In this case, why do you care if you don't have the "set as default option"
if you don't want to respect it anyway?

If you want them to choose from a list ignoring whatever default they
already have set, then do what you were doing.
If you want them to choose from a list respecting whatever default they
already have set, just launch the intent.
I don't see how you're going to get both.
