doubleclick was probably just a relatively small company, and litigeous america has too many lawyers so they just sue people for fun.
However google gmail, they actually read all your emails in order to better target ads. Yet no one has sued them to my knowledge, in any case they continue to do it. I don't see ads since I use adblock. so it's really quite irrelevant to me.
