One pc for each of vh, hh and o h.in term of this plane language of the act out of 100 vacancies in a establishment 3 should have been given to pwd. But government of india and all state governments made and followed their own interpetitions of the said provision of the act to minimize the recruitment of pwd in public employment.for example most of state governments maintain that 3 pc. Reservation to pwd is available only against identified jobs and only in those vacancies which are filled by direct recruitment not by promotion. For instance in a establishment total 1000 vacancies are there to be filled up out of these 1000 500 are against unidentified jobs and 500 against identified jobs, out of 500 indentified vacancies 200 are filled up by promotion and 300 are filled up by director recruitment. In this case as per the interpetition of most of governments 3 pc quota will be computed only against 300 vacancies which are identified and to be filled by direct recruitment . Thus out of 1000 vacancies pwd get only 9 posts while in term of above mentioned provision of pwd act they should get 30 posts out of 1000 at the rate of 3 pc. Now the apex court in its recent judgement has made it very clear that this is obligatary for every appropriate government to ensure minimum 3 pc. Reservation in total vacancies of its each establishment. In that way the apex court has ended all misinterpetitions and wrong practices of bearocrates and widened the scope of placement of pwd in employment of center and states.with regard.
Hi Friends, i wana know that according to PWD ACT, out of the three percent (3%), one percent (1%) seats/post are reserved for VH candidate? or please some body can inter prate the Pwd Act in little detail and What are implications of the recent Judgement by supreme court as we already have the law?
