It appears that if I sign in and swap a user it will theme the login page, I
assume it has something to do with security on the theme library or

I am assuming, your custom theme is working fine for your publishing pages/Web
Part pages.
If you are using simple.master, your theme should simply work for login.aspx as
well.
Please check whether your theme is applied on signout.aspx because it also uses
simple.master. After
