Just thinking further about this: I guess at the end of the day, if this article is true, what Microsoft will do is provide constant justification for the re-working of the software patent laws. It would be a sad day indeed if I could run my own installation of the Server Message Block protocol, one that makes my file server faster and more secure, and end up getting sued for it.
