Hi

Have you stopped getting emails from this group suddenly? It is highly unlikely 
that your name has been deleted from the list. We do not delete anybody’s 
membership until and unless the person repeatedly spams or sends 
pornographic/crude emails

 you might not be getting your mails is because  your email is on the bouncing 
list. Some members have trouble with bouncing e-mails: Messages that are sent 
out by the group cannot be delivered to their mailboxes and are sent back to 
Yahoo. This can happen for various reasons, for example, when their mailboxes 
are full, or their e-mail addresses have become obsolete, etc. Yahoo doesn't 
tolerate bouncing mails and will deactivate these persons' memberships. It 
will, however, send you a reactivation request. All you have to do is reply 
to that (once you've fixed the problem with your mailbox), and Yahoo will 
resume sending you the messages. We will also send out these requests daily.

Bounced Messages
If you subscribe to a Yahoo Groups discussion group under one of the e-mail 
options (normal or digest), Yahoo Groups will suspend sending mail to you 
after repeated attempts bounce back. To see your recent bounced messages, 
view your Yahoo Groups preferences at http://groups.yahoo.com/myprefs and 
click Bounce history for your e-mail address. For more information on 
bounced-message handling by Yahoo Groups, search Yahoo Groups help for the word 
bounce.

Why does it say my account is bouncing?
If group messages sent to your email address are returned to Yahoo! Groups as 
undeliverable (bouncing), your Yahoo! Groups account may be temporarily 
disabled. 
Messages can be returned for several reasons: 
•   Your mailbox may be full -- try deleting messages from your Inbox. 
•   Your ISP may have a backlog of email to process -- contact your ISP. 
•   Your ISP may be blocking email from Yahoo! Groups -- contact your ISP. 
In many cases, Yahoo! Groups can automatically reactivate your account once the 
delivery problem is solved. However, in some cases you will need to manually 
reactivate your account: 
1.  Visit your My Groups page. 
2.  Look for a bounce alert near the top of the page. 
3.  Click the Alert link to reactivate your account.

please CLICK ON THE PERSON'S EMAIL ADDRESS while replying to him .
this will enable you to send a mail to the person with whom you want
to communicate.

if you click on the reply button, the message will go the entire
group. it is unfair and many persons have complained that they do
not want personal correspondence in their box.

funny, at times informative mails and also seeing the JPGs/pictures 
that members post on this list

However, at times you may get a lot of mail and it may flood your 
email box.

If you feel flustered and feel that there are too many emails, I'd 
like to remind you that you don't have to leave just to stop us from 
clogging your inbox. 

You have the option of

1) getting your mails in digest form (however you will not be able 
to see the pictures in this format)
Daily digest ... once or twice a day, you will receive an
email -- text only -- listing all new postings ... just click on the
messages link at the top of the digest to go to the web archive to 
see any
attachments.)



2) or you can view mails directly on the web... and choose the 
option ...
you can see what's new on the website and still keep a clear
mailbox. You will never receive mail from us if you do that. YOU 
choose
when to visit us ... and you can check out what you like and can 
skip over
what doesn't interest you.


3)no email option

I know that this group has been generating too many emails. Many 
subscribers are flustered at the number of mails. Some of you might

I dont think the guy talking from the side of gay community did a very good 
job, he was ok in my opinion, however he was far better than rohit bal on ndtv 
who could not even put together his thoughts to frame a proper sentence. i wish 
to see you aditya on tv from the side of gay community, i think there is no one 
else who can defend us better on these talk shows/debates. i think ashok row 
kavi also does a good job.

There were these 4 guys, a Russian, a German, an American and a French, who 
found this small genie bottle. When they rubbed the bottle, a genie  appeared. 
Thankful that the 4 guys had released him out of the bottle, He said, Next to 
you all are 4 swimming pools, I will give each of you a  wish. When you run 
towards the pool and jump, you shout what you want the pool of water to become, 
and then your wish will come true. 

The French wanted to start. He ran towards the pool, jumped and shouted, 
WINE. The pool immediately changed into a pool of wine. The Frenchman was so 
happy swimming and drinking from the pool. 

Next is the Russian's turn, he did the same and shouted, VODKA and immersed

'Our Constitution is different and our moral and social values are also
different from other countries… so we cannot follow them. Societal
disapproval of gay sex is strong enough reason to criminalise it. It is an
offence because it is unnatural.




