Country facing threat of "constitutional terrorism": Shatrughan: [India News]: Jalandhar, Mar 6 : Terming the recent developments in Goa and Jharkhand as "constitutional terrorism", star-turned-politician Shatrughan Sinha today said Governors of both the states could not have acted against the NDA without the patronage of UPA government."You see, without the patronage of union government governors of both Goa and Jharkhand could not have acted against the NDA keeping the constitution and sanctity of their post at stake," Sinha, who was here to attend a function by the Hind Samachar group of newspapers, told reporters."Constitutional terrorism is more dangerous for the democracy as any other form of terrorism can be dealt with by the security forces but if law-makers themselves indulge in it, who will save democracy," the BJP leader added.He claimed that the Jharkhand Governor had indulged in unconstitutional activity by ignoring the claim of NDA who had paraded over 41 MLAs before him and inviting a party to form the government which did not even present the list of MLAs who would support it.On Bihar, where the confusion over forming of next government was still prevailing, Sinha said "in the current political situation, imposition of President's rule is the only option left".Asked whether he was in the race for the post of Bihar Chief Minister, Sinha in his filmy style said "hazoor aate aate bahut der kardi" (it is too late now). NDTVGOOGLE Defection politics: Single MLA syndrome rules the day Rahul Srivastava, Priyakna Kakodkar NDTV.comSunday, March 6, 2005 (Ranchi/Goa): The last seven days have been dominated by political controversies, be it the vote of confidence in Goa, or the alleged kidnapping of Enos Ekka, the man who seems to hold the fate of the new Jharkhand Governor. Today, many independent MLAs have become a crucial make or break factor in elections across the country. One of Goa's master defectors is Isidore Fernandes, who has switched back and forth between the Congress and the BJP without a problem, in the last three years.In 2002, he was a Congress MLA, but two years later, he was re-elected from the same constituency on a BJP ticket.Within three months, he quit the Parrikar government to re-join the Congress, and was sworn in as a minister in the Pratapsingh Rane cabinet in January this year.Switching sidesSingle MLAs like him are worth their weight in gold for big parties like Congress and the BJP, especially in a legislature where one vote can make or break a government. During the crisis in Goa, each vote counted and neither the Congress nor the BJP could afford to take a chance with horse-trading.Congress supporters were holed up in the bungalow of Taligao MLA Babush Monserrate, while the BJP flew its contingent to Jaipur for safekeeping. Toppling gamesHowever, Goa is a state famous for its culture of defections and topple games, considering it's a state which has had 14 chief ministers in the last 15 years.Isidore laughingly admits that switiching sides are all about bargaining for ministerial berths. Be it Goa or Jharkhand, all an MLA has to do is pick the winning side. What else changes hands is a matter of speculation. "It's important to be on the ruling side. Everyone wants to be a minister, but the limit on the cabinet is 12. We should change the rules and all 40 MLAs should get ministries," said Isidore Fernandes."The (Goa) government had two ministers without portfolios. Maybe we could all get ministries even without portfolios," he added. Tough anti-defection lawIncidentally, Isidore also has the dubious distinction of being the very first MLA in the country to switch sides after the anti-defection law became tougher.According to the 91st amendment, 10th Schedule, MLAs who switch sides now have to resign their seats and face a by-election. During the Goa crisis, five BJP MLAs resigned their seats. It was their resignation rather than the withdrawal of support by two MLAs (one independent, one MGP), which destabilised the Parrikar government.Resignation strategySo, both the Congress and the BJP weren't just trying to get smaller parties and independents to switch sides. They were trying to get each other's MLAs to resign. Mikky Pacheco is one of those who resigned from the Parrikar government. In the last two years, he has been with the United Goan Democratic Party, the BJP and now the NCP."I had decided on going for the by-election in September itself. I had joined the BJP with the intention of bringing down the government," said Pacheco.Defection politicsElection officials say that this shows how Goa, one of India's most recent states, has become the laboratory of defection politics. "Goa is known for setting an example for the whole country on the different ways to split and defect without incurring the wrath of the anti-defection law. This is a state in which the Speaker himself had defected," said Prabhakar Timble, state election commissioner."But after the anti-defection law, the new trend will not be defections but resignations, and the Isidore case, the brainchild of the Parrikar government, was the very first case," he added. Art of switching sides However, if Goa is a laboratory, then in the past week, Jharkhand has taken the art of switching sides to a new level. Independent MLA Enos Ekka has emerged as the man of the moment in Jharkhand. Whoever Ekka votes for, will decide the future of the government. On Monday, the NDA claimed his support in a letter to the Governor when they staked claim. But on Tuesday, the UPA alliance claimed likewise, leading the Governor to allow them to form the government. On Thursday, the NDA actually produced him before President Kalam as proof that Ekka was supporting them. But a day later, the Congress accused the NDA of using strong-arm tactics on him literally. The UPA claims the NDA has kidnapped Ekka. He is now being kept in Rajasthan by the NDA along with other independent MLAs, presumably away from the clutches of the Soren government until the vote of confidence on March 15. Hung assembliesWhat Jharkhand and Goa have done in the past week is to just highlight a political reality. Several states are throwing up hung assemblies or governments with precarious majorities. Each vote counts, and the big parties, be it national or regional, who have realised that it's easy to scuttle a government, are no longer looking at wholesale
