ok, I think that I am going to reply to myself. but I am not 100% sure

The libcap has been incorporate on the kernel setting up this property:

CONFIG_SECURITY_CAPABILITIES=m

Then, we could skip to build libcap, and most important to patch it in 
order to get samba support.
