The HTML code is in both cases indeed the same - printing an invisible menu to
the page. What you are probably missing in the 2010 version is the javascript
that makes the menu visible.

I was wondering how come the menu is displaying on one site when it's
{display:none}.. it's javascript which does it.

I was getting premature disposal issues with a custom field control. Removing
the using statements and defining the site directly by context has resolved the
errors.