'Gay sex is highly immoral and against social order and there is high
chance of spreading of diseases (like AIDS) through such acts,' Malhotra
told the court.


Even as the hearing was on, an embarrassed ministry issued a statement
around 2pm that it had 'not taken' any position on homosexuality.

Canada,Denmark,Norway, Ireland, Sweden, the UK, France, Belgium, the
Netherlands, Spain, Portugal and New
Zealand are among the countries that ban all forms of anti-gay
discrimination.

Not all these countries recognise homosexual marriages though.

The statement said the Union cabinet had decided that the central
government may not challenge the Delhi High Court ruling of July 2009 that
struck down provisions of Section 377 of the Indian Penal Code (IPC)
decriminalising homosexuality.


'The ministry of home affairs (MHA) conveyed this decision to the attorney
general. The ministry has also not given any instruction apart from
conveying the decision of the cabinet,' the statement said.


Soon after, another ASG, Mohan Jain, rose to say in the Supreme Court that
he had been instructed to say that the Centre was not taking any stand on
the issue.


The bench, however, was not amused by the government's shifting position.


'The Union of India has advanced its arguments. We are not taking
cognisance of your instructions. Never make such statements in court. It
will only embarrass you,' the bench tersely told Jain.


The apex court is hearing a bunch of petitions filed by antigay rights
activists challenging the high court order. The next hearing on the matter
is on February 28.


This whole confusion stems from the inconsistent stand of the Centre on the
issue. Even in the high court, the home ministry had opposed watering down
of Section 377 while the Union health ministry had taken a contradictory
position.


Health and gay rights activists have been pushing for decriminalisation of
gay/lesbian sex saying it is key for HIV/AIDS prevention and control.


The Union home ministry said: 'The decision of the Cabinet was that the
central government may not file an appeal against the judgment to the
Supreme Court.


'However, if any other party to the case prefers an appeal, the attorney
general may be requested to assist the Supreme Court to examine the matter
and to decide the legal questions involved.'


The 'clarification', however, does not make it clear whether the ministry
favours decriminalising gay sex or not. It also remains a mystery as to how
Malhotra advanced arguments opposing the HC order when the ministry had
instructed the government's law officers to not take any stand on the issue
before the Supreme Court.


Malhotra was forwarding the same arguments that the MHA had made before the
high court. The health ministry is still to argue before the SC.


Reacting to additional solicitor general P.P. Malhotra's submissions in the
court, lawyer and gay rights activist Aditya Bandopadhyay said the home
ministry publicly distanced itself from Malhotra's statements.


'It is crucial that we acknowledge that the state and the law cannot be
used as a tool to defend someone's personal homophobia,' he said.

'While the media has misreported the matter and blown it out of proportion,
how can Malhotra speak on the part of the government when it has openly
supported the decriminalisation of homosexuality?

As Gay Marriage Gains Ground in Nation, New Hampshire May Revoke Its Law

As same-sex marriage supporters celebrate victories in Washington and Maryland 
this month, they are keeping a wary eye on New Hampshire, where lawmakers may 
soon vote to repeal the state’s two-year-old law allowing gay couples to wed. 
 
A repeal bill appears to have a good chance of passing in the State House and 
Senate, which are both controlled by Republicans. The bigger question is 
whether they can muster enough votes to overcome a promised veto from Gov. John 
Lynch, a Democrat. 
 
Based on party lines, House and Senate Republicans both have veto-proof 
majorities. But this is an issue where party allegiance gets muddy. 
 
In a state whose “Live Free or Die” motto figures into many a policy decision, 
even many opponents of same-sex marriage wish the issue would just disappear. 
Republican lawmakers with libertarian leanings, a sizable group, seem 
especially unhappy to be facing a repeal vote, as well as those who maintain 
that cutting spending should be the legislature’s sole concern. Both groups 
appear worried about a backlash from their constituents. 
 
Representative Andrew Manuse, a Republican, said in an e-mail that he would 
support a repeal because he objected to government “using its power to redefine 
a religious, social and societal institution.” But he added, “I really am not 
focusing on this issue.” 
Should the repeal pass, New Hampshire would be the first state in which a 
legislature has reversed itself on the issue of same-sex marriage. In Maine, 
voters repealed a marriage law through a referendum in November 2009, shortly 
after the Legislature approved it. This fall, a ballot initiative will ask 
voters to make same-sex marriage legal again. The California Supreme Court 
ruled in 2008 that same-sex couples there had a right to marry, but voters 
banned same-sex marriage in an initiative later that year. The issue remains in 
court. 
In a recent poll by the University of New Hampshire Survey Center, 59 percent 
of respondents were either strongly or somewhat opposed to repealing the law, 
while 32 percent said they supported repeal. 
 
