Wednesday, January 31, 2001 Lawyer likens Zainur's role to a postman PENANG: Lawyer Zainur Zakaria's conviction for contempt of court was a classic example of the syndrome 'shoot the messenger', a Federal Court heard yesterday. His counsel Sulaiman Abdullah compared Zainur's role to a postman and a messenger who had merely filed Datuk Seri Anwar Ibrahim's application in the High Court to disqualify two senior deputy public prosecutors in the corruption trial against the former deputy prime minister. "To say Zainur was the only one responsible is like totally missing the whole picture as counsel Raja Aziz (Addruse) and I were the ones responsible for putting together the supporting documents,'' Sulaiman said. He was submitting in the appeal by Zainur against his conviction and three-month jail sentence for contempt. Sulaiman said, as part of Anwar's defence team, Zainur would have knowledge that Anwar had denied any sexual misconduct and realised that any evidence which suggested otherwise would have to be fabricated. "When Anwar's tennis partner Datuk S.Nallakaruppan's lawyer Manjeet Singh Dhillon alleged that Nalla, who was then facing a death penalty charge, was asked by the prosecutors to fabricate evidence against Anwar, Zainur was duty bound to put forward Anwar's application to disqualify the prosecutors,'' he said. He added that the allegations by Manjeet Singh--who had served for years in the Legal and Judicial Services, a leading criminal lawyer and a former Bar Council chairman, was not an "Ah Chong''--could be relied on. Sulaiman also submitted that the judge should have considered the fact that Zainur was defending his client's innocence of any allegations of sexual misconduct instead of focusing on his role in filing the application. Sulaiman added that nowhere in his judgment, had the trial judge indicated he was satisfied beyond reasonable doubt that Zainur, in his capacity as a solicitor, had interfered with the integrity of the court. Earlier at 11.35am, a small commotion broke out outside the courtroom when two Kedah Parti Keadilan Nasional Youth members unfurled a banner during a short break, reports PRISCILLA DIELENBERG. Baling Keadilan Youth chief Mohd Hider Khalid, 24, who is also Kedah Keadilan Youth exco member, had unfurled the banner with the help of a fellow member in the corridor. Within a minute, the officer-in-charge of the Central Police Station Chief Insp Sulaiman Awang confiscated the banner which read Beri Keadilan Kepada Zainur Zakaria (Give Justice to Zainur Zakaria). This caused the 30-odd Keadilan members and supporters to question the police officer's action. One supporter shouted "reformasi'' but was hushed by the others. Chief Insp Sulaiman told the crowd that he was only trying to let the court proceedings progress smoothly. He then took down Hider's particulars, inspected the banner and returned it to Hider. Speaking to reporters later, Hider said he did not feel that he was disrupting any proceedings as none of the courts were in session then. About 100 people had turned up to hear the appeal. The public gallery was already full before 9am. Among them were Zainur's wife Lily Hanem Ahmad, daughter and two sons.
