The terms do mention higher versions of Android in the judging
sections:

Still, it would be nice if something could be done to help devs with
broken apps. I wonder if there is some option besides letting everyone
submit an update, which may not even be allowable by the terms. Maybe
the judging app could run apps in a compatibility layer, or a patch to
1.6 addressing the issues could be rushed out. Those are probably too
much work to be practical, I guess. Especially with the holiday
shopping season here. Helping carriers and manufacturers get phones
out to take advantage of that is probably a high priority for Google.
