I handle libel and slander as a substantial part of my law practice. I have posted on my website a basic summary of the elements of defamation law in Minnesota, at
http://www.abbottlaw.com/defamation.html

As amusing as it might be to see our list manager in the dock for failing to police the forum, it's not going to happen.

You can't sue the phone company for slander disseminated over the phone lines, even if they have actual knowledge of the phone calls in question. Nor can you sue the post office for libel disseminated in letters sent by mail, even if they have actual knowledge of the contents. For better or worse, the law has decided that people who host and moderate internet bulletin boards also fall into this common carrier category.

Individuals can be held liable for defamatory statements posted to an internet bulletin board or mailing list. But bringing an action for defamation is more complicated than it seems -- there are a lot of legal defenses, not the least of which is the First Amendment.

Still, as Sgt. Esterhaus used to say in Hill Street Blues, be careful out there.

As list members might appreciate, lawsuit threats require a careful
response.

Greg Abbott's post covers the subject of list members' liability; I'll
withhold comment on my situation - except to say that if forum members think
a rule has been broken, they have to let me know OFF LIST.

I'd appreciate it if others (who I know are well intentioned) could not post
to the list on this topic.

As the rules indicate, personal attacks of all sorts are not to be put here.

Good god, if there were in fact a basis for the claims made by Zachary, RT
(and other elected officials) would own every bit of property of most of the
list members using the service.

Oh, get a grip, Zachary. Do you honestly expect the list manager to
cross verify every statement made about someone on this list, especially
about public persons such as yourself?

Thank you for posting this message, however, because it so clearly
reveals the nature of your character. Bellicosely threatening anyone
and everyone with legal action certainly sounds like something from the
mold of Basim Sabri, so I'm no longer surprised to see your name
associated with his.

I want to thank the creators of this list, the list manager and all of
the pariticipants for an eye-opening view under the hood of the
machinations and politics in Minneapolis. My characterization and
opinion of many people has been greatly modified by what I've learned
here. Lots of future votes at the polls have been changed in my
household, as well.

It's funny how one sometimes finds nuggets of gold in the stinkiest of
garbage.

2003-08-20 Thread Barbara Lickness
Thanks for that information Greg. I was at the Ventura
Village meeting that David Piehl posted about. In
fact, I was called at home by the Secretary of the VV
organization. She expressed concern that their meeting
had gotten out of control and that Mr. Metoyer and Mr.
Basim Sabri were in fact attempting to take over the
meeting. She s requested my help. She indicated that
police had been called in an effort to calm the
turmoil. I immediately went over to the meeting. When
I arrived there, the police were already there. While
they may not have escorted Mr. Metoyer out of the
meeting physically, it was clear in my conversations
with the police that they asked him to leave the
premises.
