Ssempebwa wrote a ‘minority report’

KAMPALA – The chairman of the Constitutional Review Commission, Prof. Frederick Ssempebwa, wrote a minority report to government opposing the lifting of the term limits, The Monitor can reveal.

A very senior official in government, who has seen the final report, told The Monitor that another member of the CRC, Mr Sam Owor, also wrote a minority report that was annexed to the main report.

“There are two minority reports which oppose the lifting of the term limits,” the usually credible source told The Monitor.

On November 17, The Monitor exclusively reported that the CRC had rejected a Cabinet proposal to lift the constitutional two-term limit on the presidency.
Government sought a High Court injunction that stopped The Monitor from publishing details of the CRC proceedings.

Reports at the time, some of them originating from the CRC, that pressure was being brought to bear on the commissioners to change their position on the term limits, were denied by Justice and Constitutional Affairs minister Janat Mukwaya.

The Monitor has learnt, however, that several commissioners on the CRC eventually changed their position on the term limits and proposed that the matter be settled by a referendum.

Although it has been rumoured that some members of the CRC did not agree to the change of position and wrote dissenting reports, this is the first time that their identities are being revealed.

Ssempebwa declined to comment when contacted by The Monitor yesterday, while Owor was unavailable.

The government source, however, told The Monitor: “The two reports make interesting reading; once the main report is released, you shall be able to see them – they are part of the main report.”
