The refurbs page at apple only goes back to the previous generation of iPods and I think that is what they are most likely to ship out. Apple's description of the program is here http://www.apple.com/support/ipod/service/battery/ but it says very little about what criteria they use for replacement

If this is a battery issue there may be an inexpensive way to get a replacement. Apples battery replacement plan costs $59 + $6.95 for the replacement of out of warranty iPod batteries. They ship you a new (to you at least) iPod with a fresh battery. They don't say whether the replacements are
