First, write a cease-and-desist letter to the violator and 
assert your rights.

Second, you can use the Google trademark form and DMCA 
also gives you remedies.

Third, copyright inheres automatically upon creation of the work in the 
U.S. 
(You don't say where you are). Proving it, as you hint, is the hard part.

You don't have to prove your copyright to write the cease-and-desist letter.
You do need to prove it to prevail in court.

People familiar with your work when you did it can attest to their 
knowledge.
Rough copies and intermediate stages on your hard drive, with time stamps, 
are evidence. Any printed or handwritten material, original recordings from 
the 
field, and such are evidence.

You might need a lawyer. Find one who specializes in this sort of thing.
