"easier to ask forgiveness than permission" I think is the phrase you're looking for here. Without rehashing old ground, I don't see why POCSAG would be any less legal than DSTAR. "But it's a code!" - yes, a well-documented one, unlike DSTAR with its super-sekrit only-for-the-inner-circle codec and poorly-documented protocol.
