It has not been a problem the times I have done it - but being a government agency they have it pretty well spelled out that if you request the audit they will only go back on the existing year at the true-up. Ohio bases your premiums on the prior years wages and you are required to ’true-up’ at the end of the year to cover whatever increase/decrease in payroll occurred during the year.
Ohio doesn’t have a state OSHA but delegates that responsibility to workers comp. They specifically state that if you ask for a ’safety review’ they will not cite you for anything they find. If you don’t implement the findings that they make they can come after you in a later visit though. I personally have not seen them try to trap anyone or act in bad faith.
