Easy.  Find out who owns it.  An active UPRR longitudinal ROW is expensive but 
easy to do.  
If there is no RR easement any more, then you just deal with the land owner.

There is a hiking / biking trail going in on an old railroad corridor that I 
might like to run fiber along. Does anyone have experience with this? Or is is 
generally too much of a hassle to deal with?
