Nowhere in the contract does it specify that you cannot unlock the phone, sell it, etc. (Thats on par with the "is it legal to reflash my phone" questions.)
However, I agree with you - his problem isn't with android. Its not even with an android developer device. Its with tmobile and if he doesn't want to risk getting his code online he needs to call them. Nobody else can do it.
