Well, I would not term it a gender biased law. If wife is not earning, husband has to pay maintainance, and vice versa. If the spouse is earning, or remarried, then there is no maintainance. And more often than not, children are required to be with their mother so we may say that biology itself is gender biased... Well, but we may not discuss in general, as you have rightly said. We may explore the ways blindness is relevant in divorce.
