Thank you for taking the time to report this issue and help to improve
Ubuntu.
Clearly, grub *does* recognize this kernel, and has configured it for
use by default. Installing kernels directly in /boot without using the
Ubuntu packages is a supported use case; and grub quite intentionally
boots
I don't think Grub was at fault here though. I had a menu.lst without
this kernel in it before the upgrade, and after the upgrade it had been
put back into menu.lst. Wouldn't it have been update-manager that did
that?
I agree this is far from a normal use case though.

The menu.lst is updated when update-grub is called. If you didn't call
update-grub manually, then it would only be run when you installed a new
kernel version - as when upgrading to a new release.
