I think they do use the term utility or quasi utility but the explicitly say access to ducts, poles etc.

FCC says you are regulated under Title II, they do not say you are a "utility" which is governed by the states.

All little town owns a few blocks of conduit they put in some time ago
during a side walk remodel.  I'd like to get an agreement with them to
use it, ie: free access for the city in exchange for space in the
conduit.

They need convincing that I don't need to be a utility to do this.

Does anyone (who is not a CLEC) have an agreement with a town/city for
use of conduit/muni-right of way that they would be willing to share?
