NEW DELHI, September 3, 2014 Devesh K. Pandey On-paper owner says it belongs to an IRS officer facing bribery charges It is a curious case of a Goa property that no one wishes to lay claim on. The woman who signed the sale deed on behalf of the owners, which has been attached by the Enforcement Directorate as “proceeds of crime” and the attachment now confirmed by the Adjudicating Authority, is missing. And the on-paper owner alleges that the property belongs to an Indian Revenue Service officer who is facing bribery allegations. The ED case pertains to the Central Bureau of Investigation (CBI) charge sheet against IRS officer Ashutosh Verma and others, including Suresh Nanda, his son Sanjeev Nanda and chartered accountant Bipin Shah. The CBI has accused the officer of receiving bribes purportedly to dilute Income-Tax appraisal of companies owned by the Nandas. According to the ED, the case is an off-shoot of legal technical surveillance of the telephone/mobile calls made by all the suspected persons including Mr. Verma conducted by the CBI. The relevant purported conversations of Mr. Verma with Nanda and Bipin Shah pertained to proposed purchase of an 11,615 sq metre property at Morgim in Goa for Rs.4.40 crore. Subsequently, the CBI registered a case in March 2008, arrested the accused persons and subsequently filed a charge sheet against them. Searches led to seizure of documents relating to a Goa house in the name of Rajender Kashyap. The CBI probe revealed that the property ownership had been transferred in the name of a front company. The agency identified another 2,100 sq metre property at Bardez in Goa purportedly owned by Mr. Kashyap. Revenue records revealed that the sale deed of the property was executed in January 2006 between Mumbai-based Neilia Furniturewala, daughter of one of the sellers) and Mr. Kashyap. The ED was unable to contact her. In his statement to the ED, Mr. Kashyap claimed the property was bought on behalf of the accused IRS officer and its original papers were with Mr. Verma, who vehemently denied all the allegations. The agency found that the IRS officer’s wife was earlier an authorised signatory in one of Mr. Kashyap’s companies. Based on the investigations, the ED alleged that the 2,100 sq metre property was bought in the name of Mr. Kashyap, but was in fact allegedly purchased by Mr. Verma. Accordingly, the agency recently issued an order for provisional attachment of the “proceeds of crime”. The Adjudicating Authority under the Prevention of Money Laundering Act confirmed the attachment a few days ago. The ED had earlier attached the 11,615-sq-feet property in connection with the case. PETER LYNN SINAI, DIPLOMAT OF GOAN ORIGIN: Former Indian ambassador to many countries, including Austria, and the United Nations too. Passed away in Bangalore last week. He topped the competitive exams in 1956. Listed as a prominent alumni of Bishop Cotton's Bangalore. An online 'daily diary of President Jimmy Carter' [http://www.jimmycarterlibrary.gov/documents/diary/1978/d010178t.pdf] reminds us that it was Chief of Protocol of India Sinai who greeted the President and the First Lady (along with US Ambassador Robert F Goheen) during their visit to India on January 1, 1978. This was during the Janata Party regime. Among them was the Rhodes scholar Peter Lynn Sinai. A former Ambassador to Austria and Iraq, Mr Sinai has now chosen to make his home in Bangalore. Peter Sinai took his first degree in Bombay, but then his father, a native of Goa, instructed him to move to Delhi for further studies. The object was to make him learn Hindi, to better equip himself for a career in the newly independent (and presumably hyper-nationalist) India. By sending him to Delhi's premier college, the father planned to make his son a proper desi. However, on his first day at St. Stephen's, the young Sinai discovered that the conversation at the dining table was conducted in (as he put it) a 'very haw-haw English'. It is always prudent to follow the notion that truth is somewhere in between. It is not hard to find evidence for the belief that there are corrupt pharmacists, doctors, businessmen and financial analysts anywhere, and at any time in history. The question is only of scale, and of the causes that are attributed to it, because the latter in particular depend on the biases of the persons making and believing the claims. Any reasonable unbiased person though would recognize that these corrupt practices have nothing to do with race, ethnicity, nationality or religion, and in Goa they certainly have nothing to do with liberation from the Portuguese, which in Goan forums is usually a code word for the former categories lumped together in the minds of people who consciously or unconsciously hold these prejudices. After building a good rapport, one auditor confided with me that their people routinely fake test data for audit, even now after Ranbaxy and Wockhardt scare. Another audit guy who works for an MNC pharma said that their plant makes formulations for their global operations. in that, they give ingredients exactly as specified. However, they sell the same API (raw material) to Indian companies for Indian distribution (the MNC does not sell in India under its brands). There, they give lower