I can't see anything the driver is doing wrong. It looks like the problem might start midway through the scan, where you seem to stop receiving frames even on the operating channel for your AP. As far as I can see the driver is setting up the hardware the exact same way but getting different results.
So either there's something wrong with the way the hardware is being set up that only causes problems part of the time or else there's some quirk to setting up this particular dongle.
