You can save yourself a lot of time by upgrading to 5.5 then applying the 5.5.1 patch straight from where you are. You'll need to run the upgradedb command, but other than that you should be good. We went straight to 5.5.1 from 5.2.9, and all is well. You may need to re-register your licenses

We don't have the info between where you saw that the server was not in license compliance to why you tried to reapply the tsmee license. Be sure that you performed Query LICense to ascertain just what elements were not in compliance so as to be able to address those. See Technote 1181499 for