quality ingredients, though they specify higher grade. So if the API is meant to be 60% active ingredient, it is usually 45-50% active ingredient and it is sold at cheaper prices to Indian pharma companies. Indian companies prepare tablets and sell, even though they know that the ingredient is of less than specified potency. Everybody in the industry apparently knows this open secret in Goa. A PRO of a well-known hospital in Goa told me there are some small time pharma companies who bring a couple of containers of their drugs into Goa and sell those tablets at very cheap rates to local doctors / pharmacies with strange, unknown brands. They throw parties for the doctors requesting them to write prescriptions for their brands. Once the containers are finished, they disappear. The brand or the company never comes again to the doctors. Finally, another trend in Goa medical practice: Some generic pharma companies approach big specialist doctors and offer to prepare tablets in the doctor's name!! They offer to make customised formulation with the doctor's branding. So you hear some funny brands that you never hear anywhere else. Only the other local doctors can tell that this brand is such and such doctor's brand of tablets. I took photos of some tablet strips. They were definitely not tested for anything. I know a lot about pharma industry, being involved with it for 21 years. One look at the contents and I could tell that all these ingredients cannot be put in one tablet - sort of a polypill with 38 ingredients. Dear JoeGoaUk, This is very useful. Thanks for your compilation! Without you reminding us, my rusting brain would have definitely forgotten many names on the list. We will never know how many non-active members of Goanet have passed on since the past 20 years. (Which just reminds me of one more active Goanetter, Edgar Martins, who died too. And then, there was one of the first seniors whom I befriended through the Net in Goa, it was Dr Ivo da Costa Azaredo... hope I got the spellings right... of the famous Costa's brand and who returned from Portugal to shore up the family business in wine, masalas and more. When I got to know him he was probably in his 70s or late 60s already. His was quite a colourful story, and I wrote about his wine-making once.) As you know, not everyone reading Goanet is active in posting. So we might not know how many we're really missing. If I trawl through my in-box, I would surely get more names, since I've tried to invite people locally here to Goanet. Another prominent name should be that of Dr Sharon Fernandes, the young historian who was prolific in her academic output, but died suddenly within a week after a brain tumour was suddenly discovered. Of the above names, I knew Jorge, Cornel, Fr Ivo, Olav, Tony, Melinda and Alfred Tavares very well. Philip Thomas had corresponded with me, but we somehow never met, despite the short distance between us! I'm sure there would be other names whom we have missed out... The company certainly has much to boast of. It is hugely profitable, earning more than any other private Indian firm. It is brave, going where others fear to tread, constructing refineries, drilling for oil and gas, building supermarkets and broadband networks. It invests more in India and pays more corporation tax there than any other firm. Without Reliance, which generates 15% of the country’s exports, the balance of payments would be a wreck. Yet in other ways, Reliance is a rotten role model for corporate India. When it comes to governance this secretive and politically powerful private empire is not a national champion but an embarrassment. The father of Indian capitalism Reliance’s culture reflects its roots. In the days before India liberalised its economy in 1991, the firm’s founder, Dhirubhai Ambani, fought his way up from a menial job in Yemen through Mumbai’s heaving tenements to the top of Indian business. Socialist dogma and meddling officials were his foes, charm and cunning his tools. He managed to run rings around the country’s stifling rules. Dhirubhai’s tactics appalled India’s establishment. But he marshalled resources to create industrial facilities of the kind every economy needs, including one of the world’s biggest refineries in Gujarat, his birthplace. India is a more open place now and Mukesh Ambani—the country’s richest man, worth $23.5 billion—is a more cosmopolitan figure than his father. He studied in America, funds think-tanks and was a director of a Wall Street bank. Yet he has maintained two family traditions. One, making big bets on India, is welcome. Reliance is in the midst of a $30 billion investment plan. Dhirubhai’s other legacy, poor governance, is not. Although a listed firm, it makes payments equivalent to a quarter of its pre-tax profits to related entities, mainly privately held by the Ambani family. Its ultimate ownership and beneficiaries are obscured by a mesh of holding vehicles that India’s securities regulator says it does not fully understand. The regulator accuses the firm of making illegal gains from trading derivatives linked to its own subsidiary’s shares (an accusation Reliance is contesting). Some foreign investors, put off by the lack of transparency, shy away. Reliance’s relationship with the government