Representative David Bates, a Republican, filed the repeal bill in January 
2011, shortly after Republicans took control of the legislature. But House 
leaders postponed a vote, saying they needed to focus on the budget. Under 
legislative rules, the bill must come up for a vote this year, although 
lawmakers could vote to table it again. 
 
A House vote would need to take place by March 29, the deadline for the House 
to send its legislation to the Senate. Mr. Bates said Monday that he was 
working on ways to broaden the bill’s support in both chambers, like changing 
or removing a sentence that states, “Children can only be conceived naturally 
through copulation by heterosexual couples.” 
 
“I recognize there’s things in it that some aren’t happy with,” he said, “so 
we’re going to change it, get it to a place where as many people as possible 
are comfortable with it.” 
Mr. Bates dismissed the University of New Hampshire poll findings, saying, 
“It’s just not credible to suggest the people of New Hampshire are the 
aberration of the nation.” 
A New York Times/CBS News poll conducted this month found that 40 percent of 
respondents supported same-sex marriage, while 23 percent supported civil 
unions for gay couples and 31 percent said there should be no legal recognition 
of a gay couple’s relationship. 
 
When New Hampshire became the sixth state to approve same-sex marriage, in 2009 
— following California, Connecticut, Iowa, Massachusetts and Vermont — it was 
not an easy feat. The law passed with close votes in both chambers, which were 
then under Democratic control, and with last-minute support from Governor 
Lynch, who had preferred civil unions. 
 
Since then, about 1,900 same-sex couples have wed in the state. The repeal bill 
would not invalidate those marriages, but would allow only civil unions for gay 
couples moving forward. 
 
Same-sex couples can currently marry in Connecticut, Iowa, Massachusetts, New 
Hampshire, New York, Vermont and the District of Columbia. Lawmakers in 
Washington State approved a same-sex marriage law this month, and Gov. Martin

The law has no right to legalise same-sex marriage, the Archbishop of 
Canterbury declared yesterday.

Dr Rowan Williams said a new marriage law for gay couples would amount to 
forcing unwanted change on the rest of the nation.

He also said it would be wrong to legalise assisted dying because of the threat 
it would pose to the vulnerable and because it would go against the beliefs of 
most people.

In a key speech on human rights, the head of the Anglican Church put his weight 
behind other leading clergy who have launched a powerful campaign to prevent 
David Cameron from going ahead with his plan to allow the full rights of 
marriage to same-sex couples.

Dr Williams’s predecessor in Lambeth Palace, Lord Carey, notably told the Mail 
last week that same-sex marriage laws would be ‘one of the  greatest political 
power grabs in history’. 

Dr Williams’s statement means the Prime Minister now knows he will face 
opposition from the liberal-minded leadership of the Church of England – as 
well as its determined traditionalists – if he continues on the track towards 
legalised gay marriage. 
The Archbishop said human rights law ‘falls short of a legal charter to promote 
change in institutions’. 

Dr Williams added: ‘If it is said that a failure to legalise assisted suicide – 
or same-sex marriage – perpetuates stigma or marginalisation for some people, 
the reply must be, I believe, that issues like stigma and marginalisation have 
to be addressed at the level of culture rather than law.’ 
 

The Archbishop indicated to MPs earlier this week that CofE churches would 
never be used to solemnise gay marriages and Anglican officials underlined that 
the Church says marriage must remain a union between a man and a woman.

Dr Williams’s intervention in the argument yesterday, in a speech to a World 
Council of Churches gathering in Geneva, echoed, in typically mild academic 
language, the sentiments expressed by Lord Carey.

The Archbishop has long been a personal supporter of gay rights and his lecture 
yesterday insisted Christians must accept that gay equality laws are here to 
stay.

But he has also listened to the concerns of traditional Christian believers 
since he began his career at Lambeth Palace in 2003 by refusing to allow an 
openly gay cleric to take a post as a CofE bishop.

His remarks yesterday came after Coalition ministers insisted they would go 
ahead with a same-sex marriage law whatever the churches say.
 
Equality minister Lynne Featherstone said last week the churches did not own 
marriage law. She added a same-sex marriage law would be ‘about the underlying 
principles of family, society and personal freedoms’. 