[Gulf Goans] Parrikars plea in SC on 14/3/2005
With the political developments in the North Indian State of Jarkhand (separated from erstwhile Bihar)where the Governor Mr Syed Sibte Razis (an INC stalwart ) decision appeared controversial viz; to appoint JMM Chief Mr Sibu Soren (a tribal) as the Chief Minister, even though the NDA ex CM Mr Arjun Munda commands and parades a 41 member MLAs (now taken to the same Sunrise Resorts in Jaipur Rajasthan ---where the Goa BJP MLAs and UGDP MLA were earlier housedto avoid kidnap or poaching ) before the President of India as further proof that he has the numbers on his side; the ex CM Mr Munda also a tribal has now petitioned the Supreme Court ironically before the same three-judge Bench hearing Mr Parrikars case (on similar grounds of unconstitutional step by Goa Governor S C Jamir) comprising Chief Justice R C Lahoti, Justice D M Dharmadhikari and Justice AR Lakshmanan pleading for directions from the Court for his appointment and to prepone the trial of strenght immediately a day after the House convenes on 10 March, 2005 to avoid horsetrading and coercion. After the ---mention by counsel of Mr Munda the matter has now been posted for hearing on Wednesday 9/3/2005. Incidentally the Lok Sabha gets reconvened the same day after being adjourned following the disruption of the proceedings earlier last week. Meanwhile the Goa case has come up before the Supreme Court and has since been postponed to next Monday 14th March, 2005 with a direction to counsel of Mr Manohar Parrikar to amend the petition if he so desires following further political developments after the cause of action arose on 2/3/2005. The BJP + UGDP combine meanwhile will have enough time to test the political fall out of the month long quick political developments in the State as campaigning picks up this week for the 50 member Zilla Parishad election on 13/3/2005 though fought on non political lines this will sure be the litmus test for the rival political parties to ascertain the vox populi views on the turmoil. There is however a new development in the INC camp. Though upset at the Central decision to impose Presidents rule (much of which was guided by developments in Jarkhand ) the INC has now got to decide how to go about the seat sharing with the NCP and UGDP Party for the seats of Benaulim Taleigao Velim Poinguinim and Cumbarjua. It may be recalled that these seats in Benaulim were held by the Mr Francisco Mickey Pacheco UGDP turned UGDP (S) turned NCP the other in Taleigao by Atanasio Babush Monseratte UGDP turned BJP turned INC Velim Filipe Neri Rodrigues Independent now disqualified from re-elections (until he obtains a High Court order and stays his controversial disqualification by ex Speaker Vishwas Satarkar ( but that depends on the original --- now missing ---of the alleged tampered membership form being produced before the Court) the Poinguinim seat held by Mr Isidore Fernandes INC turned BJP turned INC and the Cumbarjua seat of Mr Pandurang Madkaikar by MGP turned BJP turned INC. The NCP has already staked its claim for the Benaulim hot seat which the UGDP demands and the INC feels it is their inherent birth right. Therefore the days to come will witness another tussle within the secular forces once the bye elections are announced. Atleast the INC can ride rough shod over the UGDP demand and put up candidates conceding the Benaulim seat to the NCP, but in a three tier contest with the UGDP remaining adamant there may be opportunity for the BJP backed candidate to take up the challenge in the Catholic dominated constituencies on the grounds of development. Given the imminent fight for seats the BJP will be seen as a better choice atleast the Hindu community vote will be discreetly polarised. The BJP had already made a demand from the electorate to give them atleast twenty five seats to enable them showcase their true potential and there are many who have vowed to fulfill this genuine demand of the BJP atleast in the New Conquests come election time. It is not clear what the BJP strategy is for the moment but following the arrival of Mr Pramod Mahajan the BJP member looking after the Goa desk there is bound to be some strategic decision. The BJP knows too well that it cannot hold its bandwagon in harness for too long also except for the seats of Cumbarjua Taleigao (doubtful)Poinguinim where the BJP could field their candidates and hope to win atleast two seats it is ideal for it to resign enmasse to ensure a disolution of the House and fresh elections to be announced after the monsoons. Though this may not be necessary to hold fresh bye elections for the resigned seats -- as there is no Constitutional limit even if the House continues with the INC + NCP 16 members. Even otherwise it is now amply clear that in the coming days the BJP can expect a ray of hope to keep its battle moving as the INC camp is disillusioned by the High Command's decision especially the utterances of the Union
