accidentally dousing Max
and having to fend off his advances, Timothy sprays Jonathan with
the concoction and soon has the boy of his dreams. However, before
long Timothy's magic potion gets loose, and things get very lively
on campus, among both the students and the teachers