Mr Cameron declared for same-sex marriage last autumn, saying: ‘Conservatives 
believe in the ties that bind us; that society is stronger when we make vows to 
each other and support each other.

‘I don’t support gay marriage in spite of being a Conservative. I support gay 
marriage because I am a Conservative.’ 

A consultation document on how a gay marriage law would work is due out shortly.

Dr Williams said in his speech that same-sex marriage law was wrong because it 
tried to impose cultural change. 
He added human rights language could be ‘confused and artificial’ when it 
strayed from protecting the vulnerable. It could become ‘an alien culture, 
pressing the imperatives of universal equality over all local custom and 
affinity’.

On March 18, Prayatna Pune is having its first ever Parents meet. In keeping 
with that theme, our film for March is the Rituparno Ghosh written film 
Memories In March, which won the 2011 National Film Award for Best Feature 
Film in English.

This film is essentially an 'ode to grief'. This is a simple story of a mother 
finding it hard to come to terms with and to switch her emotions between her 
son's sudden death  his homosexuality hitherto unknown to her. It shows a 
strong bonding which develops between the mother and his lover who also greatly 
feels the loss of his boyfriend. It is an emotional drama based on real life 
experiences. Some of the scenes are so well-written that they seem like a page 
out of everyday life.

Details -
Deepti Naval plays the role of Aarti Mishra who is a 50 year old divorcée and 
lives in Delhi. Her husband lives in the US with another woman, Claudia. Her 
twenty-eight years old only son (Siddharth) works as an executive of an ad 
agency in Kolkata enjoying a lavish lifestyle. He dies in a car accident in 
Kolkata. For this reason Aarti goes to Kolkata to complete the last rituals and 
to get her deceased son's belongings. In her four-day stay on Kolkata, she is 
helped by her son's colleagues, Raima Sen (as Shahana) and Rituparno Ghosh (as 
Arnob). There and through his friends she learns of her son's secret engagement 
in a gay relationship with Arnob. The information comes to her as a deadly blow 
as she always thought her son to be a normal man with the usual sexual 
attractions. She is devastated to know the naked truth and initially puts the 
blame of 'seducing' her son on Arnob. She finds it next to impossible to come 
to terms with the real story. It
 surprises her as to how her son could have overlooked the beauty of Shahana 
and be involved with bald Arnob. She laments that if only she knew of her son's 
such relationship earlier, she could have shown him to a psychiatrist and got 
him relief.

It is gradually that she learns and begins to accept that it was her son's 
preference to be with Arnob with no fault of his boyfriend. Along with carrying 
back the belongings of her son, she is overburdened to carry back with her the 
truth of her son's secret gay life. A bonding develops between Aarti and Arnob 
over the common loss, she at the loss of her only son and he at the loss of his 
only partner.

Subtle, quiet, tender  yet very lyrical, this film definitely strikes a chord 
with the heartstrings, however without any melodrama. It's about leaving a 
piece of yourself behind with your loved ones, like what Siddharth did and 
what Aarti does.

The extraordinary performance by Deepti Naval - her emotions, her inner turmoil 
in not being able to accept her son's sexuality at first  finally coming to 
terms with it - are moving. To top that is a splendid background  musical 
score.

For us gays, the movie's biggest plus is the sensibility  sensitivity with 
which it looks at homosexuality as a normal fact of life.

So lets not miss this wonderful opportunity to see such a sensitive movie 
together  then share our feelings. Do come!

Lake , I decided to have my next one carried out while visiting friends in San 
Francisc o, where the beautiful nurses are allegedly much more gentle and 
accommodating.

As I lay naked on my side on the table, the nurse began my procedure.

Don't worry, at this stage of the procedure it's quite normal to get an 
erection, the nurse told me.

I haven't got an erection, I replied.

