If you look at the resolution, 1-h: h) los datos no estarán sujetos a ninguna regulación de derechos de autor, excepto por restriccuiones razonables de privacidad, privilegio o seguridad.- h) the data won't be subject to any copyright regulation, except for reasonable privacy, privilege or safety restrictions.- That kinda clashes with the non-commercial bit.
