Lots of apps do this when they shouldn't, but I do believe it's against the market rules. In general I'd be a bit weary of applications that do what you describe, it's pretty frightening that an app could charge you monthly without you knowing, especially since apps don't really have a firmly trusted and associated author that can be contacted to resolve if want to stop being charged.