is even more troubling. Anti-corruption campaigners claim Mr Ambani is the power behind the throne of India’s political leaders. Politicians, officials and regulators say Reliance has unusual clout. Reliance denies these claims. Meanwhile, the national auditor is investigating a telecoms-spectrum auction the firm won. In 2010 it seemed that Reliance might be changing. Mr Ambani bid for LyondellBasell, a global chemicals giant. The deal would have both made Reliance a killing and forced it to modernise its governance, but it fell through. Since then the company’s culture has become even more personalised. In June Mr Ambani’s wife joined the board. In July Reliance took control of a big broadcaster, which will provide Mr Ambani with a platform for his views, should he choose to use it that way. Mr Ambani seems to believe that Reliance does not need to reform. He is wrong, for two reasons. First, India’s economy is opening up, and the firms most exposed to global competition—tech giants, for instance—have the world-class governance and open cultures needed to command the trust of counterparties, investors and clients, to attract talent and to foster innovation. Asia’s best multinationals, such as Samsung and Lenovo, have had to make painful reforms to stay competitive. Reliance operates in the more opaque parts of the economy, such as infrastructure, that are trapped in a time warp of barons and scandals. But to revive India’s growth rate, Narendra Modi, the new prime minister, will probably expose these sectors to a blast of competition and investment from abroad. The more open the economy, the more of a liability Reliance’s opacity and bad reputation will become. Second, Indian society is turning against its tycoons. Independent institutions such as the Supreme Court, the national auditor and the central bank are on the warpath against crony capitalism. The electorate is incensed by corruption. NEW DELHI, September 3, 2014 Devesh K. Pandey On-paper owner says it belongs to an IRS officer facing bribery charges It is a curious case of a Goa property that no one wishes to lay claim on. The woman who signed the sale deed on behalf of the owners, which has been attached by the Enforcement Directorate as “proceeds of crime” and the attachment now confirmed by the Adjudicating Authority, is missing. And the on-paper owner alleges that the property belongs to an Indian Revenue Service officer who is facing bribery allegations. The ED case pertains to the Central Bureau of Investigation (CBI) charge sheet against IRS officer Ashutosh Verma and others, including Suresh Nanda, his son Sanjeev Nanda and chartered accountant Bipin Shah. The CBI has accused the officer of receiving bribes purportedly to dilute Income-Tax appraisal of companies owned by the Nandas. According to the ED, the case is an off-shoot of legal technical surveillance of the telephone/mobile calls made by all the suspected persons including Mr. Verma conducted by the CBI. The relevant purported conversations of Mr. Verma with Nanda and Bipin Shah pertained to proposed purchase of an 11,615 sq metre property at Morgim in Goa for Rs.4.40 crore. Subsequently, the CBI registered a case in March 2008, arrested the accused persons and subsequently filed a charge sheet against them. Searches led to seizure of documents relating to a Goa house in the name of Rajender Kashyap. The CBI probe revealed that the property ownership had been transferred in the name of a front company. The agency identified another 2,100 sq metre property at Bardez in Goa purportedly owned by Mr. Kashyap. Revenue records revealed that the sale deed of the property was executed in January 2006 between Mumbai-based Neilia Furniturewala, daughter of one of the sellers) and Mr. Kashyap. The ED was unable to contact her. In his statement to the ED, Mr. Kashyap claimed the property was bought on behalf of the accused IRS officer and its original papers were with Mr. Verma, who vehemently denied all the allegations. The agency found that the IRS officer’s wife was earlier an authorised signatory in one of Mr. Kashyap’s companies. Based on the investigations, the ED alleged that the 2,100 sq metre property was bought in the name of Mr. Kashyap, but was in fact allegedly purchased by Mr. Verma. Accordingly, the agency recently issued an order for provisional attachment of the “proceeds of crime”. The Adjudicating Authority under the Prevention of Money Laundering Act confirmed the attachment a few days ago. The ED had earlier attached the 11,615-sq-feet property in connection with the case. He topped the competitive exams in 1956. Listed as a prominent alumni of Bishop Cotton's Bangalore. An online 'daily diary of President Jimmy Carter' [http://www.jimmycarterlibrary.gov/documents/diary/1978/d010178t.pdf] reminds us that it was Chief of Protocol of India Sinai who greeted the President and the First Lady (along with US Ambassador Robert F Goheen) during their visit to India on January 1, 1978. She was then posted in Macau and later in Angola and returned to Portugal when these Portuguese colonies gained independence. She returned to Goa as a companion and caretaker to her aging parents. Upon her return, Maria Teresa taught Portuguese to a generation of youngsters in Margao.
