man of tracepath mentions that in contrast with traceroute it does NOT require
root privilegies. Probably at some point in time it was true, but

traceroute without root privilegies.

It fails because of patch changing default tcptraceroute to tracepath
for ubuntu (and porobably debian).
And tracepaths seems broken:
