There we go: http://live.gnome.org/GnomeWeb/MerchandisingAgreement This is a sanitized version of the provate page Dave wrote and has linked below. Not that the original contains any secret but it's fool of subjective opinions (since this was the job to do) and many of them might be outdated nowadays anyway. Hi, Some time ago, I did a survey of what others are doing in the domain of merchandising, and wrote up my conclusions: http://live.gnome.org/FoundationBoard/MerchandisingAgreement It's currently a board-private page, perhaps you might want to suggest splitting any confidential/non-onfidential stuff out and making some or all of the page public? FWIW, Zazzle is still an active offer, and since I wrote this, several possibilities have opened up. In merchandising, to my mind, what's important is to ensure that we geographically carve things up properly, that we guarantee quality with the marks, and that we don't over-disperse ourselves by having too many resellers selling GNOME stuff. Cheers, Dave. Quim Gil wrote: On 8/5/07, Patrick Wagstrom [EMAIL PROTECTED] wrote: I'm willing to look into some of the swag related issues. Good! Hi sri, Sriram Ramkrishna wrote: We should talk about trademarks and our team's use of it. I expect that we have explicit use of the GNOME trademark under a set of rules. For example, if I'm in merchandising it should be okay for me to create a t-shirt design with the GNOME logo. Ironing out the use of the GNOME trademark in this team would be useful for the reason as Quim noted earlier to be able to make non-centralized decisions if it includes our use of the trademark. It might be useful for you and others in the team to familiarise themselves with the current status of our trademark policy - we have a user group agreement which covers basic usage of the logo (derivatives which identify the user group as being affiliated to GNOME, printing posters, non-profit uses of the mark), and we have a model agreement which we drafted for use with Open Source Factory, a German company, for commercial use of the mark. I believe there was also an agreement signed with Hackerthreads, but last I heard, we don't have it on record. Any commercial usage of the marks has to be done case-by-case and approved by the board. There's no way around that, it's pretty much a minimum requirement of trademark law. Creating a t-shirt design is not a commercial activity of itself. The precedent of user groups printing up t-shirts selling them to recoup costs has happened a few times - no problem there. If this team is acting as an agent for GNOME on merchandising, then we need to keep the board informed regularly, and of course, when we get to the business end of things, ask the board to approve any agreements and sign any contracts. Beyond that, I don't see trademark issues being that important. Afraid the timezone issue puts me out of service for this one - it'll be 6 or 7 AM in France at this stage. Plus, next Saturday I will be in the mountains, cut off from the world (not even cell-phone coverage!). I would like to continue working on (and improve) the infrastructure the marketing team the foundation provides for user groups, and work to get that critical mass where the grass-roots effect will take hold - where GNOME user groups finally feel empowered to start spreading GNOME without asking our permission. Beyond that, I don't see trademark issues being that important. It's good to know all the same from the onset. Feel free to take it out of the agenda. I'd disagree. There still are many ways that the marketing team can work with merchandising GNOME that need to be addressed. For example, collecting designs, letting people know about standard presentations, providing references to successful user groups, advertising that we do this, etc. As someone who has been trying to figure out how to do a simple thing like sell t-shirts at a conference, I can we need people on the marketing team to look at these issues. Besides, KDE has a decent amount of swag you can order online. The number of Windows t-shirts you see folks wearing is appalling. At work you see people wearing Google shirts all the time even though they're a competitor. Finally, let's face it, your hipster apple shirt just isn't as hip anymore now that they've partnered with the same company that delivers your data directly to the NSA. If I'm going to wear a t-shirt on it it should serve one of three purposes: 1. be very witty and make me look smart, 2. attract fair members of the opposite sex, 3. proclaim truths about something I'm passionate about. Doing one of these is not that hard, two gets complicated, and if you can do all three, well then, you'd be a hero. GNOME needs more heroes. Hey folks, I'll try to make it, but I'm supposed to be on a plane that evening from 9-11pm EDT. However, the flight is always late, which means there is good chance I'll be in the air during the meeting and end up missing it. So I'll put my stake down and say that I'm willing to look into some of the swag related issues. Collecting designs, contacting the board about easier licensing for people without a GUG (most of North America), and getting more swag than just the one t-shirt. Being in the US, I'd imagine that the result will be a little North America centric, so if someone from other parts of the world wants to help, let me know. --Patrick -- marketing-list mailing list marketing-list@gnome.org http://mail.gnome.org/mailman/listinfo/marketing-list