No, but I have, replied the nurse.

g_b apologies and (partial) update

First, apologies to everyone for not being able to post updates on the 377 case 
this week. The reasons are both personal and general and I'll do my best to 
rectify them. For the record, the case was heard over Tuesday (28/2), Wednesday 
(29/2) and Thursday (1/3) and now is on hold for 10 days until the Supreme 
Court comes back from its Holi break. 
I wasn't able to post updates partly because I had work in Nasik and while I 
had thought I'd be able to get and post info, in the place I was, really way 
out in the countryside, I found of course that my Internet connection 
disappeared. I had feared this might happen, but the reason I felt I could take 
this trip was because I didn't really anticipate much to happen this week.
This was because it looked like this week, and quite some time more, would be 
devoted to all our many opponents. The Bench has given the first lawyer, for 
Koushal, a regular amount of time, but had given the second lawyer, for the 
Delhi Commission on Child Rights, a lot of time, and while it was unlikely all 
the others would get as much, I still thought they'd get a fair amount of time, 
and in total this phase would go on for quite a while. 
But in fact what happened on Tuesday was that the judges indicated that they 
did not want proceedings to stretch out at length, and the lawyers were given 
the signal that they should hurry up, because they wanted to start listening to 
Fali Nariman, who as the seniormost counsel in the case would kick off the 
arguments from our side. 
Some of our opponents were given a decent amount of time, like JACK, perhaps in 
view of the fact that they have been the most devoted opponents from early on 
in the Delhi High Court. They were given about an hour and a half today. But 
then just before lunch the time given to our opponents came to an end, and Fali 
Nariman got up to speak. 
What this means, as far as the minutes goes, is that the people who were 
compiling the information were simply too busy with preparations for our 
arguments to pass on detailed information to me, so I simply had nothing to 
post. I am trying to put together this information in the break that now starts 
and I will try and post a consolidated account of what happened in the last few 
days by this weekend. 
And a lot happened! This seems to have been a rather roller coaster few days in 
the case! This was only to be expected, I guess, when you have a group of 
determined haters out to spew their worst, but I gather that it was really 
difficult to hear some of the stuff that came up. I realise one should take a 
detached attitude to this, that some stuff is said for effect, that one 
shouldn't take things personally, that a lot of what was said was so ridiculous 
that it should be discounted but I don't think it could have been easy to 
hear. 
I don't think anything can be assumed about what the judges felt about all 
this, but I think one thing is clear that these are judges that are going to 
methodically go through all aspects of this case, good or bad, serious or 
silly. So they would sometimes have seemed hard on the arguments, sometimes 
receptive, and they will do the same with the lawyers on our side and no real 
conclusion can be drawn from anything they say, which might be reported in the 
media. 
I do a few core issues are coming up. There is the question about whether this 
is a sexuality, whether something like the homosexual community can be said to 
exist, or whether it is just a sexual practice. There is the question of what 
decriminalisation might mean for other laws. 
And there is the question of impact, in all its aspects. Has the law really 
impacted people's lives? Is there real harm or just a perception of it, which 
might be unfortunate, but may not actually be due to the law? Has the 
decriminalisation that has been in place since the Delhi High COurt decision 
had any real impact? Are people less persecuted? Have HIV rates come down? What 
does it mean not to live under 377 - and what would it mean if the law was in 
force again? 
This is a really key question and perhaps its something we should be discussing 
and describing on these lists, an exercise we all can do in tandem with the 
courts. Do you feel your life was raelly affected when 377 was in force? Has it 
changed now that it is not? And how would you convince the judges about that? 
Finally, just before lunch Fali Nariman started speaking and this was clearly a 
moment that everyone in court had been waiting for. What can one say about 
Mr.Nariman other than that he is the seniormost and most respected counsel in 
India today. He is a legend in the Court, for his vast experience and 
abilities, the number of historic cases he has fought, and, despite his age, 
the sheer vigour and power he still brings to his arguements today. 
We can perhaps say this. When Mr.Nariman was approached by us to appear in this 
case - of course, pro bono, since we couldn't dream of paying the sort of

g_b QA Active Event Report - Transgender Sensitization

This was the first time that Queer Adda has organized a Transgender
Sensitization event. A brainchild of Sachin Awasthi, we decided that
events like this were long overdue. Two weeks before this event Urmi
Jadav, a transgender, readily agreed to be the focus of curious
questions from the members of a (possibly) awkward audience. She put our
minds at rest when she said that she had conducted similar events in
colleges and other places where the questions are sometimes hostile and
trans-phobic. We were absolutely thrilled when Ashok Row Kavi said that
he would like to talk on transgenders at the event. Pallav and Vivek
from Humsafar were more than helpful in allowing Queer Adda to use the
drop-in center at Vakola. We had more than 20 members of a supportive
and understanding audience. Our initial fears of an awkward audience
were completely unfounded.

