As far as I know this problem has been there since 2.6.7 (or even 
earlier). By the time I got the laptop kernel 2.6.16 was out. I removed 
windows from the laptop, installed linux and the fan did not run. So my 
guess is that the problem has been there for a long time, someone worked 
around it (or fixed a kernel bug, whichever you would call most 
appropriate) and made his fix available for kernel 2.6.7 but nothing 
happened in the mainstream kernel ever since.

So the fan has not been running on 2.6.16 and 2.6.17 and according to 
your first link it has not been working correctly on any 2.4 or 2.6 kernel

I do not believe a stock Linux kernel will run the cooling fan properly 
on this laptop. Various 2.4 and 2.6 kernels from different distros 
either ran the fan continuously or not at all.

The guy who sold me the laptop said it had the latest firmware, but I 
never checked this for my self. I will try to do so asap.

About your remark that it includes a firmware override: I am not sure 
about what the patch does exactly, since I'm not a developer and not 
really in to these matters, but: When the laptop overheats and shuts 
down, and I restart the laptop immediately after, the fan will start to 
run immediately (this should be firmware, as grub has not even been 
loaded yet) and stops as soon as linux loads it's ACPI stuff (looks to 
me like some kernel action, but I'm not an expert on this). This is done 
while the laptop casing is still "hot enough to fry an egg" as we say in 
the netherlands.

My guess is that something in linux is not handling the fan control 
provided by compaq correctly. In the case that this is caused by Compaq 
providing buggy firmware and linux developers will refuse to work around 
it, no one will be able to use the laptop with stock kernels. Because 
honestly I do not see compaq developing a new firmware for a laptop this 
old...

Personnaly I don't see why this patch (or anything like it) should not 
be included, as there will probably be more hardware with buggy firmware 
that has to be worked around somehow since people want to use it with 
linux too. It's something one has to live with sometimes. But then 
again, this is only my personal vision.
