SBA: Confirmed. Omitting protected content is a Feature as the desired behavior
(FINDING it there) is the desgned behavior. I can imagine this being an
additional option in the Find & Replace dialog, i.e. a check box "omit protected
content".

(1) You write "Deselecting the target text within the index (by CTRL-Clicking on
the selected entries) does not re-enable the tools."
This is not exactly correct. When you de-select a ("the last") string in a
protected area, then the cursor is still in the protected area. Thus the
formatting tools stay greyed out.
If you keep the <Ctrl> button pushed and click into the unprotected text, then
release the <Ctrl> button, you have the (desired, changeable) selection you want
and the formatting tools get activated again.
(2) Another hint to ease the things you intend to do is to to HIDE the protected
areas before you call the "Find & Replace" Dialog. On the other hand... To hide
and unhide the areas is about the same effort as to protect and unprotect them.
(3) Last not least, see if getting familiar with "Character Styles" gets you
further. I think you have a good scenario to use them for "the string" that
seems to appear more-often-than-never in your documents. By changing a style,
all its occurences in a document get this change and the "Find&Replace party"
has to take place only once, in order to apply the needed styles to the
respective strings ONCE. Changing the character styles later on applies to
protected content, too.