The event commenced on Sunday, February 26, 2012 at 5:15 pm at Humsafar
Center, Mumbai with an introduction to `Dancing Queens', a group
of talented transgender beauties, by Sachin Awasthi and a video clipping
of their dance event organized for the second consecutive year during
the QAM Pride week.

Next we watched a movie, directed by Anirban Gosh and shown in Kashish
2011, based on the life of seven transgenders in Kolkata which depicted
their journey of love, social struggles and daily issues for survival.
Harassment by the police and customers of transgender commercial sex
workers is just one of the million issues they struggle with. The movie
provided a glimpse of what a person born a transgender goes through
because the rest of society chooses to ignore their very existence. It
was a fifty five minute glimpse into a world of hatred and injustice
that exists right in the middle of our civil society; a
glimpse that will open the eyes of anyone who is unaware of what it is
to live a life of a pariah.

After the movie Ashok gave a beautiful introduction to gender and gender
identity. He explained the medical facts about a transgender. He also
gave us a brief insight into the hijra community in India.

Now the stage was thrown open for the audience to pose questions at
Urmi. She unveiled her life story. She has struggled, she said, to reach
where she is. Struggled with her family, our system, our society and our
culture which simply does not accept her kind. Urmi shared the
initiatives taken by an NGO which helps transgenders get adopted by
families. Urmi is now adopted by one such family.

This event was video-recorded by the students from St .Andrews College
as part of their class project. Ofcourse, care was taken that no member
of the audience was filmed.


At 7:30 pm a vote of thanks was given to Ashok, Humsafar and their
staff, movie director Arinban Gosh, Urmi Jadav, director of Kashish
Shridhar, the students of St. Andrews College and all the members of the
audience.

Queer Adda thanks everyone who made this event a success. Queer Adda

This might not be the a very professional report for the event organized
in Hamsafar today, but something that I would like to put forward
straight from my heart.

A big thank for this initiative and thanks to Ashok and Urmi for taking
us through the life of a transgender/Hijra. The group size was approx 20
and Sachin took us through the agenda for the day. There was a glimpse
over the performance of Dancing queens. Yes, dancing is one mean of
their source of income. And a short film in Bangla about the Hijras,
their life, their acceptance in the society, their problems, their
ambition, the source of income, difficulty for an individual to adopt
them, government support and so on.

Ashok helped us understanding what we are biologically, what
transgenders are and explored the concept of behaviour, desire,
orientation and so on through `His Four Balls'.

There were many question asked to Urmi, for us to understand how she
faces the society, what is Hijra community like, how could we
differentiate a cross dresser and a Hijra, their marriage, their
communities acceptance for them to work in an organization.

With change in time will the culture in Hijra community change?

Will we start accepting them in our society?

Do they face similar problems in life as gays do?

Is there a need of education in hijra community?

If they can earn more in begging why will they join a 9-6 job?

Are they safe in this society, if they would be attacked by someone,
will the police take any action?

The list of question would keep increasing….

We will get answers of all these questions if we work hand in hand and
not as two different groups.

The bench also pulled up the government and its officials for not doing
their homework in the case.

of homosexuals were HIV infected, the bench queried about the latest figure
on the LGBT population and their numbers inflicted with the deadly
infection.

The government, however, contended that there are 23.9 lakh people infected
with HIV in the country.

The apex court is hearing petitions filed by anti-gay rights activists and
also by political, social and religious organisations, which have opposed
the high court verdict.

an entertainment with a difference.

constituted an arts club under each SHG in this connection, said Sethunath
V, a counselor with the Suraksha project of KSACS.

This year, we are trying to provide a platform to the talented members of
our SHGs to perform during the celebrations of Nehru Trophy boat race. Many
of them have expressed interest to stage their programmes. However, some
are not ready to perform in public to keep their identity confidential. We
held discussions with the organisers of Nehru Trophy boat race in this
regard, he said.

In November 2010, we started this project for gays in the district. Our
project is aiming to provide a safe and healthy life to homosexuals. Of
1,500 members, around 600 of them have wives and children and are leading a
good life, he said.
Besides cultural programmes, the SHGs are actively involved in various
other self-employment activities. They operate tailoring units, soap powder
production units and also conduct beauty parlours for men. Each member of
these SHG now earns Rs 2,500 to Rs 3,000 per month through their
self-employment programmes, said Sunilkumar R, a counselor with KSACS.

*New Delhi* There has been greater societal acceptance and decrease in
police harassment of lesbian, gay, bisexual and transgender (LGBT)
community after the Delhi High Court's landmark verdict of banning
discrimination on the basis of sexual orientation, a report said.

