Speaking from personal experience with my G1 with root access, you can
indeed see protected apps.  As I have mentioned in another thread, I
was able to download a protected app, and pull it off the phone from
the app-private folder.  Up to this point, nothing illegal about it,
but if I were to uninstall the app, then use ADB to install the APK
could be considered illegal, especially if it were a paid app that I
got a refund for.

Anyhow, long story short, rooted G1s can indeed see and access
protected apps.

Now, per the discussion, I personally do not see anything illegal with
gaining root access on MY phone.  It has allowed me to modify the OS
so that application are stored on the SD card rather than on internal
memory.  There are some other nice things like WiFi tethering, of
course that app may be breaching the telco's contract by using it.

The way I see it, I paid for the hardware so I should be allowed to do
with it what I want, provided it does not infringe on laws.
