Hello every one:
This time I have come with a few recommendations from my side for PWD
act1995. They are as follows:
1. Firstly, we should change the name of this act “PERSONS WITH
DISABILITY” to “PERSONS WITH INABILITIES” act,
Or The persons with different abilities act.
The term Disability, may send a very wrong connotation in to one’s
mind as bad attracts first than the good.
2. According to the act, we are entitled for three % reservation in
all the jobs advertised for and by the government offices and
companies. Out of this three %, we (All visually Impaired persons)
enjoy 1 % of the three % of vacancies.
In this way, there are many jobs or the vacancies which are not or
can’t be given for the visually impaired by the government since they
cannot execute the duties pertaining to that job. For example: bus and
train drivers and conducters, Doctors, nurses, police constables and
so on. There are many jobs or the vacancies that we cannot pursue as
per the governament’s understanding of the visually impaired.
Similarly, there are many jobs and vacancies which are identified as
VI friendly jobs.
That is, the jobs like teachers, attenders, lecturers, clerks etc.
My advice is that, why can’t we request or demand the government to
shift that 1% of vacancies that are not recognized by the government
as blind friendly to the jobs that are recognized by the government as
blind friendly.
That is, why can’t we have more vacancies in teaching and other areas
since they have been identified by the government as blind friendly
jobs.
This enables more visually impaired to be employed, as it is very
important for a VI to be financially independent than the rest of the
society.
This might be a very difficult task for the NGOs and the government,
since still there are plenty of complaints about the improper
implementation of the existing act.
3. Recently, I have read a notification from BHEL regarding the
special recruitment drive for PWD. This notification advertised a
couple of vacancies for language officers, but it clearly states that
these vacancies are for the partially blind only. When the government
boasts itself as the impartial and unbiased body to govern each and
every individual irrespective of their cast, creed, religion and so on
with equality, why such a huge discrimination? Is there any term like
partially blind in the 1995 PWD act?
If there is, such terms and priorities should be curbed and removed
from the act. I clearly opine that the first priority should be given
for those who are 100% or the complete visually impaired. As result of
such discrimination, the government may neglect the complete blind in
the future. Besides this, there are bank application forms which ask
the percentage of your impairment. Based on the data available with
them, what if they neglect totally blind and prefer only the partially
blind?
Therefore, I seriously asume that, this gap or the discrimination has
to be abolished from the governament’s dictionary.
4. All the people who discriminate or insult a differently abled
should strongly punished like SC and ST’s.
Why should we be punished for something which is not a crime?
5. Is there any committee to supervise the implementation of this act?
If so, what are their duties and responsibilities?
In the absence of such supervising committee, what is the platform to
express our difficulties?
Therefore we should have some supervising committee to express our
dissatisfactions, problems, difficulties and so on.
Before I conclude, I request all the legal experts to comment on these
recommendations. I’m not a legal expert therefore I seek your valuable
comments and feedback.