The research by Haryana-based Jindal Global Law School has found that the
High Court's judgement passed in July 2009 on decriminalisation of gay sex
led to increased self- confidence of LGBT members and there has been a
positive impact of the verdict.

There is a growing societal acceptance for Gay, MSM and Kothi men. Many
respondents (LGBT members) stated that the societal perception of
homosexuals is changing and people were treating them with respect, said
the report of a research team from the Centre for Health Law, Ethics and
Technology (CHLET) at the law school.

The study, first of its kind after the High Court's verdict, assumes
significance as the Supreme Court is hearing a bunch of petition filed by
anti-gay rights groups challenging High Court's verdict of legalising gay
sex.

Gay sex was earlier a offence under Section 377 of the Indian Penal Code
punishable up to life imprisonment but the High Court decriminalised the
act among consenting adults done in private.

It is evident from the study that decriminalization of section 377 has led
to increased self-confidence and self-acceptance amongst the respondents.
Some respondents also reported that they could now argue with the police
since they know there is no section 377 in the law books any more, the
report said.

The study reveals that police harassment has substantially reduced among
MSM outreach workers, the report said, adding that media and movies also
played a vital part in making LGBT acceptable to mainstream society.


A statement released by the law school said the study was conducted for
over a period of six months from February to October 2011 comprising face
to face interviews with 32 members of the LGBT community.

Professor C Raj Kumar, Vice Chancellor of O P Jindal University noted that,
The study points towards the positive impact that the high court judgement
has had through a first-hand account of those impacted directly through an
empirical evaluation of the people who are affected by the judgement.

The author of the study, professor Dipika Jain of the law school, said, It
is evident from the study that there has been a positive impact on the LGBT
community in Delhi and a country wide decriminalisation is bound to
positively impact the lives of this community and their right to live with
dignity.

The statement said that a copy of preliminary interviews was filed as a
part of the intervention by the legal academics in the Supreme Court.

Kavya Kommareddy, a student researcher with the team said, It is
heartening to see the law having a real impact on the people by giving them
self-confidence and a sense of empowerment and courage to fight for their
rights.

The Indian government sought to clarify its views on homosexuality Tuesday,
saying it fully backed a 2009 court order decriminalising gay sex despite
the objections of a top state lawyer last week. During a hearing in the
Supreme Court last Thursday, additional solicitor general P.P. Malhotra had
called gay sex against nature in a submission that caused outrage among
gay rights activists.

The home ministry later sought to disown the comments, causing confusion
about the government's stance on the highly sensitive social issue.

On Tuesday, another additional solicitor general, Mohan Jain, stressed that
his views were those of the government, which he said fully supported a
Delhi High Court decision in 2009 to decriminalise gay sex.

It's a government of India decision that there is no legal error in the
judgment of the Delhi High Court, Mohan told the Supreme Court, which is
hearing several appeals seeking to overturn the decriminalisation decision.

The government was pulled up in the Supreme Court today for the many
different stands it has taken in court on whether gay sex is
unconstitutional.

Appearing for the government, the Additional Solicitor General today told
the court that the Centre does not oppose the judgement of the Delhi High
Court on the matter. In that landmark ruling in 2009, the High Court
decriminalised gay sex between consenting adults.

Don't make a mockery of the system, said the Supreme Court judges,
pointing out that just last week, the Ministry of Home Affairs had, through
a senior government lawyer, stated that homosexuality is immoral and
against nature and should be banned. Additional Solicitor General PP
Malhotra had said he was representing the Home Ministry when he urged the
Supreme Court to reverse the High Court's verdict. The Home Ministry had
then corrected him, clarifying through a statement that it  has not taken
any position on homosexuality.

Different ministries of the government have taken stands in court that are
diametrically opposite. The Health Ministry today said it sees no legal
error in the High Court judgement.

The Supreme Court is hearing more than a dozen petitions filed to overturn
the High Court ruling that struck down a colonial-era ban on gay sex on the
grounds that it was unconstitutional

The 2009 judgment to overturn the colonial-era ban on gay sex was hailed by
gay activists at the time as a major victory in their fight for equal
rights and opportunities in the world's biggest democracy.

A conviction for gay sex carried a fine and maximum 10-year jail sentence.
Prosecutions were rare, but activists said police used the law to harass
and intimidate homosexuals.
