Disabled MHADA job-seekers get relief through HC

Respite candidates for clerical exams needn’t choose ‘poor writers’ as
writers.



Acting on a clutch of petitions filed on behalf of disabled persons, the
Bombay high court, on Thursday, directed the Maharashtra Housing and Area
Development Authority (MHADA) to relax certain guidelines it had laid down
for handicapped candidates appearing for exams to be conducted by the
housing board on December 11.



The court has directed MHADA to delete the part, which insisted that the
writer whose assistance a disabled person chose to seek for the exam had to
be at least a grade lower than the candidate.



The guidelines further stated that such a writer should have scored less
than 60% marks in his last examination. These conditions were asked to be
deleted by the high court.



The petitions, filed by the Maharashtra Rajya Apang Karmachari Sanghatana
and others, seek implementation of provisions under the Persons with
Disabilities Act, 1995.



The petitioners further sought to know details of the software and various
implements that are to be provided to the handicapped employees by the
state government. However, this plea was strongly opposed by MHADA counsel
GW Mattos.



He argued that such a demand was tantamount to interference in government
affairs and that the government officials were capable of catering to the
needs of their handicapped employees.



The grievance in this regard could only be made by the employee concerned,
Mattos argued.



Earlier, the court had directed the chief secretary to file a report in the
high court regarding the particulars of the software sought by government
employees, among other things.



When the petitioners sought to see information beforehand on the grounds
that they have made an application before the government, Mattos submitted
that this information would not be provided but would be placed before the
high court as per the directions it has passed. MHADA is scheduled to
conduct exams for recruiting clerical staff on December 11. The court has
adjourned the hearing till December 21.
