Student: I was detained for five days
KUALA LUMPUR: A 17-year-old student told a public inquiry yesterday that she
was beaten by police and detained for five days when she went to check on a
crowd which gathered near the Kesas Highway toll booth on Nov 5. 
Despite pleas that she was an innocent bystander and was on her way back to
her hostel at the time, Ummi Jumaina Mohamed Jan, who was to sit for her SPM
exam on Nov 13, said she was released only three days before her exam. 
And even then, the police did not return her identity card which she needed
in order to sit for the exam, she told the Human Rights Commission of
Malaysia (Suhakam) inquiry. 
The Klang Teknik Secondary School student said she had to get a temporary
identity card so that she would not miss the exam. 
The inquiry is being held to look into allegations of police brutality
during the Nov 5 illegal gathering. 
Both Jumaina and her mother Hamidah Mat Som testified yesterday. 
Jumaina said she had gone to Kuala Lumpur with her parents and two brothers
in the morning to do some Hari Raya shopping, and they had planned to drop
her and her brother off at their hostel in Klang on the way back. 
When the family found themselves caught in a traffic jam along the Kesas
Highway, near the Bukit Rimau toll booth, she said her father suggested that
they get down and perform prayers at the prayer room near the toll booth. 
While waiting for her father and two brothers to finish their prayers,
Jumaina said her mother chatted with a toll booth worker. 
Jumaina said that when she saw a crowd of about 1,000 people nearby she went
to see what the fuss was all about and saw the crowd gathering around Kuala
Kedah MP Mohamad Sabu. 
"When I saw the Federal Reserve Unit approaching, I tried to run away but I
was caught and hit by the baton. My tudung (headscraf) was pulled from me
and I fell. 
"When I got up, I could not walk properly because my leg was beaten also,''
she said. 
Hamidah told the inquiry that she did not realise her daughter had moved
towards the crowd until she heard the General Operations Force order the
crowd to disperse. 
"But they did not wait five minutes even. The officers hit the rotan against
their shield three times and then started chasing the people. 
"I saw my daughter panic and she did not know which direction to run. I saw
an officer hold her by the head and pull off her headscarf,'' she said,
adding that she went to help her daughter who was crouching in fright. 
Jumaina added that when her father asked the officer to release her as she
was only 17 and about to sit for her SPM exam, the officer sternly replied
that he had his orders. 
Both Jumaina and Hamidah were taken away in a Black Maria. Jumaina said she
was also handcuffed. 
She said it was only later that she learnt from lawyers that as a juvenile,
she could not be detained for more than two days. 
Both Hamidah and Jumaina gave statements to the police but said they were
not informed of their right not to answer questions or say anything that
could incriminate them. 
"I don't know whether this can be construed as a threat. But the two women
officers who questioned me said I had to co-operate or my future would be in
jeopardy,'' said Jumaina. 
She said when she related what had actually happened, the two officers were
not satisfied and kept insisting that she was not telling the truth. 
The inquiry continues on Jan 2.
