Forgot a line, I tried the following which does not work:

        RemoveHandler x-httpd-php5
        suPHP_AddHandler x-httpd-php5 .php
        suPHP_Engine on
        suPHP_ConfigPath /home/upload/
        AddHandler x-httpd-php5 .php
