Actually, I wonder which really is more likely, an aircraft accident due to no tower lights or the FAA catching you. If it is at a site with other towers, they probably have functioning lights so it is probably more likely that the FAA would catch you.
But if it is an isolated site, more likely to snag an airplane or helicopter I would think. This whole landscape changed about 30 years ago when a medical helicopter hit a tower that had just been erected but the lights had not yet been commissioned.
