Yea that is similar to what I have read, the intended use is as much the 
issue. If you are at a beach taking video of your kids and other people 
are in the area you dont need a release. If you were doing a promo of 
the beach and planned to sell it or use it non privately you are in 
different territory. Even news people will sometimes get verbal releases 
even it is abundantly clear what they are doing. Also on the same topic 
in the US you can "borrow" a lot of creative elements if your intention 
is satire, like say a presidential logo.
