Shampa
as you know we have a meeting with the Chief Justice on 15th January 2011. I
have sent you on your personal id the list of issues as an attachment.
Maharashtra has several good judgements but these are interim, we have tried
hard not to allow the petitions to be disposed off. You may while speaking
to your audience flag the issues that I have listed but explain to them that
these have arisen because we are very vigilant and have achieved some
success. The employment of the disabled is evolving both in the courts and
on the ground.
Assuming that we get orders on the issues that I have listed, we would have
gone a long way.
HLRN is coming out with a new book soon . How soon I dont know but Rajiv
keeps promising me every month and I keep after him every month. Even then
the book would have judgements until mid 2010. Lots may have happened since
then.
Best wishes

Subject: Re: [AI] information on legal cases wanted
Thanks everyone for sending information on legal cases. I have the book
published by HRLN -it helps me and all our interns/volunteer immensely.
But
it was published in 2005, being in touch with HRLN Kolkata office I do not
think there is another book of judgement that came after that. So it is
little dated.
Vaisnavi, your suggestion of compiling disability related judgements in a
centralised online keyword-searchable database is very much appreciated. I
was thinking of the same but I do not have the expertise. However if this
work is started, let me know - few lawyers who are volunteers of Sruti
would
like to be part of it.
Read the below mentioned news last week in Times of India. Would be
interested in reading this particular judgement.
*'Mental disability' is no ground for dismissal:

Slamming a government department for having unfairly terminated the
services
of an office assistant on the ground of "mental disability", the Madras
high
court has ordered payment of all service and monetary benefits.

Hi,
You may like to visit
http://disabilityrightsthroughcourts.blogspot.com/where
I have tried to put together learnings from each case on disability that
I
have personally taken up in courts or have come across through different
channels. Also where I couldn't lay my hands on judgements atleast a
brief
is available. A few other issues are also addressed on
http://subhashvashishth.blogspot.com/ also that are not directly related
to
courts but have a bearing on disability issues.
Hope this helps.
