The fix didn't make it into 2.6.38, but is committed as http://git.kernel.org/?p=linux/kernel/git/torvalds/linux-2.6.git;a=commitdiff;h=f44937718ce3b8360f72f6c68c9481712517a867 so I hope it will be in 2.6.38-rc2.
