The National Human Rights Commission, New Delhi (Law Division) has in a letter dated 29th April, / 6th May, 2008, directed the Director General of Police, Govt. of Goa Panaji, Goa to take action as is deemed appropriate and dispose off the complaint pertaining to Mr. Antanasio (Babush) Monseratte, MLA and others in Case No: 4/5/1/08-09/OC

It may be noted that following the merciless and brutal assault on the son of MLA Mr. Antanasio Monseratte and others at his residence and elsewhere by the Goa Police , on 19th February, 2008, this writer, pained by the brutality had filed a complaint before the The National Human Rights Commission, New Delhi directing the members of the Commission, to a) take cognizance of the assault on innocents as reported in the local dailies of the State and b) to constitute a branch of the Commission in the State, to put in check, such highhandedness of the law enforcing authorities.

While the undersigned expresses gratitude to the members of the Commission who on 25th April, 2008 perused the complaint and directed necessary action; it is hoped that the Director General of Police Shri. Brijendra Singh Brar (IPS) will examine the incident in its proper perspective and ensure that such atrocities on human beings are not resorted to under the garb of enforcing law and order in a civilized society.

It is also hoped that the NHRC will constitute a Bench in Goa to rid the state of such human rights violations which are mounting with politicization of the police force in since the beginning of this century.

Respected Sirs,

A brutal assault by policemen attached to the capital city Panaji Police Station, on two innocent youths both teenagers from Taleigao one a son (who has a grave ailment and is under specialized medical attention for a physical ailment) of a local politician a sitting MLA, supporting the ruling Indian National Congress-Nationalist Congress Party coalition in Goa Legislative Assembly on the night of 19th February, 2008 has traumatised the righteous and peace loving citizens Goans.

The condemnation of this brutality is moreso, because the police force in utter disregard to decorum or restraint expected of a law enforcing personnel,allegedly made a forceful entry of the residence of the MLA at Taleigao and having smashed everything on their path to smithern in futile search of the MLA picked up his son and another who were in the house pushed them mercilessly into a waiting police van and after brutal assault took them to the police station only to be joined there by their parents and several others there.

What Goans are agitated is that ---while they express reservation on the merits and demerits of the arrests involving the MLA and his spouse who were also detained by the police for squirmishes outside the Police station and subsequently released on bail, they condemn the brutal assault on the innocent youth and have reason to believe that the police bestiality deserves not only exemplary punishment but need to be weeded out of the police force as they could not be expected to discharge their duties to maintain law and order, peace and tranquility in the State by their crudest behaviour.

Goa State does not have the Human Rights Commissions. In the absence of this Commission many citizens have enquired telephonically with this writer and social activist

a) whether your esteemed NHRC has the powers to direct the local Government to set up immediately or in a time bound ramework the State Human Rights Commission under the Protection of Human Rights Act, 1993. b) whether your esteemed NHRC has access to information appearing on the local cable networks or local dailies of States where such incidents as this one on 19th February, 2008 in Goa which is not fully reportedly by the national networks in States like Goa which do not have State Human Rights Commission; c) whether your esteemed NHRC obtains from the State Government daily report from the Chief Secretary directly viz suo moto or through any other of your own intelligence sources when snippets of such brutality reach the attention of the NHRC. d) whether any such incidents or other incidents pertaining to this State are presently before your esteemed NHRC and are being investigated.

A reply in the matter will be most appreciated as any delay will only amount to the brutalities of the policemen law abiding citizens and innocent person like these two teenagers. Presently the SP North Mr Neeraj Thakur has been transferred to New Delhi according to late report and demand by MLA's cutting accross party lines for suspension of the SDPO Mr Mohan Naik, Police Inspector Mr Sudesh Naik Panaji Police Station and other constables who ransacked the house and meted out brutality to the inocent youth besides their colleague viz the MLA and his spouse who is also a serving peoples representative in the local self government bodies is awaited.
